Shumica e trupit gjykues t\u00eb Kolegjit, e p\u00ebrb\u00ebr\u00eb nga relatori Sokol \u00c7omo dhe an\u00ebtar\u00ebt Albana Shtylla, Ina Rama dhe Ardian Hajdari e kan\u00eb gjetur t\u00eb drejt\u00eb vendimin e Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK p\u00ebr konfirmimin e tij n\u00eb detyr\u00eb duke i rr\u00ebzuar shkaqet e Komisionerit p\u00ebr deklarim t\u00eb pamjaftuesh\u00ebm dhe munges\u00eb burimesh financiare lidhur me dy pasuri.<\/p>\n<p>Nd\u00ebrsa kryesuesja Rezarta Schuetz n\u00eb pakic\u00eb vler\u00ebson se intepretimi i shumic\u00ebs \u00ebsht\u00eb formalist dhe bie ndesh me legjislacionin e vetingut t\u00eb magjistrat\u00ebve. Ashtu si Komisioneri Ballhysa, ajo \u00e7mon se Kalaja duhej t\u00eb ishte shkarkuar nga detyra.<\/p>\n<p>Gjyqtari Astrit Kalaja u konfirmua m\u00eb 20 dhjetor 2019 me shumic\u00eb votash n\u00eb KPK, por \u00e7\u00ebshtja e tij u d\u00ebrgua n\u00eb Kolegjin e Posa\u00e7\u00ebm t\u00eb Apelimit nga komisioneri Florian Ballhysa.<\/p>\n<p>Sipas vendimit t\u00eb arsyetuar t\u00eb KPA-s\u00eb, komisioneri pretendoi se Kalaja kishte kryer deklarim t\u00eb pasakt\u00eb dhe t\u00eb pamjaftuesh\u00ebm p\u00ebr nj\u00eb apartament me sip\u00ebrfaqe 109,5 m2 si dhe p\u00ebr nj\u00eb sip\u00ebrfaqe toke prej 379 m2 n\u00eb Velipoj\u00eb, ku gjendet edhe nj\u00eb nd\u00ebrtim informal prej 60 m2.<\/p>\n<p>P\u00ebr blerjen e apartamentit n\u00eb vitin 2009, Kalaja deklaroi si burim nj\u00eb kredi bankare prej 3 milion\u00eb lek\u00ebsh, e garantuar fillimisht me hipotek\u00ebn e nj\u00eb apartamenti t\u00eb m\u00ebparsh\u00ebm. Garancia \u00ebsht\u00eb z\u00ebvend\u00ebsuar m\u00eb pas me nj\u00eb depozit\u00eb prej 3.3 milion\u00eb lek\u00ebsh e ark\u00ebtuar p\u00ebr llogari t\u00eb gjyqtarit nga nj\u00eb person tjet\u00ebr, por e padeklaruar prej tij.<\/p>\n<p>Komisioneri konstatoi se Kalaja nuk e ka deklaruar k\u00ebt\u00eb marr\u00ebdh\u00ebnie huaje, si dhe nuk ka provuar mund\u00ebsin\u00eb e huadh\u00ebn\u00ebsit p\u00ebr t\u00eb mbuluar me burime t\u00eb ligjshme vler\u00ebn 3.3 milion\u00eb lek\u00eb. Sipas Ballhys\u00ebs, Kalaja nuk mbulon me burime t\u00eb ligjshme edhe shlyerjen e k\u00ebstit t\u00eb dyt\u00eb dhe shlyerjen e parakohshme t\u00eb kredis\u00eb p\u00ebr blerjen e apartamentit.<\/p>\n<p>Kolegji vler\u00ebsoi se subjekti ka pasur detyrim t\u00eb deklaronte marr\u00ebdh\u00ebnien me shtesatin Rr.P., q\u00eb ka vendosur garanci shum\u00ebn 3.3 milion\u00eb lek\u00eb p\u00ebr kredin\u00eb e subjektit. Megjithat\u00eb, mosdeklarimi konsiderohet si pasakt\u00ebsi q\u00eb nuk mund t\u00eb sjell\u00eb penalizimin.<\/p>\n<p>Kolegji vler\u00ebson gjithashtu se subjekti i rivler\u00ebsimit \u00ebsht\u00eb sjell\u00eb si pronar i k\u00ebtyre parave dhe e cil\u00ebson si t\u00eb pabazuar pretendimin e tij se rasti n\u00eb fjal\u00eb \u00ebsht\u00eb marr\u00ebdh\u00ebnie juridike pengu dhe jo huadh\u00ebnie.<\/p>\n<p>Megjith\u00ebse shumica e trup\u00ebs s\u00eb KPA \u00e7mon se dh\u00ebnia e parave nga z.Rr.P \u00ebsht\u00eb nj\u00eb marr\u00ebdh\u00ebnie huaje, v\u00ebren se subjekti nuk e ka futur n\u00eb qarkullim p\u00ebr krijim pasurie apo kryerje shpenzimesh vler\u00ebn 3.3 milion\u00eb lek\u00eb, e cila ka sh\u00ebrbyer vet\u00ebm p\u00ebr garantimin e kredis\u00eb.<\/p>\n<p>Bazuar n\u00eb k\u00ebto konstatime, shumica ka vler\u00ebsuar t\u00eb mos e verifikoj\u00eb mund\u00ebsin\u00eb e huadh\u00ebn\u00ebsit p\u00ebr krijimin e shum\u00ebs 3.3 milion\u00eb lek\u00eb me burime financiare t\u00eb ligjshme.<\/p>\n<p>P\u00ebr pretendimin e komisionerit se deklarimet kontadiktore t\u00eb subjektit lidhur me burimin e shum\u00ebs 3.3 milion\u00eb lek\u00eb krijojn\u00eb paqart\u00ebsi n\u00eb drejtim t\u00eb identifikimit t\u00eb huadh\u00ebn\u00ebsit real, shumica \u00e7mon se \u00ebsht\u00eb e provuar me dokumentacion se huadh\u00ebn\u00ebsi \u00ebsht\u00eb z.Rr.P.<\/p>\n<p>Shumica ka rr\u00ebzuar edhe shkakun e ankimit lidhur me mosdeklarimin si likujditet cash t\u00eb t\u00eb ardhurave t\u00eb siguruara nga shitja e apartamentit, q\u00eb ishte l\u00ebn\u00eb fillimisht si garanci p\u00ebr kredin\u00eb. Sipas KPA-s\u00eb, ndon\u00ebse Kalaja nuk ka kryer n\u00eb vitin 2008 deklarim n\u00eb p\u00ebrputhje me parashikimet ligjore lidhur me gjendjen cash, ai i ka deklaruar k\u00ebto t\u00eb ardhura n\u00eb rubrik\u00ebn e shtesave dhe pak\u00ebsimeve t\u00eb pasurive.<\/p>\n<p>Gjithashtu, nj\u00eb deklarim i vitit 2010 i Kalas\u00eb se ka shlyer nj\u00eb pjes\u00eb t\u00eb kredis\u00eb me kursimet cash n\u00eb sht\u00ebpi, ka krijuar bindjen e shumic\u00ebs mbi v\u00ebrtet\u00ebsin\u00eb e pretendimeve t\u00eb subjektit gjat\u00eb procesit t\u00eb rivler\u00ebsimit p\u00ebr disponimin e likujditeteve cash.<\/p>\n<p>Bazuar n\u00eb k\u00ebto konkluzione, shumica ka vler\u00ebsuar se subjekti ka pasur burime t\u00eb ligjshme p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb t\u00eb apartamentit dhe p\u00ebr shlyrjen e pjesshme t\u00eb kredis\u00eb n\u00eb vitin 2010 n\u00eb shum\u00ebn 2 milion\u00eb lek\u00eb, duke i \u00e7muar t\u00eb pabazuara shkaqet e ankimit t\u00eb Komisionerit p\u00ebr deklarim t\u00eb pasakt\u00eb dhe t\u00eb pamjaftuesh\u00ebm.<\/p>\n<p>Por kryesuesja e trup\u00ebs, gjyqtarja Rezarta Schuetz vler\u00ebson ndryshe. Ajo v\u00ebren se gjat\u00eb hetimit t\u00eb kryer n\u00eb Komision, subjekti ka qen\u00eb kontradiktor n\u00eb lidhje me identitetin e huadh\u00ebn\u00ebsit real, fakt q\u00eb e konsideron si pasakt\u00ebsi n\u00eb deklarim dhe se pamund\u00ebson vler\u00ebsimin e burimeve t\u00eb ligjshme n\u00eb kuad\u00ebr t\u00eb procesit t\u00eb rivler\u00ebsimit kalimtar.<\/p>\n<p>Po ashtu, ajo thekson se nga hetimi ka rezultuar se subjekti ka garantuar kredin\u00eb me nj\u00eb shum\u00eb t\u00eb ngurt\u00ebsuar n\u00eb dispozicion t\u00eb tij nga nj\u00eb individ tjet\u00ebr q\u00eb e mb\u00ebshtet financiarisht, veprim i padeklaruar nga Kalaja p\u00ebr 9 vjet, pavar\u00ebsisht se e ka pasur detyrim ligjor.<\/p>\n<p>Sipas saj, n\u00eb marr\u00ebdh\u00ebnien e huas\u00eb legjislacioni i vetingut detyron justifikimin e burimeve t\u00eb ligjshme t\u00eb personit t\u00eb lidhur. Ajo argumenton se n\u00ebse subjekti nuk do ta posedonte shum\u00ebn e dh\u00ebn\u00eb hua n\u00eb vitin 2007, do ta kishte pasur t\u00eb pamundur t\u00eb \u00e7lironte nga barra apartamentin e vendosur si koletareal dhe p\u00ebr rrjedhoj\u00eb p\u00ebr ta shitur at\u00eb.<\/p>\n<p>Gjithashtu, pakica v\u00ebren se marr\u00ebdh\u00ebnia e huadh\u00ebnies nuk \u00ebsht\u00eb provuar, pasi nuk rezultojn\u00eb t\u00eb dokumentuara transaksione t\u00eb kryera nga z. P. apo bashk\u00ebshortja e tij n\u00eb momentin dhe n\u00eb vler\u00ebn e huas\u00eb s\u00eb dh\u00ebn\u00eb. Sipas Schuetz, nga analiza financiare ka rezultuar se huadh\u00ebn\u00ebsi nuk ka pasur mund\u00ebsi p\u00ebr dh\u00ebnien e shum\u00ebs 3.3 milion\u00eb lek\u00eb.<\/p>\n<p>\u201c\u2026Qasja e shumic\u00ebs q\u00eb anashkalon natyr\u00ebn e v\u00ebrtet\u00eb t\u00eb rrethanave faktike, t\u00eb cilat nuk len\u00eb vend p\u00ebr dilema, \u00ebsht\u00eb e gabuar pasi anashkalon logjik\u00ebn e ftoht\u00eb, duke e fokusuar analiz\u00ebn n\u00eb sasin\u00eb e parave q\u00eb kan\u00eb hyr\u00eb e dal\u00eb nga llogaria e subjektit, pasi ka marr\u00eb huan\u00eb dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb redukton detyrimet e subjekteve t\u00eb rivler\u00ebsimit..,\u201d argumenton Shuetz, e cila shton se q\u00ebllimi i ligjit \u00ebsht\u00eb cenuar.<\/p>\n<p>Bazuar n\u00eb faktin se Kalaja nuk ka deklaruar si gjendje cash t\u00eb ardhurat e p\u00ebrfituara nga shitja e apartamentit; destinacionin e k\u00ebtyre fondeve dhe as arsyen p\u00ebrse i nevojiteshin jasht\u00eb sistemit bankar, pakica ashtu si Komisioneri, vler\u00ebson se subjekti nuk ka pasur mund\u00ebsi p\u00ebr shlyerjen e k\u00ebstit t\u00eb dyt\u00eb.<\/p>\n<p>\u201cN\u00eb munges\u00eb t\u00eb burimeve t\u00eb ligjshme t\u00eb mjaftueshme, subjekti gjendet minimalisht n\u00eb kushtet e deklarimit t\u00eb rrem\u00eb p\u00ebr burimet q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr t\u00eb shlyer k\u00ebstin e dyt\u00eb t\u00eb apartamentit,\u201d vler\u00ebson Schuetz dhe shton se Kalaja gjendet n\u00eb t\u00eb nj\u00ebjt\u00ebn situat\u00eb edhe p\u00ebr shlyerjen e kredis\u00eb.<\/p>\n<p>Edhe p\u00ebr blerjen e pasuris\u00eb tok\u00eb ar\u00eb n\u00eb Velipoj\u00eb, Komisioneri vler\u00ebson se subjekti nuk ka pasur burime t\u00eb ligjshme financiare p\u00ebr krijimin e k\u00ebsaj pasurie, pasi nuk ka pasqyruar gjendje cash n\u00eb banes\u00eb.<\/p>\n<p>Por shumica e Kolegjit, duke u bazuar n\u00eb hetimin e kryer n\u00eb Komision, konstaton se Kalaja ka pasur mund\u00ebsin\u00eb e disponimit t\u00eb nj\u00eb likuiditeti n\u00eb gjendje cash n\u00eb fund t\u00eb vitit 2012, n\u00eb vler\u00ebn e 3.7 milion\u00eb lek\u00eb, ndon\u00ebse kjo shum\u00eb apo pjes\u00eb e saj nuk \u00ebsht\u00eb pasqyruar n\u00eb deklarat\u00ebn periodike t\u00eb vitit 2012.<\/p>\n<p>KPA v\u00ebren se subjekti e ka deklaruar burimin e blerjes s\u00eb k\u00ebsaj pasurie n\u00eb deklarat\u00ebn pasardh\u00ebse t\u00eb vitit 2013, duke \u201csh\u00ebruar\u201d pasakt\u00ebsit\u00eb e evidentuara n\u00eb deklarimin e likujditeteve t\u00eb vitit 2012.<\/p>\n<p>Kryesuesja Schuetz n\u00eb pakic\u00eb e konsideron dhe n\u00eb k\u00ebt\u00eb rast n\u00eb kund\u00ebrshtim me ligjin vler\u00ebsimin e shumic\u00ebs. \u201cSubjekti nuk ka deklaruar gjendje likuiditetesh jasht\u00eb sistemit bankar n\u00eb deklarat\u00ebn periodike vjetore t\u00eb vitit 2012, gj\u00eb q\u00eb do t\u00eb mund t\u00eb justifikonte teorikisht disponimin e t\u00eb ardhurave prej tij n\u00eb momentin kur \u00ebsht\u00eb kryer blerja,\u201d argumenton Schuetz.<\/p>\n<p>Duke ju referuar hetimit n\u00eb shkall\u00ebn e par\u00eb ku \u00ebsht\u00eb bazuar shumica n\u00eb vler\u00ebsimin e saj, Schuetz konstaton se Komisioni ka vendosur t\u2019i injoroj\u00eb dokumentet zyrtare t\u00eb hartuara n\u00eb vite q\u00eb sipas saj kan\u00eb vler\u00eb provuese, duke e bazuar vler\u00ebsimin n\u00eb pretendimet e Kalas\u00eb gjat\u00eb procesit administrativ dhe n\u00eb funksion t\u00eb p\u00ebrmir\u00ebsimit t\u00eb situat\u00ebs s\u00eb tij.<\/p>\n<p>Duke iu referuar edhe jurisprudenc\u00ebs s\u00eb m\u00ebparshme t\u00eb Kolegjit, Schuetz vler\u00ebson ndryshe nga kat\u00ebr koleg\u00ebt e saj dhe \u00e7mon se Kalaja duhej t\u00eb ishte shkarkuar nga detyra.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Kolegji i Posa\u00e7\u00ebm i Apelimit, KPA \u00ebsht\u00eb ndar\u00eb n\u00eb vendimarrjen p\u00ebr konfirmimin n\u00eb detyr\u00eb t\u00eb gjyqtarit t\u00eb Apelit Shkod\u00ebr, Astrit Kalaja.
