Nd\u00ebrkoh\u00eb, nuk u gjet\u00ebn probleme n\u00eb kriterin e past\u00ebrtis\u00eb s\u00eb figur\u00ebs dhe n\u00eb at\u00eb profesional.<\/p>\n<p>Shumica e trup\u00ebs s\u00eb KPK e p\u00ebrb\u00ebr\u00eb nga kryesuesja Brunilda Bekteshi dhe an\u00ebtari Lulzim Hamitaj, vler\u00ebsuan se \u00c7ar\u00e7iu duhej t\u2019i n\u00ebnshtrohej procesit t\u00eb rivler\u00ebsimit kalimtar n\u00eb cil\u00ebsin\u00eb e inspektores dhe si ish-gjyqtare, megjith\u00ebse nuk e kishte dor\u00ebzuar n\u00eb koh\u00eb k\u00ebrkes\u00ebn p\u00ebr t\u2019u vetuar si e till\u00eb. Relatorja e \u00e7\u00ebshtjes, Firdes Shuli doli me mendim paralel duke \u00e7muar se nuk \u00ebsht\u00eb subjekt rivler\u00ebsimi dhe se vetingu ndaj saj duhej t\u00eb nd\u00ebrpritej pa nj\u00eb vendim p\u00ebrfundimtar.<\/p>\n<p>Brunilda \u00c7ar\u00e7iu ka kryer studimet n\u00eb Fakultetin e Shkencave Politike dhe Juridike n\u00eb vitet akademike 1987 \u2013 1991. Pas p\u00ebrfundimit t\u00eb studimeve \u00ebsht\u00eb em\u00ebruar gjyqtare n\u00eb Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Gramsh, funksion q\u00eb e ka mbajtur deri m\u00eb 13 maj t\u00eb vitit 2000, kur me k\u00ebrkes\u00ebn e saj, \u00ebsht\u00eb liruar nga detyra si gjyqtare dhe \u00ebsht\u00eb em\u00ebruar si ndihm\u00ebse ligjore n\u00eb Gjykat\u00ebn e Lart\u00eb. K\u00ebt\u00eb detyr\u00eb,\u00a0 \u00c7ar\u00e7iu e ka ushtruar deri m\u00eb 1 mars t\u00eb vitit 2011, kur me urdh\u00ebrin ish-KLD-s\u00eb \u00ebsht\u00eb em\u00ebruar si specialiste pran\u00eb inspektoriatit t\u00eb k\u00ebtij institucioni dhe n\u00eb vitin 2016 \u00ebsht\u00eb caktuar si inspektore, por pasi kishin hyr\u00eb n\u00eb fuqi ndryshimet kushtetuese p\u00ebr legjislacionin e vetingut ku p\u00ebrcaktohej se rivler\u00ebsoheshin ata q\u00eb e g\u00ebzonin n\u00eb at\u00eb koh\u00eb statusin e magjistratit.<\/p>\n<p>Megjithat\u00eb, n\u00eb dhjetor t\u00eb vitit 2019, K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor ka arritur n\u00eb p\u00ebrfundimin se inspektorja Brunilda \u00c7ar\u00e7iu e ka ruajtur statusin e magjistratit.<\/p>\n<p><strong>Debati p\u00ebr statusin e subjektit<\/strong><\/p>\n<p>Subjekti ka plot\u00ebsuar deklarat\u00ebn \u201cveting\u201d n\u00eb vitin 2017 dhe i ka k\u00ebrkuar Komisionit nj\u00eb vit m\u00eb von\u00eb q\u00eb t\u00eb kryhet procesi i vetingut ndaj saj n\u00eb cil\u00ebsin\u00eb e ish-gjyqtares. Por, kjo k\u00ebrkes\u00eb ka rezultuar se \u00ebsht\u00eb kryer jasht\u00eb afatit t\u00eb p\u00ebrcaktuar ligjor.<\/p>\n<p>Megjith\u00ebse subjekti ka qen\u00eb specialiste n\u00eb momentin e hyrjes n\u00eb fuqi t\u00eb ndryshimeve kushtetuese p\u00ebr vetingun e magjistrat\u00ebve, ajo ka paraqitur gjithashtu si argument p\u00ebr pasjen e statusit t\u00eb subjektit t\u00eb rivler\u00ebsimit, faktin se ka ushtruar m\u00eb par\u00eb detyr\u00ebn e gjyqtares dhe t\u00eb inspektores, si dhe p\u00ebr faktin se Shkolla e Magjistratur\u00ebs i ka k\u00ebrkuar t\u00eb kryej\u00eb testimin profesional.<\/p>\n<p>Shumica v\u00ebren se ndryshimet ligjore hyn\u00eb n\u00eb fuqi n\u00eb tetor t\u00eb vitit 2016, kur \u00c7ar\u00e7iu punonte si specialiste, por shton se ato u pezulluan po at\u00eb muaj nga Mbledhja e Gjyqtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetuese dhe p\u00ebr rrjedhoj\u00eb, efektet e zbatimit nis\u00ebn me publikimin e vendimit t\u00eb k\u00ebsaj gjykate, m\u00eb 19 janar 2017.<\/p>\n<p>Bekteshi dhe Hamitaj shtojn\u00eb se situata ligjore duhet t\u00eb shihet e lidhur dhe me faktin se KLGJ-ja n\u00eb vitin 2019 ka disponuar me \u201cdeklarimin e pasjes s\u00eb statusit \u2018magjistrat\u2019\u201d p\u00ebr \u00c7ar\u00e7iun.<\/p>\n<p>Trupi gjykues \u00e7mon se ruajtja e statusit p\u00ebr \u00c7ar\u00e7iun nga institucioni kushtetues i KLGJ-s\u00eb, si dhe q\u00ebnia e saj n\u00eb detyr\u00ebn e inspektores, jan\u00eb arsye dhe rrethana ligjore q\u00eb e vendosin n\u00eb kushtet e kryerjes s\u00eb vetingut e saj.<\/p>\n<p>Sipas shumic\u00ebs, vendimi i KLGJ-s\u00eb nuk mund t\u00eb n\u00ebnshtrohet nj\u00eb vler\u00ebsimi ndryshe nga ana e KPK. \u201cN\u00eb rastin konkret, kuadri ligjor q\u00eb p\u00ebrb\u00ebn procesin e rivler\u00ebsimit, \u00ebsht\u00eb kompetenc\u00eb e Komisionit dhe e Kolegjit. Po ashtu, kuadri ligjor q\u00eb rregullon statusin e magjistrat\u00ebve, \u00ebsht\u00eb kompetenc\u00eb e KLGJ-s\u00eb apo KLP-s\u00eb, sipas rastit\u201d, arsyeton shumica dhe e cil\u00ebson q\u00ebndrimin e saj n\u00eb p\u00ebrputhje me jurispudenc\u00ebn e Gjykat\u00ebs Kushtetuese.<\/p>\n<p>N\u00eb vijim, shumica v\u00ebren se \u00c7ar\u00e7iu \u00ebsht\u00eb sjell\u00eb n\u00eb m\u00ebnyr\u00eb kosistente si subjekt rivler\u00ebsimi, megjith\u00ebse nuk ka paraqitur nj\u00eb k\u00ebrkes\u00eb benda afatit ligjor p\u00ebr t\u2019u vetuar si ish-gjyqtare apo si ish-k\u00ebshilltare.<\/p>\n<p>Shumica shkon m\u00eb tej n\u00eb arsyetimin e saj, duke e shprehur se nd\u00ebrprerja e procesit me nj\u00eb vendim jo p\u00ebrfundimtar do t\u00eb ishte totalisht e pamb\u00ebshtetur n\u00eb ligj dhe n\u00eb prova, si dhe me mang\u00ebsi t\u00eb \u2018argumenteve analitikojuridike bind\u00ebse\u2019.<\/p>\n<p>Sipas shumic\u00ebs, nd\u00ebrprerja e vetingut p\u00ebr \u00c7ar\u00e7iun dhe p\u00ebrjashtimi i saj p\u00ebr 15 vjet nga sistemi i drejt\u00ebsis\u00eb, nuk do t\u00eb ishte n\u00eb p\u00ebrputhje me parimin e objektivitetit dhe t\u00eb proporcionalitetit. \u201cMidis mosveprimit (n\u00eb koh\u00eb), pa pasoja administrative lidhur me procesin e rivler\u00ebsimit (q\u00eb ka nisur pas paraqitjes s\u00eb deklarat\u00ebs nga znj. Brunilda \u00c7ar\u00e7iu), si dhe mas\u00ebs penalizuese, t\u00eb p\u00ebrjashtimit nga sistemi p\u00ebr 15 vjet, Komisioni vler\u00ebsoi se zgjidhja m\u00eb e p\u00ebrshtatshme dhe n\u00eb p\u00ebrputhje me vullnetin e shprehur nga subjekti, me frym\u00ebn e ligjit dhe me interesin publik, do t\u00eb ishte kryerja e rivler\u00ebsimit p\u00ebr k\u00ebt\u00eb subjekt\u201d, ka \u00e7muar shumica.<\/p>\n<p>Relatorja e \u00e7\u00ebshtjes, Firdes Shuli, ndan opinion t\u00eb ndrysh\u00ebm nga dy an\u00ebtar\u00ebt e trup\u00ebs, duke vler\u00ebsuar se \u00c7ar\u00e7iu nuk \u00ebsht\u00eb subjekt rivler\u00ebsimi.<\/p>\n<p>Pakica v\u00ebren se n\u00eb momentin e hyrjes n\u00eb fuqi t\u00eb ndryshimeve kushtetuese lidhur me legjislacionin e vetingut t\u00eb magjistrat\u00ebve, \u00c7ar\u00e7iu ka qen\u00eb specialiste n\u00eb Drejtorin\u00eb Juridike pran\u00eb ish-K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb, me status t\u00eb n\u00ebpun\u00ebsit civil. \u201cSi e till\u00eb, nuk e ka marr\u00eb cil\u00ebsin\u00eb e subjektit t\u00eb rivler\u00ebsimit ex officio, si\u00e7 do ta merrte n\u00ebse do t\u00eb kishte qen\u00eb inspektore pran\u00eb KLD-s\u00eb\u201d, argumenton Shuli dhe vler\u00ebsoj se e vemtja m\u00ebnyr\u00eb q\u00eb \u00c7ar\u00e7iu t\u2019i n\u00ebnshtrohej vetingut ishte n\u00eb cil\u00ebsin\u00eb e ish-gjyqtares ose ish-k\u00ebshilltares n\u00eb Gjykat\u00ebn e Lart\u00eb, por me kushtin q\u00eb k\u00ebrkesa prej saj duhej t\u00eb ishte paraqitur me shkrim n\u00eb Komision brenda tre muajve nga hyrja n\u00eb fuqi e ligjit.<\/p>\n<p>Ndryshe nga shumica, Shuli vler\u00ebson se vendimi i KLGJ-s\u00eb \u201cp\u00ebr deklarimin e statusit\u201d, si dhe nd\u00ebrmarrja e subjektit, nuk mund t\u00eb z\u00ebvend\u00ebsojn\u00eb k\u00ebrkes\u00ebn q\u00eb \u00c7ar\u00e7iu duhet t\u00eb b\u00ebnte brenda tre muajve nga hyrja n\u00eb fuqi e ligjit.<\/p>\n<p>Ajo kund\u00ebrshton edhe q\u00ebndrimin tjet\u00ebr t\u00eb shumic\u00ebs, se ndryshimet ligjore kan\u00eb hyr\u00eb n\u00eb fuqi pas publikimit t\u00eb vendimit t\u00eb Gjykat\u00ebs Kushtetuese. \u201c\u00cbsht\u00eb Kushtetuta ajo q\u00eb ka p\u00ebrcaktuar kuptimin dhe kategorit\u00eb e subjekteve t\u00eb rivler\u00ebsimit, nd\u00ebrkoh\u00eb q\u00eb n\u00eb ligjin nr. 84\/2016 \u00ebsht\u00eb p\u00ebrcaktuar procedura e detajuar e procesit t\u00eb rivler\u00ebsimit p\u00ebr secil\u00ebn kategori\u201d, vler\u00ebson Shuli.<\/p>\n<p>N\u00eb vijim ajo argumenton se vullneti i \u00c7ar\u00e7iut p\u00ebr t\u2019iu n\u00ebnshtruar vetingut, pa p\u00ebrmbushur kushtet e tjera ligjore q\u00eb lidhen detyrimisht me pasjen e nj\u00eb funksioni t\u00eb caktuar, \u00ebsht\u00eb i pamjaftuesh\u00ebm p\u00ebr ta kualifikuar at\u00eb si subjekt rivler\u00ebsimi.<\/p>\n<p>Shuli shprehet kund\u00ebr arsyetimit t\u00eb shumic\u00ebs se kuadri ligjor duhej analizuar bazuar n\u00eb situat\u00ebn faktike ku gjendej \u00c7ar\u00e7iu, \u201cme nj\u00eb vler\u00ebsim pragmatik dhe jo strikt formal\u201d.<\/p>\n<p>\u201cUn\u00eb si an\u00ebtare n\u00eb pakic\u00eb, mendoj se shumica ka anashkaluar vler\u00ebsimin e p\u00ebrmbushjes s\u00eb kritereve ligjore t\u00eb vendosura n\u00eb Kushtetut\u00eb p\u00ebr ta kualifikuar znj.Brunilda \u00c7ar\u00e7iu si subjekt rivler\u00ebsimi\u201d, vler\u00ebson Shuli.<\/p>\n<p>Pakica vler\u00ebson ndryshe edhe lidhur me sanksionin 15-vje\u00e7ar q\u00eb sipas shumic\u00ebs duhej vendosur n\u00eb rast t\u00eb nd\u00ebrprerjes s\u00eb vetingut. \u201cJam e mendimit q\u00eb kjo nd\u00ebrprerje nuk duhet t\u00eb shoq\u00ebrohet me mas\u00ebn e largimit p\u00ebr 15 vjet nga sistemi i drejt\u00ebsis\u00eb, sipas nenit G, pika 2, e Aneksit t\u00eb Kushtetut\u00ebs, pasi p\u00ebr nj\u00eb vendimmarrje t\u00eb till\u00eb do t\u00eb ishte m\u00eb par\u00eb i nevojsh\u00ebm kualifikimi i subjektit si subjekt rivler\u00ebsimi, sipas kritereve kushtetuese\u201d, arsyeton Shuli.<\/p>\n<p>Por Shuli shprehet se pas hetimit n\u00eb t\u00eb tre kriteret, ka propozuar shkarkimin nga detyra t\u00eb \u00c7ar\u00e7iut p\u00ebr shkak t\u00eb konkluzionee n\u00eb kriterin pasuror.<\/p>\n<p><strong>Balancat negative<\/strong><\/p>\n<p>Subjekti \u00ebsht\u00eb gjetur n\u00eb pamund\u00ebsi financiare p\u00ebr blerjen e tre pasurive t\u00eb paluajtshme n\u00eb vitin 2007, konkretisht t\u00eb dy dyqaneve me sip\u00ebrfaqe totale 52.32 m2 n\u00eb Tiran\u00eb kundrejt \u00e7mimit 35 mij\u00eb euro dhe t\u00eb nj\u00eb apartamenti me sip\u00ebrfaqe 56 m2 n\u00eb Durr\u00ebs, n\u00eb vler\u00ebn 2 milion\u00eb lek\u00eb.<\/p>\n<p>Si burime krijimi t\u00eb k\u00ebtyre pasurive, \u00c7ar\u00e7iu ka deklaruar kursimet nga t\u00eb ardhurat nga pagat nd\u00ebr vite dhe shitja e nj\u00eb banese 2+1 n\u00eb Gramsh n\u00eb vitin 2003 n\u00eb shum\u00ebn 1.7 milion\u00eb lek\u00eb.<\/p>\n<p>Nga analiza financiare e kryer nga Komisioni ka rezultuar pamund\u00ebsi p\u00ebr kursimin e shum\u00ebs 5.7 milion\u00eb lek\u00eb t\u00eb deklaruar n\u00eb vitin 2003. Megjith\u00ebse n\u00eb analiz\u00eb jan\u00eb konsideruar t\u00eb ardhurat nga shitja e apartamentit n\u00eb Gramsh dhe ka rezultuar mund\u00ebsi kursimi n\u00eb vitin 2006 t\u00eb shum\u00ebs 450 mij\u00eb lek\u00eb, k\u00ebto vlera jan\u00eb konsideruar t\u00eb pamjaftueshme p\u00ebr krijimin e pasurive n\u00eb 2007-\u00ebn, prej nga ka rezultuar balanc\u00eb negative n\u00eb shum\u00ebn 2.3 milion\u00eb lek\u00eb.<\/p>\n<p>Komisioni konstaton pamund\u00ebsi edhe n\u00eb investimin t\u00eb familjes s\u00eb subjektit n\u00eb \u00bc-\u00ebn pjes\u00eb takuese t\u00eb nj\u00eb banese 2- kat\u00ebshe n\u00eb Laprak\u00eb t\u00eb Tiran\u00ebs, pasuri p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb deklaruar se \u00ebsht\u00eb vet\u00ebnd\u00ebrtuar q\u00eb prej vitit 1996-2000. Bazuar n\u00eb dokumentet e administruara gjat\u00eb hetimit administrativ, KPK ka konsideruar se objekti \u00ebsht\u00eb nd\u00ebrtuar gjat\u00eb periudh\u00ebs 1997-2000 dhe si vler\u00eb e kostos s\u00eb nd\u00ebrtimit \u00ebsht\u00eb p\u00ebrfshir\u00eb shuma 3 milion\u00eb lek\u00eb q\u00eb \u00ebsht\u00eb deklaruar nga vet\u00eb \u00c7ar\u00e7iu, megjith\u00ebse sipas \u00e7mimeve t\u00eb Entit Komb\u00ebtar t\u00eb Banesave, vlera ka qen\u00eb m\u00eb e ul\u00ebt.<\/p>\n<p>Subjekti ka kund\u00ebrshtuar nj\u00eb pjes\u00eb t\u00eb konkluzioneve t\u00eb analiz\u00ebs financiare p\u00ebr burimet e krijimit t\u00eb k\u00ebsaj pasurie, por s\u00ebrish balanca ka rezultuar negative n\u00eb mas\u00ebn 206 mij\u00eb lek\u00eb.<\/p>\n<p>Sipas KPK, \u00c7ar\u00e7iu nuk ka arritur t\u00eb provoj\u00eb ligjshm\u00ebrin\u00eb e burimeve p\u00ebr blerjen e nj\u00eb automjti tip \u201cRenault\u201d, me vler\u00eb 270 mij\u00eb lek\u00eb n\u00eb vitin 2010, si dhe krijimin e disa depozitave.<\/p>\n<p>Nga analiza p\u00ebrfundimtare e Komisionit e shtrir\u00eb gjat\u00eb gjith\u00eb periudh\u00ebs q\u00eb subjekti ka ushtruar detyr\u00ebn e gjyqtares, k\u00ebshilltares n\u00eb Gjykat\u00ebn e Lart\u00eb, por dhe n\u00eb at\u00eb t\u00eb rivler\u00ebsimit kalimtar t\u00eb magjistrat\u00ebve ku p\u00ebr disa vite \u00c7ar\u00e7iu nuk e ka g\u00ebzuar statusin e magjistratit, \u00ebsht\u00eb konstatuar balanc\u00eb negative totale n\u00eb vler\u00ebn 4.8 milion\u00eb lek\u00eb. N\u00eb vendimin e arsyetuar t\u00eb Komisionit sqarohet se mungesa financiare n\u00eb vler\u00ebn rreth 3.6 milion\u00eb lek\u00eb jan\u00eb konstatuar gjat\u00eb periudh\u00ebs kur subjekti e ka g\u00ebzuar statusin e magjistratit, nd\u00ebrsa balanca negative 1 milion e 155 mij\u00eb lek\u00eb i p\u00ebrket periudh\u00ebs jasht\u00eb ushtrimit t\u00eb detyr\u00ebs.<\/p>\n<p>Komisioni \u00e7mon se balanca negative e konstatuar n\u00eb periudh\u00ebn jasht\u00eb ushtrimit t\u00eb detyr\u00ebs e vler\u00ebsuar n\u00eb parimin e proporcionalitetit, nuk mund t\u00eb jet\u00eb penalizuese.
