Ai u p\u00ebrfaq\u00ebsua s\u00ebrish nga avokati <a href=\"https:\/\/www.linkedin.com\/in\/gedeon-dudushi-37384ab\/?originalSubdomain=al\">Gedeon Dudushi<\/a> i cili dha shpjegime dhe kund\u00ebrshtoi barr\u00ebn e prov\u00ebs q\u00eb Komisioni i ka kaluar gjyqtarit Ndoka p\u00ebr pasurin\u00eb, kriterin e vet\u00ebm p\u00ebr t\u00eb cilin \u00ebsht\u00eb p\u00ebrfunduar hetimi administrativ.<\/p>\n<p>N\u00eb seanc\u00ebn parardh\u00ebse t\u00eb premten m\u00eb 19 n\u00ebntor, avokati Dudushi paraqiti dy k\u00ebrkesa t\u00eb nj\u00ebpasnj\u00ebshme q\u00eb soll\u00ebn shtyrjen e seanc\u00ebs. Ai k\u00ebrkoi ri\u00e7eljen e hetimit p\u00ebr pasurin\u00eb, figur\u00ebn dhe profesionalizmin, si dhe p\u00ebrjashtimin e trupit gjykues.<\/p>\n<p>Kryesuesja Sanxhaktari njoftoi n\u00eb fillim t\u00eb seanc\u00ebs t\u00eb h\u00ebn\u00ebn se ishte rr\u00ebzuar nj\u00eb k\u00ebrkes\u00eb e re p\u00ebr shtyrjen e seanc\u00ebs d\u00ebgjimore dhe relatorja Xhensila Pine vijoi me paraqitjen e rezulteteve t\u00eb hetimit administrativ p\u00ebr Ndok\u00ebn.<\/p>\n<p>Komisioni ngre dyshime se gjyqtari i lezh\u00ebs Jak Ndoka ka deformuar t\u00eb v\u00ebrtet\u00ebn n\u00ebp\u00ebrmjet disa transaksioneve n\u00eb shitjen e nj\u00eb apartamenti t\u00eb vjet\u00ebr n\u00eb Lezh\u00eb me q\u00ebllim justifikimin e burimeve financiare p\u00ebr blerjen e disa pasurive t\u00eb tjera n\u00eb k\u00ebt\u00eb rreth.<\/p>\n<p>E dyshimt\u00eb u cil\u00ebsua edhe bashk\u00ebpron\u00ebsia e v\u00ebllait n\u00eb nj\u00eb apartament n\u00eb Tiran\u00eb q\u00eb p\u00ebrdoret vet\u00ebm prej subjektit, si dhe u konstatua pamund\u00ebsi financiare n\u00eb krijimin e pasurive.<\/p>\n<p>Jak Ndoka e ka nisur karrier\u00ebn n\u00eb sistemin shqiptar t\u00eb drejt\u00ebsis\u00eb n\u00eb vitin 1995. Prej gati dy dekadash, ai ka punuar kryetar dhe gjyqtar i Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Lezh\u00eb.<\/p>\n<p><strong>Transaksione me vlera t\u00eb pazakonta<\/strong><\/p>\n<p>Komisioni ngriti dyshime lidhur me t\u00eb ardhurat e deklaruara nga subjekti si t\u00eb p\u00ebrfituara nga shitja e nj\u00eb apartamenti me sip\u00ebrfaqe 68 m2 n\u00eb Lezh\u00eb n\u00eb vitin 2007, q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr krijimin e pasurive t\u00eb tjera.<\/p>\n<p>N\u00eb deklarat\u00ebn veting Ndoka ka sh\u00ebnuar se k\u00ebt\u00eb apartament e ka bler\u0451 nga Enti i Banesave n\u00eb vitin 2001 p\u00ebr shum\u00ebn 557 mij\u00eb lek\u00eb, nd\u00ebrsa n\u00eb deklarat\u00ebn fillestare t\u00eb dor\u00ebzuar n\u00eb vitin 2004 ka deklaruar se vlera e apartamentit ishte rreth 1.2 milion\u00eb lek\u00eb.<\/p>\n<p>N\u00eb vitin 2007 Ndoka ka deklaruar shitjen e k\u00ebtij apartamenti n\u00eb shum\u00ebn 5.3 milion\u00eb lek\u00eb. N\u00eb seanc\u00eb u evidentua nga Komisioni dhe v\u00ebzhguesi nd\u00ebrkomb\u00ebtar <a href=\"https:\/\/eeas.europa.eu\/sites\/default\/files\/imo_-_bios_of_appointed_observers.pdf\">Theo Jacobs<\/a> se rezultonin kat\u00ebr kontrata t\u00eb ndryshme p\u00ebr shitjen e k\u00ebsaj pasurie, t\u00eb gjitha t\u00eb n\u00ebnshkruara n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb.<\/p>\n<p>Avokati Dudushi k\u00ebmb\u00ebnguli se thelbi i kontrat\u00ebs ishte i nj\u00ebjt\u00eb, pasi \u00e7mimi figuronte 5.3 milion\u00eb lek\u00eb, nd\u00ebrsa ndryshimet p\u00ebr m\u00ebnyr\u00eb e pages\u00ebs s\u00eb k\u00ebsteve kishin ndodhur n\u00eb funksion t\u00eb mund\u00ebsis\u00eb s\u00eb p\u00ebrfitimit t\u00eb nj\u00eb kredie nga ana e bler\u00ebsit.<\/p>\n<p>Megjithat\u00eb, Jacobs evidentoi se kontratat ishin ndryshuar n\u00eb nj\u00eb dit\u00eb dhe ngriti dyshime lidhur me ndryshimin \u00e7do or\u00eb t\u00eb m\u00ebnyr\u00ebs s\u00eb pages\u00ebs s\u00eb k\u00ebsteve nga bler\u00ebsi.<\/p>\n<p>N\u00eb nj\u00eb prej kat\u00ebr kontratave, n\u00eb at\u00eb t\u00eb p\u00ebrcjell\u00eb nga ZVRPP Lezh\u00eb, ka rezultuar se \u00e7mimi i shitjes ishte 3 milion\u00eb lek\u00eb. Nga hetimi ka rezultuar se tatimi mbi t\u00eb ardhurat p\u00ebr kalimin e t\u00eb drejt\u00ebs s\u00eb pron\u00ebsis\u00eb \u00ebsht\u00eb paguar p\u00ebr \u00e7mimin 3 milion\u00eb lek\u00eb. Gjithashtu, bler\u00ebsi L.M. ka depozituar n\u00eb llogarin\u00eb e subjektit n\u00eb maj t\u00eb vitit 2007 shum\u00ebn 3 milion\u00eb lek\u00eb.<\/p>\n<p>Pretendimet e Ndok\u00ebs p\u00ebr p\u00ebrfitimin e vler\u00ebs 5.3 milion\u00eb lek\u00eb jan\u00eb konsideruar prej KPK jo bind\u00ebse dhe n\u00eb kund\u00ebrshtim me logjik\u00ebn e ligjit<\/p>\n<p>N\u00eb deklarat\u00eb noteriale e vitit 2008 mes subjektit t\u00eb rivler\u00ebsimit dhe pal\u00ebs bler\u00ebse, deklarimi se \u00ebsht\u00eb likujduar k\u00ebsti i fundit n\u00eb shum\u00ebn 1.5 milion lek\u00eb p\u00ebr apartamentin 68 m2, \u00ebsht\u00eb konsideruar n\u00eb kund\u00ebrshtim me kontrat\u00ebn e lidhur nga pal\u00ebt n\u00eb vitin 2007 e cila \u00ebsht\u00eb d\u00ebrguar nga ASHK.<\/p>\n<p>\u201cGjithashtu n\u00eb vitin 2007 subjekti nuk ka deklaruar detyrime t\u00eb papaguara nga bler\u00ebsi, konkretisht n\u00eb vler\u00ebn 1.5 milion lek\u00eb nga shitja e apartamentit\u201d, v\u00ebrejti Pine dhe e cil\u00ebsoi t\u00eb pabesuesh\u00ebm k\u00ebt\u00eb deklarim n\u00eb raport me faktet.<\/p>\n<p>Komisioni vler\u00ebson se subjekti ka nd\u00ebrmarra veprime p\u00ebr t\u00eb paraqitur n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb t\u00eb ardhurat e p\u00ebrfituara nga shitja e k\u00ebsaj pasurie dhe ka p\u00ebrfshir\u00eb n\u00eb analiz\u00ebn financiare vet\u00ebm shum\u00ebn 3 milion\u00eb lek\u00eb p\u00ebr t\u00eb cil\u00ebn jan\u00eb paguar detyrimet tatimore.<\/p>\n<p>Sipas Pines, lidhja dhe n\u00ebnshkrimi i disa\u00a0 kontrateve me \u00e7mime t\u00eb ndryshme p\u00ebr t\u00eb nj\u00ebjt\u00ebn pasuri n\u00eb qytetin ku subjekti kryente funksionin e gjyqtarit dhe njihej si i till\u00eb p\u00ebrb\u00ebjn\u00eb zgjedhje t\u00eb cilat jo vet\u00ebm q\u00eb nuk sh\u00ebrbejn\u00eb n\u00eb krijimin e besimit t\u00eb publikut te drejt\u00ebsia, por edhe e d\u00ebmtojn\u00eb at\u00eb.<\/p>\n<p>Dudushi deklaroi se besimi i publikut mund t\u00eb vler\u00ebsohej bazuar n\u00eb m\u00ebnyr\u00ebn se si subjkti ka ushtruar detyr\u00ebn e gjyqtarit. \u201cDuhet vler\u00ebsuar n\u00ebse ka dh\u00ebn\u00eb drejt\u00ebsi\u201d, theksoi avokati dhe sqaroi se kjo kishte qen\u00eb arsyeja p\u00ebrse kishte k\u00ebrkuar \u00e7eljen e hetimit p\u00ebr profesionalizmin dhe figur\u00ebn.<\/p>\n<p>Sipas Dudushit, Ndoka nuk kishte qen\u00eb n\u00eb dijeni t\u00eb ndryshimit t\u00eb vler\u00ebs s\u00eb shitjes n\u00eb kontrat\u00ebn e dor\u00ebzuar n\u00eb zyr\u00ebn e regjistrimit. Ai solli n\u00eb v\u00ebmendje se p\u00ebr k\u00ebt\u00eb arsye subjekti kishte k\u00ebmb\u00ebngulur q\u00eb t\u00eb thirrej dhe t\u00eb pyetej bler\u00ebsi p\u00ebr \u00e7mimin e shitjes s\u00eb apartamentit.<\/p>\n<p>Dudushi pretendoi se pagesa e detyrimeve tatimore ishte kryer nga bler\u00ebsi. An\u00ebtari i Komisionit, Olsi Komici dhe kryesuesja Sanxhaktari konstatuan se ishte detyrim ligjor i pal\u00ebs shit\u00ebse t\u00eb kryente pages\u00ebn lidhur me t\u00eb ardhurat e p\u00ebrfituara nga shitja e sendit, nd\u00ebrsa avokati Dudushi dha se kishte qen\u00eb dakord\u00ebsi mes pal\u00ebve q\u00eb t\u2019i paguante pala bler\u00ebse.<\/p>\n<p>Sipas avokatit, subjekti ishte i gatsh\u00ebm q\u00eb t\u00eb hetohej ndryshimi i vler\u00ebs n\u00eb kontat\u00ebn q\u00eb gjendejh n\u00eb zyr\u00ebn e regjistrimit.<\/p>\n<p>Vlera 3 milion\u00eb lek\u00eb e pretenduar nga subjekti se \u00ebsht\u00eb p\u00ebrfituar si k\u00ebst i par\u00eb i shitjes s\u00eb apartamentit me sip\u00ebrfaqe 68 m2 \u00ebsht\u00eb deklaruar prej tij si burim p\u00ebr blerjen e nj\u00eb apartamenti tjet\u00ebr 108 m2 kundrejt \u00e7mimit 3.2 milion\u00eb lek\u00eb dhe t\u00eb nj\u00eb nj\u00ebsie 20 m2 p\u00ebr shum\u00ebn 600 mij\u00eb lek\u00eb, po n\u00eb vitin 2007. Nga analiza financiare ka rezultuar se Ndoka nuk ka pasur mund\u00ebsi financiare p\u00ebr shlyerjen e gjith\u00eb \u00e7mimit 3.8 milion\u00eb lek\u00eb p\u00ebr blerjen e dy pasurive n\u00eb vitin 2007 me shum\u00ebn 3 milion\u00eb lek\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb, Komisioni konstaton se k\u00ebto pasuri jan\u00eb bler\u00eb n\u00eb vler\u00eb disa her\u00eb m\u00eb t\u00eb vog\u00ebl nga ajo sipas \u00e7mimit t\u00eb referenc\u00ebs s\u00eb EKB-s\u00eb, por subjekti nuk e ka deklaruar \u00e7mimin preferencial.<\/p>\n<p>Po ashtu, KPK v\u00ebren se Ndoka nuk ka v\u00ebrtetuar si burim t\u00eb ligjsh\u00ebm t\u00eb ardhurat e pretenduara si t\u00eb p\u00ebrfituara nga dh\u00ebnia me qira e nj\u00ebsis\u00eb s\u00eb sh\u00ebrbimit, pasi nuk ka rezultuar t\u00eb jet\u00eb paguar detyrimet tatimore mbi t\u00eb ardhurat.<\/p>\n<p>Pine konstatoi se Ndoka ka kryer deklarim t\u00eb pasakt\u00eb p\u00ebr burimin e apartamentit 108 m2 dhe nj\u00ebsis\u00eb 20 m2 dhe sqaroi se rrethanat faktike t\u00eb evidentuara nga hetimi e b\u00ebjn\u00eb t\u00eb pamundur qart\u00ebsimin e t\u00eb v\u00ebrtet\u00ebs p\u00ebr krijimin e tyre.<\/p>\n<p>\u201cDuket se ka p\u00ebrpjekje te subjektit t\u00eb rivler\u00ebsimit p\u00ebr t\u00eb deformuar t\u00eb v\u00ebrtet\u00ebn n\u00eb funksion t\u00eb paraqitjes t\u00eb t\u00eb dh\u00ebnave q\u00eb lidheshin me justifikimin e burimeve t\u00eb k\u00ebsaj pasurie apo dhe me p\u00ebrfitimin e t\u00eb ardhurave prej k\u00ebsaj pasurie\u201d, u shpreh Pine.<\/p>\n<p>Ndoka ka deklaruar se me t\u00eb ardhurat e p\u00ebrfituara nga k\u00ebsti i dyt\u00eb i apartamentit 68 m2, ka bler\u00eb nj\u00eb banes\u00eb tjet\u00ebr n\u00eb Sh\u00ebngjin me sip\u00ebrfaqe 87.4 m2 n\u00eb vitin 2010, kundrejt \u00e7mimit 2.6 milion\u00eb lek\u00eb. Pasi k\u00ebsti i dyt\u00eb i petenduar nuk \u00ebsht\u00eb konsideruar n\u00eb analiz\u00ebn financiare, ka rezultuar pamund\u00ebsi p\u00ebr blerjen e apartamentit n\u00eb Sh\u00ebngjin.<\/p>\n<p>Nisur nga nj\u00eb deklarim i vitit 2008 ku Ndoka ka sqaruar se apartamentin n\u00eb Sh\u00ebngjin do ta blinte n\u00eb shum\u00ebn 2.4 milion\u00eb lek\u00eb, Komisioni konstaton mosp\u00ebrputhje lidhur me \u00e7mimin e blerjes. Megjith\u00ebse subjekti ka pretenduar se \u00e7mimi p\u00ebrfundimtar ka qen\u00eb 2.6 milion\u00eb lek\u00eb p\u00ebr shkak t\u00eb disa punimeve t\u00eb kryera nga shoq\u00ebria, KPK i vler\u00ebson deklarimet e Ndok\u00ebs t\u00eb paprovuara nga ansj\u00eb dokumentacion ligjor.<\/p>\n<p>Edhe n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb v\u00ebrtejtur se pasuria \u00ebsht\u00eb bler\u00eb sa gjysma e \u00e7mimit t\u00eb tregut, por nga subjekti nuk \u00ebsht\u00eb deklaruar trajtim preferencial.<\/p>\n<p>Komisioni ngre dyshime lidhur me transaksionet e subjektit me pasurit\u00eb n\u00eb rrethin e Lezh\u00ebs, sipas t\u00eb cilave ai pretendon se shiti nj\u00eb apartament t\u00eb vjet\u00ebr me sip\u00ebrfaqe 68 m2 t\u00eb p\u00ebrfituar me privatizim p\u00ebr \u00e7mimin 5.3 milion\u00eb lek\u00eb dhe bleu apartament banimi me sip\u00ebrfaqe 108 m2 dhe nj\u00ebsi tregtimi me siperfaqe 20 m2 me vler\u00eb totale 3.8 milion\u00eb lek\u00eb, si dhe nj\u00eb apartament tjet\u00ebr n\u00eb Lezh\u00eb 2.6 milion\u00eb lek\u00eb.<\/p>\n<p>\u201cTransaksione me vlera t\u00eb pazakonta, t\u00eb cilat nuk\u00a0 mb\u00ebshteten\u00a0 duksh\u00ebm n\u00eb llogjik\u00ebn ekonomike\u201d, theksoi Pine dhe vijoi se k\u00ebto transaksione duket se jan\u00eb kryer prej subjektit vet\u00ebm p\u00ebr t\u00eb justifikuar t\u00eb ardhurat p\u00ebr blerjen e pasurive t\u00eb tij.<\/p>\n<p>Avokati Dudushi i kund\u00ebrshtoi konstatimet p\u00ebr trajtim preferencial n\u00eb blerjen e pasurive duke pretenduar se Ndoka kishte dor\u00ebzuar kontrata t\u00eb tjera p\u00ebr shitjen e apartamenteve me t\u00eb nj\u00ebjtin \u00e7mim p\u00ebr m2.<\/p>\n<p>Probleme jan\u00eb gjetur edhe n\u00eb blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 103 m2 n\u00eb Tiran\u00eb n\u00eb vitin 2012 kundrejt \u00e7mimit 60 mij\u00eb euro. Ndoka ka deklaruar se e ka bler\u00eb s\u00eb bashku me v\u00ebllan\u00eb e tij k\u00ebt\u00eb pasuri, duke paguar vet\u00eb 15 mij\u00eb euro. Ai ka pretenduar si burim t\u00eb k\u00ebsaj shume kursimet gjat\u00eb periudh\u00ebs 2009-2012, por nga analiza financiare ka rezultuar n\u00eb pamund\u00ebsi.<\/p>\n<p>Si burim p\u00ebr vler\u00ebn 45 mij\u00eb euro t\u00eb paguar nga v\u00ebllai, ka deklaruar t\u00eb ardhurat e k\u00ebtij t\u00eb fundit nga puna n\u00eb Greqi q\u00eb prej vitit 1992 e n\u00eb vijim, si dhe nga bashk\u00ebshortja greke. Pasi subjekti ka dor\u00ebzuar dokumentacion p\u00ebr t\u00eb ardhurat e v\u00ebllait, KPK ka hetuar mbi mund\u00ebsin\u00eb p\u00ebr pages\u00ebn 45 mij\u00eb euro.<\/p>\n<p>Nga hetimi ka rezultuar se v\u00ebllai i Ndok\u00ebs ka porositur nj\u00eb tjet\u00ebr apartament n\u00eb vitin 2010 n\u00eb Sh\u00ebngjin kundrejt shum\u00ebs 22 mij\u00eb euro q\u00eb duhej t\u00eb paguhej me dy k\u00ebste deri n\u00eb 2011-\u00ebn. Pine pohoi se ve\u00e7 faktit se v\u00ebllai i subjektit ka bler\u00eb nj\u00eb tjet\u00ebr pasuri n\u00eb k\u00ebt\u00eb periudh\u00eb, dokumentet mbi t\u00eb ardhurat n\u00eb Greqi jan\u00eb t\u00eb paqarta.<\/p>\n<p>Komisioni konstaton se kontrata e furnizimit me uj\u00eb rezulton n\u00eb em\u00ebr t\u00eb subjektit t\u00eb rivler\u00ebsimit dhe se kjo pasuri \u00ebsht\u00eb p\u00ebrdorur vet\u00ebm prej familjes s\u00eb tij dhe jo nga v\u00ebllai.<\/p>\n<p>\u201cSubjekti\u00a0 ka deklaruar p\u00ebrdorimin e\u00a0 k\u00ebtij\u00a0 apartamenti q\u00eb nga viti 2012 pa nd\u00ebrprerje nga momenti i blerjes\u201d, pohoi Pine dh theksoi se bashk\u00ebpronari i deklaruar nuk provohet se ka jetuar n\u00eb k\u00ebt\u00eb banes\u00eb.<\/p>\n<p>Shpjegimet e subjektit se v\u00ebllai i tij nuk disponon asnj\u00eb pasuri tjet\u00ebr n\u00eb Greqi apo n\u00eb Shqip\u00ebri jan\u00eb gjetur n\u00eb kund\u00ebrshtim me provat e administruara, pasi ka rezultuar blerja e apartamentit n\u00eb Sh\u00ebngjin.<\/p>\n<p>\u201cNuk krijohet\u00a0 bindja se v\u00ebllai \u00ebsht\u00eb bashk\u00ebpronar de facto i nj\u00eb pjese t\u00eb k\u00ebtij apartamenti\u201d, tha Pine.<\/p>\n<p>Dudushi i kund\u00ebrshtoi konstatimet e KPK.
