Foto: Besar Likmeta.<\/figcaption><\/figure>\n<p>Prokurori i Apelit t\u00eb Tiran\u00ebs, Luan Kalo\u00e7i u shkarkua nga detyra m\u00eb 5 korrik 2018, pasi Komisioni i Pavarur i Kualifikimit arriti n\u00eb p\u00ebrfundimin se ai ka fshehur origjin\u00ebn e krijimit t\u00eb nj\u00eb apartamenti dhe nj\u00eb dyqani n\u00eb Tiran\u00eb.<\/p>\n<p>Vendimi i arsyetuar i KPK-s\u00eb, q\u00eb p\u00ebrfaq\u00ebsohej n\u00eb k\u00ebt\u00eb proces nga Valbona Sanxhaktari, kryesuese, Xhensila Pine, relatore dhe komisionerja Etleda \u00c7iftja argumenton se prokurori Luan Kalo\u00e7i d\u00ebshtoi t\u00eb shpjegoj\u00eb bindsh\u00ebm burimin e blerjes s\u00eb apartamentit me sip\u00ebrfaqe 145 metra katror\u00eb si dhe t\u00eb nj\u00eb dyqani me sip\u00ebrfaqe 132 metra katror\u00eb-t\u00eb dyja n\u00eb Tiran\u00eb.<\/p>\n<p>Luan Kalo\u00e7i u b\u00eb pjes\u00eb e list\u00ebs prioritare t\u00eb vetingut p\u00ebr shkak t\u00eb kandidimit t\u00eb tij p\u00ebr K\u00ebshillin e Lart\u00eb t\u00eb Prokuroris\u00eb. Trupi gjykues e konsideroi t\u00eb mjaftuesh\u00ebm hetimin administrativ p\u00ebr k\u00ebt\u00eb subjekt, bazuar vet\u00ebm n\u00eb kriterin e pasuris\u00eb.<\/p>\n<p>Vendimi i arsyetuar i Komisionit t\u00eb Pavarur t\u00eb Kualifikimit p\u00ebr prokurorin Kalo\u00e7i nxjerr n\u00eb pah deklaratat kontradiktore t\u00eb prokurorit p\u00ebr koh\u00ebn e blerjes, sip\u00ebrfaqen, \u00e7mimin real dhe burimin e parave p\u00ebr t\u00eb dyja pasurit\u00eb.<\/p>\n<p>Prokurori e kishte deklaruar blerjen e apartamentit q\u00eb n\u00eb vitin 2003 me \u00e7mim 4.2 milion\u00eb lek\u00eb dhe burim t\u00eb ardhurat e shitjes s\u00eb nj\u00eb apartamenti n\u00eb Elbasan. Por vlera e k\u00ebsaj pasurie ndryshon s\u00ebrish n\u00eb deklarat\u00ebn periodike t\u00eb vitit 2005, ku sh\u00ebnohet si vler\u00eb shuma 55 mij\u00eb euro dhe si burim nj\u00eb kredi bankare. N\u00eb deklarat\u00ebn \u201cveting\u201d, prokurori Kalo\u00e7i i q\u00ebndron versionit se pasuria ka si burim kredin\u00eb, por ndryshon s\u00ebrish \u00a0vler\u00ebn e tij n\u00eb 52 mij\u00eb dollar\u00eb.<\/p>\n<p>Sipas hetimit administrativ, prokurori i Apelit e ka bler\u00eb k\u00ebt\u00eb apartament nga kush\u00ebriri i tij p\u00ebrmes nj\u00eb kontrate t\u00eb n\u00ebnshkruar n\u00eb mars 2005, ku vlera sh\u00ebnohej si 1.5 milion\u00eb lek\u00eb. Gjithashtu, Komisioni gjeti se kredia \u00ebsht\u00eb disbursuar dy muaj m\u00eb von\u00eb, duke ngritur dyshime p\u00ebr origjin\u00ebn e pron\u00ebs.<\/p>\n<p>I pranish\u00ebm n\u00eb seanc\u00ebn d\u00ebgjimore, prokurori Kalo\u00e7i pranoi indirekt se kishte n\u00ebnshkruar kontrat\u00eb fiktive me kush\u00ebririn e tij me q\u00ebllim shmangien e taksave dhe se \u00e7mimi real i pron\u00ebs ishte 52 mij\u00eb dollar\u00eb. Ai shtoi se kishte banuar s\u00eb bashku me familjen n\u00eb t\u00eb q\u00eb n\u00eb vitin 2002, por n\u00eb at\u00eb koh\u00eb nuk kishte as kontrat\u00eb shitblerje dhe as regjistrimin e pron\u00ebs n\u00eb hipotek\u00eb.<\/p>\n<p>I pyetur n\u00ebse e pranonte q\u00eb kontrata ishte fiktive, subjekti i rivler\u00ebsimit deklaroi \u201cka qen\u00eb nj\u00eb nga format q\u00eb p\u00ebrdorej n\u00eb kushtet ku ishim ne\u201d.<\/p>\n<p>\u201cArsyeja ka qen\u00eb se n\u00eb periudh\u00ebn q\u00eb \u00ebsht\u00eb bler\u00eb sht\u00ebpia, ka pasur nj\u00eb ligj q\u00eb shit\u00ebsi duhet t\u00eb paguante n\u00eb mos gaboj 1 ose 2 p\u00ebr qind t\u00eb vler\u00ebs\u2026n\u00ebse vlera e sendit ishte mbi 2 milion\u00eb. Duke qen\u00eb n\u00eb k\u00ebto kushte, besoj se kjo ka qen\u00eb arsyeja, nuk mendoj se ka arsye tjet\u00ebr,\u201d \u00ebsht\u00eb p\u00ebrgjigja e zbardhur e Kalo\u00e7it ndaj pyetjes s\u00eb ngritur nga v\u00ebzhguesi nd\u00ebrkomb\u00ebtar.<\/p>\n<p>Lidhur me k\u00ebt\u00eb pasuri, KPK ka arritur n\u00eb p\u00ebrfundimin se subjekti nuk ka dokumentacion p\u00ebr t\u00eb v\u00ebrtetuar \u00e7mimin real t\u00eb apartamentit, nuk ka dokumentacion p\u00ebr t\u00eb v\u00ebrtetuar koh\u00ebn e blerjes s\u00eb tij dhe p\u00ebr rrjedhoj\u00eb edhe faktin q\u00eb burimi \u00ebsht\u00eb kredia bankare.<\/p>\n<p>\u201cSubjekti i rivler\u00ebsimit nuk ka shpjeguar n\u00eb m\u00ebnyr\u00eb t\u00eb besueshme origjin\u00ebn e ligjshme t\u00eb k\u00ebtij aseti\u2026Subjekti i rivler\u00ebsimit ka nd\u00ebrmarr\u00eb hapa p\u00ebr t\u00eb fshehur ose evidentuar n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb pasurit\u00eb n\u00eb pron\u00ebsi, posedim ose p\u00ebrdorim t\u00eb tij,\u201d shkruhet n\u00eb vendim, ku deklarimi i tij konsiderohet i pamjaftuesh\u00ebm.<\/p>\n<p>Kontradita t\u00eb ngjashme, Komisioni i Pavarur i Kualifikimit gjeti edhe n\u00eb blerjen e nj\u00eb dyqani 132 metra katror\u00eb n\u00eb Tiran\u00eb n\u00eb vitin 2003. N\u00eb deklarat\u00ebn \u201cveting\u201d, subjekti ka shpjeguar se k\u00ebt\u00eb pasuri e kishte bler\u00eb p\u00ebr 5 milion\u00eb lek\u00eb me t\u00eb ardhurat e siguruara nga shitja e nj\u00eb apartamenti n\u00eb Elbasan.<\/p>\n<p>Por KPK rendit n\u00eb vendim deklarimet e ndryshme p\u00ebr t\u00eb nj\u00ebjt\u00ebn pasuri; n\u00eb vitin 2003 sip\u00ebrfaqja ishte 86 metra katror\u00eb dhe vlera 5.8 milion\u00eb lek\u00eb, nd\u00ebrsa kontrata e sip\u00ebrmarrjes tregon se kjo pasuri i \u00ebsht\u00eb dhuruar bashk\u00ebshortes s\u00eb prokurorit. KPK ngre gjithashtu pik\u00ebpyetje mbi burimin e k\u00ebsaj pasurie, ku n\u00eb deklarat\u00ebn e vitit 2003 thuhet se jan\u00eb llotot sportive dhe dy hua n\u00eb vler\u00ebn e 1.5 milion\u00eb lek\u00ebve dhe 700 mij\u00eb lek\u00ebve. Dy huat\u00eb nuk rezultojn\u00eb m\u00eb pas t\u00eb sh\u00ebnuara n\u00eb deklaratat periodike t\u00eb viteve 2004-2016 dhe as n\u00eb deklarat\u00ebn \u201cveting\u201d.<\/p>\n<p>Trupi gjykues i ka k\u00ebrkuar prokurorit Kalo\u00e7i certifikat\u00ebn e pron\u00ebsis\u00eb dhe kontrat\u00ebn e shitblerjes, por ai ka sqaruar se kjo pron\u00eb \u00ebsht\u00eb ende e paregjistruar n\u00eb ZRVPP.<\/p>\n<p>\u201cDyqani \u00ebsht\u00eb bler\u00eb n\u00eb faz\u00ebn karabina n\u00eb shum\u00ebn 5 800 000 lek\u00eb dhe \u00ebsht\u00eb p\u00ebrfunduar me shpenzimet e mia n\u00eb shum\u00eb 1 200 000 lek\u00eb n\u00eb vitin 2003. Si burim p\u00ebr kryerjen e shpenzimeve kan\u00eb sh\u00ebrbyer t\u00eb ardhurat e mia nga paga dhe t\u00eb bashk\u00ebshortes. Nd\u00ebrsa vlera e dyqanit si karabina \u00ebsht\u00eb mbuluar nga fitimi n\u00eb lotari sportive[ i djalit], p\u00ebr t\u00eb cilat kam paraqitur mandate-pagesat n\u00eb kontrollet p\u00ebrkat\u00ebse,\u201d ka shpjeguar m\u00eb tej ai.<\/p>\n<p>KPK ka administruar si prova kontrat\u00ebn e sip\u00ebrmarrjes, ku rezulton se prona i \u00ebsht\u00eb falur bashk\u00ebshortes s\u00eb subjektit si dhe nj\u00eb shkres\u00eb nga drejtoria e P\u00ebrgjithshme e Taksave dhe Tarifave Vendore, e cila konfirmon se subjekti i rivler\u00ebsimit ka t\u00eb regjistruara dy pjes\u00eb (44 m2 dhe 88 m2) t\u00eb regjistruara n\u00eb koh\u00eb t\u00eb ndryshme.<\/p>\n<p>N\u00eb p\u00ebrgjigje t\u00eb pyet\u00ebsorit t\u00eb dyt\u00eb, subjekti i rivler\u00ebsimit ka sqaruar: \u201cSa i takon burimit t\u00eb blerjes s\u00eb k\u00ebsaj pasurie, q\u00eb n\u00eb fillim dua t\u00eb b\u00ebj me dije se ai \u00ebsht\u00eb i ligjsh\u00ebm dhe mjafton t\u00eb shikohen t\u00eb ardhurat nga paga ime dhe e bashk\u00ebshortes, t\u00eb ardhurat nga shitja e sht\u00ebpis\u00eb n\u00eb Elbasan apo nga lotaria e fituar nga djali im. Pasakt\u00ebsit\u00eb n\u00eb deklarimin e burimit duhet t\u00eb vler\u00ebsohen si lapsuse apo pakujdesi t\u00eb miat dhe duhet t\u00eb kihet parasysh edhe koha e kaluar nga deklarimi i b\u00ebr\u00eb n\u00eb vitin 2003 me deklarimin e b\u00ebr\u00eb n\u00eb vitin 2017 p\u00ebr efekt vetingu\u201d.<\/p>\n<p>Komisioni i Pavarur i Kualifikimit argumenton se nuk ka dokumentacion p\u00ebr t\u00eb v\u00ebrtetuar \u00e7mimin real t\u00eb pasuris\u00eb dhe se shpjegimet e tij mbi origjin\u00ebn e k\u00ebsaj prone nuk jan\u00eb t\u00eb besueshme dhe t\u00eb bazuara.
