Mund\u00ebsia e kursimit nuk \u00ebsht\u00eb konsideruar, pasi Vel\u00e7ani ka deklaruar si burim p\u00ebr pjes\u00ebn m\u00eb t\u00eb madhe t\u00eb \u00e7mimit t\u00eb apartamentit, nj\u00eb kredi q\u00eb e ka p\u00ebrfituar pas blerjes s\u00eb k\u00ebsaj pasurie.<\/p>\n<p>Marjana Vel\u00e7ani u shkarkua nga detyra prej Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK m\u00eb 12 dhjetor 2019, pasi nuk justifikoi dot blerjen e nj\u00eb apartamenti me burime t\u00eb ligjshme, si dhe u konstatuan balanca negative p\u00ebr nj\u00eb makin\u00eb dhe shpenzimet familjare. P\u00ebr past\u00ebrtin\u00eb e figur\u00ebs nuk u gjet\u00ebn probleme, nd\u00ebrsa konstatimet p\u00ebr profesionalizmin u vler\u00ebsuan jopenalizuese.<\/p>\n<p>Vendimi i Komisionit u ankimua gjyqtarja Vel\u00e7ani, e cila p\u00ebrve\u00e7 kund\u00ebrshtimeve t\u00eb konkluzioneve p\u00ebr pasurin\u00eb, ngriti pretendime edhe mbi procesin e rregullt ligjor dhe ndaj konstatimeve n\u00eb kriterin profesional.<\/p>\n<p>Gjat\u00eb shqyrtimit t\u00eb ankimit t\u00eb subjektit n\u00eb dhom\u00eb k\u00ebshillimi, Kolegji ka konstatuar dokumentacioni i gjetur n\u00eb fashikujt e Komisionit p\u00ebr nj\u00eb kredi t\u00eb marr\u00eb p\u00ebr blerjen e nj\u00eb apartamenti n\u00eb Berat, ishte p\u00ebrcjell\u00eb nga Alpha Bank p\u00ebrmes post\u00ebs elektronike, i pashoq\u00ebruar me shkres\u00eb p\u00ebrcjell\u00ebse me ekstremitetet p\u00ebrkat\u00ebse, si num\u00ebr protokolli e dat\u00eb. Po ashtu, n\u00eb e-mail nuk referohej lista e dokumenteve t\u00eb p\u00ebrcjella, si dhe n\u00eb to nuk p\u00ebrfshiheshin disa dokumente t\u00eb praktik\u00ebs s\u00eb kredis\u00eb t\u00eb paraqitura nga subjekti bashk\u00ebngjitur ankimit.<\/p>\n<p>Bazuar n\u00eb k\u00ebto konstatime, trupi gjykues i KPA i kryesuar nga Rezarta Schuetz, me relatore Albana Shtyll\u00ebn dhe an\u00ebtar\u00eb Ina Rama, Mimoza Tasi e Sokol \u00c7omo vendosi t\u00eb kaloj\u00eb shqyrtimin e \u00e7\u00ebshtjes n\u00eb seanc\u00eb gjyq\u00ebsore publike, me q\u00ebllim konstatimin e plot\u00eb t\u00eb situat\u00ebs faktike dhe p\u00ebrs\u00ebritjen e marrjes s\u00eb proves, p\u00ebr sa i p\u00ebrket praktik\u00ebs s\u00eb kredis\u00eb bankare.<\/p>\n<p>Kolegji administroi si prova dokumentet e Alpha Bank t\u00eb depozituara nga subjekti lidhur me kredin\u00eb, nd\u00ebrkoh\u00eb q\u00eb u vler\u00ebsuan t\u00eb panevojshme akte t\u00eb tjera t\u00eb dor\u00ebzuara prej saj. Pretendimet e Vel\u00e7anit p\u00ebr mosgarantimin e procesit t\u00eb rregullt ligjor n\u00eb Komision, jan\u00eb gjetur t\u00eb pabazuara prej trupit gjykues t\u00eb KPA.<\/p>\n<p>Problemi kryesor i evidentuar prej Komisionit n\u00eb vler\u00ebsimin e pasuris\u00eb s\u00eb Vel\u00e7anit ishte blerja e nj\u00eb apartamenti me sip\u00ebrfaqe 111 m2 n\u00eb Berat n\u00eb vler\u00ebn e 3 milion\u00eb lek\u00ebve. Sipas Komisionit, gjyqtarja Mariana Vel\u00e7ani ka pasur munges\u00eb burimesh t\u00eb ligjshme p\u00ebr krijimin e k\u00ebsaj pasurie, si dhe ka kryer deklarim t\u00eb pasakt\u00eb dhe t\u00eb pamjaftuesh\u00ebm.<\/p>\n<p>Vel\u00e7ani ka deklaruar si burim krijimi t\u00eb apartamentit t\u00eb ardhurat nga paga n\u00eb shum\u00ebn 300 mij\u00eb lek\u00eb dhe nj\u00eb kredi n\u00eb vler\u00ebn 20 mij\u00eb euro marr\u00eb n\u00eb Alpha Bank, q\u00eb \u00ebsht\u00eb disbursuar m\u00eb dat\u00eb 2 korrik 2003, rreth tre muaj pas blerjes s\u00eb apartamentit.<\/p>\n<p>Sipas KPK, n\u00eb kontrat\u00ebn e kredimarrjes nuk \u00ebsht\u00eb parashikuar q\u00ebllimi i p\u00ebrfitimit t\u00eb k\u00ebsaj vlere dhe nuk rezulton q\u00eb kredia t\u00eb ket\u00eb kaluar me transaksion bankar n\u00eb favor t\u00eb shoq\u00ebris\u00eb nd\u00ebrtuese, nd\u00ebrkoh\u00eb q\u00eb \u00ebsht\u00eb p\u00ebrfituar duke vendosur si kolateral t\u00eb nj\u00ebjtin apartament.<\/p>\n<p>Vel\u00e7ani e ka kund\u00ebrshtuar konkluzionin e KPK duke pretenduar se \u00ebsht\u00eb v\u00ebrtetuar me prova t\u00eb plota e t\u00eb pakund\u00ebrshtueshme se q\u00ebllimi i kredis\u00eb n\u00eb Alpha Bank ka qen\u00eb p\u00ebr blerjen e apartamentit 111 m2 n\u00eb Berat. Ajo ka shpjeguar se n\u00eb dakord\u00ebsi dhe mir\u00ebkuptim me pal\u00ebn shit\u00ebse, shlyerja e plot\u00eb e \u00e7mimit t\u00eb k\u00ebsaj pasurie \u00ebsht\u00eb kryer pas marrjes s\u00eb kredis\u00eb dhe jo n\u00eb momentin e shitjes s\u00eb pasuris\u00eb, ashtu si \u00ebsht\u00eb e p\u00ebrcaktuar n\u00eb kontrat\u00eb.<\/p>\n<p>Trupi gjykues v\u00ebren se dokumentacioni i praktik\u00ebs s\u00eb kredis\u00eb i p\u00ebrcjell\u00eb nga Alpha Bank n\u00eb Kolegj ishte i nj\u00ebjt\u00eb me at\u00eb t\u00eb administruar n\u00eb fashikujt e Komisionit dhe p\u00ebr k\u00ebt\u00eb arsye ka pranuar si prov\u00eb dokumentet shtes\u00eb t\u00eb depozituara nga subjekti.<\/p>\n<p>Megjithat\u00eb, s\u00ebrish ka rezultuar se n\u00eb dokumentacion nuk \u00ebsht\u00eb p\u00ebrcaktuar q\u00ebllimi i marrjes s\u00eb kredis\u00eb.<\/p>\n<p>Pretendimi i subjektit t\u00eb rivler\u00ebsimit se kontrata e shitjes s\u00eb pasuris\u00eb \u00ebsht\u00eb bazuar n\u00eb marr\u00ebdh\u00ebnie besimi mes pal\u00ebve, me q\u00ebllim q\u00eb pala shit\u00ebse t\u00eb mund\u00ebsonte krijimin e kolateralit p\u00ebr pal\u00ebn bler\u00ebse p\u00ebr p\u00ebrfitimin e vler\u00ebs s\u00eb plot\u00eb t\u00eb shitjes s\u00eb apartamentit nga kredia bankare, vler\u00ebsohet jobind\u00ebs nga Kolegji.<\/p>\n<p>\u201cTjet\u00ebrsimi i pron\u00ebs pa asnj\u00eb garanci p\u00ebr pal\u00ebn shit\u00ebse p\u00ebr shlyerjen e detyrimit, mund t\u00eb jet\u00eb premis\u00eb probabiliteti p\u00ebr mosshlyerjen e detyrimit nga pala bler\u00ebse, n\u00eb nj\u00eb marr\u00ebdh\u00ebnie e cila bazohet vet\u00ebm n\u00eb cil\u00ebsin\u00eb e bashk\u00ebqytetar\u00ebve\u201d, argumenton KPA.<\/p>\n<p>Subjekti pretendoi n\u00eb KPA se i gjith\u00eb \u00e7mimi i blerjes 3 milion\u00eb lek\u00eb nuk \u00ebsht\u00eb likiuduar para dhe n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb shitblerjes, por sipas mandateve t\u00eb l\u00ebshuara nga shoq\u00ebria nd\u00ebrtuese n\u00eb koh\u00eb t\u00eb m\u00ebvonshme.<\/p>\n<p>Por, Kolegji konstaton se mandatark\u00ebtimet nuk jan\u00eb p\u00ebrpiluar n\u00eb p\u00ebrputhje me rregullat e koh\u00ebs dhe p\u00ebr rrjedhoj\u00eb nuk mund t\u00eb provohet koha e kryerjes s\u00eb pagesave p\u00ebr blerjen e pasuris\u00eb.<\/p>\n<p>Lidhur me arsyen e cop\u00ebzimit t\u00eb shlyerjes s\u00eb detyrimit pas disbursimit t\u00eb kredis\u00eb, subjekti ka shpjeguar se kjo situat\u00eb \u00ebsht\u00eb krijuar me q\u00ebllim p\u00ebr t\u00eb p\u00ebrfituar nga kursi i k\u00ebmbimit t\u00eb valutave. Kolegji sjell n\u00eb v\u00ebmendje pretendimin e subjektit n\u00eb ankim p\u00ebr mir\u00ebkuptimin e shoq\u00ebris\u00eb nd\u00ebrtuese n\u00eb n\u00ebnshkrimin e kontrat\u00ebs s\u00eb shitjes p\u00ebrkundrejt shlyerjes s\u00eb plot\u00eb t\u00eb \u00e7mimit pas p\u00ebrfitimit t\u00eb kredis\u00eb dhe e vler\u00ebson jobind\u00ebs k\u00ebt\u00eb shpjegim p\u00ebr arsyen e pages\u00ebs me k\u00ebste.<\/p>\n<p>Kolegji v\u00ebren se subjekti ka mbajtur q\u00ebndrime t\u00eb ndryshme lidhur me nj\u00eb marr\u00ebveshje shtes\u00eb t\u00eb financimit nga banka, p\u00ebr blerje dhe rikonstruksion apartamenti. N\u00eb ankim, Vel\u00e7ani ka pretenduar se Komisioni nuk kishte vler\u00ebsuar drejt marr\u00ebveshjen shtes\u00eb t\u00eb financimit q\u00eb mban dat\u00eb m\u00eb t\u00eb hershme se ajo e kontrat\u00ebs s\u00eb kredis\u00eb, duke theksuar se ky fakt p\u00ebrb\u00ebnte prov\u00eb se marrdh\u00ebnia me bank\u00ebn ka filluar koh\u00eb p\u00ebrpara n\u00ebnshkrimit t\u00eb huadh\u00ebnies p\u00ebr t\u00eb cil\u00ebn \u00ebsht\u00eb vendosur si garanci hipotekore apartamenti n\u00eb Berat.<\/p>\n<p>KPA ka gjetur se kjo marr\u00ebveshje shtes\u00eb financimi \u00ebsht\u00eb n\u00ebnshkruar n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb me kontrat\u00ebn e kredis\u00eb, pavar\u00ebsisht se ka t\u00eb pasqyruar nj\u00eb dat\u00eb m\u00eb t\u00eb hershme, \u00e7\u2019ka ka sjell\u00eb q\u00ebndrim t\u00eb ri t\u00eb subjektit.<\/p>\n<p>Gjat\u00eb parashtrimeve, Vel\u00e7ani ka ndryshuar deklarime, duke e konsideruar si lapsus dat\u00ebn e pasqyruar n\u00eb marr\u00ebveshjen shtes\u00eb t\u00eb financimit. N\u00eb vijim, edhe ajo ka argumentuar se nuk kishte mund\u00ebsi objektive q\u00eb marr\u00ebveshja e financimit t\u00eb lidhej mes pal\u00ebve p\u00ebrpara n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb kredis\u00eb.<\/p>\n<p>Q\u00ebndrimet dhe k\u00ebrkimet e ndryshme t\u00eb subjektit n\u00eb k\u00ebt\u00eb rast vler\u00ebsohen prej Kolegjit si tentativ\u00eb p\u00ebr t\u00eb shtremb\u00ebruar faktet dhe p\u00ebr t\u00eb prezantuar nj\u00eb situat\u00eb t\u00eb ndryshme nga ajo faktike.<\/p>\n<p>\u201c\u2026Kur kredimarr\u00ebsi provonte p\u00ebrkundrejt bank\u00ebs titullin e pron\u00ebsis\u00eb p\u00ebr apartamentin me sip\u00ebrfaqe 111 m2 n\u00eb Berat, trupi gjykues i Kolegjit, vler\u00ebson se q\u00ebllimi i kredis\u00eb i p\u00ebrcaktuar n\u00eb marr\u00ebveshjen shtes\u00eb t\u00eb financimit p\u00ebr blerje dhe rikonstruksion apartamenti, nuk provohet se ka pasur p\u00ebr q\u00ebllim blerjen e k\u00ebtij apartamenti\u201d, konstaton KPA dhe konkludon se kredia e marr\u00eb n\u00eb Alpha Bank nuk provohet t\u00eb jet\u00eb p\u00ebrdorur si burim krijimi i apartamentit me sip\u00ebrfaqe 111 m2 n\u00eb Berat.<\/p>\n<p>Kolegji ka rr\u00ebzuar edhe pretendimin tjet\u00ebr t\u00eb Vel\u00e7anit se kishte aft\u00ebsi paguese dhe nuk mund t\u00eb rezultonte n\u00eb pamund\u00ebsi financiare p\u00ebr blerjen e apartamentit.<\/p>\n<p>Trupi gjykues vler\u00ebson se megjith\u00ebse subjekti rezulton me mjaftueshm\u00ebri financiare n\u00eb vler\u00ebn afro 1.7 milion\u00eb lek\u00eb, konstatohet balanc\u00eb negative n\u00eb vler\u00ebn 968 mij\u00eb lek\u00eb p\u00ebr pages\u00ebn e \u00e7mimit t\u00eb apartamentit, pasi si burim krijimi jan\u00eb konsideruar n\u00eb analiz\u00eb kredia dhe shuma 300 mij\u00eb len\u00eb nga pagat, t\u00eb deklaruara prej Vel\u00e7anit.<\/p>\n<p>Pamund\u00ebsi financiare n\u00eb vlera t\u00eb vogla jan\u00eb konstatuar edhe p\u00ebr blerjen e nj\u00eb autoveture dhe shpenzimet familjare. P\u00ebr blerjen e nj\u00eb automjeti \u00ebsht\u00eb konkluduar balanc\u00eb negative n\u00eb shum\u00ebn 52 mij\u00eb lek\u00eb; p\u00ebr shpenzimet n\u00eb vitin 2012 pamund\u00ebsi n\u00eb vler\u00ebn 78 mij\u00eb lek\u00eb dhe n\u00eb 2005-\u00ebn jan\u00eb kryer dy analiza financiare, ku vlera e arredimit e p\u00ebrllogaritur sipas shifr\u00ebs s\u00eb konstatuar n\u00eb praktik\u00ebn e nj\u00eb kredie ka rezultuar n\u00eb shum\u00ebn 314 mij\u00eb lek\u00eb, nd\u00ebrsa sipas variantit t\u00eb pretenduar nga subjekti mungesa ka rezultuar n\u00eb mas\u00ebn 127 mij\u00eb lek\u00eb.<\/p>\n<p>KPA ka l\u00ebn\u00eb n\u00eb fuqi edhe konstatimin e Komisionit p\u00ebr deklarim t\u00eb pasakt\u00eb t\u00eb vler\u00ebs s\u00eb nj\u00eb apartamenti tjet\u00ebr n\u00eb Tiran\u00eb.<\/p>\n<p>Vel\u00e7ani ka kund\u00ebrshtuar edhe konkluzionin e Komisionit p\u00ebr probleme t\u00eb saj n\u00eb kriterin profesional, n\u00eb drejtim t\u00eb procedur\u00ebs. Subjekti ka pretenduar se n\u00eb periudh\u00ebn e kontrollit t\u00eb ushtruar, p\u00ebr shkak t\u00eb volumit t\u00eb madh pun\u00ebs, ishte e v\u00ebshtir\u00eb t\u00eb gjente zbatim procedura.<\/p>\n<p>Duke ju referuar legjislacionit administrativ dhe atij p\u00ebr \u201cP\u00ebr statusin e gjyqtar\u00ebve dhe prokuror\u00ebve n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d, ku parashikohen veprime m\u00eb t\u00eb shpejta dhe dobiprur\u00ebse p\u00ebr pal\u00ebt nd\u00ebrgjygj\u00ebse, Kolegji e gjen t\u00eb pabazuar k\u00ebt\u00eb pretendim t\u00eb subjektit.
