N\u00eb vitin 2008 ai \u00ebsht\u00eb transferuar p\u00ebr t\u00eb kryer funksionin n\u00eb Prokurorin\u00eb e Lushnj\u00ebs.<\/p>\n<p>Nga dokumentacioni i administruar n\u00eb dosjen e\u00a0Inspektoratit t\u00eb Lart\u00eb t\u00eb Deklarimit dhe Kontrollit t\u00eb Pasurive dhe Konfliktit t\u00eb Interesave,\u00a0ILDKPKI-s\u00eb ka rezultuar se n\u00eb dhjetor t\u00eb vitit 2016\u00a0prokurori Dyla i ka dh\u00ebn\u00eb hua nd\u00ebrtuesit A.K. vler\u00ebn 50 mij\u00eb euro, me afat 5-vje\u00e7ar dhe me interes mujor 2% mbi kapitalin, q\u00eb n\u00eb fund p\u00ebrllogaritej t\u00eb arrinte n\u00eb shum\u00ebn 60 mij\u00eb euro. N\u00eb kontrat\u00eb \u00ebsht\u00eb parashikuar se shlyerja e kapitalit t\u00eb investuar dhe e interesave t\u00eb huas\u00eb q\u00eb n\u00eb total arrijn\u00eb shum\u00ebn 110 mij\u00eb euro, do t\u00eb kryhej m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme pas pes\u00eb viteve.\u00a0\u00a0N\u00eb vendim thuhet se veprimet jan\u00eb kryer jasht\u00eb sistemit bankar.<\/p>\n<p>I pyetur nga Komisioni lidhur me k\u00ebt\u00eb marrdh\u00ebnie financiare, subjekti ka sqaruar se shtetasin A. K. e ka njohur fillimisht si bashk\u00ebqytetar nga Kavaja dhe m\u00eb pas si biznesmen t\u00eb suksessh\u00ebm. Dyla ka deklaruar se huaja me k\u00ebt\u00eb interes i \u00ebsht\u00eb dh\u00ebn\u00eb biznesmenit A. K. me k\u00ebrkes\u00ebn e k\u00ebtij t\u00eb fundit, pasi i kishte llogarit\u00eb bankare t\u00eb bllokuara.<\/p>\n<p>Sipas Dyl\u00ebs, i ndodhur n\u00eb k\u00ebto kushte A.K. nuk mund t\u00eb merrte kredi dhe se kishte qen\u00eb pik\u00ebrisht interesi i lart\u00eb q\u00eb ai kishte ofruar, q\u00eb e kishin joshur p\u00ebr t\u2019i besuar k\u00ebtij shtetasi gjith\u00eb \u201ckursimet e jet\u00ebs\u201d. Subjekti ka shtuar se huamarr\u00ebsi kishte garantuar se pas pes\u00eb viteve ai do t\u00eb kishte p\u00ebrfunduar me sukses proceset gjyq\u00ebsore me shoq\u00ebrin\u00eb italiane \u201cS. C.\u201d s.p.a., nga do t\u00eb p\u00ebrfitonte n\u00eb total vler\u00ebn 20 milion\u00eb euro dhe se shuma 110 mij\u00eb euro do t\u00eb ishte e pap\u00ebrfillshme.<\/p>\n<p>Dyla ka deklaruar se huaja q\u00eb ai i kishte dh\u00ebn\u00eb shtetasit A.K. do t\u00eb p\u00ebrdorej me q\u00ebllim p\u00ebr t\u00eb siguruar vazhdimin e aktivitetit tregtar t\u00eb dy shoq\u00ebrive t\u00eb tij; p\u00ebrballimin e shpenzimeve gjyq\u00ebsore n\u00eb gjyqin me shoq\u00ebrin\u00eb \u201cS. C.\u201d s.p.a.; si dhe shlyerjen e detyrimeve ndaj disa subjekteve tregtare me q\u00ebllim p\u00ebr t\u00eb hequr sekuestrot bankare t\u00eb llogarive t\u00eb tij.<\/p>\n<p>Megjith\u00ebse subjekti ka dor\u00ebzuar dokumentacion p\u00ebr t\u00eb provuar pretendimet e tij, Komisioni konstaton se nuk \u00ebsht\u00eb arritur t\u00eb v\u00ebrtetohet destinacioni i p\u00ebrdorimit t\u00eb shum\u00ebs s\u00eb marr\u00eb hua prej 50 mij\u00eb euro p\u00ebr vazhdimin e aktivitetit nga A.K., apo p\u00ebr mbulimin e shpenzimeve t\u00eb tij gjyq\u00ebsore. Nd\u00ebrkoh\u00eb, Dyla ka arritur t\u00eb provoj\u00eb\u00a0pamund\u00ebsin\u00eb e shtetasit A. K. p\u00ebr marrjen e kredive n\u00eb sistemin bankar pasi llogarit\u00eb e tij kan\u00eb rezultuar t\u00eb bllokuara.<\/p>\n<p>Si garanci p\u00ebr shum\u00ebn e dh\u00ebn\u00eb hua, A.K. ka vendosur nj\u00eb apartament me sip\u00ebrfaqe 150 m2 n\u00eb Kavaj\u00eb q\u00eb e kishte porositur tek nj\u00eb shoq\u00ebri nd\u00ebrtuese s\u00eb bashku me disa pasuri t\u00eb tjera p\u00ebr vler\u00ebn totale 500 mij\u00eb euro.<\/p>\n<p>N\u00eb kontrat\u00ebn e huas\u00eb \u00ebsht\u00eb p\u00ebrcaktuar nd\u00ebr t\u00eb tjera se n\u00eb rast t\u00eb mosshlyerjes s\u00eb shum\u00ebs s\u00eb dh\u00ebn\u00eb, huamarr\u00ebsi p\u00ebrve\u00e7 pasuris\u00eb s\u00eb l\u00ebn\u00eb si garanci mund t\u2019i paraqes\u00eb huadh\u00ebn\u00ebsit edhe pasuri t\u00eb tjera t\u00eb paluajtshme q\u00eb ai disponon, me q\u00ebllim shlyerjen e huas dhe interesave.<\/p>\n<p>Referuar k\u00ebsaj kontrate, Komisioni v\u00ebren se \u00ebsht\u00eb p\u00ebrcaktuar q\u00eb apartamenti t\u00eb dor\u00ebzohej prej huamarr\u00ebsit vet\u00ebm n\u00eb rastin kur nuk do t\u00eb shlyhej shuma 110 mij\u00eb euro pas pes\u00eb viteve. Nd\u00ebrkoh\u00eb, Dyla e ka deklaruar k\u00ebt\u00eb pasuri si adres\u00eb banimi q\u00eb n\u00eb vitin 2016.\u00a0\u201c[\u2026]pra, ka banuar n\u00eb k\u00ebt\u00eb pasuri menj\u00ebher\u00eb me lidhjen e kontrat\u00ebs s\u00eb huas, [\u2026] dhe se nuk ka kryer asnj\u00eb shpenzim mobilimi, pasi apartamenti ka qen\u00eb i pajisur me mobilje, p\u00ebr shkak se m\u00eb par\u00eb ka banuar familja e shtetasit A. K.\u201d, sqarohet n\u00eb vendim.<\/p>\n<p>I pyetur nga Komisioni lidhur me k\u00ebt\u00eb fakt, Dyla ka sqaruar se A.K. e kishte l\u00ebn\u00eb apartamentin n\u00eb p\u00ebrdorim pasi nuk do t\u00eb paguhej interesi \u00e7do muaj. Ai ka pretenduar se n\u00eb kontrat\u00eb nuk p\u00ebrcaktohet q\u00eb n\u00eb rast t\u00eb moshlyerjes s\u00eb huas\u00eb do t\u00eb merrej n\u00eb dor\u00ebzim apartamenti 150 m2, por se ishte parashikuar q\u00eb huamarr\u00ebsi mund t\u00eb paraqiste edhe pasuri t\u00eb tjera me q\u00ebllim shlyerjen e huas\u00eb.<\/p>\n<p>\u201c[&#8230;]Interesi im prioritar, si n\u00eb koh\u00ebn e n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb huas me z. A. K., por edhe aktualisht \u00ebsht\u00eb t\u00eb siguroj\u00eb nj\u00eb banes\u00eb p\u00ebr familjen time\u201d, \u00ebsht\u00eb shprehur Dyla gjat\u00eb procesit t\u00eb vetingut, por ky deklarim ka forcuar dyshimet e\u00a0trupit gjykues se q\u00ebllimi i subjektit ka qen\u00eb p\u00ebrfitimi i apartamentit dhe ka n\u00ebnshkruar kontrat\u00eb fiktive.<\/p>\n<p>Megjith\u00ebse Dyla ka pretenduar se mes tij dhe huamarr\u00ebsit ka pasur nj\u00eb marr\u00ebveshje paraprake verbale p\u00ebr dor\u00ebzimin e apartamentit q\u00eb n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs s\u00eb huas, trupi gjykues e konsideron k\u00ebt\u00eb deklarim n\u00eb kund\u00ebrshtim me parashikimet e kontrat\u00ebs ku \u00ebsht\u00eb p\u00ebrcaktuar se pasuria do t\u00eb dor\u00ebzohej n\u00eb rast t\u00eb moshlyerjes s\u00eb huas\u00eb.<\/p>\n<p>\u201c[\u2026]N\u00eb dhjetor t\u00eb vitit 2016, subjekti i rivler\u00ebsimit ka nisur t\u00eb banoj\u00eb n\u00eb apartamentin e l\u00ebn\u00eb si garanci, \u00e7ka b\u00ebn q\u00eb ky apartament ta humbas\u00eb kuptimin e garancis\u00eb t\u00eb rregulluar nga dispozitat p\u00ebrkat\u00ebse[\u2026]\u201d, konstaton KPK.<\/p>\n<p>\u201c[\u2026]Sjellja e subjektit si nj\u00eb institucion financiar, duke pranuar me vullnetin e tij nj\u00eb interes huaje q\u00eb kap\u00ebrcen \u00e7do limit t\u00eb lejuar dhe tej arsyes dhe logjik\u00ebs ekonomike, e nd\u00ebrthurur me elemente faktike t\u00eb ekzistenc\u00ebs s\u00eb nj\u00eb marr\u00ebdh\u00ebnieje q\u00eb nuk ka pasur si q\u00ebllim dh\u00ebnien e huas, por p\u00ebrfitimin e pasuris\u00eb apartament banimi, vler\u00ebsohet nga Komisioni n\u00eb disfavor t\u00eb tij\u201d, arsyeton KPK.<\/p>\n<p>Nd\u00ebrkoh\u00eb, nisur nga fakti se apartamenti ishte i pa regjistruar, trupi gjykues vler\u00ebson se subjekti nuk ka pasur ndonj\u00eb garanci reale. Gjithashtu, Komisioni konstaton se Dyla duke bllokuar krusimet e jet\u00ebs t\u00eb pretenduara prej tij p\u00ebr 5 vjet ka humbur mund\u00ebsin\u00eb p\u00ebr t\u00eb bler\u00eb banes\u00eb tjet\u00ebr. Bazuar n\u00eb k\u00ebto gjetje, trupi gjykues dhe \u00e7mon se kontrata e huas duket t\u00eb jet\u00eb nj\u00eb veprim juridik fiktiv.<\/p>\n<p>Megjith\u00ebse n\u00eb analiz\u00ebn paraprake Komisioni ka konsideruar se Dyla e ka paguar gjith\u00eb vler\u00ebn 110 mij\u00eb euro p\u00ebr apartamentin n\u00eb vitin 2016, n\u00eb analiz\u00ebn p\u00ebrfundimtare \u00ebsht\u00eb p\u00ebrfshir\u00eb si shpenzim vet\u00ebm huaja 50 mij\u00eb euro, pasi nuk \u00ebsht\u00eb provuar dh\u00ebnia e pjes\u00ebs tjet\u00ebr 60 mij\u00eb euro. Pavar\u00ebsisht zbritjes s\u00eb vler\u00ebs 60 mij\u00eb euro, Dyla ka rezultuar n\u00eb pamund\u00ebsi finaciare edhe p\u00ebr krijimin e shum\u00ebs 50 mij\u00eb euro t\u00eb dh\u00ebn\u00eb hua.<\/p>\n<p>Komisioni konstaton se gjendja cash e deklaruar \u00e7do vit nga subjekti nuk p\u00ebrputhet me vler\u00ebn 50 mij\u00eb euro t\u00eb pretenduar gjat\u00eb procesit t\u00eb rivler\u00ebsimit se p\u00ebrb\u00ebn\u00eb shum\u00ebn e dh\u00ebn\u00eb hua.<\/p>\n<p>Dyla ka pretenduar se ai ka deklaruar \u00e7do vit shtesat e gjendjes cash egzistuese pasi ashtu e ka kuptuar ligjin dhe ka k\u00ebmb\u00ebngulur se e ka zot\u00ebruar vler\u00ebn 50 mij\u00eb euro n\u00eb fund t\u00eb vitit 2016. Nd\u00ebrsa p\u00ebr mosdeklarimin e paks\u00ebsimit t\u00eb gjendjes cash p\u00ebr shkak t\u00eb dh\u00ebnies s\u00eb huas\u00eb, ai e ka pranuar pasakt\u00ebsin\u00eb.
