Nd\u00ebrkoh\u00eb, konstatimet p\u00ebr mang\u00ebsit\u00eb n\u00eb aspektin e njohurive ligjore nuk u gjet\u00ebn penalizuese.<\/p>\n<p>Procesi i rivler\u00ebsimit p\u00ebr prokurorin Garunja u krye nga trupa e KPK-s\u00eb, e kryesuar nga Roland Ilia, me relatore Etleda \u00c7iftjan dhe an\u00ebtare Pamela Qirkon.<\/p>\n<p>Shp\u00ebtim Garunja e nisi karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1988 dhe punoi si prokuror n\u00eb Lezh\u00eb dhe n\u00eb Kurbin. Prej vitit 2010, ai e ushtron funksionin n\u00eb Prokurorin\u00eb e Rrethit Tiran\u00eb.<\/p>\n<p>N\u00eb deklarat\u00ebn \u201cveting\u201d, subjekti ka pasqyruar nj\u00eb apartament me sip\u00ebrfaqe 86.5 m2 n\u00eb Tiran\u00eb, me vler\u00eb 4 milion\u00eb lek\u00eb, nga t\u00eb cilat 1.5 milion\u00eb se kan\u00eb sh\u00ebrbyer p\u00ebr blerjen dhe 2.5 milion\u00eb si t\u00eb investuara deri n\u00eb momentin e par\u00eb t\u00eb deklarimit n\u00eb 2003-in. Si burim krijimi t\u00eb k\u00ebsaj pasurie subjekti ka deklaruar t\u00eb ardhurat nga pagat e tij dhe t\u00eb bashk\u00ebshortes, si dhe nj\u00eb kredi t\u00eb marr\u00eb nga Enti Komb\u00ebtar i Banesave, EKB.<\/p>\n<p>Lidhur me ndryshimin midis vler\u00ebs s\u00eb deklaruar t\u00eb \u00e7mimit t\u00eb blerjes s\u00eb apartamentit, shum\u00ebs 4 milion lek\u00eb, me at\u00eb t\u00eb pasqyruar n\u00eb kontrat\u00ebn e shitblerjes 1.5 milion\u00eb lek\u00eb, subjekti ka shpjeguar n\u00eb ILDKPKi se vlera 4 milion\u00eb lek\u00eb \u00ebsht\u00eb vendosur pasi ka dashur t\u00eb shpreh\u00eb vler\u00ebn e apartamentit pas blerjes dhe investimit t\u00eb kryer.<\/p>\n<p>Por pas verifikimit t\u00eb t\u00eb dh\u00ebnave p\u00ebr tregun e lir\u00eb t\u00eb apartamenteve p\u00ebr vitin 2001, ka rezultuar se at\u00ebher\u00eb \u00e7mohej n\u00eb shum\u00ebn rreth 4.8 milion\u00eb lek\u00eb. Bazuar n\u00eb k\u00ebt\u00eb konstatim, Garunj\u00ebs i \u00ebsht\u00eb kaluar barr\u00eb prove.<\/p>\n<p>Subjekti ka theksuar se ka deklaruar gjithmon\u00eb vler\u00ebn e apartamentit pas blerjes dhe investimit. Nd\u00ebrkoh\u00eb, ka shtuar se banesa \u00ebsht\u00eb nd\u00ebrtuar n\u00eb vitet 1997-1999, kur sipas tij nuk ka pasur \u00e7mime reference. Ai ka pretenduar se pas k\u00ebrkimeve p\u00ebr ofert\u00ebn m\u00eb t\u00eb mir\u00eb n\u00eb tregun e lir\u00eb \u00ebsht\u00eb p\u00ebrcaktuar \u00e7mimi i blerjes me marr\u00ebveshjen e t\u00eb dy pal\u00ebve.<\/p>\n<p>Pas analizimit t\u00eb shpjegimeve dhe p\u00ebrcaktimeve p\u00ebr \u00e7mimet e tregut t\u00eb lir\u00eb, Komisioni vler\u00ebson se \u00ebsht\u00eb pa logjik\u00eb ekonomike p\u00ebr shit\u00ebsin e apartamentit vendosja e \u00e7mimit 1.5 milion\u00eb lek\u00eb n\u00eb kontrat\u00ebn e shitblerjes, por me interes p\u00ebr subjektin e rivler\u00ebsimit. Megjithat\u00eb, KPK ka konkluduar se kjo situat\u00eb nuk mund t\u00eb p\u00ebrb\u00ebj\u00eb shkak p\u00ebr penalizimin e Garunj\u00ebs, duke qen\u00eb se ai vet\u00eb n\u00eb deklarat\u00ebn e vitit 2003 e n\u00eb vijim ka sh\u00ebnuar se p\u00ebr apartamentin ka shpenzuar gjithsej shum\u00ebn 4 milion\u00eb lek\u00eb. N\u00eb k\u00ebt\u00eb vler\u00ebsim, KPK ka konsideruar edhe faktin se nuk ka rezultuar q\u00eb subjekti t\u00eb gjendej n\u00eb kushtet e konfliktit t\u00eb interesit me shoq\u00ebrin\u00eb nd\u00ebrtuese.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb shqyrtimit t\u00eb k\u00ebsaj gjetjeje, Komisioni vler\u00ebson se subjekti ka b\u00ebr\u00eb deklarimin sipas dokumentacionit q\u00eb ai dispononte, duke pasqyruar \u00e7mimin e paguar p\u00ebr blerjen e apartamentit n\u00eb shum\u00ebn 1.5 milion lek\u00eb dhe at\u00eb t\u00eb investuar n\u00eb vler\u00ebn 2.5 milion\u00eb lek\u00eb. P\u00ebr rrjedhoj\u00eb, n\u00eb analiz\u00ebn financiare \u00ebsht\u00eb konsideruar si shpenzim p\u00ebr k\u00ebt\u00eb pasuri vlera 4 milion\u00eb lek\u00eb.<\/p>\n<p>Lidhur me burimet e krijimit t\u00eb k\u00ebsaj pasurie, subjekti ka shpjeguar se prej kredis\u00eb s\u00eb marr\u00eb nga Enti Komb\u00ebtar i Banesave n\u00eb vler\u00ebn rreth 2.2 milion\u00eb lek\u00eb, ka paguar shum\u00ebn 1.5 milion lek\u00eb p\u00ebr blerjen e apartamentit, nd\u00ebrsa pjes\u00ebn e mbetur e ka p\u00ebrdorur p\u00ebr mobilimin e saj. Sipas Garunj\u00ebs, pjesa e mbetur rreth 1.7 milion\u00eb lek\u00eb, \u00ebsht\u00eb mbuluar nga t\u00eb ardhurat prej pag\u00ebs s\u00eb tij e t\u00eb bashk\u00ebshortes s\u00eb ndjer\u00eb.<\/p>\n<p>Nga hetimi ka rezultuar se subjekti e ka p\u00ebrfituar kredin\u00eb nga Drejtoria Rajonale e EKB-s\u00eb Lezh\u00eb pasi ka hequr dor\u00eb nga blerja me k\u00ebste e nj\u00eb apartamenti si i pastreh\u00eb, pasuri p\u00ebr t\u00eb cil\u00ebn ka lidhur edhe nj\u00eb kontrat\u00eb shitblerje.<\/p>\n<p>Nisur nga fakti se kredia e marr\u00eb prej EKB-s\u00eb n\u00eb Lezh\u00eb, \u00ebsht\u00eb p\u00ebrdorur p\u00ebr blerjen e apartamentit n\u00eb Tiran\u00eb, KPK i ka k\u00ebrkuar sqarime subjektit. Ai ka deklaruar se kontrata me rezerv\u00eb p\u00ebr blerjen e banes\u00ebs n\u00eb Lezh\u00eb ka qen\u00eb formale dhe se vjen si rrjedhoj\u00eb e trajtimit t\u00eb familjes s\u00eb tij si e pastreh\u00eb.<\/p>\n<p>Garunja ka sqaruar n\u00eb vijim se p\u00ebr shkak t\u00eb transferimeve t\u00eb shumta, nd\u00ebrkoh\u00eb q\u00eb familja jetonte n\u00eb Shkod\u00ebr dhe vet\u00eb punonte n\u00eb Lezh\u00eb, ka hequr dor\u00eb nga apartamenti n\u00eb at\u00eb qytet, duke u dakord\u00ebsuar edhe me p\u00ebrfaq\u00ebsuesit e EKB-s\u00eb. Sipas tij, kur ka kryer nj\u00eb pages\u00eb n\u00eb shum\u00eb 90 mij\u00eb lek\u00eb p\u00ebr llogari t\u00eb EKB-s\u00eb, kjo e fundit i ka kaluar vler\u00ebn 2 milion e 257 mij\u00eb lek\u00eb.<\/p>\n<p>Komisioni konstaton se EKB ka sqaruar se kontrata e lidhur me Garunj\u00ebn vijon t\u00eb jet\u00eb aktive dhe se ai paguar k\u00ebstet e apartamentit duke qen\u00eb zot\u00ebrues, por jo pronar i ligjsh\u00ebm i asaj pasurie. Nd\u00ebrkoh\u00eb, nga verifikimi n\u00eb ASHK ka rezultuar se apartamenti n\u00eb Lezh\u00eb figuron ende i regjistruar n\u00eb em\u00ebr t\u00eb personave q\u00eb e kan\u00eb privatizuar n\u00eb vitin 1993.<\/p>\n<p>Bazuar n\u00eb k\u00ebto t\u00eb dh\u00ebna, KPK i ka kaluar subjektit barr\u00eb prove p\u00ebr mosmb\u00ebshtetjen me prova justifikuese t\u00eb pretendimit se kredia nga EKB ka sh\u00ebrbyer p\u00ebr pages\u00ebn e \u00e7mimit t\u00eb apartamentit n\u00eb Tiran\u00eb dhe nj\u00eb pjese t\u00eb investimit, pasi kontrata p\u00ebr blerjen e banes\u00ebs n\u00eb Lezh\u00eb ka rezultuar t\u00eb jet\u00eb ende n\u00eb fuqi.<\/p>\n<p>Garunja ka k\u00ebmb\u00ebngulur se apartamenti n\u00eb Lezh\u00eb nuk \u00ebsht\u00eb n\u00eb pron\u00ebsin\u00eb e tij dhe se nuk e ka p\u00ebrdorur asnj\u00ebher\u00eb, si dhe ka theksuar se kontrata ka qen\u00eb formale. Ai ka rikthesuar se nga ky apartament ka hequr dor\u00eb me dakord\u00ebsin\u00eb e p\u00ebrfaq\u00ebsuesit t\u00eb EKB-s\u00eb Lezh\u00eb dhe se vlera 2 milion e 257 mij\u00eb lek\u00eb i \u00ebsht\u00eb dor\u00ebzuar personalisht n\u00eb gusht t\u00eb vitit 2001.<\/p>\n<p>Komisioni analizon p\u00ebrmbajtjen e kontrat\u00ebs s\u00eb shitjes me rezerv\u00eb t\u00eb apartamentit n\u00eb Lezh\u00eb, duke e konsideruar si nj\u00eb veprim juridik me natyr\u00eb t\u00eb dyfisht\u00eb. \u201cNga nj\u00ebra an\u00eb \u00ebsht\u00eb veprim juridik detyrimi, por nga ana tjet\u00ebr ka edhe nj\u00eb natyr\u00eb juridike pron\u00ebsie\u201d, vler\u00ebson KPK.<\/p>\n<p>Lidhur me transaksionet e kryera n\u00eb vitin 2001 p\u00ebr apartamentin n\u00eb Lezh\u00eb, Komisioni v\u00ebren se kjo pasuri \u00ebsht\u00eb bler\u00eb me fonde shtet\u00ebrore dhe se bler\u00ebsi, n\u00eb k\u00ebt\u00eb rast subjekti, duhej t\u00eb shlyente pages\u00ebn e kryer. Nd\u00ebrkoh\u00eb, jan\u00eb p\u00ebrcaktuar k\u00ebstet p\u00ebr pages\u00ebn e \u00e7mimit t\u00eb k\u00ebsaj banese n\u00eb shum\u00ebn 2 milon\u00eb e 258 mij\u00eb lek\u00eb, q\u00eb rezulton se Garuja i ka shlyer n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe dhe se i kan\u00eb mbetur p\u00ebr t\u00eb paguar 281 mij\u00eb lek\u00eb deri n\u00eb p\u00ebrfundimin e kontrat\u00ebs.<\/p>\n<p>\u201cEvidentohet qart\u00ebsisht dhe provohet se nd\u00ebrmjet EKB-s\u00eb Lezh\u00eb dhe subjektit t\u00eb rivler\u00ebsimit ekziston nj\u00eb marr\u00ebdh\u00ebnie detyrimi q\u00eb ka lindur nga kontrata e shitjes me k\u00ebste, me kusht, nr. ***, dat\u00eb 1.8.2001, ku subjekti i rivler\u00ebsimit detyrohet t\u2019i kthej\u00eb EKB-s\u00eb shum\u00ebn 2.258.000 lek\u00eb, si dhe ekzekutimi i detyrimit, i v\u00ebrtetuar me deklarimet e subjektit n\u00eb deklarata periodike vjetore dhe transfertat bankare nga llogaria e tij n\u00eb llogarin\u00eb e EKB-s\u00eb\u201d, argumenton Komisioni.<\/p>\n<p>\u201cSubjekti i rivler\u00ebsimit nga kjo marr\u00ebveshje ka p\u00ebrfituar vet\u00ebm shum\u00ebn prej 2.257.000 lek\u00ebsh, me t\u00eb cil\u00ebn ka paguar k\u00ebstin e apartamentit t\u00eb bler\u00eb n\u00eb Tiran\u00eb\u201d, konstaton KPK dhe ka konsideruar se subjekti ka kryer dekarim t\u00eb sakt\u00eb lidhur me p\u00ebrdorimin e kredis\u00eb s\u00eb marr\u00eb nga EKB n\u00eb Lezh\u00eb p\u00ebr pages\u00ebn e \u00e7mimit t\u00eb apartamentit n\u00eb Tiran\u00eb. P\u00ebr rrjedhoj\u00eb shuma e kredis\u00eb afro 2.3 milion\u00eb lek\u00eb \u00ebsht\u00eb vler\u00ebsuar si burim i ligjsh\u00ebm n\u00eb analiz\u00ebn financiare<\/p>\n<p>Po ashtu, KPK ka konkluduar se subjekti dhe bashk\u00ebshortja e tij kan\u00eb pasur mund\u00ebsi q\u00eb nga kursimet prej pagave t\u00eb tyre t\u00eb kursejn\u00eb shum\u00ebn tjet\u00ebr 1.7 milion\u00eb lek\u00eb, q\u00eb ka sh\u00ebrbyer p\u00ebr investimet e kryera p\u00ebr banes\u00ebn n\u00eb kryeqytet.<\/p>\n<p>Shpjegimet dhe provat e Garunj\u00ebs jan\u00eb gjetur bind\u00ebse edhe lidhur me nj\u00eb kontrat\u00eb porosie t\u00eb vitit 2006 p\u00ebr nj\u00eb apartament n\u00eb Durr\u00ebs, kundrejt \u00e7mimit 25 mij\u00eb e 200 euro, nga t\u00eb cilat ka shlyer 21 mij\u00eb e 200 euro.<\/p>\n<p>Komisioni i ka k\u00ebrkuar subjektit t\u00eb shpjegonte se kur e ka marr\u00eb n\u00eb p\u00ebrdorim apartamentin, por ai ka deklaruar se nuk e ka marr\u00eb n\u00eb p\u00ebrdorim dhe as e g\u00ebzon k\u00ebt\u00eb apartament, pasi nuk \u00ebsht\u00eb kryer akti i shitblerjes dhe as pagesa e plot\u00eb &#8211; p\u00ebr shkak t\u00eb mos p\u00ebrfundimit dhe kolaudimit t\u00eb pallatit.<\/p>\n<p>Sipas tij, apartamenti aktualisht figuron n\u00eb pron\u00ebsi t\u00eb subjektit nd\u00ebrtues. Gjithashtu, ka deklaruar se nuk disponon kontrata t\u00eb furnizimit me energji elektrike dhe uj\u00eb p\u00ebr k\u00ebt\u00eb apartament p\u00ebr shkak t\u00eb mosposedimit fizikisht. Komisioni shprehet se subjekti ka dor\u00ebzuar dokumentacion provues p\u00ebr t\u00eb v\u00ebrtetuar deklarimin e tij.<\/p>\n<p>Nga analiza financiare p\u00ebr pages\u00ebn e k\u00ebsteve p\u00ebr k\u00ebt\u00eb pasuri, \u00ebsht\u00eb konstatuar se subjekti dhe familjar\u00ebt e tij kan\u00eb pasur burime t\u00eb ligjshme t\u00eb mjaftueshme p\u00ebr t\u00eb shlyer pages\u00ebn e vler\u00ebs 21 mij\u00eb e 200 euro.<\/p>\n<p>Po ashtu, KPK vler\u00ebson se Garunja ka pasur mund\u00ebsi financiare p\u00ebr blerjen e nj\u00eb automjeti n\u00eb vler\u00ebn 7000 euro n\u00eb vitin 2013; p\u00ebr nj\u00eb gjendje cash n\u00eb shum\u00ebn 980 mij\u00eb lek\u00eb t\u00eb pasqyruar n\u00eb deklarat\u00ebn \u2018veting\u201d; krijimin e nj\u00eb llogarie rrjedh\u00ebse n\u00eb shum\u00ebn 3.2 milion\u00eb lek\u00eb; si dhe p\u00ebr \u00a0mbulimin e shpenzimeve p\u00ebr kurimin e bashk\u00ebshortes s\u00eb ndjer\u00eb.<\/p>\n<p>Gjat\u00eb hetimit n\u00eb kriterin profesional lidhur me disa \u00e7\u00ebshtje t\u00eb hetuara nga prokurori Garunja, Komisioni konstaton mang\u00ebsi t\u00eb subjektit n\u00eb aspektin e njohurive ligjore. Megjithat\u00eb, Komisioni vler\u00ebson se n\u00eb raport me gjith\u00eb \u00e7\u00ebshtjet e analizuara dhe ngarkes\u00ebs s\u00eb Garunj\u00ebs n\u00eb pun\u00eb, nuk \u00ebsht\u00eb vler\u00ebsuar se gjenden gabime thelb\u00ebsore.
