Hoxhaj<\/figcaption><\/figure>\n<p>Gjyqtari i Lezh\u00ebs, Jak Ndoka u shkarkua nga detyra m\u00eb 24 n\u00ebntor, pasi Komisioni i Pavarur i Kualifikimit, KPK konkludoi se ai ka nd\u00ebrmarr\u00eb hapa p\u00ebr t\u00eb fshehur ose paraqitur n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb pasurit\u00eb; se nuk ka shpjeguar bindsh\u00ebm burimin e krijimi t\u00eb tyre; si dhe ka c\u00ebnuar besimin e publikut tek drejt\u00ebsia me veprimet e tij n\u00eb transaksionet e kryera p\u00ebr nj\u00eb apartament.<\/p>\n<p>Vendimi p\u00ebr shkarkimin e Ndok\u00ebs \u00ebsht\u00eb marr\u00eb nga trupa e KPK e kryesuar nga Valbona Sanxhaktari, me relatore Xhensila Pinen dhe an\u00ebtar Olsi Komicin, p\u00ebr t\u00eb cil\u00ebt p\u00ebrfaq\u00ebsuesi ligjor i subjektit, avokati Gedeon Dudushi k\u00ebrkoi p\u00ebrjashtimin pasi rr\u00ebzuan k\u00ebrkes\u00ebn p\u00ebr ri\u00e7eljen e hetimit dhe p\u00ebr dy kriteret e tjer\u00eb, at\u00eb t\u00eb past\u00ebrtis\u00eb s\u00eb figur\u00ebs dhe profesionalizmit. K\u00ebrkesa e p\u00ebrjashtimit u shqyrtua nga nj\u00eb tjet\u00ebr trup\u00eb gjykuese e Komisionit, q\u00eb e gjeti t\u00eb pabazuar.<\/p>\n<p>Jak Ndoka e ka nisur karrier\u00ebn n\u00eb sistemin shqiptar t\u00eb drejt\u00ebsis\u00eb n\u00eb vitin 1995. Prej gati dy dekadash, ai ka punuar kryetar dhe gjyqtar i Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Lezh\u00eb. Ndoka nuk u paraqit n\u00eb seancat e zhvilluara n\u00eb KPK.<\/p>\n<p><strong>\u201cP\u00ebrpjekje p\u00ebr t\u00eb krijuar burime t\u00eb ligjshme\u201d<\/strong><\/p>\n<p>Komisioni ngre dyshime se gjyqtari Ndoka ka deformuar t\u00eb v\u00ebrtet\u00ebn p\u00ebr \u00e7mimin e shitjes s\u00eb nj\u00eb apartamenti t\u00eb vjet\u00ebr me sip\u00ebrfaqe 68 m2 n\u00eb Lezh\u00eb duke n\u00ebnshkruar kat\u00ebr kontrata t\u00eb ndryshme, me q\u00ebllim justifikimin e burimeve financiare p\u00ebr blerjen e disa pasurive t\u00eb tjera n\u00eb vijim.<\/p>\n<p>N\u00eb deklarat\u00ebn \u201cveting\u201d, subjekti ka sh\u00ebnuar se apartamentin me sip\u00ebrfaqe 68 m2 e ka bler\u00eb nga Enti Komb\u00ebtar i Banesave,EKB n\u00eb vitin 2001, p\u00ebr shum\u00ebn 557 mij\u00eb lek\u00eb.<\/p>\n<p>N\u00eb vitin 2007 Ndoka ka deklaruar se e ka shitur k\u00ebt\u00eb banes\u00eb p\u00ebr vler\u00ebn 5.3 milion\u00eb lek\u00eb. Nga hetimi jan\u00eb evidentuar dy aktmarr\u00ebveshje p\u00ebr shitjen e apartamentit t\u00eb n\u00ebnshkruara nga subjekti, nj\u00eb e dat\u00ebs 19 prill 2007 dhe tjetra e 24 prillit 2007, si dhe nj\u00eb kontrat\u00eb e shitblerjes s\u00eb pasuris\u00eb, po e dat\u00ebs 24 prill2007 &#8211; ku n\u00eb t\u00eb tre k\u00ebto akte, \u00e7mimi i shitjes s\u00eb banes\u00ebs \u00ebsht\u00eb p\u00ebrcaktuar 5.3 milion\u00eb lek\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb, ASHK-ja Lezh\u00eb ka informuar se egziston dhe nj\u00eb kontrat\u00eb tjet\u00ebr shitblerje p\u00ebr k\u00ebt\u00eb apartament me dat\u00ebn 24 prill 2007, sipas s\u00eb cil\u00ebs subjekti ia ka shitur k\u00ebt\u00eb apartament shtetasit L. M. kundrejt \u00e7mimit prej 3 milion\u00eb lek\u00eb.<\/p>\n<p>Komisioni konstaton se detyrimet tatimore jan\u00eb shlyer vet\u00ebm p\u00ebr shum\u00ebn 3 milion\u00eb lek\u00eb dhe p\u00ebr k\u00ebt\u00eb arsye kjo vler\u00eb \u00ebsht\u00eb konsideruar n\u00eb analiz\u00eb.<\/p>\n<p>\u201cQ\u00ebndrimi i subjektit t\u00eb rivler\u00ebsimit, si gjat\u00eb deklarimeve t\u00eb tij ashtu edhe gjat\u00eb hetimit administrativ, se vlera e p\u00ebrfituar nga shitja e apartamentit \u00ebsht\u00eb 5.300.000 lek\u00eb, nuk arriti t\u00eb kap\u00ebrcejn\u00eb natyr\u00ebn deklarative, pasi nuk mund t\u00eb zhb\u00ebjn\u00eb nj\u00eb dokument me vler\u00eb t\u00eb plot\u00eb ligjore, si\u00e7 \u00ebsht\u00eb kontrata e shitjes e riregjistruar n\u00eb ZVRPP-n\u00eb Lezh\u00eb, p\u00ebr tjet\u00ebrsimin e k\u00ebsaj pasurie, n\u00eb rastin konkret\u201d, vler\u00ebson trupi gjykues.<\/p>\n<p>Fakti se subjekti nuk ka revokuar asnj\u00eb prej kat\u00ebr kontratave t\u00eb n\u00ebnshkruara, si dhe deklarimet e tij n\u00eb vijim se vlera 5.3 milion\u00eb lek\u00eb ka sh\u00ebrbyer p\u00ebr blerjen e pasurive t\u00eb tjera, kan\u00eb ngritur dyshime tek Komisioni se kan\u00eb pasur si q\u00ebllim justifikimin e burimeve.<\/p>\n<p>\u201cK\u00ebto veprime fiktive t\u00eb subjektit t\u00eb \u00e7ojn\u00eb n\u00eb konkluzionin se \u00ebsht\u00eb p\u00ebrpjekur t\u00eb krijoj\u00eb burime t\u00eb ligjshme t\u00eb krijimit t\u00eb pasurive q\u00eb do t\u00eb krijonte n\u00eb vitet n\u00eb vijim\u201d, citohet n\u00eb vendimin e arsyetuar.<\/p>\n<p>Po ashtu jan\u00eb rr\u00ebzuar pretendimet e Ndok\u00ebs se kontrata e depozituar n\u00eb hipotek\u00eb \u00ebsht\u00eb e falsifikuar dhe e b\u00ebr\u00eb nga bler\u00ebsi, p\u00ebr t\u2019i shp\u00ebtuar detyrimeve tatimore. Komisioni v\u00ebren se sipas legjislacionit p\u00ebr tatimin mbi t\u00eb ardhurat, \u00ebsht\u00eb shit\u00ebsi ai q\u00eb paguan detyrimet, para se pasuria t\u00eb regjistrohet n\u00eb emrin e bler\u00ebsit.\u00a0 \u201cPo ashtu edhe mandatark\u00ebtimi nr. ***, dat\u00eb 27.4.2007, \u00ebsht\u00eb n\u00eb em\u00ebr t\u00eb shit\u00ebsit dhe provon se shit\u00ebsi ka paguar detyrimin tatimor bazuar n\u00eb \u00e7mimin e shitjes prej 3.000.000 lek\u00ebsh\u201d, thekson trupi gjykues.<\/p>\n<p>N\u00eb p\u00ebrfundim, Komisioni konstaton se lidhja dhe n\u00ebnshkrimi i disa kontratave p\u00ebr t\u00eb nj\u00ebjt\u00ebn pasuri, me ndikim edhe n\u00eb burimet financiare p\u00ebr pasurit\u00eb e krijuara m\u00eb von\u00eb, c\u00ebnojn\u00eb besimin e publikut t\u00eb sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Komisioni konstaton se subjekti nuk ka pasur burime t\u00eb ligjshme financiare p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 108 m2 + nj\u00ebsi sh\u00ebrbimi me sip\u00ebrfaqe 20 m2 n\u00eb n\u00ebntor t\u00eb vitit 2007 n\u00eb Lezh\u00eb, p\u00ebrkat\u00ebsisht n\u00eb vlerat 3.2 milion\u00eb lek\u00eb dhe 600 mij\u00eb lek\u00eb, pasi vlera e konsideruar si e p\u00ebrfituar nga shitja e apartamentit t\u00eb m\u00ebparsh\u00ebm 3 milion\u00eb lek\u00eb \u00ebsht\u00eb vler\u00ebsuar e pamjaftueshme.<\/p>\n<p>Situat\u00eb e ngjashme ka rezultuar dhe p\u00ebr blerjen e nj\u00eb apartamenti banimi me sip\u00ebrfaqe 78.4 m2 n\u00eb Sh\u00ebngjin t\u00eb Lezh\u00ebs n\u00eb vitin 2010 p\u00ebr \u00e7mimin 2.6 milion\u00eb lek\u00eb. Edhe n\u00eb k\u00ebt\u00eb rast si burim krijimi kryesor t\u00eb k\u00ebsaj pasurie, Ndoka ka deklaruar t\u00eb ardhurat e p\u00ebrfituara nga shitja e apartamentit 68 m2 n\u00eb vitin 2007, si dhe kursime nga t\u00eb ardhurat.<\/p>\n<p>Komisioni ka vler\u00ebsuar t\u00eb mos e konsideroj\u00eb vler\u00ebn 2.3 milion\u00eb p\u00ebr t\u00eb cil\u00ebn Ndoka ka preteduar se p\u00ebrfaq\u00ebson k\u00ebstin e dyt\u00eb t\u00eb shitjes s\u00eb apartamentit n\u00eb 2007-\u00ebn. \u201c[\u2026]Vlera e shitjes s\u00eb apartamentit n\u00eb lagjen \u201c***\u201d u provua me dokumentacion se \u00ebsht\u00eb 3.000.000 lek\u00eb\u201d, v\u00ebren KPK dhe i konsideron deklarative pretendimet e subjektit.<\/p>\n<p>Sipas KPK, Ndoka nuk ka arritur t\u00eb shpjegoj\u00eb bindsh\u00ebm as burimin e ligjsh\u00ebm t\u00eb t\u00eb ardhurave t\u00eb pretenduara, si dhe nuk ka provuar p\u00ebrdorimin e kursimeve cash si burim p\u00ebr pages\u00ebn p\u00ebr apartamentin n\u00eb Sh\u00ebngjin.<\/p>\n<p>\u201c[\u2026]Shiti nj\u00eb apartament t\u00eb vjet\u00ebr, p\u00ebrfituar me privatizim, me sip. 68 m2 n\u00eb lagjen \u201c***\u201d, n\u00eb Lezh\u00eb, deklaruar me \u00e7mim 5.300.000 lek\u00eb dhe bleu apartament banimi me sip. 108 m2 dhe nj\u00ebsi tregtimi me sip. 20 m2 n\u00eb lagjen \u201c***\u201d, Lezh\u00eb, me \u00e7mimin 3.800.000 lek\u00eb, dhe apartamentin me sip. 87.4 m2, n\u00eb Sh\u0451ngjin, Lezh\u0451, n\u0451 vler\u0451n 2.600.000 lek\u0451, duke kryer transaksione t\u00eb paqarta dhe t\u00eb pamb\u00ebshtetura n\u00eb logjik\u00eb ekonomike\u201d, konstaton Komisioni n\u00eb lidhje me transaksionet e Ndok\u00ebs me pasurit\u00eb n\u00eb Lezh\u00eb dhe konkludon se ai \u00ebsht\u00eb p\u00ebrpjekur t\u00eb krijoj\u00eb burime t\u00eb ligjshme p\u00ebr blerje pasurie.<\/p>\n<p><strong>Dyshime p\u00ebr fshehje<\/strong><\/p>\n<p>Komisioni ngre dyshime se subjekti i rivler\u00ebsimit ka fshehur nj\u00eb pjes\u00eb t\u00eb nj\u00eb apartamenti me sip\u00ebrfaqe 103 m2 n\u00eb Tiran\u00eb. N\u00eb deklarat\u00ebn \u201cveting\u201d Ndoka ka sh\u00ebnuar se ky apartament \u00ebsht\u00eb porositur n\u00eb vitin 2012 kundrejt shum\u00ebs 60 mij\u00eb euro dhe si burim krijimi ka deklaruar kursimet cash t\u00eb periudh\u00ebs 2009-2011 dhe nj\u0451 pjes\u0451 t\u0451 vitit 2012, nd\u00ebrsa pjesa tjet\u0451r n\u00eb vler\u00ebn 45 mij\u00eb euro e paguar nga bashk\u0451pronari A. N., me kursime cash gjat\u0451 pun\u0451s n\u0451 shtetin grek, q\u0451 prej vitit 1992.<\/p>\n<p>Ndoka ka deklaruar p\u00ebrdorimin e k\u00ebtij apartamenti nga viti 2012 e n\u00eb vijim dhe shpenzime mobilimi. Kontrata e furnizimit me uj\u00eb \u00ebsht\u00eb n\u00eb em\u00ebr t\u00eb tij, nd\u00ebrsa nuk \u00ebsht\u00eb provuar q\u00eb v\u00ebllai q\u00eb \u00ebsht\u00eb nj\u00ebkoh\u00ebsisht dhe bashk\u00ebpronar t\u00eb ket\u00eb jetuar n\u00eb k\u00ebt\u00eb banes\u00eb, pasi prej vitesh e ka nd\u00ebrtuar jet\u00ebn e tij n\u00eb Greqi<\/p>\n<p>Po ashtu, jan\u00eb gjetur mosp\u00ebrputhje t\u00eb pretendimeve t\u00eb Ndok\u00ebs lidhur me k\u00ebt\u00eb pasuri. Konkretisht, nuk \u00ebsht\u00eb v\u00ebrtetuar deklarimi i subjektit se ai disponon 25% t\u00eb k\u00ebsaj pasurie pasi nuk \u00ebsht\u00eb pasqyruar n\u00eb kontrat\u00eb, si dhe ka rezultuar i pav\u00ebrtet\u00eb pretendimi s\u00eb v\u00ebllai nuk disponon asnj\u00eb pasuri tjet\u00ebr, pasi ai ka bler\u00eb nj\u00eb apartament tjet\u00ebr n\u00eb Sh\u00ebngjin.<\/p>\n<p>\u201c[\u2026]P\u00ebr m\u00eb tep\u00ebr duket e paqart\u00eb mund\u00ebsia financiare e v\u00ebllait t\u00eb subjektit, shtetasit A. P. N., p\u00ebr krijimin e pasurive\u201d, konstaton KPK dhe vler\u00ebson se prej fakteve dhe provave t\u00eb administruara gjat\u00eb hetimit, nuk krijohet bindja se v\u00ebllai \u00ebsht\u00eb bashk\u00ebpronar de facto i nj\u00eb pjese t\u00eb k\u00ebtij apartamenti.<\/p>\n<p>Ndoka ka rezultuar n\u00eb pamund\u00ebsi financiare dhe p\u00ebr blerjen e n\u00eb automjeti tip \u201cDaimler Chrysler\u201d n\u00eb vitin 2014 p\u00ebr \u00e7mimin 500 mij\u00eb lek\u00eb.
