Foto:LSA<\/figcaption><\/figure>\n<p>Kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb, Xhezair Zaganjori u konfirmua n\u00eb detyr\u00eb m\u00eb 24 korrik 2018 nga Komisioni i Pavarur i Kualifikimit-vendim i cili u kund\u00ebrshtua nga Operacioni Nd\u00ebrkomb\u00ebtar i Monitorimit.<\/p>\n<p>Trupa gjykuese e drejtuar nga Olsi Komi\u00e7i dhe me an\u00ebtar\u00eb Roland Ilian dhe Pamela Qirkon zbardhi t\u00eb premten vendimin, ku ndon\u00ebse konstatohen mosp\u00ebrputhje mes deklarimeve, nj\u00eb kontrat\u00eb fiktive, mungesa t\u00eb kontratave noteriale dhe mospagim t\u00eb detyrimeve tatimore-shkelje t\u00eb tilla nuk konsiderohen shkarkuese.<\/p>\n<p>Ndryshe nga raste t\u00eb ngjashme, ku mosp\u00ebrputhjet e deklarimeve nd\u00ebr vite apo kontratat fiktive jan\u00eb shoq\u00ebruar me shkarkim t\u00eb magjistrat\u00ebve, n\u00eb k\u00ebt\u00eb rast trupa gjykuese e KPK-s\u00eb ka arsyetuar n\u00eb favor t\u00eb Zaganjorit.<\/p>\n<p>Komisioni e leht\u00ebsoi kreun e Gjykat\u00ebs s\u00eb Lart\u00eb nga nj\u00eb akt \u201cn\u00eb pamje t\u00eb par\u00eb fiktiv\u201d shit-blerje e b\u00ebr\u00eb n\u00eb vitin 2001, duke arsyetuar se ai kishte shfryt\u00ebzuar boshll\u00ebqet ligjore. \u201cKjo shmangie \u00ebsht\u00eb kryer duke shfryt\u00ebzuar boshll\u00ebqet ligjore n\u00eb legjislacion, duke sjell\u00eb p\u00ebr pasoj\u00eb evazion tatimor t\u00eb ligjsh\u00ebm,\u201d thuhet n\u00eb vendimin e zbardhur t\u00eb KPK-s\u00eb i cili konfirmoi Zaganjorin n\u00eb detyr\u00eb.<\/p>\n<p>Xhezair Zaganjori ka nj\u00eb karrier\u00eb 40-vje\u00e7are fillimisht si pedagog dhe diplomat e m\u00eb pas si an\u00ebtar i Gjykat\u00ebs Kushtetuese dhe kryetar i Gjykat\u00ebs s\u00eb Lart\u00eb n\u00eb Shqip\u00ebri. Procesi i rivler\u00ebsimit p\u00ebr t\u00eb u fokusua kryesisht n\u00eb kriterin e pasuris\u00eb, nd\u00ebrsa vendimi i zbardhur tregon se n\u00eb dy kriteret e tjera KPK nuk u gjet\u00ebn probleme.<\/p>\n<p><strong>Lexo m\u00eb tep\u00ebr:<\/strong><\/p>\n<p><a href=\"\/?p=50923\">Xhezair Zaganjori konfirmohet n\u00eb detyr\u00eb<\/a><\/p>\n<p><a href=\"\/?p=51290\">ONM kund\u00ebr konfirmimit t\u00eb Zaganjorit, k\u00ebrkon rihapjen e vetingut n\u00eb Apel<\/a><\/p>\n<p><a href=\"\/?p=50777\">Skeda e pasuris\u00eb s\u00eb deklaruar-Xhezair Zaganjori-kryetar i Gjykat\u00ebs s\u00eb Lart\u00eb<\/a><\/p>\n<p><strong>Pasakt\u00ebsi e kontrata fiktive<\/strong><\/p>\n<p>Si kryetar i Gjykat\u00ebs s\u00eb Lart\u00eb, Zaganjori u b\u00eb pjes\u00eb e subjekteve prioritare t\u00eb sistemit t\u00eb rivler\u00ebsimit. Pasuria e tij u\u00a0 mor fillimisht n\u00eb shqyrtim nga Inspektoriati i Lart\u00eb i Deklarimit dhe Kontrollit t\u00eb Pasurive dhe Konfliktit t\u00eb Interesit (ILDKPKI) i cili i raportoi komisionit se nuk kishte gjetur probleme.<\/p>\n<p>Por hetimi i pavarur i KPK-s\u00eb identifikoi pasakt\u00ebsi n\u00eb deklarimet vjetore t\u00eb Zaganjorit p\u00ebr ILDKPKI-n\u00eb, krahasimisht me ato t\u00eb b\u00ebra p\u00ebr llogari t\u00eb vetingut. \u00a0Vendimi i zbardhur thot\u00eb se deklarimet vjetore nuk p\u00ebrputheshin me deklarimin \u201dveting\u201d.<\/p>\n<p>Nj\u00eb apartament me sip\u00ebrfaqe 293 metra katror\u00eb i deklaruar p\u00ebr llogari t\u00eb procesit t\u00eb vetingut me vler\u00eb 5.8 milion\u00eb lek\u00eb, ishte deklaruar n\u00eb vitin 2003 me vler\u00eb 7.4 milion\u00eb lek\u00eb, nd\u00ebrsa nj\u00eb kontrat\u00eb shit-blerje p\u00ebr k\u00ebt\u00eb apartament e vitit 2001 kishte vler\u00ebn 500 mij\u00eb lek\u00eb. M\u00eb pas Zaganjori deklaroi se shpenzimet p\u00ebr k\u00ebt\u00eb nj\u00ebsi kishin shkuar n\u00eb vler\u00ebn 9.1 milion\u00eb lek\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb rast, KPK argumenton se b\u00ebhej fjal\u00eb p\u00ebr nj\u00eb kontrat\u00eb \u201cn\u00eb pamje t\u00eb par\u00eb fiktive\u201d. Hetimi administrativ zbuloi se pasuria n\u00eb fjal\u00eb kishte qen\u00eb e banueshme q\u00eb n\u00eb vitin 1997, por kontrata e shitblerejes dhe rregjistrimi n\u00eb hipotek\u00eb u kryen n\u00eb vitin 2001 me nj\u00eb kontrat\u00eb me vler\u00eb minimale 500 mij\u00eb lek\u00eb.<\/p>\n<p>Nga hetimi i KPK-s\u00eb rezultoi se pasuria nuk ishte bler\u00eb, por ishte krijuar p\u00ebrmes bashkimit t\u00eb kat\u00ebr familjeve me lidhje farefisnore q\u00eb kishin nd\u00ebrtuar godin\u00ebn pes\u00ebkat\u00ebshe n\u00eb nj\u00eb pron\u00eb t\u00eb trash\u00ebguar. Akti i shitjes, sipas k\u00ebtij hetimi kishte qen\u00eb formal, p\u00ebr t\u00eb mund\u00ebsuar kalimin n\u00eb pron\u00ebsi.<\/p>\n<p>Bashk\u00eb me apartamentin, n\u00eb t\u00eb nj\u00ebjt\u00ebn form\u00eb jan\u00eb regjistruar edhe nj\u00eb bodrum dhe nj\u00eb zyr\u00eb, n\u00eb t\u00eb cilat Zaganjori dhe familja e tij zot\u00ebrojn\u00eb \u00bc-\u00ebn, duke i ndar\u00eb sip\u00ebrfaqet me tre familjet e tjera. Po ashtu, n\u00eb t\u00eb nj\u00ebjt\u00ebn form\u00eb rezulton e v\u00ebn\u00eb edhe nj\u00eb hap\u00ebsir\u00eb tregtare rreth 250 metra katror\u00eb e dh\u00ebn\u00eb me qira, ku familja Zaganjori zot\u00ebron \u00e7erekun.<\/p>\n<p>Qiraja e marr\u00eb nga kjo e fundit rezulton m\u00eb pas t\u00eb jet\u00eb pjes\u00eb thelb\u00ebsore p\u00ebr t\u00eb justifikuar shpenzimet dhe po ashtu transaksionet e tjera me prona t\u00eb paluajtshme t\u00eb kryera nga Zaganjori. Madje sipas vendimit t\u00eb KPK-s\u00eb, qiraja nga dyqani ka sh\u00ebrbyer p\u00ebr t\u00eb mbuluar edhe nj\u00eb pjes\u00eb t\u00eb shpenzimeve t\u00eb b\u00ebra p\u00ebr nd\u00ebrtimin e vet\u00eb godin\u00ebs.<\/p>\n<p>N\u00eb hetimin administrativ p\u00ebr t\u00eb gjith\u00eb k\u00ebt\u00eb pasuri, KPK-s\u00eb i rezultojn\u00eb disa probleme. Fillimisht Komisioni merret me pasakt\u00ebsit\u00eb dhe deklarimet e ndryshme t\u00eb vler\u00ebs apo shpenzimeve t\u00eb kryera aty, por n\u00eb arsyetimin ligjor i justifikon ato.<\/p>\n<p>P\u00ebrndryshe nga raste t\u00eb ngjashme kur deklarimi i pasakt\u00eb p\u00ebr ILDKPKI ka qen\u00eb n\u00eb nj\u00eb mas\u00eb penalizuese p\u00ebr subjektet e rivler\u00ebsimit, n\u00eb k\u00ebt\u00eb rast KPK arsyeton se kjo nuk ishte shkelje shkarkuese dhe se gjykat\u00ebsi kishte dh\u00ebn\u00eb sqarime q\u00eb p\u00ebrputheshin me rezultatin e hetimit t\u00eb kryer nga vet\u00eb Komisioni.\u00a0 \u201cK\u00ebto deklarime mund t\u00eb sh\u00ebrbejn\u00eb si prov\u00eb p\u00ebr Komisionin n\u00eb proces, por nuk mund t\u00eb jen\u00eb shkak p\u00ebr shkarkimin e subjektit. Konkluzioni p\u00ebrfundimtar i Komisionit do t\u00eb duhet t\u00eb nxirret nga motivi dhe sjelljet e subjektit, nga m\u00ebnyra e plot\u00ebsimit t\u00eb Deklarat\u00ebs-Vetting dhe nga t\u00eb dh\u00ebnat e hedhura n\u00eb t\u00eb,\u201d thuhet n\u00eb konkluzionin p\u00ebrfundimtar.<\/p>\n<p>Sipas KPK-s\u00eb, pasakt\u00ebsit\u00eb n\u00eb deklarimet e m\u00ebparshme t\u00eb Zaganjorit ishin ndrequr me deklarimin e sakt\u00eb p\u00ebr llogari t\u00eb vetingut. P\u00ebr k\u00ebt\u00eb arsye, trupi gjykues nuk i cil\u00ebsoi mosp\u00ebrputhjet n\u00eb deklarime si arsye p\u00ebr shkarkim. N\u00eb nj\u00eb moment, KPK arsyeton: \u201cArrihet n\u00eb konkluzionin\u00a0 se subjekti nuk ka qen\u00eb i sakt\u00eb n\u00eb deklarimet nd\u00ebr vite, por nuk mund t\u00eb arsyetohet n\u00eb favor t\u00eb mas\u00ebs disiplinore t\u00eb shkarkimit nga detyra, duke qen\u00eb se nuk ka asnj\u00eb dyshim p\u00ebr fshehje t\u00eb pasuris\u00eb\u201d.<\/p>\n<p>Ngjash\u00ebm, KPK shpjegoi edhe kontrat\u00ebn fiktive t\u00eb b\u00ebr\u00eb n\u00eb vitin 2001 p\u00ebr \u201cshit-blerjen e k\u00ebsaj pasurie\u201d. Treshja gjykuese ka arsyetuar se kontrata formale e b\u00ebr\u00eb n\u00eb vitin 2001, megjith\u00ebse \u00ebsht\u00eb fiktive dhe nuk pasqyron vler\u00ebn e v\u00ebrtet\u00eb dhe pavar\u00ebsisht se \u00ebsht\u00eb b\u00ebr\u00eb me q\u00ebllim e till\u00eb p\u00ebr t\u00eb shmangur detyrimet tatimore [duke p\u00ebrfituar nga boshll\u00ebqet ligjore] p\u00ebr nj\u00eb kontrat\u00eb n\u00eb vler\u00ebn reale, nuk kishte efekt shkarkues.<\/p>\n<p>\u201cN\u00eb pamje t\u00eb par\u00eb t\u00eb krijohet p\u00ebrshtypja se kontratat e shitjes s\u00eb vitit 2001 jan\u00eb fiktive, n\u00eb baz\u00eb t\u00eb nenit 92\/\u00e7 t\u00eb Kodit Civil, pasi jan\u00eb kryer nga pal\u00ebt vet\u00ebm me q\u00ebllimin q\u00eb t\u00eb realizohej formalisht regjistrimi i pasurive t\u00eb paluajtshme n\u00eb regjistrin publik\u201d, thuhet n\u00eb vendimin e zbardhur.<\/p>\n<p>Por po aty ky veprim justifikohet duke th\u00ebn\u00eb se nuk ishte b\u00ebr\u00eb \u201cme q\u00ebllim mashtrimin\u201d dhe meq\u00eb nuk ishte as vep\u00ebr penale, as kund\u00ebrvajtje administrative, nuk duhej nd\u00ebshkuar. KPK thekson se n\u00eb k\u00ebt\u00eb rast, Zaganjori nuk ishte gjykat\u00ebs dhe se po ashtu veprimet ishin kryer \u201cjasht\u00eb periudh\u00ebs s\u00eb rivler\u00ebsimit\u201d. KPK megjithat\u00eb pranon se veprimet \u201cn\u00eb dukje fiktive\u201d ishin kryer p\u00ebr t\u00eb p\u00ebrfituar, por thot\u00eb se kjo ishte b\u00ebr\u00eb duke shfryt\u00ebzuar boshll\u00ebkun ligjor dhe jo duke shkelur ligjin.<\/p>\n<p>\u201cN\u00eb k\u00ebto kushte, Komisioni \u00e7mon se fiktiviteti n\u00eb dukje i kontratave t\u00eb lidhura me familjar\u00ebt e bashk\u00ebshortes, nuk ka pasur q\u00ebllim mashtrimin apo fshehjen e fakteve, ngjarjeve apo pasuris\u00eb. Subjekti ka shfryt\u00ebzuar hap\u00ebsirat ligjore n\u00eb favor t\u00eb interesave t\u00eb tij,\u201d thuhet n\u00eb vendimin e zbardhur, i cili e cil\u00ebson k\u00ebt\u00eb si \u201cevazion tatimor t\u00eb ligjsh\u00ebm\u201d.<\/p>\n<p><strong>T\u00eb ardhurat nga qiraja\u00a0 <\/strong><\/p>\n<p>Nj\u00eb seri kontratash qiraje jo noteriale p\u00ebr hap\u00ebsir\u00ebn dyqan dhe at\u00eb bodrum n\u00eb nd\u00ebrtes\u00ebn pes\u00ebkat\u00ebshe t\u00eb p\u00ebrmendur m\u00eb sip\u00ebr u gjet\u00ebn pas hetimit t\u00eb KPK-s\u00eb. Kontratat e qiras\u00eb rezultuan t\u00eb r\u00ebnd\u00ebsishme, pasi Zaganjori, sipas vendimit t\u00eb zbardhur i p\u00ebrdori ato p\u00ebr t\u00eb justifikuar pasuri t\u00eb v\u00ebna pas tyre, p\u00ebrfshi blerjen e nj\u00eb apartamenti n\u00eb Durr\u00ebs dhe nj\u00eb p\u00ebrpjekje p\u00ebr t\u00eb bler\u00eb nj\u00eb apartament n\u00eb Shkod\u00ebr, q\u00eb n\u00eb fund nuk u realizua.<\/p>\n<p>Po ashtu, t\u00eb ardhurat nga qiraja p\u00ebrdoren edhe p\u00ebr pagesa shkollimi jasht\u00eb vendit dhe shpenzime t\u00eb tjera apo kursimet e familljes.<\/p>\n<p>KPK sidoqoft\u00eb gjeti nj\u00eb mori problemesh n\u00eb k\u00ebto kontrata. Fillimisht sipas Komisionit, fakti q\u00eb ato nuk ishin noteriale i b\u00ebnte t\u00eb dyshimta. \u201cGj\u00eb q\u00eb l\u00eb vend p\u00ebr dyshime dhe sidomos kur deklaratat e b\u00ebra nga subjekti i rivler\u00ebsimit nuk p\u00ebrputhen me dokumentacionin p\u00ebrkat\u00ebs shkresor q\u00eb ndodhet n\u00eb dosje\u201d, thuhet n\u00eb pjes\u00ebn ku p\u00ebrshkruhet hetimi.<\/p>\n<p>Aty KPK thot\u00eb se gjeti raste t\u00eb mbivendosjes, ku p\u00ebr t\u00eb nj\u00ebjtin objekt p\u00ebr t\u00eb nj\u00ebjt\u00ebn periudh\u00eb ka disa kontrata qiraje jo noteriale. Nj\u00ebra prej kontratave rezulton e n\u00ebnshkruar p\u00ebr 100 mij\u00eb lek\u00eb n\u00eb muaj p\u00ebr tre vjet nga marsi 2010 me nj\u00eb shoq\u00ebri tregtare. KPK thot\u00eb se nuk ka fatura t\u00eb plota dhe se nj\u00eb pjes\u00eb e faturave jan\u00eb n\u00eb em\u00ebr t\u00eb nj\u00eb shoq\u00ebrie tjet\u00ebr. N\u00eb t\u00eb nj\u00ebjt\u00ebn periudh\u00eb p\u00ebr t\u00eb nj\u00ebjt\u00ebn pasuri jan\u00eb b\u00ebr\u00eb edhe dy kontrata t\u00eb tjera me t\u00eb nj\u00eb shoq\u00ebri me em\u00ebr t\u00eb anonimizuar. Nj\u00eb kontrat\u00eb q\u00eb fillon po n\u00eb mars 2010 me afat deri n\u00eb mars 2013 dhe nj\u00eb tjet\u00ebr nga viti 2012 deri n\u00eb dhjetor\u00a0 2013.<\/p>\n<p>Sipas KPK-s\u00eb nuk p\u00ebrcaktohet qart\u00eb sa merrte Zaganjori si pjes\u00eb n\u00eb k\u00ebto qira, ku ishin edhe t\u00eb tjer\u00ebt bashk\u00ebpronar\u00eb, por ashtu p\u00ebr nj\u00eb pjes\u00eb t\u00eb tyre nuk ka t\u00eb dh\u00ebna t\u00eb pagesave t\u00eb detyrimeve tatimore. Gjithashtu n\u00eb k\u00ebto kontrata t\u00eb ndryshme qiradh\u00ebnie nuk ka em\u00ebr t\u00eb pasuris\u00eb, por vet\u00ebm sip\u00ebrfaqe t\u00eb saj, e cila edhe kjo del e ndryshme n\u00eb kontrata t\u00eb ndryshme.<\/p>\n<p>Megjithat\u00eb, Komisioni arsyetoi se nuk mund t\u2019i konsideronte t\u00eb paligjshme k\u00ebto t\u00eb ardhura vet\u00ebm me faktin se p\u00ebr to nuk rezultonte t\u00eb ishte paguar detyrim tatimore. \u201cN\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, mospagimi i detyrimeve fiskale, pa v\u00ebrtetuar paligjshm\u00ebrin\u00eb e pasuris\u00eb, nuk mundet t\u00eb sh\u00ebrbej\u00eb si shkak p\u00ebr dh\u00ebnien e masave disiplinore n\u00eb baz\u00eb t\u00eb k\u00ebsaj dispozite kushtetuese dhe dispozitave ligjore t\u00eb dala n\u00eb zbatim t\u00eb saj\u201d, thuhet n\u00eb vendim.<\/p>\n<p>N\u00eb vendim arsyetohet se megjith\u00ebse p\u00ebrcaktimi ligjor,\u00a0 me t\u00eb cilin jan\u00eb dh\u00ebn\u00eb vendime shkarkimi p\u00ebr nj\u00eb s\u00ebr\u00eb magjistrat\u00ebsh n\u00eb proces, konsideron t\u00eb ligjshme vet\u00ebm t\u00eb ardhurat p\u00ebr t\u00eb cilat ishin paguar tatimet, n\u00eb k\u00ebt\u00eb rast KPK dilte me p\u00ebrfundim se mosagimi i tatimeve nuk e b\u00ebnte nj\u00eb pasuri t\u00eb paligjshme.<\/p>\n<p>\u201cDuke sjell\u00eb n\u00eb v\u00ebmendje konkluzionin se t\u00eb gjitha burimet e pasuris\u00eb s\u00eb tij rrjedhin ose nga puna e ligjshme, ose nga marr\u00ebdh\u00ebniet kontraktore t\u00eb ligjshme, at\u00ebher\u00eb konkludohet se subjekti i rivler\u00ebsimit arriti t\u00eb provoj\u00eb ligjshm\u00ebrin\u00eb e t\u00eb ardhurave dhe t\u00eb pasuris\u00eb s\u00eb deklaruar\u201c, thuhet n\u00eb vendim.<\/p>\n<p>KPK arsyeton se fakti q\u00eb pagesat e p\u00ebrfituara nga qirat\u00eb ishin derdhur n\u00eb bank\u00eb dhe po ashtu ishin deklaruar n\u00eb ILDKPKI dhe se p\u00ebr k\u00ebt\u00eb nuk i shikonte ato si t\u00eb paligjshme. Ajo po ashtu thekson se n\u00eb nj\u00eb pjes\u00eb t\u00eb kontratave jonoteriale detyrimet fiskale i ishin kaluar pal\u00ebs q\u00eb merrte ambjentin me qira.<\/p>\n<p>\u201cMospagimi i detyrimeve fiskale mundet t\u00eb konsiderohet apo t\u00eb kualifikohet si shkelje e etik\u00ebs s\u00eb magjistratit apo si shkelje administrative sipas parashikimeve respektive ligjore, por jo si shkak p\u00ebr t\u00eb aplikuar masa disiplinore sipas nenit D t\u00eb Kushtetut\u00ebs,\u201d thuhet n\u00eb vendim.<\/p>\n<p><strong>Bler\u00ebsi \u201cfantaz\u00ebm\u201d i apartamentit <\/strong><\/p>\n<p>Nj\u00eb apartament i shitur dhe nj\u00eb tjet\u00ebr i bler\u00eb rezultojn\u00eb po ashtu me probleme n\u00eb pasurin\u00eb e kreut t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb. KPK thot\u00eb se gjeti q\u00eb apartamenti i vler\u00eb para viteve \u201990 dhe i shitur n\u00eb vitin 1999 rezultonte ende n\u00eb em\u00ebr t\u00eb Zaganjorit.<\/p>\n<p>\u201cSipas ZVRPP-s\u00eb Tiran\u00eb rezulton se \u00ebsht\u00eb ende n\u00eb pron\u00ebsi t\u00eb subjektit,\u201d thuhet n\u00eb vendim.<\/p>\n<p>Vendimi megjithat\u00eb nuk ndalon gjat\u00eb n\u00eb k\u00ebt\u00eb rast. Aty nuk p\u00ebrmendet n\u00ebse kishte apo jo nj\u00eb kontrat\u00eb shit-blerje dhe n\u00ebse Komisioni kishte administruar ndonj\u00eb t\u00eb till\u00eb. Ndryshe nga rastet e tjera kur Komisioni i referohet hetimeve t\u00eb saj, p\u00ebr k\u00ebt\u00eb pasuri i \u00ebsht\u00eb referuar ILDKPKI-s\u00eb. Sipas vendimit kjo e fundit ka b\u00ebr\u00eb me dije se bler\u00ebsi \u201cnuk ka kryer procedur\u00ebn e regjistrimit t\u00eb apartamentit n\u00eb em\u00ebr t\u00eb tij\u201d , nd\u00ebrsa po ashtu citohet se \u201c(ILDKPKI) nuk \u00ebsht\u00eb shprehur n\u00ebse p\u00ebrputhet deklarimi i subjektit me dokumentacionin e dor\u00ebzuar dhe p\u00ebrgjigjet e institucioneve\u201d.<\/p>\n<p>N\u00eb vendim nuk rezulton q\u00eb KPK t\u00eb ket\u00eb b\u00ebr\u00eb verifikime t\u00eb tjera. Parat\u00eb e shitjes s\u00eb apartamentit, 3.9 milion\u00eb lek\u00eb, jan\u00eb p\u00ebrdorur p\u00ebr nd\u00ebrtimin e godin\u00ebs pes\u00ebkat\u00ebshe sipas KPK-s\u00eb. \u00a0Mbetet e paqart\u00eb se si apartamenti \u00ebsht\u00eb ende i regjistruar n\u00eb em\u00ebr t\u00eb Zaganjorit. KPK thot\u00eb se nj\u00eb vendim i Gjykat\u00ebs s\u00eb Lart\u00eb ia ngarkonte p\u00ebrgjegj\u00ebsin\u00eb bler\u00ebsit, por nd\u00ebrkoh\u00eb n\u00eb vendimin e zbardhur nuk ka t\u00eb dh\u00ebna t\u00eb tjera rreth k\u00ebsaj pasurie.<\/p>\n<p>Rasti i dyt\u00eb \u00ebsht\u00eb nisma p\u00ebr t\u00eb bler\u00eb nj\u00eb apartament n\u00eb Shkod\u00ebr. Sipas KPK-s\u00eb Zaganjori, investoi atje 35 mij\u00eb dollar\u00eb dhe 1.2 milion\u00eb lek\u00eb. KPK doli n\u00eb p\u00ebrfundimin q\u00eb apartamenti nuk u ble pasi pallati nuk u nd\u00ebrtua. Mungesa e kontratave noteriale n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb justifikuar me lidhjen shoq\u00ebrore q\u00eb gjyqtari kishte me nd\u00ebrtuesit, shok\u00eb gjimnazi.<\/p>\n<p>Nd\u00ebrkoh\u00eb fakti q\u00eb n\u00eb nj\u00eb fatur\u00eb pagesa \u00ebsht\u00eb cil\u00ebsuar si investim dhe jo si pages\u00eb p\u00ebr blerje apartamenti, u shpjegua me faktin se kompania nd\u00ebrtuese kishte aplikuar model t\u00eb ngjash\u00ebm edhe me t\u00eb tjer\u00eb klient\u00eb. N\u00eb k\u00ebt\u00eb rast po ashtu KPK gjeti se pasuria justifikohej me t\u00eb ardhurat nga qiraja dhe nga paga.<\/p>\n<p>Nj\u00eb apartament i bler\u00eb n\u00eb plazh Durr\u00ebs i rezultoi KPK-s\u00eb pa probleme. Megjithat\u00eb n\u00eb arsyetim mbetet i pasqaruar nj\u00eb veprim bankar. \u00a0Aty thuhet se subjekti kishte paguar 16 mij\u00eb dollar\u00eb q\u00eb i kishte t\u00ebrhequr nga nj\u00eb llogari bankare.<\/p>\n<p>\u201cSubjekti i \u00ebsht\u00eb p\u00ebrgjigjur k\u00ebrkes\u00ebs se pjesa m\u00eb e madhe e shum\u00ebs prej rreth 16.000 USD \u00ebsht\u00eb t\u00ebrhequr nga depozita e p\u00ebrbashk\u00ebt me bashk\u00ebshorten\u201d, thuhet n\u00eb vendim. Por nga ana tjet\u00ebr theksohet se banka e nivelit t\u00eb dyt\u00eb ku ndodhej llogari mohoi kryerjen e veprimit n\u00eb at\u00eb periudh\u00eb dhe p\u00ebr at\u00eb shum\u00eb. Ajo i shkroi KPK-s\u00eb se \u201cnuk rezulton t\u00eb ket\u00eb kryer veprime p\u00ebr t\u00ebrheqjen e k\u00ebsaj vlere dhe kryerjen e pages\u00ebs ndaj shoq\u00ebris\u00eb shit\u00ebse t\u00eb pasuris\u00eb s\u00eb paluajtshme\u201d. KPK thot\u00eb n\u00eb arsyetim se gjyqtari kishte t\u00eb ardhura p\u00ebr t\u00eb b\u00ebr\u00eb blerjen rreth 34 mij\u00eb dollar\u00eb q\u00eb ishin n\u00eb llogarit\u00eb e tij bankare.<\/p>\n<p>N\u00eb fund, KPK thot\u00eb se gjeti pasakt\u00ebsi edhe p\u00ebr shpenzime kryesisht p\u00ebr shkollim t\u00eb f\u00ebmij\u00ebve apo t\u00eb ardhura t\u00eb gjykat\u00ebsit. Gjeti n\u00eb disa raste shpenzime q\u00eb nuk ishin deklaruar n\u00eb deklaratat vjetore edhe pse duhej t\u00eb ishin deklaruar dhe t\u00eb ngjashme.<\/p>\n<p>KPK megjithat\u00eb arriti n\u00eb p\u00ebrfundimin se k\u00ebto pasakt\u00ebsi shpjegoheshin nga subjekti n\u00eb deklarat\u00ebn \u201cveting\u201d dhe nuk i quajti penalizuese.
