Ri\u00e7elja e hetimit pas seanc\u00ebs d\u00ebgjimore t\u00eb zhvilluar m\u00eb 13 dhjetor p\u00ebr gjetjet lidhur me dy transaksione bankare t\u00eb kryera prej subjektit n\u00eb vitin 2002 kur ajo ndiqte studimet n\u00eb Shkoll\u00ebn Administrative nuk soll\u00ebn ndryshime n\u00eb rezultatin e hetimeve.<\/p>\n<p>Tereza Merkaj p\u00ebrfundoi studimet n\u00eb Shkoll\u00ebn e Magjistratur\u00ebs n\u00eb vitin 2003 dhe kreu stazhin p\u00ebr nj\u00eb vit n\u00eb Gjykat\u00ebn e Durr\u00ebsit. N\u00eb vitin 2004 u em\u00ebrua n\u00eb Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Elbasan dhe n\u00eb 2013-\u00ebn u transferua n\u00eb Gjykat\u00ebn e Tiran\u00ebs, n\u00eb fush\u00ebn e drejt\u00ebsis\u00eb p\u00ebr t\u00eb mitur.<\/p>\n<p>Prej vitit 2019 ajo \u00ebsht\u00eb komanduar si pedagoge e brendshme pran\u00eb Shkoll\u00ebs s\u00eb Magjistratur\u00ebs, me afat 5-vje\u00e7ar, si dhe ka aplikuar p\u00ebr nj\u00eb pozicion n\u00eb Gjykat\u00ebn e Posa\u00e7me t\u00eb Apelit p\u00ebr Korrupsionin dhe Krimin e Organizuar.<\/p>\n<p>Gjat\u00eb seanc\u00ebs d\u00ebgjimore, gjyqtarja Merkaj u pyet m\u00eb s\u00eb shumti lidhur me nj\u00eb hua t\u00eb marr\u00eb nga nj\u00eb person, sipas saj i panjohur, q\u00eb kishte sh\u00ebrbyer p\u00ebr blerjen e nj\u00eb apartamenti 1 +1 me sip\u00ebrfaqe 57.4 m2 n\u00eb Tiran\u00eb n\u00eb vitin 2004, kundrejt \u00e7mimit 5 milion\u00eb lek\u00eb.<\/p>\n<p>Si burime krijimi t\u00eb k\u00ebsaj pasurie, Merkaj ka deklaruar nj\u00eb kredi n\u00eb shum\u00ebn 32 mij\u00eb euro dhe kursimet e saj e t\u00eb bashk\u00ebshortit n\u00eb shum\u00ebn 1 milion lek\u00eb. Por, nga verifikimi i dokumentacionit bankar KPK ka konstatuar se kredia \u00ebsht\u00eb disbursuar rreth 20 dit\u00eb pas formalizimit t\u00eb kontrat\u00ebs s\u00eb shitblerjes.<\/p>\n<p>Kur \u00ebsht\u00eb p\u00ebrballur me k\u00ebt\u00eb gjetje, subjekti ka shpjeguar se bankat k\u00ebrkonin detyrimisht q\u00eb para l\u00ebvrimit t\u00eb kredis\u00eb t\u00eb vendosej si garanci hipotekore vet\u00eb banesa.<\/p>\n<p>\u201cNga ana tjet\u00ebr edhe shit\u00ebsi i pasuris\u00eb s\u00eb paluajtshme, apartamentit objekt financimi, shtetasi V. I., nuk pranonte q\u00eb t\u00eb lidhte kontrat\u00ebn e shitblerjes p\u00ebr kalimin e t\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb s\u00eb pasuris\u00eb tek ne, me rezerv\u00ebn e kalimit t\u00eb \u00e7mimit t\u00eb apartamentit pas l\u00ebvrimit t\u00eb kredis\u00eb nga banka, duke k\u00ebrkuar detyrimisht pagimin e shum\u00ebs n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb shitblerjes\u201d, ka vijuar shpjegimin subjekti.<\/p>\n<p>Merkaj ka deklaruar se n\u00eb kushtet kur dispononin vet\u00ebm 1 milion lek\u00eb kursime, n\u00eb p\u00ebrfundim jan\u00eb dakord\u00ebsuar me zgjidhjen e ofruar nga banka, q\u00eb nj\u00eb pjes\u00eb e shum\u00ebs s\u00eb \u00e7mimit t\u00eb apartamentit t\u00eb huazohej paraprakisht, po nga banka n\u00ebp\u00ebrmjet nj\u00eb klienti t\u00eb saj, por t\u00eb panjohur p\u00ebr subjektin dhe bashk\u00ebshortin e k\u00ebsaj t\u00eb fundit.<\/p>\n<p>\u201cP\u00ebr k\u00ebt\u00eb shkak jan\u00eb n\u00ebnshkruar dy deklarata noteriale prej meje dhe klientit t\u00eb bank\u00ebs A. B., respektivisht deklarata noteriale nr. ***, dat\u00eb 1.12.2004, p\u00ebr marrjen e shum\u00ebs prej 4.000.000 lek\u00ebsh dhe pas l\u00ebvrimit t\u00eb kredis\u00eb, deklarata noteriale nr. ***, dat\u00eb 22.12.2004, q\u00eb konfirmon kthimin e saj n\u00ebp\u00ebrmjet bank\u00ebs tek llogaria e tij\u201d, ka pohuar Merkaj dhe ka v\u00ebrejtur se kjo procedur\u00eb \u00ebsht\u00eb pjes\u00eb p\u00ebrb\u00ebr\u00ebse e kontrat\u00ebs s\u00eb kredis\u00eb si n\u00eb an\u00ebn dokumentare ashtu dhe n\u00eb p\u00ebrmbajtjen e saj.<\/p>\n<p>Nga hetimi ka rezultuar se po n\u00eb dat\u00ebn q\u00eb \u00ebsht\u00eb disbursuar kredia n\u00eb shum\u00ebn 32 mij\u00eb euro, vlera 31 mij\u00eb e 480 euro ka kaluar n\u00eb llogarin\u00eb e shtetasin A.B..<\/p>\n<p>N\u00eb analiz\u00ebn e gjetjeve KPK v\u00ebren se, deklaratat noteriale p\u00ebr dh\u00ebnien e shum\u00ebs nga personi i panjohur p\u00ebr subjektin \u00ebsht\u00eb b\u00ebr\u00eb pjes\u00eb integrale e kontrat\u00ebs s\u00eb kredimarrjes. Gjithashtu, evidentohet q\u00ebndrimi i p\u00ebrs\u00ebritur i Merkajt se nuk e ka njohur asnj\u00ebher\u00eb k\u00ebt\u00eb shtetas, por thjesht dhe vet\u00ebm ka zgjidhur me t\u00eb nj\u00eb koh\u00eb t\u00eb shkurt\u00ebr kohore, nj\u00eb situat\u00eb t\u00eb ofruar prej vet\u00eb bank\u00ebs.<\/p>\n<p>Komisioni ka administruar n\u00eb cil\u00ebsin\u00eb e prov\u00ebs nj\u00eb deklarat\u00eb noteriale t\u00eb huadh\u00ebn\u00ebsit t\u00eb dat\u00ebs 17 n\u00ebntor 2021, ku ai konfirmon ato \u00e7far\u00eb ka pretenduar subjekti. Nd\u00ebrkoh\u00eb, edhe banka ka konfirmuar q\u00eb praktika t\u00eb tilla kredidh\u00ebnieje jan\u00eb t\u00eb zakonshme dhe t\u00eb ligjshme n\u00eb sistemin e tyre.<\/p>\n<p>Trupi gjykues vler\u00ebson se subjekti ka shpjeguar dhe dokumentuar gjith\u00eb historikun e formalizimit t\u00eb kontrat\u00ebs s\u00eb shitblerjes s\u00eb k\u00ebtij apartamenti dhe rolin e bank\u00ebs kredidh\u00ebn\u00ebse n\u00eb p\u00ebrfitimin paraprak t\u00eb shum\u00ebs 4 milion\u00eb lek\u00eb n\u00ebp\u00ebrmjet nj\u00eb personi t\u00eb panjohur p\u00ebr gjyqtaren.<\/p>\n<p>N\u00eb vler\u00ebsimin e Komisionit jan\u00eb konsideruar arsyeja e marrjes s\u00eb shum\u00ebs p\u00ebr blerjen e apartamentit; parashikimet kontraktuale t\u00eb kredimarrjes ku \u00ebsht\u00eb pasqyruar dhe huaja; dokumentacioni provues p\u00ebr situat\u00ebn e deklaruar, i n\u00ebnshkruar n\u00eb koh\u00eb reale mes subjektit dhe huadh\u00ebn\u00ebsit t\u00eb panjohur dhe mungesa e konfliktit t\u00eb interesit mes tyre; roli nd\u00ebrmjetusues i bank\u00ebs; marrjen e kredis\u00eb dhe destinacioni i saj p\u00ebr shlyerjen e huas\u00eb menj\u00ebher\u00eb pas disbursimit &#8211; t\u00eb gjitha sipas KPK, t\u00eb konfirmuara me gjurm\u00eb bankare.<\/p>\n<p>\u201c[\u2026]Trupi gjykues krijon bindjen se t\u00eb gjith\u00eb veprimet e kryera nga subjekti p\u00ebr t\u00eb arrir\u00eb plot\u00ebsimin e shum\u00ebs p\u00ebrpara disbursimit t\u00eb kredis\u00eb, jo vet\u00ebm jan\u00eb realizuar n\u00eb nivel provash, por edhe jan\u00eb kryer n\u00eb kushtet e mir\u00ebbesimit\u201d, shprehet KPK dhe pranon q\u00eb kusht\u00ebzimi i shit\u00ebsit ka sh\u00ebrbyer si nj\u00eb faktor nxit\u00ebs p\u00ebr Merkajn p\u00ebr t\u00eb k\u00ebrkuar dhe gjetur nj\u00eb zgjidhje provizore.<\/p>\n<p>Ofert\u00ebn e bank\u00ebs p\u00ebr dh\u00ebnien e huas\u00eb nga klienti i saj, trupi gjykues e vler\u00ebson si rrethan\u00eb diktuese te subjekti p\u00ebr t\u00eb p\u00ebrligjur p\u00ebrmbushjen e q\u00ebllimit reciprok mes pal\u00ebve shit\u00ebs e bler\u00ebs, p\u00ebr blerjen e pasuris\u00eb. Gjithashtu, konstatohet se Merkaj nuk \u00ebsht\u00eb trajtuar n\u00eb m\u00ebnyr\u00eb preferenciale apo t\u00eb jet\u00eb favorizuar n\u00eb lidhje me kushtet dhe termat e p\u00ebrfitimit t\u00eb kredis\u00eb.<\/p>\n<p>Komisioni shkon m\u00eb tej n\u00eb arsyetimin e tij dhe vler\u00ebson se marrdh\u00ebnia e huas\u00eb n\u00eb t\u00eb v\u00ebrtet\u00eb nuk ka qen\u00eb e till\u00eb. \u201c[\u2026]P\u00ebr sa koh\u00eb provohet se ato jan\u00eb karakterizuar nga nj\u00eb marr\u00ebdh\u00ebnie nd\u00ebrmjet\u00ebsimi nga nj\u00eb institucion legjitim, pra, nuk konfirmohet nj\u00eb marr\u00ebdh\u00ebnie huaje sipas parashikimit t\u00eb Kodit Civil dhe, si t\u00eb tilla, vler\u00ebsohen nga trupi gjykues si rrethana p\u00ebrjashtuese p\u00ebr subjektin e rivler\u00ebsimit, nga detyrimi ligjor sipas nenit 32\/4 t\u00eb ligjit nr. 84\/2016\u201d, vler\u00ebson trupa dhe nuk e konsideruar si person t\u00eb lidhur huadh\u00ebn\u00ebsi A.B. e p\u00ebr rrjedhoj\u00eb nuk rezulton t\u00eb ket\u00eb kryer analiz\u00eb t\u00eb burimeve financiare t\u00eb tij p\u00ebr krijimin e shum\u00ebs q\u00eb i ka dh\u00ebn\u00eb subjektit n\u00eb 2004-\u00ebn.<\/p>\n<p>K\u00ebt\u00eb vler\u00ebsim trupi gjykues e mb\u00ebshtet dhe me rolin aktiv t\u00eb bank\u00ebs n\u00eb marrjen e huas\u00eb. \u201c[\u2026]Nd\u00ebrsa subjekti \u00ebsht\u00eb gjendur n\u00eb rolin e tij pasiv dhe, p\u00ebr m\u00eb tep\u00ebr n\u00eb kushtet e mir\u00ebbesimit\u201d, citohet n\u00eb vendim ku shtohet dhe fakti se nuk ka rezultuar n\u00eb asnj\u00eb rast q\u00eb subjekti dhe huadh\u00ebn\u00ebsi t\u00eb ken\u00eb pasur njohje apo t\u00eb jen\u00eb gjendur ndonj\u00ebher\u00eb n\u00eb kushtet e konfliktit t\u00eb interesit.<\/p>\n<p>Gjithashtu, trupi gjykues shprehet se ky rast \u00ebsht\u00eb vler\u00ebsuar edhe n\u00eb krahasim me \u00e7\u00ebshtje t\u00eb tjera, q\u00eb sipa KPA n\u00eb dukje prezantohen t\u00eb ngjashme. \u201c[\u2026]Rezultoi se \u00e7\u00ebshtja objekt hetimi nuk paraqet t\u00eb nj\u00ebjt\u00ebn panoram\u00eb me \u00e7\u00ebshtje t\u00eb tjera, qoft\u00eb n\u00eb aspektin e deklarimeve t\u00eb subjektit, pasi ato kan\u00eb rezultuar t\u00eb jen\u00eb n\u00eb vijueshm\u00ebri konsistente dhe jo kontradiktore, por dhe n\u00eb aspektin e nivelit t\u00eb provueshm\u00ebris\u00eb s\u00eb pretendimeve, t\u00eb cilat n\u00eb k\u00ebt\u00eb rast nuk kan\u00eb mbetur n\u00eb nivel deklarativ, por jan\u00eb mb\u00ebshtetur me nj\u00eb mori provash t\u00eb realizuara n\u00eb koh\u00ebn e kryerjes s\u00eb veprimeve\u201d, v\u00ebren Komisioni dhe vler\u00ebson se nuk gjendet para t\u00eb nj\u00ebjt\u00ebs zgjidhje ashtu sin\u00eb rastet n\u00eb dukje t\u00eb ngjashme p\u00ebr subjektet e tjer\u00eb t\u00eb rivler\u00ebsimit.<\/p>\n<p>N\u00eb p\u00ebrfundim, KPK e ka konsideruar vler\u00ebn 4 milion\u00eb lek\u00eb t\u00eb krijuar me burime t\u00eb ligjshme dhe pa pasoja negative n\u00eb vler\u00ebsimin e burimeve t\u00eb krijimit t\u00eb apartamentit.<\/p>\n<p>Komisioni konkludon se nuk jan\u00eb gjetur probleme as p\u00ebr kursimet e deklaruara, pasi shpjegimet dhe provat e subjektit lidhur me nj\u00eb balanc\u00eb negative n\u00eb shum\u00ebn 365 mij\u00eb lek\u00eb t\u00eb konstatuar gjat\u00eb hetimit paraprak jan\u00eb konsideruar bind\u00ebse, duke rezultuar n\u00eb fund me t\u00eb ardhura t\u00eb mjaftueshme dhe p\u00ebr pages\u00ebn 1 milion lek\u00eb.<\/p>\n<p>Po ashtu, trupi gjykues konkludon se Merkaj ka deklaruar sakt\u00eb nj\u00eb apartament 2+1, me sip\u00ebrfaqe 88.82 m2 n\u00eb Tiran\u00eb t\u00eb bler\u00eb n\u00eb vitin 2011 p\u00ebr vler\u00ebn 5.3 milion\u00eb lek\u00eb, ku si burim jan\u00eb deklaruar nj\u00eb hua me interes 6% n\u00eb vit n\u00eb shum\u00ebn 5 milion\u00eb lek\u00eb t\u00eb marr\u00eb prej bashk\u00ebshorti i subjektit nga nj\u00eb shok i tij, nd\u00ebrsa pjes\u00ebn e mbetur nga t\u00eb ardhurat vjetore.<\/p>\n<p>KPK konkludon se huadh\u00ebn\u00ebsi ka pasur mund\u00ebsi financiare p\u00ebr krijimin e vler\u00ebs 5 milion\u00eb lek\u00eb, si dhe nuk jan\u00eb gjetur probleme n\u00eb shlyerjen nj\u00eb vit m\u00eb von\u00eb t\u00eb huas\u00eb me t\u00eb ardhurat e p\u00ebrfituara nga shitja e apartamentit 1+1 kundrejt \u00e7mimit 5.5 milion\u00eb lek\u00eb q\u00eb \u00ebsht\u00eb konsideruar e mjaftueshme.<\/p>\n<p>Trupa e KPK \u00ebsht\u00eb bindur edhe nga shpjegimet e Merkajt lidhur me blerjen e nj\u00eb apartamenti garsoner me sip\u00ebrfaqe 34 m2 n\u00eb Durr\u00ebs , Plazh kunddrejt \u00e7mimit 1.1 milion lek\u00eb, q\u00eb \u00ebsht\u00eb konsideruar m\u00eb i ul\u00ebt nga vlera e tregut.<\/p>\n<p>\u201cTrupi gjykues i gjen bind\u00ebse argumentet e prezantuar nga subjekti se shit\u00ebsit duke qen\u00eb pronar\u00eb t\u00eb truallit dhe p\u00ebrfitues t\u00eb disa apartamenteve dhe garazheve dhe, p\u00ebr m\u00eb tep\u00ebr, duke qen\u00eb se k\u00ebt\u00eb apartament e kan\u00eb p\u00ebrdorur ata vet\u00eb m\u00eb par\u00eb, kan\u00eb qen\u00eb t\u00ebr\u00ebsisht n\u00eb kushte t\u00eb vullnetshme p\u00ebr t\u00eb shitur pasurin\u00eb n\u00eb vler\u00ebn q\u00eb vet\u00eb ata kan\u00eb menduar[\u2026]\u201d, argumenton Komisioni.<\/p>\n<p>\u201c[\u2026]N\u00eb vler\u00ebsimin t\u00ebr\u00ebsor t\u00eb komponentit t\u00eb pasuris\u00eb, mb\u00ebshtetur n\u00eb parimin e proporcionalitetit dhe objektivitetit, si dhe n\u00eb bindjen e brendshme, subjekti i rivler\u00ebsimit, me veprimet dhe mosveprimet e saj, nuk ka cenuar besimin e publikut dhe ka arritur nivel t\u00eb besuesh\u00ebm t\u00eb vler\u00ebsimit
