Vendimi i Komisionit u ankimua nga Haveri, e cila ngriti pretendime mbi procesin e rregullt ligjor dhe se kishte pasur burime t\u00eb ligjshme p\u00ebr krijimin e pasurive e kryerjen e shpenzimeve. Ajo e cil\u00ebsoi analiz\u00ebn e KPK-s\u00eb t\u00eb padrejt\u00eb dhe t\u00eb paqart\u00eb.<\/p>\n<p>Nd\u00ebr t\u00eb tjera, Haveri k\u00ebrkoi n\u00eb KPA q\u00eb t\u00eb administrohej si prov\u00eb d\u00ebshmia e nj\u00eb t\u00eb af\u00ebrmi p\u00ebr nj\u00eb hua q\u00eb kishte marr\u00eb prej tij p\u00ebr blerjen e nj\u00eb apartamenti, q\u00eb u b\u00eb shkak p\u00ebr kalimin e \u00e7\u00ebshtjes p\u00ebr shqyrtim n\u00eb seanc\u00eb d\u00ebgjimore. Sipas KPA, Komisioni nuk kishte asnj\u00eb lloj vendimarrje lidhur me k\u00ebrkes\u00ebn e subjektit p\u00ebr pyetjen e huadh\u00ebn\u00ebsit n\u00eb cil\u00ebsin\u00eb e d\u00ebshmitarit, duke e vler\u00ebsuar k\u00ebt\u00eb situat\u00eb si mang\u00ebsi t\u00eb hetimit adminisrativ n\u00eb shkall\u00ebn e par\u00eb. Kolegji i rr\u00ebzoi pretendimet e tjera t\u00eb Haverit lidhur me procesin e rregullt ligjor gjat\u00eb hetimit administrativ n\u00eb KPK.<\/p>\n<p><strong>Rezultatet e p\u00ebrmbysura<\/strong><\/p>\n<p>Hetimi administrativ nga Komisioni \u00ebsht\u00eb p\u00ebrqendruar n\u00eb disa pasuri, p\u00ebrfshir\u00eb nj\u00eb apartament me sip\u00ebrfaqe 135.9 m2 bler\u00eb p\u00ebr \u00e7mimin 69 mij\u00eb e 309 euro n\u00eb Tiran\u00eb n\u00eb vitin 2004; nj\u00eb apartament 75.6 m2 n\u00eb Shkod\u00ebr i shitur p\u00ebr 2 milion\u00eb lek\u00eb, vler\u00eb q\u00eb \u00ebsht\u00eb deklaruar si burim krijimi p\u00ebr apartamentin n\u00eb kryeqytet; apartament banimi 115 m2 i bler\u00eb n\u00eb vitin 2011 n\u00eb Shkod\u00ebr; apartament tjet\u00ebr me sip\u00ebrfaqe 95 + 14.3 m2 i bler\u00eb n\u00eb vitin 2015 dhe nj\u00eb garazh n\u00eb ish-komun\u00ebn Fark\u00eb.<\/p>\n<p>Ndryshe nga Komisioni, KPA vler\u00ebson se Haveri arrin t\u00eb provoj\u00eb burimet financiare t\u00eb ligjshme q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr blerjen e apartamentit me sip\u00ebrfaqe 135.9 m2 n\u00eb kryeqytet dhe t\u00eb garazhit 14 m2 n\u00eb Fark\u00eb t\u00eb Tiran\u00ebs.<\/p>\n<p>P\u00ebr apartamentin me sip\u00ebrfaqe 135.9 m2, subjekti ka pasqyruar si burime n\u00eb deklarat\u00ebn periodike dhe at\u00eb \u201cveting\u201d, t\u00eb ardhura nga shitja e nj\u00eb apartamenti n\u00eb Shkod\u00ebr me vler\u00eb 2.6 milion\u00eb lek\u00eb, huamarrje nga familjar\u00eb emigrant\u00eb dhe kursime nga paga me vler\u00eb 15 mij\u00eb euro.<\/p>\n<p>Sipas Komisionit, apartamenti n\u00eb Shkod\u00ebr \u00ebsht\u00eb shitur p\u00ebr 2 milion\u00eb lek\u00eb dhe jo 2.6 milion\u00eb lek\u00eb si\u00e7 pretendon subjekti, si dhe nuk \u00ebsht\u00eb e provuar q\u00eb bashk\u00ebpronar\u00ebt e tjer\u00eb kan\u00eb hequr dor\u00eb nga pjesa takuese.<\/p>\n<p>Gjithashtu, nga verifikimi i akteve, KPK ka konkluduar se t\u00eb ardhurat nga shitja e apartamentit n\u00eb Shkod\u00ebr nuk mund t\u00eb jen\u00eb p\u00ebrdorur si burim p\u00ebr blerjen e apartamentit n\u00eb Tiran\u00eb, pasi pagesa e k\u00ebstit t\u00eb fundit prej 12 mij\u00eb euro, \u00ebsht\u00eb kryer n\u00eb dat\u00ebn 14 qershor 2004, nd\u00ebrsa t\u00eb ardhurat sipas aktit t\u00eb shitjes s\u00eb apartamentit n\u00eb Shkod\u00ebr vijn\u00eb m\u00eb pas, m\u00eb 28 qershor 2004. N\u00eb analiz\u00ebn financiare t\u00eb Komisionit \u00ebsht\u00eb konstatuar balanc\u00eb negative n\u00eb vler\u00ebn 3 milion\u00eb lek\u00eb n\u00eb krijimin e k\u00ebtij aseti.<\/p>\n<p>Trupi gjykues i Kolegjit v\u00ebren llogaritje t\u00eb gabuara n\u00eb analiz\u00ebn financiare t\u00eb Komisionit p\u00ebr t\u00eb ardhurat e subjektit n\u00eb vite. Po ashtu, shpenzimet jetike jan\u00eb vler\u00ebsuar n\u00eb mas\u00eb m\u00eb t\u00eb ul\u00ebt nga Komisioni, duke vler\u00ebsuar t\u00eb drejt\u00eb pretendimin e Haverit se n\u00eb periudhat tranzitore 1997-1998, minimumi jetik lidhej vet\u00ebm me nevojat ekzistenciale t\u00eb ushqimit dhe jo t\u00eb privilegjeve t\u00eb tjera. P\u00ebr rrjedhoj\u00eb, shpenzimet jetike p\u00ebr periudh\u00ebn 1991-1999 jan\u00eb p\u00ebrllogaritur n\u00eb mas\u00ebn 30% dhe jo n\u00eb mas\u00ebn 70% si i ka konsideruar KPK.<\/p>\n<p>Kolegji ka konsideruar n\u00eb analiz\u00eb vler\u00ebn 2 milion lek\u00eb nga shitja e apartamentit n\u00eb Shkod\u00ebr p\u00ebr blerjen e banes\u00ebs n\u00eb Tiran\u00eb. N\u00eb vendim evidentohet se n\u00eb kontrat\u00ebn e shitjes s\u00eb apartamentit n\u00eb Shkod\u00ebr \u00ebsht\u00eb sh\u00ebnuar se pagesa ishte kryer m\u00eb par\u00eb, por pa u p\u00ebrcaktuar nj\u00eb dat\u00eb konkrete. \u201cKjo pages\u00eb mund t\u00eb jet\u00eb b\u00ebr\u00eb edhe para ose n\u00eb dat\u00ebn 14.06.2004, kur \u00ebsht\u00eb b\u00ebr\u00eb pagesa e k\u00ebstit t\u00eb fundit p\u00ebr apartamentin me sip\u00ebrfaqe 135,9 m2\u2026,\u201d argumenton Kolegji.<\/p>\n<p>N\u00eb vijim, \u00ebsht\u00eb konkluduar se apartamenti n\u00eb Shkod\u00ebr \u00ebsht\u00eb p\u00ebrdorur n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrper\u00eb nga bashk\u00ebshorti i subjektit, edhe pse certifikata rezultonte n\u00eb bashk\u00ebpron\u00ebsi me familjar\u00ebt e tij q\u00eb sipas KPA, nuk kan\u00eb jetuar n\u00eb k\u00ebt\u00eb sht\u00ebpi dhe nuk kan\u00eb shfaqur asnj\u00eb interes n\u00eb drejtim t\u00eb pron\u00ebsis\u00eb.<\/p>\n<p>Kolegji konsideron si bind\u00ebse edhe shpjegimet p\u00ebr p\u00ebrfitimin e shum\u00ebs 600 mij\u00eb lek\u00eb nga shitja e mobiljeve t\u00eb apartamentit n\u00eb fjal\u00eb, pasi ka rezultuar e pasqyruar n\u00eb deklaratat periodike.<\/p>\n<p>Duke i konsideruar k\u00ebto t\u00eb ardhura si burime t\u00eb ligjshme, n\u00eb analiz\u00ebn e kryer n\u00eb KPA, gjyqtarja Haveri ka rezultuar me balanc\u00eb pozitive n\u00eb blerjen e apartamentit me sip\u00ebrfaqe 135.9 m2 n\u00eb Tiran\u00eb.<\/p>\n<p>Shpjegimet dhe provat e subjektit e kan\u00eb p\u00ebrmbysur edhe konkluzionin e Komisionit p\u00ebr munges\u00ebn e burimeve p\u00ebr blerjen e nj\u00eb garazhi me sip\u00ebrfaqe 14 m2 n\u00eb Fark\u00eb t\u00eb Tiran\u00ebs, \u00e7mimin e t\u00eb cilit e ka shlyer n\u00eb 2014-\u00ebn.<\/p>\n<p>Sipas KPK, subjekti kishte pasur pjes\u00ebrisht mund\u00ebsi p\u00ebr t\u00eb kryer pagesat n\u00eb 2014-\u00ebn, pasi nuk mbulonte me burime t\u00eb ligjshme nj\u00eb pjes\u00eb t\u00eb gjendjes cash n\u00eb vler\u00ebn 900 mij\u00eb lek\u00eb t\u00eb deklaruar n\u00eb 2013-\u00ebn.<\/p>\n<p>Por, nga analiza e kryer n\u00eb Kolegj, Haveri rezulton me mund\u00ebsi kursimi n\u00eb shum\u00ebn 900 mij\u00eb lek\u00eb dhe p\u00ebr rrjedhoj\u00eb \u00ebsht\u00eb konkluduar se kishte mund\u00ebsi p\u00ebr blerjen e garazhit n\u00eb Fark\u00eb.<\/p>\n<p><strong>Balancat negative penalizuese <\/strong><\/p>\n<p>Kolegji vler\u00ebson se nuk jan\u00eb t\u00eb mb\u00ebshtetura pretendimet e ish-gjyqtares Haveri p\u00ebr analiz\u00ebn financiare t\u00eb viteve 2006, 2007, 2009, 2011, 2014 dhe 2015, nga p\u00ebr rrjedhoj\u00eb ajo \u00ebsht\u00eb gjetur n\u00eb kushtet e munges\u00ebs s\u00eb burimeve financiare t\u00eb ligjshme p\u00ebr t\u00eb justifikuar blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 111.5 m2 n\u00eb Shkod\u00ebr; nj\u00eb automjeti; nj\u00eb apartamenti me sip\u00ebrfaqe nd\u00ebrtimi 95 m2 + 14,3 m2 n\u00eb Fark\u00eb; si dhe shpenzimet e kryera n\u00eb k\u00ebto vite, ku nd\u00ebr t\u00eb tjera \u00ebsht\u00eb konstatuar pamund\u00ebsi p\u00ebr t\u00eb justifikuar me burime financiare t\u00eb ligjshme edhe shlyerjen e kredis\u00eb s\u00eb marr\u00eb p\u00ebr pages\u00ebn e nj\u00eb pjese t\u00eb \u00e7mimi t\u00eb apartamentit me sip\u00ebrfaqe 135.9 m2 n\u00eb Tiran\u00eb.<\/p>\n<p>Si burim p\u00ebr blerjen e apartamentit me sip\u00ebrfaqe 111.5 m2 n\u00eb Shkod\u00ebr n\u00eb vitin 2011 p\u00ebr \u00e7mimin 4.7 milion\u00eb lek\u00eb, subjekti ka deklaruar nj\u00eb hua t\u00eb marr\u00eb nga nj\u00eb i af\u00ebrm n\u00eb shum\u00ebn 5 milion\u00eb lek\u00eb. Ky i fundit u thirr si d\u00ebshmitar n\u00eb KPA, ku shpjegoi marrdh\u00ebnien e huas\u00eb dhe burimet e krijimit t\u00eb shum\u00ebs q\u00eb i kishte dh\u00ebn\u00eb gjyqtares Haveri.<\/p>\n<p>N\u00eb nj\u00eb prej seancave publike n\u00eb KPA, i af\u00ebrmi i Haverit pasqyroi formimin e tij profesional si inxhinier topograf, profesion q\u00eb tha se e kishte ushtruar prej vitit 1979 kur ishte diplomuar pran\u00eb Fakultetit t\u00eb Inxhineris\u00eb s\u00eb Nd\u00ebrtimit n\u00eb Tiran\u00eb. Ai deklaroi se kishte qen\u00eb gjat\u00eb gjith\u00eb koh\u00ebs i pun\u00ebsuar n\u00eb institucione shtet\u00ebrore, derisa n\u00eb vitin 1996 kishte vendosur s\u00eb bashku me dy koleg\u00eb t\u00eb regjistronin nj\u00eb shoq\u00ebri private q\u00eb ofronte sh\u00ebrbime n\u00eb fush\u00ebn e topografis\u00eb, prej nga kishte siguruar t\u00eb ardhura t\u00eb konsiderueshme.<\/p>\n<p>Nga verifikimet e kryera ka rezultuar se i af\u00ebrmi i subjektit, ka zot\u00ebruar depozita n\u00eb vlera t\u00eb konsiderueshme n\u00eb vitet 1999 dhe 2000. Por,trupi gjykues i Kolegjit vler\u00ebson se nga dokumentet e administruara gjat\u00eb hetimit administrativ n\u00eb Komision, rezulton se z. V. V ka pasur cil\u00ebsin\u00eb e drejtuesit teknik n\u00eb shoq\u00ebrin\u00eb e krijuar dhe se n\u00eb k\u00ebt\u00eb cil\u00ebsi nuk rezultojn\u00eb t\u00eb dokumentuara t\u00eb ardhura t\u00eb ligjshme t\u00eb p\u00ebrfituara prej tij.<\/p>\n<p>\u201cSubjekti i rivler\u00ebsimit, znj. Dhurata Haveri, por dhe z. V. V me d\u00ebshmin\u00eb e tij, n\u00eb cil\u00ebsin\u00eb e personit tjet\u00ebr t\u00eb lidhur, nuk provuan me dokumentacion llojin e marr\u00ebdh\u00ebnies juridike t\u00eb vendosur nd\u00ebrmjet tij dhe shoq\u00ebris\u00eb \u201c{***}\u201d, si dhe t\u00eb ardhurat t\u00eb cilat do t\u00eb p\u00ebrfitoheshin bazuar n\u00eb k\u00ebt\u00eb marr\u00ebdh\u00ebnie juridike\u201d, konstaton Kolegji duke argumentuar se dokumentet e paraqitura nga subjekti i rivler\u00ebsimit, si fatura dhe situacione, referojn\u00eb n\u00eb aktivitetin ekonomik t\u00eb shoq\u00ebris\u00eb, por jo t\u00eb ardhura t\u00eb p\u00ebrfituara nga i af\u00ebrmi i saj, z. V. V..<\/p>\n<p>Po ashtu, nuk jan\u00eb konsideruar t\u00eb ardhurat e V.V. nga ekzekutimi i nj\u00eb vendimi gjyq\u00ebsor, pasi pjesa m\u00eb e madhe e vler\u00ebs \u00ebsht\u00eb p\u00ebrfituar pas dh\u00ebnies s\u00eb huas\u00eb.<\/p>\n<p>Duke mos e p\u00ebrfshir\u00eb n\u00eb analiz\u00eb huan 5 milion\u00eb lek\u00eb, me argumentin se nuk \u00ebsht\u00eb arritur t\u00eb provohet burimi i ligjsh\u00ebm i k\u00ebsaj vlere, Kolegji arrin n\u00eb p\u00ebrfundimin se ish-gjyqtarja Haveri ka qen\u00eb n\u00eb pamund\u00ebsi p\u00ebr blerjen e apartamentit me sip\u00ebrfaqe 111.5 m2 n\u00eb Shkod\u00ebr duke rezultuar me balanc\u00eb negative n\u00eb shum\u00ebn 2.3 milion\u00eb lek\u00eb.<\/p>\n<p>Si burime financiare p\u00ebr blerjen e apartamentit me sip\u00ebrfaqe nd\u00ebrtimi 95 m2 + 14.3 m2 n\u00eb Fark\u00eb, subjekti ka deklaruar t\u00eb ardhurat nga puna dhe nj\u00eb kredi n\u00eb shum\u00ebn 5 milion\u00eb lek\u00eb. Kolegji vler\u00ebson se p\u00ebr pages\u00ebn e kryer n\u00eb vitin 2014 rezulton i provuar burimi i ligjsh\u00ebm n\u00ebp\u00ebrmjet kredis\u00eb bankare, nd\u00ebrsa n\u00eb 2015-\u00ebn ka rezultuar balanc\u00eb negative n\u00eb shum\u00ebn 323 mij\u00eb lek\u00eb.<\/p>\n<p>Nga verifikimi edhe i shpenzimeve t\u00eb tjera p\u00ebr k\u00ebto vite kan\u00eb rezultuar pamund\u00ebsi financiae n\u00eb vler\u00ebn totale rreth 1.9 milion lek\u00eb.<\/p>\n<p>Haveri \u00ebsht\u00eb gjetur n\u00eb pamund\u00ebsi edhe p\u00ebr blerjen e nj\u00eb automjeti si dhe ka rezultuar me balanca negative n\u00eb mbulimin e investimeve dhe shpenzimeve p\u00ebr vitet 2006, 2007, 2009, 2011, 2014 dhe 2015.
