Ai u vler\u00ebsua se kishte arritur nivel kualifikues p\u00ebr profesionalizmin, nd\u00ebrsa nj\u00eb raport i dyt\u00eb i Drejtoris\u00eb s\u00eb Sigurimit t\u00eb Informacionit t\u00eb Klasifikuar, DSIK q\u00eb rekomandonte pap\u00ebrshtatshm\u00ebrin\u00eb p\u00ebr t\u00eb vazhduar detyr\u00ebn, nuk e bindi KPK-n\u00eb.<\/p>\n<p>Sulejman Kurti e ka filluar karrier\u00ebn n\u00eb sistemin gjyq\u00ebsor n\u00eb vitin 1996 dhe ka punuar p\u00ebr gati nj\u00eb dekad\u00eb si gjyqtar n\u00eb Librazhd. Me shkrirjen e k\u00ebsja gjykate n\u00eb vitin 2007, ai u em\u00ebrua n\u00eb Elbasan kun \u00eb vitin 2016 u promovua si drejtues i asaj gjykate.<\/p>\n<p>Kurti ka paraqitur bashk\u00eblidhur ankimit rreth 18 prova t\u00eb reja, t\u00eb cilat ka pretenduar se nuk ka mundur t\u2019i dor\u00ebzonte n\u00eb Komision pasi jan\u00eb siguruar pas dh\u00ebnies s\u00eb vendimit n\u00eb shkall\u00ebn e par\u00eb. Kolegji nuk i ka pranuar k\u00ebto akte me argumentin se subjekti nuk arriti t\u00eb v\u00ebrtetoj\u00eb se nuk ka qen\u00eb faji i tij q\u00eb nuk ka mundur t\u2019i paraqes\u00eb gjat\u00eb hetimit administrativ n\u00eb Komision. Po ashtu, KPA ka konkluduar se ato nuk jan\u00eb t\u00eb nevojshme pasi nuk p\u00ebrmbajn\u00eb ndonj\u00eb t\u00eb dh\u00ebn\u00eb apo fakt q\u00eb do t\u00eb ndikonte n\u00eb shqyrtimin e ankimit n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p>Kurti \u00ebsht\u00eb gjetur n\u00eb Komision n\u00eb pamund\u00ebsi financiare p\u00ebr nd\u00ebrtimin e nj\u00eb sht\u00ebpie n\u00eb Librazhd mbi nj\u00eb truall me sip\u00ebrfaqe 163 m2. KPK konstaton se kati i par\u00eb i k\u00ebsaj sht\u00ebpie \u00ebsht\u00eb nd\u00ebrtuar n\u00eb vitet 1997 \u2013 1998, nd\u00ebrsa kati i dyt\u00eb dhe \u00e7atia n\u00eb vitin 2005. P\u00ebr k\u00ebt\u00eb pasuri, gjyqtari Kurti ka deklaruar vler\u00ebn 3.7 milion lek\u00eb, t\u00eb p\u00ebrllogaritur n\u00eb baz\u00eb t\u00eb nj\u00eb aktvler\u00ebsimi t\u00eb vitit 1998 n\u00eb t\u00eb p\u00ebrgatitur nga Bashkia Librazhd p\u00ebr shpenzimet e katit t\u00eb par\u00eb n\u00eb shum\u00ebn 1.8 milion lek\u00eb dhe t\u00eb nj\u00eb preventivi n\u00eb vler\u00ebn 1.9 milion lek\u00eb p\u00ebr katin e dyt\u00eb, t\u00eb nd\u00ebrtuar n\u00eb vitin 2005.<\/p>\n<p>Ai ka deklaruar gjat\u00eb hetimit administrativ se p\u00ebr t\u00eb nd\u00ebrtuar sht\u00ebpin\u00eb n\u00eb Librazhd \u00ebsht\u00eb ndihmuar nga familjar\u00ebt. Kurti ka shpjeguar para Komisonit se n\u00eb m\u00ebnyr\u00eb artizanale kan\u00eb prodhuar 14 mij\u00eb tulla, dy furra me g\u00eblqere dhe kan\u00eb grumbulluar inerte n\u00eb lum\u00eb, si gur\u00eb, zhavorr dhe r\u00ebr\u00eb.<\/p>\n<p>N\u00eb vendim evidentohet se vlera e kostos s\u00eb nd\u00ebrtimit e referuar prej Kurtit \u00ebsht\u00eb disa her\u00eb m\u00eb e ul\u00ebt se ajo q\u00eb rezulton p\u00ebr nd\u00ebrtimet e kryera n\u00eb koh\u00ebn e krijimit t\u00eb pasuris\u00eb s\u00eb tij. Komisioni i ka kryer p\u00ebrllogaritjet e kostove sipas parashikimeve e akteve ligjore dhe n\u00ebnligjore q\u00eb i referohen EKB-s\u00eb, duke mbajtur n\u00eb konsiderat\u00eb sip\u00ebrfaqet e ndryshme t\u00eb nd\u00ebrtuara p\u00ebr secilin vit bazuar n\u00eb deklarimet e subjektit.<\/p>\n<p>Kurti ka pretenduar se analiza financiare e Komisionit nuk q\u00ebndron pasi \u00ebsht\u00eb e mb\u00ebshtetur n\u00eb \u00e7mimet e referenc\u00ebs, por ky shkak ankimi \u00ebsht\u00eb gjetur i pabazuar nga KPA. \u201c[\u2026]N\u00eb kushtet e munges\u00ebs s\u00eb kontrat\u00ebs s\u00eb shitjes, p\u00ebrllogaritja e tatimit p\u00ebr efekt rivler\u00ebsimi, nga ana e ZVRPP Librazhd \u00ebsht\u00eb bazuar n\u00eb koston mesatare t\u00eb nd\u00ebrtimit n\u00eb koh\u00ebn kur ai \u00ebsht\u00eb realizuar, referuar p\u00ebrcaktimeve t\u00eb Entit Komb\u00ebtar t\u00eb Banesave\u201d, konstaton Kolegji dhe e cil\u00ebson t\u00eb drejt\u00eb dhe t\u00eb arsyesh\u00ebm referimin q\u00eb Komisioni ka b\u00ebr\u00eb tek kostoja mesatare e nd\u00ebrtimit, e p\u00ebrcaktuar nd\u00ebr vite prej EKB-s\u00eb.<\/p>\n<p>\u201cTrupi gjykues vler\u00ebson se pavar\u00ebsisht faktit q\u00eb subjekti pretendon se i ka prodhuar vet\u00eb materialet p\u00ebr nd\u00ebrtimin e objektit, si tulla, g\u00eblqere etj., k\u00ebto pretendime t\u00eb subjektit mbeten n\u00eb kuadrin deklarativ, t\u00eb paprovuara me dokumentacion justifikues ligjor\u201d, citohet n\u00eb vendim.<\/p>\n<p>KPA ka kryer analiz\u00ebn financiare p\u00ebr periudh\u00ebn 1992-1998, nga ka rezultuar balanc\u00eb negative n\u00eb shum\u00ebn 1.1 milion lek\u00eb p\u00ebr nd\u00ebrtimin e katit p\u00ebrdhes n\u00eb Librazhd, si dhe p\u00ebr t\u00eb p\u00ebrballuar shpenzimet familjare. Kolegji ka marr\u00eb n\u00eb konsiderat\u00eb n\u00eb m\u00ebnyr\u00eb hipotetike edhe pretendimin e subjektit n\u00eb ankim p\u00ebr llogaritjen e kostos s\u00eb nd\u00ebrtimit, duke zbritur disa elemente bazuar n\u00eb manualet e preventivimit t\u00eb punimeve t\u00eb nd\u00ebrtimit, por s\u00ebrish ka rezultuar pamund\u00ebsi financiare p\u00ebr kryerjen e k\u00ebtij investimi.<\/p>\n<p>Ashtu si Komisioni, edhe KPA nuk i ka vler\u00ebsuar bind\u00ebse kontratat e depozituara nga subjekti p\u00ebr pasuri n\u00eb pron\u00ebsi t\u00eb personave t\u00eb tjer\u00eb, me q\u00ebllim p\u00ebrdorimin e tyre p\u00ebr analogji p\u00ebr provimin e kostove t\u00eb objektit t\u00eb tij.<\/p>\n<p>\u201cP\u00ebrdorimi me analogji i kontratave apo dokumenteve t\u00eb tjera mund t\u00eb kryhet n\u00eb kushtet e munges\u00ebs s\u00eb parashikimeve ligjore p\u00ebr p\u00ebrcaktimet e \u00e7mimeve dhe kostove t\u00eb nd\u00ebrtimit n\u00eb periudhat p\u00ebrkat\u00ebse[\u2026], konstaton KPA dhe e ka gjetur Kurtin n\u00eb pamund\u00ebsi financiare n\u00eb shum\u00ebn 3.3 milion\u00eb lek\u00eb edhe p\u00ebr investimin e kryer n\u00eb vitin 2005 p\u00ebr nd\u00ebrtimin e katit t\u00eb par\u00eb, \u00e7atis\u00eb s\u00eb shfryt\u00ebzueshme dhe shtes\u00ebs.<\/p>\n<p>Po ashtu, \u00ebsht\u00eb rr\u00ebzuar pretendimi tjet\u00ebr i Kurtit se jan\u00eb p\u00ebrdorur dy standarte nga Komisioni n\u00eb analiz\u00ebn financiare. Subjekti pretendon se Komisioni p\u00ebr shpenzimet e jetes\u00ebs, n\u00eb munges\u00eb t\u00eb dokumentacionit provues, e ka kryer analiz\u00ebn bazuar n\u00eb t\u00eb dh\u00ebna statistikore dhe sipas tij do t\u00eb ishte e logjikshme q\u00eb edhe p\u00ebr t\u00eb ardhurat q\u00eb nuk dokumentohen p\u00ebr at\u00eb periudh\u00eb, t\u00eb p\u00ebrdoret i nj\u00ebjti standard. Kurti ka k\u00ebrkuar q\u00eb t\u00eb ardhurat t\u00eb p\u00ebrllogariten bazuar n\u00eb pagat shtet\u00ebrore t\u00eb koh\u00ebs, pasi s\u00eb bashku me bashk\u00ebshorten kan\u00eb qen\u00eb t\u00eb pun\u00ebsuar n\u00eb shtet.<\/p>\n<p>KPA v\u00ebren se subjekti nuk rezulton q\u00eb t\u00eb ket\u00eb depozituar dokumentacion justifikues p\u00ebr t\u00eb ardhurat p\u00ebr periudh\u00ebn para vitit 1993 dhe t\u00eb ardhurat e bashk\u00ebshortes s\u00eb tij p\u00ebr periudh\u00ebn tetor 1993 &#8211; korrik 1996. Gjithashtu, nuk ka deklaruar n\u00ebse u \u00ebsht\u00eb drejtuar institucioneve p\u00ebrkat\u00ebse p\u00ebr pajisje me v\u00ebrtetimet p\u00ebr faktimin e t\u00eb ardhurave p\u00ebr at\u00eb periudh\u00eb, si dhe nuk ka paraqitur ndonj\u00eb argument p\u00ebr pamund\u00ebsin\u00eb e marrjes s\u00eb k\u00ebtyre t\u00eb dh\u00ebnave q\u00eb pretendon t\u2019i llogariten si e ardhur.<\/p>\n<p>\u201c[\u2026]Nuk mund t\u00eb vendoset shenja e krahasimit sikurse pretendon subjekti i rivler\u00ebsimit, pasi llogaritja e shpenzimeve p\u00ebr jetes\u00eb \u00ebsht\u00eb kryer bazuar n\u00eb llogaritjen e t\u00eb ardhurave p\u00ebr frym\u00eb nd\u00ebr vite nga nj\u00eb institucion i specializuar, sikurse \u00ebsht\u00eb INSTAT-i, kurse e ardhura nga paga p\u00ebr vitet q\u00eb pretendon subjekti, duhej t\u00eb v\u00ebrtetohej sakt\u00ebsisht me dokumentacionin p\u00ebrkat\u00ebs\u201d, arsyeton Kolegji dhe shton se ato t\u00eb ardhura n\u00eb raport me koh\u00ebn, konsiderohen t\u00eb pap\u00ebrfillshme.<\/p>\n<p>KPA vler\u00ebson nj\u00ebsoj si Komisioni edhe p\u00ebr pamund\u00ebsin\u00eb financiare p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 33.78 m2 m\u00eb 25 shtator t\u00eb vitit 2010 n\u00eb Tiran\u00eb me vler\u00eb 4.3 milion lek\u00eb, pasi nuk \u00ebsht\u00eb v\u00ebrtetuar mund\u00ebsia e nj\u00eb huadh\u00ebn\u00ebsi p\u00ebr krijimin e nj\u00eb shume 1 milion lek\u00eb q\u00eb ka sh\u00ebrbyer si burim p\u00ebr krijimin e k\u00ebsaj pasurie.<\/p>\n<p>Nd\u00ebrkoh\u00eb, KPA e ka gjetur t\u00eb drejt\u00eb nj\u00eb prej pretendimeve t\u00eb gjyqtarit Kurti duke e konsideruar t\u00eb pasakt\u00eb analiz\u00ebn e kryer nga Komisioni p\u00ebr vitin 2009. N\u00eb vendim thuhet se padrejt\u00ebsisht KPK nuk ka konsideruar gjendja e likuiditeteve n\u00eb shum\u00ebn 800 mij\u00eb lek\u00eb t\u00eb p\u00ebrfituara nga subjekti n\u00ebp\u00ebrmjet nj\u00eb kredie, si dhe duke llogaritur shpenzimet p\u00ebr \u201crikonstruksion banese\u201d dhe ato p\u00ebr \u201cpajisje elektrosht\u00ebpiake\u201d, si z\u00ebra t\u00eb ve\u00e7ant\u00eb, ka sjell\u00eb balanc\u00eb negative.
