Dedja u vler\u00ebsua pozitivisht p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs.<\/p>\n<p>Procesi i vetingut p\u00ebr gjyqtaren Dedja po kryhet nga trupa e KPK-s\u00eb e kryesuar nga Pamela Qirko, me relatore Etleda \u00c7iftjan dhe an\u00ebtar Roland Ilian. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Steven Kessler.<\/p>\n<p>Ermira Dedja e ka filluar karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1993 dhe punon prej gati tre dekadash si gjyqtare n\u00eb Gjykat\u00ebn e Rrethit Shkod\u00ebr.<\/p>\n<p><strong>Burimet e apartamentit<\/strong><\/p>\n<p>P\u00ebr kriterin e pasuris\u00eb u relatua m\u00eb s\u00eb shumti p\u00ebr nj\u00eb apartament me sip\u00ebrfaqe 104 m2 t\u00eb bler\u00eb n\u00eb shkod\u00ebr n\u00eb vitin 2010, me vler\u00eb 4 milion\u00eb e 680 mij\u00eb lek\u00eb. Relatorja \u00c7iftja evidentoi se subjekti nuk ka pasqyruar n\u00eb deklarat\u00ebn veting dhe ato periodike burimet financiare q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr shlyerjen e dy k\u00ebsteve t\u00eb para, si dhe nuk ka deklaruar detyrimin e mbetur.<\/p>\n<p>Konkretisht, n\u00eb vitin 2009 nuk ka deklaruar burimin e krijimit t\u00eb shum\u00ebs 2.1 milion\u00eb lek\u00eb q\u00eb ka sh\u00ebrbyer p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb, si dhe detyrimin e mbetur n\u00eb vler\u00ebn 2.5 milion\u00eb lek\u00eb. E nj\u00ebjta situat\u00eb \u00ebsht\u00eb paraqitur dhe n\u00eb vitin 2010 kur Dedja nuk ka deklaruar burimin financiar q\u00eb ka sh\u00ebrbyer p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb n\u00eb shum\u00ebn 2 milion\u00eb lek\u00eb, si dhe nuk ka pasqyruar detyrimin e mbetur 500 mij\u00eb lek\u00eb.<\/p>\n<p>Ky detyrim ndaj shoq\u00ebris\u00eb nd\u00ebrtuese nuk \u00ebsht\u00eb deklaruar as p\u00ebr periudh\u00ebn 2011-2013. Nd\u00ebrsa n\u00eb vitin 2008 nuk \u00ebsht\u00eb deklaruar e drejta e reale e p\u00ebrdorimit t\u00eb k\u00ebtij apartamenti.<\/p>\n<p>Dedja u paraqit n\u00eb seanc\u00eb s\u00eb bashku me avokaten Romina Zano, megjithat\u00eb ajo i paraqiti vet\u00eb kund\u00ebrshtimet e gjetjeve t\u00eb Komisionit. Ajo theksoi se n\u00eb apartamentin n\u00eb fjal\u00eb kishin filluar t\u00eb jetonin n\u00eb mar t\u00eb vitit 2009 dhe p\u00ebr k\u00ebt\u00eb arsye nuk zot\u00ebronte t\u00eb drejta reale p\u00ebr k\u00ebt\u00eb pasuri n\u00eb 2008-\u00ebn.<\/p>\n<p>Ajo pranoi se investitori\u00a0 kishte lidhur n\u00eb vitin 2008 kontrat\u00ebn e energjis\u00eb t\u00eb em\u00ebr t\u00eb bashk\u00ebshortit t\u00eb ndjer\u00eb, por sipas subjektit, nga dokumentet rezultonte e qart\u00eb se nuk kishte pasur konsumim t\u00eb energjis\u00eb elektrike. \u201cKjo situat\u00eb provon qart\u00eb, se n\u00eb at\u00eb banes\u00eb nuk ka banuar askush\u201d, deklaroi Dedja.<\/p>\n<p>P\u00ebr mosdeklarimin e burimeve financiare q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr pagesat e dy k\u00ebsteve t\u00eb para, Dedja u mbrojt duke ju referuar m\u00ebnyr\u00ebs s\u00eb kuptimit t\u00eb ligjit. Ajo k\u00ebmb\u00ebnguli se duke deklaruar periodikisht t\u00eb ardhurat e siguruara prej bashk\u00ebshortit nga aktiviteti i tij privat p\u00ebr periudh\u00ebn 2008-2011, kishte ezauruar dhe burimin e pagimit t\u00eb k\u00ebsteve t\u00eb apartamentit. \u201cKam p\u00ebrmbushur n\u00ebn k\u00ebt\u00eb m\u00ebnyr\u00eb deklarimin e burimit me t\u00eb ardhurat e fituara n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb verifikueshme\u201d, theksoi Dedja n\u00eb seanc\u00eb.<\/p>\n<p>Ajo argumentoi se nuk kishte p\u00ebrse mos ti deklaronte k\u00ebto t\u00eb ardhura si burim krjimi p\u00ebrsa koh\u00eb q\u00eb kan\u00eb qen\u00eb t\u00ebr\u00ebsisht t\u00eb ligjshme, pasi jan\u00eb krijuar nga aktiviteti profesional i bashk\u00ebshortit dhe jan\u00eb paguar t\u00eb gjitha detyrimet tatimore kundrejt shtetit.<\/p>\n<p>Lidhur me mosdeklarimin e detyrimeve t\u00eb mbetura, Dedja pretendoi se kishte konsideruar se me deklarimin e pagimit t\u00eb dy k\u00ebsteve, diferenca e pashlyer automatikisht ishte detyrimi i mbetur.<\/p>\n<p>Dedja dha shpjegime dhe p\u00ebr konstatimin e KPK se \u00e7mimi i referenc\u00ebs p\u00ebr k\u00ebt\u00eb apartament ishte m\u00eb i lart\u00eb se ai i blerjes. Ajo solli n\u00eb v\u00ebmendje se ishte dokumentuar se bashk\u00ebshorti ishte arkitekt i projektit t\u00eb pallatit ku gjendet apartamenti tyre dhe p\u00ebr k\u00ebt\u00eb kontribut profesional ishte dakord\u00ebsuar p\u00ebr nj\u00eb \u00e7mim preferencial p\u00ebr apartamentin.<\/p>\n<p>Subjekti shtoi se \u00e7mimi p\u00ebr met\u00ebr katror p\u00ebr apartamentin q\u00eb ajo zot\u00ebron ka qen\u00eb 45 mij\u00eb lek\u00eb p\u00ebr m2, q\u00eb sipas saj \u00ebsht\u00eb i p\u00ebraf\u00ebrt me at\u00eb t\u00eb tregut t\u00eb lir\u00eb n\u00eb Shkod\u00ebr p\u00ebr vitin 2008 n\u00eb vler\u00ebn 49 mij\u00eb lek\u00eb p\u00ebr m2.<\/p>\n<p>Megjith\u00ebse Dedja nuk ka dokumentuar pages\u00ebn e k\u00ebstit t\u00eb par\u00eb n\u00eb vitin 2009, Komisioni e ka kryer analiz\u00ebn financiare bazuar n\u00eb deklarimet e subjektit, duke konsideruar shlyerjen e shum\u00ebs 2.1 milion\u00eb lek\u00eb n\u00eb k\u00ebt\u00eb vit dhe t\u00eb k\u00ebstit t\u00eb dyt\u00eb 2 milion\u00eb lek\u00eb n\u00eb 2010-\u00ebn.<\/p>\n<p>KPK ka hetuar mbi t\u00eb ardhurat e bashk\u00ebshortit t\u00eb subjektit, nga ka rezultuar se ai ka krijuar 4.1 milion\u00eb lek\u00eb n\u00eb vitin 2008, 3.4 milion\u00eb lek\u00eb n\u00eb 2009-\u00ebn dhe1.3 milion lek\u00eb n\u00eb vitin 2010. P\u00ebr shkak t\u00eb mosdeklarimit t\u00eb likujditeve cash n\u00eb vitet para kryerjes s\u00eb pages\u00ebs s\u00eb dy k\u00ebsteve, trupi gjykues ka konsideruar n\u00eb analiz\u00ebn financiare vet\u00ebm t\u00eb ardhurat e siguruara n\u00eb vitin p\u00ebrkat\u00ebs, deri n\u00eb momentin e kryerjes s\u00eb pages\u00ebs.<\/p>\n<p>P\u00ebr rrjedhoj\u00eb, t\u00eb ardhurat e bashk\u00ebshortit p\u00ebr vitin 2008 nuk jan\u00eb konsideruar si burim p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb n\u00eb mars t\u00eb vitit 2009, prej nga ka rezultuar balanc\u00eb negative n\u00eb shum\u00ebn rreth 1.5 milion\u00eb lek\u00eb. E nj\u00ebjta metodologji \u00ebsht\u00eb ndjekur dhe p\u00ebr analiz\u00ebn e burimeve p\u00ebr k\u00ebstin e dyt\u00eb n\u00eb mars t\u00eb vitit 2010 n\u00eb vler\u00ebn 2 milion\u00eb lek\u00eb, duke rezultuar pamund\u00ebsi financiare n\u00eb shum\u00ebn 1.7 milion\u00eb lek\u00eb.<\/p>\n<p>Dedja v\u00ebrejti se bashk\u00ebshorti i ndjer\u00eb kishte p\u00ebrfituar nga aktiviteti i tij privat t\u00eb ardhura n\u00eb shum\u00ebn totale rreth 8.7 milion\u00eb lek\u00eb. Ajo sqaroi se n\u00eb fund t\u00eb vitit deklarues ajo nuk i dispononte k\u00ebto t\u00eb ardhura n\u00eb sht\u00ebpi n\u00eb gjendje cash, pasi gjendeshin n\u00eb ark\u00ebn e aktivitetit t\u00eb bashk\u00ebshortit.<\/p>\n<p>Ajo k\u00ebmb\u00ebnguli se p\u00ebr k\u00ebstin e par\u00eb \u00ebsht\u00eb p\u00ebrdorur fitimi neto i vitit 2008 dhe jo ai i tre muajve t\u00eb par\u00eb t\u00eb 2009-\u00ebs. T\u00eb nj\u00ebjtin argument Dedja dha edhe p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb dhe theksoi se kishte pasur burime t\u00eb ligjshme t\u00eb mjaftueshme p\u00ebr pages\u00ebn e t\u00eb dy k\u00ebsteve t\u00eb partamentit.<\/p>\n<p>Dedja dha shpjegime dhe p\u00ebr nj\u00eb balanc\u00eb negative n\u00eb shum\u00ebn 674 mij\u00eb lek\u00eb p\u00ebr blerjen e nj\u00eb makine n\u00eb mars t\u00eb vitit 2007 p\u00ebr \u00e7mimin 250 mij\u00eb lek\u00eb. Ajo sqaroi se kishin disponuar at\u00ebher\u00eb nj\u00eb depozit\u00eb, por bashk\u00ebshorti p\u00ebr t\u00eb mos humbur interesat kishte marr\u00eb nj\u00eb hua nga v\u00ebllai i saj q\u00eb jeton dhe punon n\u00eb Itali.<\/p>\n<p>Subjekti pretendoi se pasi ishte maturuar depozita, ishte t\u00ebrhequr dhe ishte shlyer huaja brenda vitit. Dedja tha se kishte siguruar dokumentacion provues p\u00ebr mund\u00ebsin\u00eb financiare t\u00eb v\u00ebllait t\u00eb saj p\u00ebr dh\u00ebnien e huas\u00eb.<\/p>\n<p>Ajo k\u00ebrkoi q\u00eb n\u00eb analiz\u00ebn financiare t\u00eb ulen shpenzimet e udh\u00ebtimeve n\u00eb Mal t\u00eb Zi, q\u00eb sipas saj kan\u00eb qen\u00eb disa or\u00ebshe, si dhe p\u00ebr udh\u00ebtimet e bashk\u00ebshortit p\u00ebr arsye t\u00eb pun\u00ebs, kur ka qen\u00eb i pajtuar nga subjekte t\u00eb tjer\u00eb p\u00ebr shkak t\u00eb profesionit t\u00eb tij si arkitekt.<\/p>\n<p>P\u00ebr profesionalizmin \u00c7iftja evidentoi dy vendime t\u00eb gjyqtares Dedja lidhur me k\u00ebrkes\u00ebn e nj\u00eb prej 6 denoncimeve nga publiku, p\u00ebr p\u00ebrjashtimin e nj\u00eb gjyqtari nga \u00e7\u00ebshtja ku denoncuesi kishte qen\u00eb pal\u00eb. Sipas KPK, denoncuesi n\u00eb t\u00eb dy k\u00ebrkesat p\u00ebr p\u00ebrjashtimin e gjyqtares q\u00eb gjykonte \u00e7\u00ebshtjen ku ishte pal\u00eb kishte ngritur t\u00eb nj\u00ebjtat pretendime, por subjekti kishte mbajtur q\u00ebndrime t\u00eb ndryshme, ku n\u00eb nj\u00eb rast e kishte pranuar kurse n\u00eb tjetrin e kishte rr\u00ebzuar k\u00ebrkes\u00ebn.<\/p>\n<p>Gjyqtarja Dedja k\u00ebmb\u00ebnguli se rrethanat p\u00ebr secil\u00ebn prej k\u00ebtyre rasteve jan\u00eb t\u00eb ndryshme n\u00eb p\u00ebrmbajtjen e tyre. \u201cDy \u00e7\u00ebshtjet kan\u00eb objekt t\u00ebr\u00ebsisht t\u00eb ndrysh\u00ebm dhe n\u00eb proces jan\u00eb administruar prova t\u00eb ndryshme\u201d, pohoi Dedja. Ajo kund\u00ebrshtoi edhe disa konstatime p\u00ebr tejkalim t\u00eb afateve t\u00eb njoftimit t\u00eb vendimit.<\/p>\n<p>N\u00eb fund t\u00eb seanc\u00ebs gjyqtarja Ermira Dedja dor\u00ebzoi nj\u00eb s\u00ebr\u00eb dokumentesh si prova t\u00eb reja dhe k\u00ebrkoi konfirmimin n\u00eb detyr\u00eb.
