{"id":70594,"date":"2022-12-01T18:34:42","date_gmt":"2022-12-01T17:34:42","guid":{"rendered":"https:\/\/reporter.al\/vetingu\/shkeljet-e-ligjit-dhe-vendimet-e-njeanshme-penalizuan-prokurorin-spartak-cocoli\/2022\/12\/01\/"},"modified":"2023-04-06T14:46:49","modified_gmt":"2023-04-06T12:46:49","slug":"shkeljet-e-ligjit-dhe-vendimet-e-njeanshme-penalizuan-prokurorin-spartak-cocoli","status":"publish","type":"post","link":"https:\/\/reporter.al\/vetingu\/shkeljet-e-ligjit-dhe-vendimet-e-njeanshme-penalizuan-prokurorin-spartak-cocoli\/2022\/12\/01\/","title":{"rendered":"Shkeljet e ligjit dhe vendimet e nj\u00ebanshme penalizuan prokurorin Spartak \u00c7o\u00e7oli"},"content":{"rendered":"<p>Kolegji i Posa\u00e7\u00ebm i Apelimit, KPA e gjeti t\u00eb drejt\u00eb vendimin e Komisionit p\u00ebr shkarkimin nga detyra t\u00eb ish-prokurorit t\u00eb Gjirokastr\u00ebs, Spartak \u00c7o\u00e7oli, duke arsyetuar se mang\u00ebsit\u00eb e p\u00ebrs\u00ebritura profesionale dhe q\u00ebndrimet e nj\u00ebanshme n\u00eb vendimarrjet e \u00e7\u00ebshtjeve t\u00eb hetuara e b\u00ebjn\u00eb t\u00eb pap\u00ebrshtatsh\u00ebm dhe n\u00eb vler\u00ebsimin t\u00ebr\u00ebsor t\u00eb tyre, k\u00ebto gjetje \u00e7mohen se c\u00ebnojn\u00eb r\u00ebnd\u00eb besimin e publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Spartak \u00c7o\u00e7oli u shkarkua m\u00eb 16 korrik 2020 nga KPK, pasi u kishte mbijetuar p\u00ebr vite me radh\u00eb informacioneve p\u00ebr veprime t\u00eb kundraligjshme, nj\u00eb procedimi disiplinor dhe nj\u00eb kall\u00ebzimi penal q\u00eb ngrinte dyshime p\u00ebr p\u00ebrfshirjen e tij n\u00eb korrupsion.<\/p>\n<p>Shkarkimi ishte i pritsh\u00ebm, pasi paralelisht me procesin e vetingut, \u00c7o\u00e7oli po gjykohej p\u00ebr \u201ckorrupsion pasiv\u201d n\u00eb Gjykat\u00ebn e Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar q\u00eb e d\u00ebnoi m\u00eb 9 shtator 2020 me dy vjet burgim, por q\u00eb u konvertua me 4 vjet sh\u00ebrbim prove.<\/p>\n<p>Vendimi i arsyetuar i KPK-s\u00eb tregoi se agjencit\u00eb ligjzbatuese kishin pasur informacione prej vitit 2007 p\u00ebr p\u00ebrfshirjen e \u00c7o\u00e7olit n\u00eb veprimtari t\u00eb kundraligjshme \u2013 por ato nuk ishin adresuar p\u00ebrpara se t\u00eb niste procedimi penal ndaj tij n\u00eb vitin 2019.<\/p>\n<p>Gjithashtu, nj\u00eb procedim disiplinor i Prokuroris\u00eb s\u00eb P\u00ebrgjithshme ishte mbyllur me \u201cV\u00ebrejtje\u201d n\u00eb vitin 2012, nd\u00ebrsa nj\u00eb kall\u00ebzim penal p\u00ebr marrje ryshfeti ishte pushuar n\u00eb vitin 2015 prej ish-Prokuroris\u00eb p\u00ebr Krime t\u00eb R\u00ebnda.<\/p>\n<p>KPK e p\u00ebrfundoi hetimin p\u00ebr \u00c7o\u00e7olin n\u00eb kriterin e past\u00ebrtis\u00eb s\u00eb figur\u00ebs dhe profesionalizmin, ku dhe u gjet\u00ebn problemet shkarkuese. Megjith\u00ebse nuk u konstatuan kontakte t\u00eb subjektit me persona t\u00eb p\u00ebrfshir\u00eb n\u00eb krimin e organizuar apo deklarim i pamjaftuesh\u00ebm p\u00ebr figur\u00ebn, Komisioni vler\u00ebsoi se gjetjet e konstatuara n\u00eb kriterin e past\u00ebrtis\u00eb s\u00eb figur\u00ebs lidhur me veprimet e subjektit n\u00eb hetimin e \u00e7\u00ebshtjeve, t\u00eb nd\u00ebrthurura me konstatimet n\u00eb kriterin profesional, evidentonin an\u00ebsi n\u00eb vendimarrje dhe p\u00ebr rrjedhoj\u00eb r\u00ebndojn\u00eb r\u00ebndojn\u00eb pozit\u00ebn e tij si prokuror. Trupa e KPK konkludoi se k\u00ebto veprime t\u00eb \u00c7o\u00e7olit t\u00eb vler\u00ebsuara n\u00eb t\u00ebr\u00ebsin\u00eb e tyre c\u00ebnojn\u00eb r\u00ebnd\u00eb besimin e publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Po ashtu, u konstatuan mang\u00ebsi t\u00eb p\u00ebrs\u00ebritura n\u00eb aspektin profesional, si gjykim i dob\u00ebt, cil\u00ebsi t\u00eb papranueshme n\u00eb pun\u00eb, si dhe mosrespektim t\u00eb t\u00eb drejtave t\u00eb pal\u00ebve &#8211; probleme q\u00eb u vler\u00ebsuan se nuk mund t\u00eb plot\u00ebsohen n\u00ebp\u00ebrmjet programit t\u00eb trajnimit n\u00eb Shkoll\u00ebn e Magjistratur\u00ebs. KPK arriti n\u00eb p\u00ebrfundimin se subjekti nuk kishte arritur nivelin minimal n\u00eb vler\u00ebsimin e aft\u00ebsive profesionale dhe se ishte i pap\u00ebrshtatsh\u00ebm n\u00eb k\u00ebt\u00eb kriter. Ashtu si p\u00ebr figur\u00ebn, gjetjet etiko-profesionale u konsideruan n\u00eb vler\u00ebsimin t\u00ebr\u00ebsor n\u00eb c\u00ebnim t\u00eb besimit t\u00eb publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Vendimi i Komisionit u ankimua nga \u00c7o\u00e7oli, i cili ve\u00e7 shkaqeve t\u00eb ngritura ndaj konkluzioneve p\u00ebr kriterin e figur\u00ebs dhe profesionalizmit, paraqiti pretendime edhe lidhur me procesin e rregullt ligjor. Duke ju referuar dokumentacionit t\u00eb administruar n\u00eb dosjen e Komisionit, Kolegji vler\u00ebson se nuk evidentohet ndonj\u00eb shkelje e procesit t\u00eb rregullt ligjor n\u00eb shkall\u00ebn e par\u00eb t\u00eb vetingut dhe p\u00ebr rrjedhoj\u00eb ky shkak i ankimit nuk \u00ebsht\u00eb gjetur i bazuar.<\/p>\n<p>Po ashtu, nuk u gjet e bazuar k\u00ebrkes\u00eb p\u00ebr kalimin e \u00e7\u00ebshtjes p\u00ebr shqyrtim n\u00eb seanc\u00eb publike dhe vendimarrja p\u00ebr k\u00ebt\u00eb subjekt rivler\u00ebsimi u mor n\u00eb dhom\u00eb k\u00ebshillimi.<\/p>\n<p><strong>Konkluzionet p\u00ebr figur\u00ebn <\/strong><\/p>\n<p>Subjekti i rivler\u00ebsimit pretendoi n\u00eb ankim se n\u00eb procesin e tij t\u00eb rivler\u00ebsimit n\u00eb Komision, nuk \u00ebsht\u00eb sqaruar se si n\u00eb dy raportet e Drejtoris\u00eb s\u00eb Informacionit t\u00eb Klasifikuar, DSIK, t\u00eb viteve 2017 dhe 2018, ai rezulton i p\u00ebrshtatsh\u00ebm p\u00ebr t\u00eb vijuar detyr\u00ebn, nd\u00ebrsa sipas raportit t\u00eb rishikuar n\u00eb 2020-\u00ebn \u00ebsht\u00eb konstatuar pap\u00ebrshtatshm\u00ebria.<\/p>\n<p>Ai pretendon se konkluzioni i Komisionit n\u00eb lidhje me komponentin e figur\u00ebs \u00ebsht\u00eb i gabuar, pasi n\u00eb asnj\u00eb rast, nuk jan\u00eb v\u00ebrtetuar dyshimet p\u00ebr p\u00ebrfshirjen n\u00eb veprimtari t\u00eb kund\u00ebrligjshme korruptive, apo q\u00eb subjekti t\u00eb ket\u00eb pasur kontakte t\u00eb pap\u00ebrshtatshme, si dhe gjetjet nuk u p\u00ebrkasin standarteve t\u00eb p\u00ebrcaktuara n\u00eb legjislacionin e vetingut.<\/p>\n<p>Kolegji analizon nj\u00eb \u00e7\u00ebshtje p\u00ebr t\u00eb cil\u00ebn \u00c7o\u00e7oli \u00ebsht\u00eb procedurar p\u00ebr \u201ckorrupsion pasiv\u201d. Nga hetimet e kryera nga ish-Prokuroria p\u00ebr Krime t\u00eb R\u00ebnda, \u00ebsht\u00eb krijuar dyshimi i arsyesh\u00ebm se \u00c7o\u00e7oli ka k\u00ebrkuar nj\u00eb p\u00ebrfitim t\u00eb padrejt\u00eb n\u00eb k\u00ebmbim t\u00eb nj\u00eb veprimi q\u00eb do t\u00eb kryente n\u00eb kuad\u00ebr t\u00eb detyr\u00ebs si prokuror. N\u00eb qershor t\u00eb vitit 2019, subjektit i \u00ebsht\u00eb komunikuar akuza. Kolegji v\u00ebren se vepra penale p\u00ebr t\u00eb cil\u00ebn akuzohej \u00c7o\u00e7oli, e b\u00ebn\u00eb at\u00eb individ t\u00eb p\u00ebrfshir\u00eb n\u00eb krimin e organizuar.<\/p>\n<p>\u201cQ\u00ebllimi dhe fryma e ligjit nr. 84\/2016, n\u00eb lidhje me kontrollin e figur\u00ebs, k\u00ebrkon q\u00eb procesi i rivler\u00ebsimit t\u00eb identifikoj\u00eb gjyqtar\u00ebt e prokuror\u00ebt, t\u00eb cil\u00ebt kan\u00eb integritet t\u00eb cenuar, duke i p\u00ebrjashtuar ata nga sistemi i drejt\u00ebsis\u00eb. Ligji, duke urdh\u00ebruar verifikimin, n\u00ebse subjektet kan\u00eb kontakte t\u00eb pap\u00ebrshtatshme, nuk mund t\u00eb p\u00ebrjashtoj\u00eb verifikimin e figur\u00ebs s\u00eb vet\u00eb subjektit t\u00eb rivler\u00ebsimit, n\u00ebse ka dyshime t\u00eb bazuara se ai \u00ebsht\u00eb p\u00ebrfshir\u00eb n\u00eb krimin e organizuar, sipas pik\u00ebs 8 t\u00eb nenit 3 t\u00eb ligjit nr. 84\/2016, konkretisht korrupsion pasiv\u201d, vler\u00ebson KPA.<\/p>\n<p>Kolegji v\u00ebren se nga ish-Gjykata e Shkall\u00ebs s\u00eb Par\u00eb p\u00ebr Krime t\u00eb R\u00ebnda Tiran\u00eb, \u00ebsht\u00eb caktuar ndaj subjektit t\u00eb rivler\u00ebsimit masa e sigurimit personal \u201cDetyrim p\u00ebr t\u2019u paraqitur n\u00eb policin\u00eb gjyq\u00ebsore\u201d, si dhe masa e sigurimit personal me karakter ndalues \u201cPezullimi i ushtrimit t\u00eb nj\u00eb detyre a sh\u00ebrbimi publik\u201d. Disa muaj m\u00eb von\u00eb prokurorja e \u00e7\u00ebshtjes ka paraqitur k\u00ebrkes\u00ebn p\u00ebr gjykimin e \u00e7\u00ebshtjes penale, ku nj\u00eb prej t\u00eb pandehurve ka qen\u00eb edhe \u00c7o\u00e7oli. K\u00ebrkesa p\u00ebr gjykim \u00ebsht\u00eb pranuar nga gjykata respektive, nd\u00ebrkoh\u00eb q\u00eb Prokuroria e Posa\u00e7me e ka informuar Kolegjin se kjo \u00e7\u00ebshtje po gjykohet me procedur\u00eb gjykimi t\u00eb shkurtuar.<\/p>\n<p>Pas marrjes s\u00eb subjektit t\u00eb pandehur, K\u00ebshilli i Lart\u00eb i Prokuroris\u00eb ka vendosur pezullimin e statusit t\u00eb prokurorit Spartak \u00c7o\u00e7oli.<\/p>\n<p>P\u00ebr shkak se \u00e7\u00ebshtja nuk kishte p\u00ebrfunduar ende, Komisioni nuk ka arritur n\u00eb nj\u00eb konkluzion lidhur me k\u00ebt\u00eb procedim penal, por e ka kualifikuar k\u00ebt\u00eb situat\u00eb si c\u00ebnim t\u00eb besimit t\u00eb publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Megjith\u00ebse subjekti nuk ka paraqitur n\u00eb Kolegj dokumentacion p\u00ebr ecurin\u00eb e \u00e7\u00ebshtjes n\u00eb fjal\u00eb, bazuar n\u00eb informacionet nga burime t\u00eb hapura, \u00ebsht\u00eb m\u00ebsuar se \u00c7o\u00e7oli \u00ebsht\u00eb shpallur fajtor p\u00ebr korrupsion. Nisur nga fakti se \u00e7\u00ebshtja vijon ende t\u00eb jet\u00eb n\u00eb faz\u00eb gjykimi, edhe Kolegji ashtu si Komisioni vler\u00ebson se rrethanat tregojn\u00eb q\u00eb subjekti ka c\u00ebnuar besimin e publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Nga t\u00eb dh\u00ebnat e p\u00ebrcjella prej Prokuroris\u00eb s\u00eb Posa\u00e7me, ka rezultuar se ndaj subjektit ka pasur nj\u00eb tjet\u00ebr kall\u00ebzim penal, por ish-Prokuroria p\u00ebr Krime t\u00eb R\u00ebnda ka vendosur mosfillimin e procedimit penal.<\/p>\n<p>Komisioni, lidhur m\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje ka vler\u00ebsuar se \u00c7o\u00e7olit nuk i atribuohet ndonj\u00eb kontakt me subjekte q\u00eb jan\u00eb p\u00ebrfshir\u00eb apo dyshohen si pjes\u00ebtar\u00eb t\u00eb strukturave t\u00eb organizuara kriminale, por konstatimet e gjetura gjat\u00eb hetimit, i vler\u00ebsoi n\u00eb t\u00ebr\u00ebsi n\u00eb c\u00ebnim t\u00eb besimit t\u00eb publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Trupi gjykues i KPA v\u00ebren se n\u00eb rastin e mosfillimit t\u00eb procedimit penal, ligji ka parasysh munges\u00ebn e elementeve q\u00eb p\u00ebrb\u00ebjn\u00eb figur\u00ebn e vepr\u00ebs penale. Sipas Kolegjit, meqen\u00ebse veprimet e subjektit nuk p\u00ebrkojn\u00eb me elemente t\u00eb veprave penale t\u00eb parashikuara nga Kodi Penal, vendimi i mosfillimit t\u00eb procedimit, barazohet me vendimin e pafaj\u00ebsis\u00eb. \u201c[\u2026]Si i till\u00eb, nuk mund t\u00eb kualifikohet as sipas nenit 61, pika 5 e ligjit nr. 84\/2016, duke e b\u00ebr\u00eb vendimmarrjen e Komisionit t\u00eb cenueshme dhe t\u00eb padrejt\u00eb lidhur me k\u00ebt\u00eb shkak ankimi\u201d, konkludon KPA lidhur me konstatimin n\u00eb k\u00ebt\u00eb rast t\u00eb c\u00ebnimit t\u00eb besimit t\u00eb publikut tek drejt\u00ebsia.<\/p>\n<p><strong>Shkaqet p\u00ebr profesionalizmin<\/strong><\/p>\n<p>\u00c7o\u00e7oli ka pretenduar se gjetjet e Komisionit p\u00ebr analizimin e aft\u00ebsive profesionale, jan\u00eb t\u00eb pabazuara dhe subjektive. Sipas tij, KPK nuk ka trajtuar thelbin e aktit procedural t\u00eb vendimarrjes, pasi nuk \u00ebsht\u00eb evidentuar n\u00ebse vendimet e tij kan\u00eb qen\u00eb t\u00eb drejta ose jo.<\/p>\n<p>P\u00ebr mang\u00ebsit\u00eb n\u00eb p\u00ebrpilimin e akteve procedurale p\u00ebr periudh\u00ebn kohore 2014 e n\u00eb vazhdim, subjekti ka pretenduar se kan\u00eb ardhur si pasoj\u00eb e mosp\u00ebrq\u00ebndrimit n\u00eb pun\u00eb p\u00ebr shkak t\u00eb problemeve familjare, si pasoj\u00eb e divorcit t\u00eb ndodhur n\u00eb vitin 2014.<\/p>\n<p>Ish-prokurori \u00c7o\u00e7oli ka argumentuar se ka nj\u00eb karrier\u00eb 27-vje\u00e7are n\u00eb sistemin e drejt\u00ebsis\u00eb dhe mang\u00ebsit\u00eb e vogla t\u00eb konstatuara n\u00eb aft\u00ebsit\u00eb profesionale n\u00eb vendimin e Komisionit, kan\u00eb qen\u00eb gjuha joprofesionale n\u00eb p\u00ebrpilimin e akteve procedurale, q\u00eb sipas tij nuk mund t\u00eb p\u00ebrb\u00ebj\u00eb element t\u00eb pap\u00ebrshtatshm\u00ebris\u00eb s\u00eb aft\u00ebsive profesionale dhe aq m\u00eb pak q\u00eb t\u00eb ket\u00eb c\u00ebnuar besimin e publikut te sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>KPA i ka gjetur t\u00eb pabazuara pretendimet e \u00c7o\u00e7olit dhe jep t\u00eb drejt\u00eb Komisionit p\u00ebr gjetjet n\u00eb kriterin profesional. \u201cKolegjit i rezultoi se subjekti i rivler\u00ebsimit shfaq modele t\u00eb nj\u00ebjta pune, t\u00eb p\u00ebrs\u00ebritura, me problematika t\u00eb ngjashme thuajse n\u00eb t\u00eb gjitha dokumentet objekt vler\u00ebsimi, duke u gjendur n\u00eb situatat ku nuk identifikohet drejt norma penale, vendimmarrjet jan\u00eb t\u00eb paarsyetuara dhe t\u00eb paargumentuara, si dhe nuk identifikohen elementet e vepr\u00ebs penale, si analiza baz\u00eb p\u00ebr t\u00eb arritur n\u00eb konkluzionin e ekzistenc\u00ebs ose jo t\u00eb vepr\u00ebs penale\u201d, konstaton trupi gjykues i Kolegjit.<\/p>\n<p>N\u00eb vijim, trupi gjykues vler\u00ebson se n\u00eb disa nga \u00e7\u00ebshtjet penale t\u00eb shqyrtuara, subjekti i rivler\u00ebsimit, n\u00eb cil\u00ebsin\u00eb e prokurorit t\u00eb \u00e7\u00ebshtjes, nuk ka kryer veprimet e nevojshme hetimore, nd\u00ebrsa n\u00eb \u00e7\u00ebshtje t\u00eb tjera, nuk ka administruar prova t\u00eb besueshme, t\u00eb cilat do t\u00eb \u00e7onin n\u00eb nxjerrjen e nj\u00eb p\u00ebrfundimi t\u00eb sakt\u00eb n\u00eb lidhje me ekzistenc\u00ebn e elementeve t\u00eb vepr\u00ebs penale.<\/p>\n<p>Po ashtu, ka rezultuar se \u00c7o\u00e7oli nuk ka respektuar t\u00eb drejtat e pal\u00ebve p\u00ebr njoftimin e vendimmarrjeve.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb vler\u00ebsimit t\u00eb kriterit t\u00eb aft\u00ebsive profesionale, Kolegji vler\u00ebson se rastet kur shkeljet e subjekteve t\u00eb rivler\u00ebsimit evidentohen q\u00eb p\u00ebrs\u00ebriten n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme dhe n\u00eb praktika t\u00eb ndryshme, p\u00ebrb\u00ebjn\u00eb p\u00ebrjashtim nga rastet e konfirmimit n\u00eb detyr\u00eb dhe duhet t\u00eb vler\u00ebsohen negativisht.<\/p>\n<p>Ashtu si KPK, edhe KPA vler\u00ebson se konkluzionet e arritura gjat\u00eb kontrollit t\u00eb kriterit s\u00eb figur\u00ebs p\u00ebr, t\u00eb nd\u00ebrthurura me rezultatet e vler\u00ebsimit profesional, konsiderohen se e vendosin subjektin e Spartak \u00c7o\u00e7oli n\u00eb situata t\u00eb p\u00ebrs\u00ebritura n\u00eb shkelje t\u00eb ligjit, t\u00eb cilat kan\u00eb elemente t\u00eb q\u00ebndrimeve t\u00eb nj\u00ebanshme n\u00eb vendimmarrje dhe r\u00ebndojn\u00eb pozit\u00ebn e tij si prokuror.
