N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Tonci Petkovic.<\/p>\n<p>Tereza Merkaj p\u00ebrfundoi studimet n\u00eb Shkoll\u00ebn e Magjistratur\u00ebs n\u00eb vitin 2003 dhe kreu stazhin p\u00ebr nj\u00eb vit n\u00eb Gjykat\u00ebn e Durr\u00ebsit. N\u00eb vitin 2004 u em\u00ebrua n\u00eb Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Elbasan dhe n\u00eb 2013-\u00ebn u transferua n\u00eb Gjykat\u00ebn e Tiran\u00ebs, n\u00eb fush\u00ebn e drejt\u00ebsis\u00eb p\u00ebr t\u00eb mitur.<\/p>\n<p>Prej vitit 2019 ajo \u00ebsht\u00eb komanduar si pedagoge e brendshme pran\u00eb Shkoll\u00ebs s\u00eb Magjistratur\u00ebs, me afat 5-vje\u00e7ar. Relatorja Bekteshi sqaroi n\u00eb fillim t\u00eb seanc\u00ebs se procesi i rivler\u00ebsimit p\u00ebr gjyqtaren Merkaj \u00ebsht\u00eb kryer me p\u00ebrpar\u00ebsi p\u00ebr shkak t\u00eb aplikimit t\u00eb saj p\u00ebr nj\u00eb pozicion n\u00eb Gjykat\u00ebn e Posa\u00e7me t\u00eb Apelit p\u00ebr Korrupsionin dhe Krimin e Organizuar.<\/p>\n<p>Gjyqtarja Tereza Merkaj mori vler\u00ebsim pozitiv p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs dhe u pyet lidhur me transaksionet e nj\u00eb kredie q\u00eb kishte sh\u00ebrbyer p\u00ebr blerjen e nj\u00eb apartamenti n\u00eb vitin 2004 si dhe p\u00ebr disa \u00e7\u00ebshtje t\u00eb denoncuara nga publiku.<\/p>\n<p>Si burime krijimi p\u00ebr blerjen e apartamentit me sip\u00ebrfaqe 57.4 m2 n\u00eb vitin 2004 n\u00eb Tiran\u00eb kundrejt \u00e7mimit 5 milion\u00eb lek\u00eb, subjekti ka deklaruar nj\u00eb kredi n\u00eb shum\u00ebn 32 mij\u00eb euro me afat 15 vje\u00e7ar, kursimet e saj dhe t\u00eb bashk\u00ebshortit, si dhe t\u00eb familjar\u00ebve t\u00eb tyre.<\/p>\n<p>Megjith\u00ebse deklarimet e subjektit p\u00ebr k\u00ebt\u00eb pasuri jan\u00eb gjetur t\u00eb sakta, n\u00eb seanc\u00eb u evidentua se kredia ishte disbursuar 20 dit\u00eb pasi ishte n\u00ebnshkruar kontrata e shitblerjes.<\/p>\n<p>Bekteshi deklaroi se subjekti ka shpjeguar se banka kishte k\u00ebrkuar q\u00eb t\u00eb vendosej si kolateral banesa dhe p\u00ebr k\u00ebt\u00eb arsye kishte nd\u00ebrmjet\u00ebsuar m\u00eb nj\u00eb klientin e saj p\u00ebr dh\u00ebnien e nj\u00eb huaje n\u00eb shum\u00ebn 4 milion\u00eb lek\u00eb q\u00eb t\u00eb blihej m\u00eb par\u00eb apartamenti n\u00eb em\u00ebr t\u00eb Merkajt. Gjat\u00eb hetimit si dhe n\u00eb seanc\u00ebn d\u00ebgjimore Merkaj deklaroi se nuk kishte pasur njohje dhe as marrdh\u00ebnie interesi me huadh\u00ebn\u00ebsin, i cili sipas saj ishte gjetur prej bank\u00ebs. &#8220;Di q\u00eb banka ka pasur interes n\u00eb k\u00ebt\u00eb transaksion pasi at\u00ebher\u00eb kredia \u00ebsht\u00eb marr\u00eb me 9% interes&#8221;, theksoi Merkaj.<\/p>\n<p>N\u00eb seanc\u00eb u tha se n\u00eb vitin 2004 jan\u00eb n\u00ebnshkruar dy kontrata noteriale me klientin e bank\u00ebs A.B., q\u00eb sipas relatores, s\u00eb bashku me dokumentet bankare konfirmojne dh\u00ebnien dhe kthimin e huas\u00eb 4 milion\u00eb lek\u00eb.<\/p>\n<p>Komisioni ka thirrur si d\u00ebshmitar shtetasin A.B., i cili ka njoftuar se e kishte t\u00eb pamundur p\u00ebr arsye t\u00eb infektimit nga COVID-19 dhe p\u00ebr k\u00ebt\u00eb arsye ka dor\u00ebzuar nj\u00eb deklarat\u00eb noteriale n\u00ebp\u00ebrmjet t\u00eb cil\u00ebs ka sqaruar se nuk njihej me subjektin n\u00eb momentin e dh\u00ebnies s\u00eb shum\u00ebs 4 milion\u00eb lek\u00eb. Gjithashtu, ai ka deklaruar se at\u00ebher\u00eb i \u00ebsht\u00eb sygjeruar nga miqt\u00eb e tij n\u00eb bank\u00eb dhe jasht\u00eb saj p\u00ebr t\u00eb dh\u00ebn\u00eb huan\u00eb, me q\u00ebllim q\u00eb t\u00eb mund\u00ebsohej procedura e kredis\u00eb p\u00ebr Merkajn. Lidhur me burimin e vler\u00ebs 4 milion\u00eb lek\u00eb, A.B. \u00ebsht\u00eb shprehur se e ka trash\u00ebguar prej gjysh\u00ebrv\u00eb t\u00eb tij.<\/p>\n<p>Komisioni ka pyetur bank\u00ebn kredidh\u00ebn\u00ebse p\u00ebr k\u00ebt\u00eb lloj transaksioni, e cila ka sqaruar se praktika t\u00eb tilla nd\u00ebrmjet\u00ebsimi kan\u00eb qen\u00eb dhe jan\u00eb t\u00eb zakonshme.<\/p>\n<p>\u201cDuket si nj\u00eb marrdh\u00ebnie nd\u00ebrmjet\u00ebsimi nga banka\u201d, pohoi relatorja Bekteshi.<\/p>\n<p>Nd\u00ebrkoh\u00eb, nga analiza financiare \u00ebsht\u00eb konstatuar balanc\u00eb negative n\u00eb shum\u00ebn 365 mij\u00eb lek\u00eb p\u00ebr krijimin e kursimeve q\u00eb jan\u00eb deklaruar se kan\u00eb sh\u00ebrbyer p\u00ebr likujdimin e pjes\u00ebs tjet\u00ebr t\u00eb \u00e7mimit t\u00eb apartamentit.<\/p>\n<p>Bekteshi sqaroi se balanca negative ka rezultuar pasi \u00ebsht\u00eb konsideruar vet\u00ebm mund\u00ebsia e kursimeve n\u00eb vitin 2004, p\u00ebr shkak t\u00eb mosdeklarimit t\u00eb gjendjes cash n\u00eb vitin 2003. Subjekti ka k\u00ebrkuar gjat\u00eb hetimit administrativ q\u00eb t\u00eb ulen shpenzimet p\u00ebr dy udh\u00ebtime t\u00eb bashk\u00ebshortit jasht\u00eb shtetit, pasi kan\u00eb qen\u00eb t\u00eb mbuluara nga institucioni ku ai punonte.<\/p>\n<p>Gjyqtarja Merkaj theksoi se t\u00eb gjitha veprimet p\u00ebr huamarrjet ishin kryer me akte noteriale sipas legjislacionit t\u00eb at\u00ebhersh\u00ebm. \u201cVe\u00e7 faktit q\u00eb veprimet jan\u00eb kryer me akte noteriale, i kemi deklaruar edhe n\u00eb koh\u00eb reale dhe i kemi shlyer detyrimet nd\u00ebr vite. P\u00ebrputhet hetimi me dokumentet e administruara, ashtu si e thot\u00eb edhe vet\u00eb Komisioni\u201d, pohoi Merkaj.<\/p>\n<p>Merkaj mbajti t\u00eb nj\u00ebjtin q\u00ebndrim dhe pas pyetjeve t\u00eb Petkovi\u00e7 p\u00ebr qart\u00ebsimin e situat\u00ebs s\u00eb marrjes s\u00eb huas\u00eb. Ajo k\u00ebmb\u00ebnguli se kontrata e kredis\u00eb ka qen\u00eb e imponuar nga banka. \u201cKan\u00eb qen\u00eb punonj\u00ebs t\u00eb bank\u00ebs q\u00eb e mund\u00ebsuan huan\u00eb nga nj\u00eb klient tjet\u00ebr. Shuma \u00ebsht\u00eb dh\u00ebn\u00eb cash dhe ka qen\u00eb e pasqyruar n\u00eb deklarat\u00ebn noteriale t\u00eb koh\u00ebs kur \u00ebsht\u00eb kryer. Kontrata noteriale ka qen\u00eb garanci dhe siguri si p\u00ebr at\u00eb q\u00eb jepte huan\u00eb, ashtu dhe p\u00ebr at\u00eb q\u00eb e merrte\u201d, argumentoi Merkaj dhe sqaroi se e kishte kthyer huan\u00eb n\u00ebp\u00ebrmjet sistemit bankar n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb q\u00eb ishte rimbursuar kredia.<\/p>\n<p>Lidhur me balanc\u00ebn negative, Merkaj k\u00ebrkoi dhe gjat\u00eb seanc\u00ebs d\u00ebgjimore q\u00eb t\u00eb ulen shpenzimet e udh\u00ebitmeve t\u00eb bashk\u00ebshortit. Ajo pretendoi se kishte depozituar dokumente q\u00eb v\u00ebrtetonin se bashk\u00ebshorti kishte qen\u00eb p\u00ebr trajnime p\u00ebr shkak t\u00eb detyr\u00ebs. Sipas saj, edhe shuma 80 mij\u00eb lek\u00eb q\u00eb mbetej, mbulohej nga t\u00eb ardhurat e familjes.<\/p>\n<p>Merkaj ka rezultuar me mund\u00ebsi financiare p\u00ebr blerjen e nj\u00eb apartamenti tjet\u00ebr me sip\u00ebrfaqe 88.8 m2 n\u00eb Tiran\u00eb n\u00eb vitin 2011 p\u00ebr vler\u00ebn 5.3 milion\u00eb lek\u00eb, ku si burime krijimi kan\u00eb sh\u00ebrbyer nj\u00eb hua n\u00eb shum\u00ebn 5 milion\u00eb lek\u00eb pa afat dhe interes 6% e marr\u00eb prej bashk\u00ebshortit nga nj\u00eb mik i tij dhe pjes\u00ebn tjet\u00ebr nga t\u00eb ardhurat familjare.<\/p>\n<p>Nga hetimi i KPK ka rezultuar se huadh\u00ebn\u00ebsi ka zot\u00ebruar nd\u00ebr vite gjasht\u00eb shoq\u00ebri dhe se ka pasur mund\u00ebsi p\u00ebr dh\u00ebnien e shum\u00ebs 5 milion\u00eb lek\u00eb n\u00eb vitin 2011 bashk\u00ebshortit t\u00eb subjektit, si dhe t\u00eb nj\u00eb huaje tjet\u00ebr n\u00eb 2009-\u00ebn.<\/p>\n<p>Po ashtu, Merkaj dhe bashk\u00ebshorti kan\u00eb rezultuar se kan\u00eb pasur mund\u00ebsi p\u00ebr shlyerjen e huas\u00eb dhe t\u00eb interesave n\u00eb vitin 2012 me t\u00eb ardhurat e siguruara nga shitja e nj\u00eb apartamenti t\u00eb bler\u00eb n\u00eb vitin 2009.<\/p>\n<p>Si burime krijimi p\u00ebr apartamentin me sip\u00ebrfaqe 51.25 m2 t\u00eb bler\u00eb n\u00eb 2009-\u00ebn p\u00ebr \u00e7mimin 3.9 milion\u00eb lek\u00eb, subjekti ka deklaruar nj\u00eb hua nga v\u00ebllai n\u00eb shum\u00ebn 1.3 milion\u00eb lek\u00eb dhe pjes\u00ebn tjet\u00ebr nga A.P., nga i cili \u00ebsht\u00eb marr\u00eb dhe huaja tjet\u00ebr n\u00eb shum\u00ebn 5 milion\u00eb lek\u00eb n\u00eb vitin 2011. Nga hetimi ka rezultuar se t\u00eb dy huadh\u00ebn\u00ebsit kan\u00eb pasur mund\u00ebsi p\u00ebr dh\u00ebnien e shumave q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr krijimin e k\u00ebsaj pasurie q\u00eb \u00ebsht\u00eb shitur n\u00eb vitin 2012<\/p>\n<p>Ka rezultuar se Merkaj ka pasur burime p\u00ebr blerjen e nj\u00eb garsonere me sip\u00ebrfaqe 34 m2 n\u00eb Durr\u00ebs p\u00ebr shum\u00ebn 1.1 milion lek\u00eb, pasuri q\u00eb \u00ebsht\u00eb shitur n\u00eb 2009-\u00ebn kundrejt \u00e7mimit 2.4 milion\u00eb lek\u00eb dhe rezulton t\u00eb jet\u00eb paguar detyrimet tatimore.<\/p>\n<p>Bekteshi pohoi se sipas referencave s\u00eb Entit Komb\u00ebtar t\u00eb Banesave vlera e garsoneres ka qen\u00eb n\u00eb shum\u00ebn 2.7 milion\u00eb lek\u00eb.<\/p>\n<p>N\u00eb fund t\u00eb seanc\u00ebs d\u00ebgjimore Merkaj dha shpjegime lidhur me disa t\u00eb ardhura t\u00eb deklaruara si t\u00eb p\u00ebrfituara nga dh\u00ebnia me qira e nj\u00eb apartamenti. P\u00ebr mospages\u00ebn n\u00eb koh\u00eb t\u00eb detyrimeve tatimore, ajo pretendoi se legjislacioni parashikon se duhet ti shlyente qiramarr\u00ebsi, ashtu si ishte dakord\u00ebsuar dhe n\u00eb kontrat\u00eb. Duke ju referuar legjislacionit t\u00eb vetingut q\u00eb p\u00ebrcakton se burimet e ligjshme jan\u00eb vet\u00ebm ato t\u00eb ardhura p\u00ebr t\u00eb cilat jan\u00eb paguar detyrimet tatimore, Merkaj tha se kishte b\u00ebr\u00eb vet\u00eb pages\u00ebn e tatimeve sapo kishte m\u00ebsuar se qiramarr\u00ebsit nuk e kishin kryer.<\/p>\n<p>Po ashtu, Merkaj dha shpjegime p\u00ebr disa \u00e7\u00ebshtje t\u00eb denoncuara nga publiku, p\u00ebr t\u00eb cilat argumentoi se vendimarrjet e saj ishin l\u00ebn\u00eb m\u00eb s\u00eb shumti n\u00eb fuqi nga apeli apo Gjykata e Lart\u00eb. P\u00ebr nj\u00eb rast kur ishte ndryshuar vendimi, subjekti sqaroi se n\u00eb gjykimin e kryer prej saj nuk ishin depozituar provat q\u00eb ishin d\u00ebrguar n\u00eb apel.<\/p>\n<p>Gjyqtarja Tereza Merkaj fal\u00ebnderoi Komisionin p\u00ebr objektivitetin dhe k\u00ebrkoi konfirmimin n\u00eb detyr\u00eb.
