Ai u vler\u00ebsua pozitivisht p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs, nd\u00ebrsa gjetjet p\u00ebr shkelje procedurale n\u00eb gjykimin e disa \u00e7\u00ebshtjeve u konsideruan t\u00eb pamjaftueshme p\u00ebr penalizim.<\/p>\n<p>Megjithat\u00eb, konkluzionet e Komisionit p\u00ebr profesionalizmin duket se e kan\u00eb l\u00ebn\u00eb t\u00eb pak\u00ebnaqur Operacionin Nd\u00ebrkomb\u00ebtar i Monitorimit, ONM, q\u00eb n\u00ebp\u00ebrmjet nj\u00eb opinioni i referon Komisioner\u00ebve Publik\u00eb q\u00eb t\u00eb vler\u00ebsojn\u00eb n\u00ebse shkeljet procedurale t\u00eb Rulit, t\u00eb shqyrtuara s\u00eb bashku me gjetjet p\u00ebr gjykimin e tre \u00e7\u00ebshtjeve nga subjekti n\u00eb kushtet e konfliktit t\u00eb interesit, do t\u00eb konsideroheshin cenim i besimit t\u00eb publikut, q\u00eb do t\u00eb justifikonte ankimin p\u00ebr k\u00ebt\u00eb kriter.<\/p>\n<p><strong>Mungesat financiare<\/strong><\/p>\n<p>P\u00ebr blerjen e nj\u00eb apartamenti 2+1 me sip\u00ebrfaqe 119.3 m2 n\u00eb Tiran\u00eb, t\u00eb porositur n\u00eb vitin 2009 p\u00ebr \u00e7mimin 9 milion\u00eb lek\u00eb, subjekti ka pasqyruar n\u00eb deklarat\u00ebn \u201cveting\u201d si burime krijimi nj\u00eb vler\u00eb 800 mij\u00eb lek\u00eb nga llogaria e pag\u00ebs s\u00eb bashk\u00ebshortes; depozit\u00eb 700 mij\u00eb lek\u00eb e grumbulluar nga kursimet; hua nga shtetasi A.Z. n\u00eb ler\u00ebn 4 milion\u00eb lek\u00eb me kontrat\u00eb huaje t\u00eb vitit 2009; si dhe hua verbale n\u00eb shum\u00ebn 3 milion\u00eb lek\u00eb nga babai, Sh.R.. Edhe n\u00eb 2009-\u00ebn ka deklaruar t\u00eb nj\u00ebjtat burime dhe se ka shlyer shum\u00ebn 8 milion\u00eb e 631 mij\u00eb lek\u00eb.<\/p>\n<p>Si burim t\u00eb vler\u00ebs 3 milion\u00eb lek\u00eb t\u00eb dh\u00ebn\u00eb nga babai, jan\u00eb deklaruar t\u00eb ardhurat e k\u00ebtij t\u00eb fundit nga puna n\u00eb emigracion n\u00eb Greqi; t\u00eb ardhurat nga bujq\u00ebsia dhe biznesi privat i regjistruar si biznes i vog\u00ebl n\u00eb Bashkin\u00eb Libohov\u00eb.<\/p>\n<p>Komisioni ka konstatuar se subjekti nuk ka arritur t\u00eb v\u00ebrtetoj\u00eb me dokumentacion ligjor provues t\u00eb ardhurat e t\u00eb atit nga emigracioni; ato nga bujq\u00ebsia; si dhe t\u00eb ardhurat nga aktiviteti privat duke i kaluar barr\u00ebn e prov\u00ebs p\u00ebr t\u00eb v\u00ebrtetuar t\u00eb kund\u00ebrt\u00ebn.<\/p>\n<p>Ruli ka shpjeguar se aktiviteti i ushtruar nga prind\u00ebrit ka qen\u00eb pjes\u00ebrisht artizanal e ambulant. P\u00ebr babain i cili ka qen\u00eb marangoz ka shpjeguar se, megjith\u00ebse ka qen\u00eb i regjistruar si biznes dhe ka pasur nj\u00eb vend ushtrimi t\u00eb aktivitetit, kryesisht ka prodhuar artikuj druri me porosi, si dhe pjes\u00eb p\u00ebr vegla pune, artikuj t\u00eb ndrysh\u00ebm druri sht\u00ebpiake p\u00ebr kuzhin\u00eb, blegtori, si dhe zbukurime t\u00eb ndryshme n\u00eb dru, q\u00eb n\u00eb t\u00eb shumt\u00ebn e rasteve shiteshin n\u00eb fshat dhe n\u00eb fshatrat p\u00ebrreth me porosi ose n\u00eb tregjet e komun\u00ebs.<\/p>\n<p>Po ashtu, ai ka shtuar se t\u00eb dy prind\u00ebrit jan\u00eb marr\u00eb me kultivimin t\u00eb drith\u00ebrave dhe bim\u00ebve medicinale, perimeve etj., p\u00ebr p\u00ebrdorim personal, si dhe p\u00ebr shitje n\u00eb treg n\u00eb fshat dhe n\u00eb fshatrat p\u00ebrreth. Ai ka shpjeguar se p\u00ebr k\u00ebto lloj aktivitetesh, sipas ligjeve t\u00eb koh\u00ebs paguheshin sigurimet shoq\u00ebrore dhe sh\u00ebndet\u00ebsore si i vet\u00ebpun\u00ebsuar n\u00eb bujq\u00ebsi, taksat vendore, si dhe tatimi si biznes i vog\u00ebl.<\/p>\n<p>Por KPK vler\u00ebson se subjekti nuk provoi me asnj\u00eb dokumentacion justifikues ligjshm\u00ebrin\u00eb e burimit t\u00eb krijimit t\u00eb t\u00eb ardhurave t\u00eb babait nga emigracioni, ato nga bujq\u00ebsia dhe treg\u00ebtimi i bim\u00ebve medicinale.<\/p>\n<p>Po ashtu, Komisioni konkludon se Ruli nuk ka v\u00ebrtetuar mund\u00ebsin\u00eb e kursimit t\u00eb vler\u00ebs s\u00eb dh\u00ebn\u00eb hua nga t\u00eb ardhurat nga aktiviteti privat i babait si zdrukthtar. Sipas Komisionit, provat e paraqitura nga subjekti bien ndesh me ato \u00e7far\u00eb ai pretenduar, se biznesi i t\u00eb atit ishte ushtruar n\u00eb form\u00ebn ambulatore.<\/p>\n<p>Sipas KPK, edhe n\u00ebse do t\u00eb konsiderohej se p\u00ebr periudh\u00ebn 2007-2009 t\u00eb ardhurat do t\u00eb ishin 3 milion\u00eb lek\u00eb si referon nj\u00eb v\u00ebrtetim i Bashkis\u00eb Libohov\u00eb p\u00ebr t\u00eb ardhura n\u00eb shum\u00ebn 1 milion lek\u00eb n\u00eb vit, po t\u00eb zbriteshin shpenzimet jetike, at\u00ebher\u00eb nuk mund t\u00eb justifikohej vlera e dh\u00ebn\u00eb hua.<\/p>\n<p>Trupa e KPK vler\u00ebson se bazuar n\u00eb situat\u00ebn faktike financiare t\u00eb prind\u00ebrve t\u00eb subjektit, nuk provohet se ata kan\u00eb pasur likujditete gjendje p\u00ebr dh\u00ebnien e huas\u00eb.<\/p>\n<p>P\u00ebr t\u00eb mb\u00ebrritur n\u00eb k\u00ebt\u00eb konkluzion, KPK mban n\u00eb konsiderat\u00eb edhe munges\u00ebn e t\u00eb dh\u00ebnave n\u00eb sistemin bankar lidhur me mund\u00ebsit\u00eb e kursimit t\u00eb prind\u00ebrve t\u00eb subjektit; munges\u00ebn e provueshm\u00ebris\u00eb lidhur me m\u00ebnyr\u00ebn e transaksionit t\u00eb kryer q\u00eb nuk \u00ebsht\u00eb v\u00ebrtetuar n\u00eb asnj\u00eb form\u00eb; si dhe mosprovueshm\u00ebria e shlyerjes s\u00eb k\u00ebsaj huaje p\u00ebr nj\u00eb periudh\u00eb 10-vje\u00e7are.<\/p>\n<p>N\u00eb analiz\u00ebn financiare p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb nuk jan\u00eb p\u00ebrfshir\u00eb edhe vlerat e t\u00ebrhequra nga llogaria bankare e bashk\u00ebshortes dhe e subjektrit, pasi k\u00ebto transaksione jan\u00eb kryer pas n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb porosis\u00eb, ku pal\u00ebt kan\u00eb konfirmuar se bler\u00ebsi kishte parapaguar vler\u00ebn prej 8 milion\u00eb e 631 mij\u00eb lek\u00ebsh.<\/p>\n<p>Por k\u00ebto vlera q\u00eb nuk kan\u00eb p\u00ebrfshir\u00eb n\u00eb analiz\u00ebn e k\u00ebstit t\u00eb par\u00eb, jan\u00eb vler\u00ebsuar t\u00eb mjaftueshme p\u00ebr t\u00eb shlyer k\u00ebstin e dyt\u00eb t\u00eb \u00e7mimit \u00eb blerjes n\u00eb vler\u00ebn 368 mij\u00eb lek\u00eb.<\/p>\n<p>Sipas KPK, subjekti nuk ka arritur t\u00eb provoj\u00eb as burimin e ligjsh\u00ebm p\u00ebr blerjen e nj\u00eb automjti n\u00eb 2015-\u00ebn p\u00ebr \u00e7mimin 1.5 milion\u00eb lek\u00eb, si burime krijimi t\u00eb t\u00eb cilit ka deklaruar edhe t\u00eb ardhurat e p\u00ebrfituara nga shitja e nj\u00eb makine tjet\u00ebr po at\u00eb vit n\u00eb shum\u00ebn 900 mij\u00eb lek\u00eb.<\/p>\n<p>Trupa e Komisionit konstaton se makina e shitur 900 mnij\u00eb lek\u00eb ishte bler\u00eb n\u00eb vitin 2011 n\u00eb shum\u00ebn 7000 euro, nd\u00ebrkoh\u00eb q\u00eb pala shit\u00ebse kishte paguar tre muaj m\u00eb par\u00eb 13 mij\u00eb e 180 euro. KPK vler\u00ebson se shpjegimet e subjektit nuk arrit\u00ebn t\u00eb provojn\u00eb vlerat reale t\u00eb shitjes s\u00eb blerjes dhe atij automjeti n\u00eb 2011-\u00ebn dhe n\u00eb vitin 2015 dhe arrin n\u00eb konkluzionin se, subjekti, pavar\u00ebsisht p\u00ebrpjekjeve, d\u00ebshtoi t\u00eb provoj\u00eb bindsh\u00ebm burimin e ligjsh\u00ebm t\u00eb krijimit t\u00eb makin\u00ebs s\u00eb bler\u00eb n\u00eb 2015-\u00ebn.<\/p>\n<p><strong>Konflikti interesit<\/strong><\/p>\n<p>Subjekti ka deklaruar nj\u00eb apartament me sip\u00ebrfaqe 119 m2 n\u00eb Tiran\u00eb t\u00eb p\u00ebrfituar prej bashk\u00ebshortes si bashk\u00ebpronare e nj\u00eb sip\u00ebrfaqe nd\u00ebrtimore prej 60 mij\u00eb m2 n\u00eb bregdetin e Gjirit t\u00eb Lal\u00ebzit n\u00eb Durr\u00ebs, dh\u00ebn\u00eb p\u00ebr nd\u00ebrtimin e nj\u00eb fshati turistik t\u00eb nj\u00ebjt\u00ebs shoq\u00ebri q\u00eb nd\u00ebrtonte pallatin n\u00eb kryeqytet. N\u00eb k\u00ebmbim t\u00eb apartamentit n\u00eb Tiran\u00eb, \u00ebsht\u00eb dakort\u00ebsuar zbritja e pjes\u00ebs takuese n\u00eb fshatin turistik.<\/p>\n<p>KPK v\u00ebren se bashk\u00ebshortja e subjektit e ka filluar marr\u00ebdh\u00ebnien juridike pasurore me shoq\u00ebrin\u00eb e nd\u00ebrtuese n\u00eb maj t\u00eb vitit 2010, n\u00eb cil\u00ebsin\u00eb e nj\u00eb prej trash\u00ebgimtar\u00ebve t\u00eb sip\u00ebrfaqes s\u00eb tok\u00ebs ku gjenden edhe pyje dhe se ka vijuar me lidhjen e kontrat\u00ebs p\u00ebr apartamentin n\u00eb Tiran\u00eb.<\/p>\n<p>Komisioni konstaton se subjekti n\u00eb deklarat\u00ebn \u201cveting\u201d ka deklaruar lidhjet e kontratave t\u00eb sip\u00ebrmarrjes me shoq\u00ebrin\u00eb nd\u00ebrtuese dhe gjat\u00eb procesit t\u00eb rivler\u00ebsimit ka depozituar n\u00eb cil\u00ebsin\u00eb e prov\u00ebs nj\u00eb kontrat\u00eb shk\u00ebmbimi t\u00eb vitit 2020 q\u00eb n\u00eb objektin e saj p\u00ebrcakton ekzekutimin e nj\u00eb kontrate sip\u00ebrmarrje t\u00eb vitit 2012 dhe nj\u00eb marrveshje t\u00eb bashk\u00ebsip\u00ebrmarr\u00ebsve t\u00eb 2015-\u00ebs.<\/p>\n<p>Nd\u00ebrkoh\u00eb, nga hetimi ka rezultuar se subjekti ka shqyrtuar n\u00eb vitin 2017 tre \u00e7\u00ebshtje ku pal\u00eb padit\u00ebse ka qen\u00eb shoq\u00ebria nd\u00ebrtuese me t\u00eb cil\u00ebn bashk\u00ebshortja kishte lidhur kontratat dhe pal\u00eb e paditur Inspektorati Komb\u00ebtar i Mbrojtjes s\u00eb Territorit. Ruli ka k\u00ebrkuar dor\u00ebheqjen nga shyqrtimi k\u00ebtyre \u00e7\u00ebshtjeve, por k\u00ebrkesat e tij jan\u00eb rr\u00ebzuar nga kryetari i gjykat\u00ebs.<\/p>\n<p>Por, KPK konstaton se Ruli nuk ka pasqyruar sakt\u00eb n\u00eb k\u00ebrkes\u00ebn e tij p\u00ebr dor\u00ebheqje se marr\u00ebdh\u00ebnia me shoq\u00ebrin\u00eb nd\u00ebrtuese vijonte n\u00eb momentin e shqyrtimit t\u00eb \u00e7\u00ebshtjeve. \u201cRezultoi e provuar se marr\u00ebdh\u00ebnia me shoq\u00ebrin\u00eb \u201c***\u201d sh.p.k. ka vazhduar deri n\u00eb vitin 2020, p\u00ebr kontrat\u00ebn e sip\u00ebrmarrjes t\u00eb lidhur n\u00eb vitin 2012, koh\u00eb kur \u00ebsht\u00eb n\u00ebnshkruar edhe kontrata e shk\u00ebmbimit, fakt ky, i cili nuk \u00ebsht\u00eb pasqyruar n\u00eb m\u00ebnyr\u00eb t\u00eb sakt\u00eb n\u00eb k\u00ebrkes\u00ebn p\u00ebr dor\u00ebheqje q\u00eb i \u00ebsht\u00eb relatuar kryetarit t\u00eb Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb, duke pretenduar se marr\u00ebdh\u00ebnia juridiko-pasurore kishte p\u00ebrfunduar midis bashk\u00ebshortes dhe shoq\u00ebris\u00eb s\u00eb nd\u00ebrtimit \u201c***\u201d sh.p.k., para gushtit t\u00eb vitit 2017\u201d, citohet n\u00eb vendim dhe shtohet fakti se kjo marrdh\u00ebnie ishte p\u00ebrforcuar nga nj\u00eb kontrate e re sip\u00ebrmarrje lidhur n\u00eb prill t\u00eb vitit 2017 mes bashk\u00ebshortes s\u00eb subjektit me shoq\u00ebrin\u00eb nd\u00ebrtuese.<\/p>\n<p>P\u00ebr rrjedhoj\u00eb, KPK arrin n\u00eb p\u00ebrfundimin se subjekti ka qen\u00eb n\u00eb kushtet e konfliktit t\u00eb interesit n\u00eb gjykimin e tri \u00e7\u00ebshtjeve me pal\u00eb nd\u00ebrgjyq\u00ebse shoq\u00ebrin\u00eb nd\u00ebrtuese m\u00eb t\u00eb cil\u00ebn bashk\u00ebshortja e tij kishte marrdh\u00ebnie juridiko-civile me karakter pasuror<\/p>\n<p><strong>ONM kund\u00ebr KPK p\u00ebr profesionalizmin<\/strong><\/p>\n<p>N\u00eb 17 denoncime nga publiku, KPK shprehet se nuk ka gjetur indicie. Nd\u00ebrkoh\u00eb, n\u00eb shumic\u00ebn e gjasht\u00eb denoncimeve t\u00eb tjera \u00ebsht\u00eb konstatuar se subjekti nuk ka zbatuar drejt ligjin proceduar dhe ligjin material, si dhe ka shfaqur mang\u00ebsi n\u00eb drejtim t\u00eb interpretimit t\u00eb akteve n\u00ebnligjore n\u00eb zbatimin t\u00eb ligjit material. Por, sipas KPK, shkeljet e konstatuara nuk jan\u00eb n\u00eb mas\u00ebn q\u00eb t\u00eb merren n\u00eb konsiderat\u00eb si shkak shkarkimi p\u00ebr subjektin e rivler\u00ebsimit.<\/p>\n<p>K\u00ebto konkluzione jan\u00eb gjetur t\u00eb paqarta dhe t\u00eb pabazuara nga Operacioni Nd\u00ebrkomb\u00ebtar i Monitorimit, ONM, q\u00eb ka shfaqur nj\u00eb opinion drejtuar Komisioner\u00ebve Publik\u00eb. Sipas ONM, p\u00ebrve\u00e7 r\u00ebnd\u00ebsis\u00eb q\u00eb ka vler\u00ebsimi i duhur i aft\u00ebsive profesionale, vendimi i KPK-s\u00eb pranon ekzistenc\u00ebn e disa gabimeve n\u00eb ushtrimin e funksioneve gjyq\u00ebsore nga ana e subjektit.<\/p>\n<p>ONM sjell n\u00eb v\u00ebmendje konkluzionet e vet\u00eb Komisionit p\u00ebr pes\u00eb prej gjasht\u00eb denoncimeve ku jan\u00eb gjetur probleme, n\u00eb t\u00eb cilat evidentohen shkelje apo mang\u00ebsi procedurale.<\/p>\n<p>\u201cGjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb ka vijuar gjykimin mbi baz\u00ebn e nj\u00eb padie, e cila n\u00eb kuptim t\u00eb nenit 117 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile \u00ebsht\u00eb e pavlefshme, pasi nuk \u00ebsht\u00eb n\u00ebnshkruar nga padit\u00ebsja, por nga nj\u00eb avokat i palegjitimuar me prokur\u00eb p\u00ebr kryerjen e k\u00ebtij veprimi. Nga aktet n\u00eb dosje konstatohen shkelje t\u00eb r\u00ebnda procedurale t\u00eb kryera nga subjekti n\u00eb gjykimin e k\u00ebsaj \u00e7\u00ebshtjeje dhe, p\u00ebr k\u00ebto arsye, Gjykata Administrative e Apelit i ka rikthyer \u00e7\u00ebshtjet p\u00ebr rigjykim\u2026 p\u00ebr t\u2019u gjykuar nga nj\u00eb tjet\u00ebr trup gjykues,\u201d sjell n\u00eb v\u00ebmendje ONM.<\/p>\n<p>N\u00eb opinionin e ONM-s\u00eb referohen konkluzionet e KPK edhe p\u00ebr kat\u00ebr \u00e7\u00ebshtje t\u00eb shqyrtuara nga subjekti, nga kan\u00eb rezultuar se Ruli ka shfaqur mang\u00ebsi n\u00eb zbatimin e ligjit procedural ose shkelje procedurale.<\/p>\n<p>ONM analizon konkluzionin e KPK-s\u00eb lidhur me gjetjet p\u00ebr profesionalizmin, duke i cil\u00ebsuar ato kontradiktore me rrethanat e konstatuara.<\/p>\n<p>Sipas Komisionit, shkeljet e konstatuara n\u00eb kriterin profesional \u201cnuk jan\u00eb n\u00eb mas\u00ebn q\u00eb t\u00eb merren n\u00eb konsiderat\u00eb si shkak shkarkimi p\u00ebr subjektin e rivler\u00ebsimit\u201d.<\/p>\n<p>Nd\u00ebrsa ONM e konsideron fjalin\u00eb e fundit t\u00eb paqart\u00eb.<\/p>\n<p>\u201cN\u00ebse i referohet analiz\u00ebs s\u00eb rasteve konkrete t\u00eb renditura n\u00eb k\u00ebt\u00eb opinion, ky pohim nuk \u00ebsht\u00eb i v\u00ebrtet\u00eb, sepse disa gabime profesionale t\u00eb b\u00ebra nga i subjekti i rivler\u00ebsimit ishin t\u00eb natyr\u00ebs procedurale, bazuar n\u00eb t\u00eb nj\u00ebjtin vendim t\u00eb KPK-s\u00eb,\u201d konstaton v\u00ebzhguesi nd\u00ebrkomb\u00ebtar dhe shton se Komisioni s\u00eb paku, duhej t\u00eb kishte marr\u00eb n\u00eb konsiderat\u00eb gjetjet profesionale s\u00eb bashku me element\u00ebt e konstatuar n\u00eb \u00e7\u00ebshtjet e gjykuara n\u00eb kushtet e konfliktit t\u00eb interesit dhe t\u00eb vler\u00ebsonte n\u00ebse subjekti mund t\u00eb gjendej n\u00eb kushtet e shkarkimit.<\/p>\n<p>Duke vler\u00ebsuar se Komisioni ka gabuar duke mos marr\u00eb n\u00eb konsiderave mang\u00ebsit\u00eb e Rulit t\u00eb konstatuara gjat\u00eb analizimit t\u00eb \u00e7\u00ebshtjeve t\u00eb denoncuara, ONM vler\u00ebson se nuk mund t\u00eb p\u00ebrjashtohet mund\u00ebsia se k\u00ebto gjetje, s\u00eb bashku me elementet e tjer\u00eb mund t\u00eb sjellin nj\u00eb largim nga puna t\u00eb subjektit.<\/p>\n<p>ONM i referon gjetjet p\u00ebr shkeljet procedurale pran\u00eb institucionit t\u00eb Komisioner\u00ebve Publik\u00eb, t\u00eb cil\u00ebve u k\u00ebrkon t\u00eb vler\u00ebsojn\u00eb n\u00ebse ka shkelje n\u00eb kuadrin e c\u00ebnimit t\u00eb besimit t\u00eb publikut tek drejt\u00ebsia, q\u00eb do t\u00eb justifikonin ankimin e vendimit t\u00eb KPK-s\u00eb lidhur me kriterin profesional.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Gjyqtari i Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb Tiran\u00eb, Emiljano Ruli u shkarkua prej Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK m\u00eb 29 korrik 2022, pasi u konkludua se kishte kryer deklarim t\u00eb pamjaftuesh\u00ebm p\u00ebr pasurin\u00eb.
