Ai ushtron funksionin e prokurorit n\u00eb Prokurorin\u00eb e Vlor\u00ebs p\u00ebr gati dy dekada.<\/p>\n<p><strong>\u201cFabrikim\u201d aktesh p\u00ebr justifikimin e burimeve<\/strong><\/p>\n<p>Dy an\u00ebtaret n\u00eb shumic\u00eb, Sanxhaktari dhe Pine konkludojn\u00eb se prokurori Marku ka fabrikuar dokumente me q\u00ebllim justifikimin e burimeve financiare q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr krijimin e pasurive t\u00eb m\u00ebvonshme.<\/p>\n<p>Sipas vendimit t\u00eb KPK, p\u00ebrpjekjet e subjektit p\u00ebr t\u00eb deformuar t\u00eb v\u00ebrtet\u00ebn kan\u00eb filluar me justifikimin e burimeve q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 103.07 m2 n\u00eb Vlor\u00eb, pasuri e prenotuar n\u00eb vitin 2005, kur ka paguar 3 milion\u00eb lek\u00eb nga 4 milion\u00eb q\u00eb ishte \u00e7mimi total. Marku ka deklaruar se ka kryer punime dhe ka pasur ulje t\u00eb \u00e7mimit, por sipas KPK ky pretendim nuk \u00ebsht\u00eb v\u00ebrtetuar me dokumentacion.<\/p>\n<p>Shumica vler\u00ebson se Marku nuk ka provuar burimin e ligjsh\u00ebm p\u00ebr gjith\u00eb vler\u00ebn e investuar p\u00ebr apartamentin, si dhe \u00ebsht\u00eb p\u00ebrpjekur p\u00ebr t\u00eb deformuar t\u00eb v\u00ebrtet\u00ebn n\u00eb funksion t\u00eb paraqitjes t\u00eb t\u00eb dh\u00ebnave q\u00eb lidheshin me justifikimin e burimeve t\u00eb k\u00ebsaj pasurie.<\/p>\n<p>\u00c7mimi i shitjes s\u00eb k\u00ebtij apartamenti n\u00eb vitin 2013 \u00ebsht\u00eb deklaruar nga prokurori Marku si burim p\u00ebr krijimin e pasurive t\u00eb m\u00ebvonshme. Ai ka deklaruar se ka n\u00ebnshkruar nj\u00eb kontrat\u00eb kapari n\u00eb vitin 2013 m\u00eb shtetasin A.D. ku parashikohej q\u00eb \u00e7mimi i shitjes 45 mij\u00eb euro t\u00eb likujdohej brenda vitit 2015.<\/p>\n<p>Gjithashtu, n\u00eb k\u00ebt\u00eb kontrat\u00eb \u00ebsht\u00eb p\u00ebrcaktuar se n\u00eb gusht t\u00eb vitit 2014 do t\u00eb dor\u00ebzohej nga pala shit\u00ebse apartamenti n\u00eb p\u00ebrdorim t\u00eb pal\u00ebs bler\u00ebse, si dhe fakti se A.D. mund t\u00eb b\u00ebhej pronar vet\u00ebm me n\u00ebnshkrimin e kontrat\u00ebs s\u00eb shitblerjes.<\/p>\n<p>Komisioni konstaton mosp\u00ebrputhje t\u00eb deklarimeve t\u00eb subjektit lidhur me arsyet e moskalimit t\u00eb pron\u00ebsis\u00eb n\u00eb em\u00ebr t\u00eb bler\u00ebsit sipas p\u00ebrcaktimeve n\u00eb kontrat\u00ebn e kaparit. Megjith\u00ebse Marku ka pretenduar se bler\u00ebsi ishte emigrant dhe jetonte jasht\u00eb shtetit, nga sistemi TIMS ka rezultuar se ai kishte hyr\u00eb n\u00eb territorin e Shqip\u00ebris\u00eb 8 her\u00eb n\u00eb vitet 2014, 2015 dhe 2016 dhe kishte q\u00ebndruar nga disa dit\u00eb deri n\u00eb dy jav\u00eb.<\/p>\n<p>Nga hetimi ka rezultuar se kjo pasuri figuronte ende n\u00eb pron\u00ebsin\u00eb e subjektit t\u00eb rivler\u00ebsimit n\u00eb momentin e procesit t\u00eb deklarat\u00ebs veting dhe se shitja \u00ebsht\u00eb realizuar m\u00eb 28 dhjetor 2017. Gjithashtu, bler\u00ebsi ka n\u00ebnshkruar nj\u00eb deklarat\u00eb noteriale m\u00eb 26 janar 2017, ku shprehej se i kishte shlyer Markut t\u00eb gjith\u00eb vler\u00ebn 45 mij\u00eb euro. Por, nga verifikimi i sistmit TIMS ka rezultuar se A.D. nuk \u00ebsht\u00eb ndodhur n\u00eb territorin e Shqip\u00ebris\u00eb kur ka n\u00ebnshkruar k\u00ebto kontrata.<\/p>\n<p>\u201c[\u2026]u gjet i pabesuesh\u00ebm shpjegimi q\u00eb subjekti i rivler\u00ebsimit ka b\u00ebr\u00eb, p\u00ebr sa i p\u00ebrket, arsyes s\u00eb mosq\u00ebnies prezent t\u00eb bler\u00ebsit n\u00eb kontrat\u00ebn e shitjes dhe nxitimit t\u00eb tij p\u00ebr t\u00eb b\u00ebr\u00eb k\u00ebt\u00eb kontrat\u00eb vet\u00ebm gjat\u00eb procesit t\u00eb deklarimit Vetting, referuar faktit se bler\u00ebsi kishte paguar gjith\u00eb vler\u00ebn e kishte hyr\u00eb e dal\u00eb n\u00eb Shqip\u00ebri rregullisht p\u00ebr disa vite\u201d, argumenton shumica.<\/p>\n<p>Sipas KPK bler\u00ebsi A.D. nuk ka qen\u00eb i pranish\u00ebm n\u00eb Shqip\u00ebri edhe kur \u00ebsht\u00eb l\u00ebshuar kartela e pasuris\u00eb s\u00eb paluajtshme n\u00eb em\u00ebr t\u00eb tij, n\u00eb shkurt t\u00eb 2017-\u00ebs. Shumica vler\u00ebson se subjekti ka hequr dor\u00eb formalisht nga pron\u00ebsia e apartamentit, pasi lidhi kontrat\u00ebn e shitblerjes kur bler\u00ebsi nuk ishte prezent n\u00eb Shqip\u00ebri, n\u00eb koh\u00ebn e plot\u00ebsimit t\u00eb deklarat\u00ebs veting.<\/p>\n<p>Sanxhaktari dhe Pine e konsiderojn\u00eb kontrat\u00ebn e kaparit dhe at\u00eb t\u00eb shitblerjes si p\u00ebrpjekje t\u00eb subjektit p\u00ebr t\u00eb fabrikuar akte q\u00eb do t\u00eb justifikonin p\u00ebrdorimin e likuiditeteve nga subjekti i rivler\u00ebsimit.<\/p>\n<p>\u201c\u00cbsht\u00eb me r\u00ebnd\u00ebsi t\u00eb theksohet se, referuar fakteve z. A. D., pranoi t\u00eb paguaj\u00eb shum\u00ebn 45.000 euro, e n\u00eb shk\u00ebmbim nuk mori as garanci ligjore se ky apartament do ti kalohej n\u00eb t\u00eb ardhmen[\u2026]\u201d, thekson shumica dhe v\u00ebren se z.A. D. ka qen\u00eb n\u00eb nj\u00eb disfavor t\u00eb qart\u00eb dhe n\u00eb mosp\u00ebrputhje me \u00e7do logjik\u00eb ekonomike.<\/p>\n<p>Gjithashtu, KPK konkludon se Marku nuk arriti t\u00eb provoj\u00eb burimin e ligjsh\u00ebm t\u00eb t\u00eb ardhurave t\u00eb pretenduara si t\u00eb p\u00ebrfituara nga kontrata e kaparit dhe nuk i ka p\u00ebrfshir\u00eb n\u00eb analiz\u00ebn financiare.<\/p>\n<p>Situat\u00eb e ngjashme \u00ebsht\u00eb konstatuar edhe n\u00eb transaksionet e nj\u00eb autoveture tip \u201cbenz, t\u00eb bler\u00eb n\u00eb vitin 2009 p\u00ebr shum\u00ebn 400 mij\u00eb lek\u00eb dhe t\u00eb shitur n\u00eb 2011-\u00ebn p\u00ebr 1 milion lek\u00eb.<\/p>\n<p>Pretendimet e subjektit se mjeti kishte pasur defekte dhe kishte shpenzuar p\u00ebr riparimet jan\u00eb gjetur n\u00eb kund\u00ebrshtim me provat e administruara, prej nga ka rezultuar se mjeti ishte bler\u00eb nga Marku n\u00eb gjendje t\u00eb mir\u00eb.<\/p>\n<p>Edhe n\u00eb k\u00ebt\u00eb rast KPK nuk i ka marr\u00eb n\u00eb konsiderat\u00eb t\u00eb ardhurat e fituara nga shitja e automjetit n\u00eb 2011-\u00ebn dhe \u00e7mon se subjekti me veprimet e tij n\u00eb k\u00ebto transaksione, ka c\u00ebnuar besimin e publikut te sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>T\u00eb ardhurat e p\u00ebrfituara nga shitja e apartamentit n\u00eb Vlor\u00eb dhe t\u00eb Benz-it jan\u00eb deklaruar nga Marku si burime p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 90 m2 n\u00eb Yzberisht, Tiran\u00eb n\u00eb vitin 2010 p\u00ebr \u00e7mimin 31 mij\u00eb e 815 euro dhe p\u00ebr blerjen e nj\u00eb apartamenti 94.65 m2 n\u00eb Vlor\u00eb n\u00eb 2014 kundrejt shum\u00ebs 30 mij\u00eb euro.<\/p>\n<p>Duke mos i konsideruar t\u00eb ardhurat e pretenduara nga shitja e apartamentit n\u00eb Vlor\u00eb n\u00eb 2013-\u00ebn dhe t\u00eb Benz-it n\u00eb vitin 2011, shumica konkludon se Marku \u00ebsht\u00eb gjendur n\u00eb kushtet e pamund\u00ebsi\u00eb financiare me burime t\u00eb ligjshme p\u00ebr t\u00eb bler\u00eb dy banesat e tjera n\u00eb Yzberisht dhe n\u00eb qytetin bregdetar.<\/p>\n<p>N\u00eb vitin 2015 Marku ka deklaruar shitjen e apartamentit n\u00eb Yzberisht p\u00ebr shum\u00ebn 35 mij\u00eb euro dhe blerjen e nj\u00eb apartamenti tjet\u00ebr n\u00eb Tiran\u00eb p\u00ebr shum\u00ebn 55 mij\u00eb euro. Si burime krijimi ka deklaruar 35 mij\u00eb euro t\u00eb p\u00ebrfituara nga shitja e apartamentit n\u00eb Yzberisht dhe 20 mij\u00eb euro nga shitja e apartamentit n\u00eb Vlor\u00eb, q\u00eb jan\u00eb konsideruar si burime jo t\u00eb ligjshme nga shumica e p\u00ebr pasoj\u00eb ka rezultuar n\u00eb pamund\u00ebsi edhe p\u00ebr blerjen e apartamentit t\u00eb dyt\u00eb n\u00eb Tiran\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb Komisioni vler\u00ebsoi se prokurori Marku ka fshehur nj\u00eb automjet tip \u201cVolkswagen golf\u201d n\u00eb em\u00ebr t\u00eb kunatit t\u00eb tij. Sipas KPK, megjith\u00ebse v\u00ebllai i bashk\u00ebshortes s\u00eb subjektit e ka bler\u00eb makin\u00ebn n\u00eb vitin 2014 kundrejt vler\u00ebs 6000 euro, rezulton t\u00eb mos e ket\u00eb p\u00ebrdorur asnj\u00ebher\u00eb vet\u00eb.<\/p>\n<p>\u201c[\u2026]g\u00ebzimi dhe p\u00ebrdorimi i tij jo prej pronarit por prej subjektit, jan\u00eb rrethana n\u00eb vler\u00ebsimin e trupit gjykues t\u00eb cilat tregojn\u00eb dhe demonstrojn\u00eb sjelljen si pronar t\u00eb subjektit t\u00eb rivler\u00ebsimit mbi k\u00ebt\u00eb automjet\u201d, argumenton shumica dhe arrin n\u00eb konkluzionin se ky automjet \u00ebsht\u00eb pasuri e fshehur e subjektit t\u00eb rivler\u00ebsimit.<\/p>\n<p><strong>Pakica p\u00ebr hetimin n\u00eb tre kriteret<\/strong><\/p>\n<p>An\u00ebtari Lulzim Hamitaj, vler\u00ebson se hetimi nuk duhej t\u00eb ishte mbyllur vet\u00ebm p\u00ebr pasurin\u00eb, pasi pas prap\u00ebsimeve t\u00eb subjektit nuk ishte arritur nivel i mjaftuesh\u00ebm provueshm\u00ebrie p\u00ebr t\u00eb p\u00ebrmbyllur vetingun e Markut p\u00ebr nj\u00eb kriter.<\/p>\n<p>\u201c[\u2026]do t\u00eb duhej t\u00eb ishte rihapur hetimi administrativ, jo vet\u00ebm p\u00ebr disa qart\u00ebsime m\u00eb t\u00eb thelluara lidhur me kriterin e pasuris\u00eb, por edhe n\u00eb lidhje me kriterin e figur\u00ebs dhe t\u00eb aft\u00ebsive profesionale, n\u00eb t\u00eb cilat mund t\u00eb konstatoheshin elemente q\u00eb do t\u00eb kristalizoheshin n\u00eb gjetje konkrete\u201d, vler\u00ebson Hamitaj.<\/p>\n<p>Ai paraqet nj\u00eb analiz\u00eb t\u00eb tij\u00ebn financiare p\u00ebr burimet e apartamentit t\u00eb porositur n\u00eb vitin 2005 n\u00eb Vlor\u00eb dhe ndryshe nga shumica e ka rrudhur balanc\u00ebn negative nga 2.2 milion\u00eb lek\u00eb, n\u00eb 1.2 milion\u00eb lek\u00eb. \u201c[\u2026]Par\u00eb edhe n\u00ebn drit\u00ebn e parimit t\u00eb proporcionalitetit, nuk mund t\u00eb p\u00ebrb\u00ebnte shkak p\u00ebr shkarkimin e subjektit t\u00eb rivler\u00ebsimit\u201d, shprehet Hamitaj p\u00ebr munges\u00ebn e burimeve t\u00eb ligjshme n\u00eb shum\u00ebn 1.2 milion\u00eb lek\u00eb.<\/p>\n<p>Komisioneri Hamitaj nuk \u00ebsht\u00eb dakord edhe me moskonsiderimin e t\u00eb ardhurave t\u00eb pretenduara nga subjekti si t\u00eb p\u00ebrfituara nga shitja e apartamentit n\u00eb Vlor\u00eb n\u00eb vitin 2013 dhe as me konkluzionin p\u00ebr c\u00ebnimin e besimit t\u00eb publikut.<\/p>\n<p>\u201c[\u2026]ndon\u00ebse titulli i kontrat\u00ebs \u00ebsht\u00eb sh\u00ebnuar \u2018kontrat\u00eb kapari\u2019, nga nj\u00eb analiz\u00eb e thjesht\u00eb e p\u00ebrmbajtjes s\u00eb saj bie ky p\u00ebrkufizim titullues, pasi aty \u00ebsht\u00eb parashikuar kryerja e disa pagesave me k\u00ebste, n\u00eb data t\u00eb ndryshme, sikurse ato edhe de facto jan\u00eb kryer midis pal\u00ebve me k\u00ebste, nd\u00ebrkoh\u00eb q\u00eb kontrata e kaparit ka krejt nj\u00eb tjet\u00ebr struktur\u00eb dhe q\u00ebllim\u201d, konstaton Hamitaj dhe vler\u00ebson se nuk mund t\u00eb konsiderohet si kontrat\u00eb kapari, por duhet t\u00eb kualifikohet n\u00eb baz\u00eb t\u00eb parashikimeve dhe efekteve q\u00eb ka prodhuar.<\/p>\n<p>Gjithashtu, Hamitaj v\u00ebren se kjo pasuri ka kaluar p\u00ebrfundimisht n\u00eb pron\u00ebsi t\u00eb A.D. si dhe ka rezultuar se e kishte pasur disponobilitetin e apartamentit q\u00eb prej vitit 2014, pasi konsumi i energjis\u00eb elektrike rezultonte n\u00eb periudhat kur ai kishte ardhur n\u00eb Shqip\u00ebri.<\/p>\n<p>Hamitaj i jep t\u00eb drejt\u00eb Markut edhe lidhur me pretendimin se nuk ka pasur lidhje me n\u00ebnshkrimin e kontrat\u00ebs noteriale t\u00eb shit-blerjes nga pala bler\u00ebse, nd\u00ebrkoh\u00eb q\u00eb nuk gjendej n\u00eb Shqip\u00ebri. \u201c[\u2026]ndon\u00ebse n\u00eb vetvete kjo rrethan\u00eb p\u00ebrb\u00ebn nj\u00eb problem lidhur me besueshm\u00ebrin\u00eb e datave t\u00eb akteve noteriale, por nuk mund t\u00eb passjell\u00eb pasoja direkte p\u00ebr subjektin, pasi nuk rezulton se ai t\u00eb ket\u00eb qen\u00eb n\u00eb dijeni t\u00eb mosprezenc\u00ebs s\u00eb pal\u00ebs tjet\u00ebr n\u00eb Shqip\u00ebri\u201d, argumenton Hamitaj.<\/p>\n<p>N\u00eb vijim ai i cil\u00ebson balanc\u00ebn negative q\u00eb sipas tij \u00ebsht\u00eb 1.2 milion\u00eb lek\u00eb dhe pasakt\u00ebsit\u00eb e deklarimeve pa pesh\u00eb specifike p\u00ebr t\u00eb konkluduar n\u00eb p\u00ebrfundimin e procesit me vendim p\u00ebrfundimtar vet\u00ebm mbi nj\u00eb kriter.<\/p>\n<p>Ai shton se pozicionimi i tij nuk ka t\u00eb b\u00ebj\u00eb me vendimin p\u00ebrfundimtar t\u00eb shkarkimit t\u00eb subjektit, por ai k\u00ebmb\u00ebngul q\u00eb kjo t\u00eb mund t\u00eb realizohej vet\u00ebm n\u00ebp\u00ebrmjet nj\u00eb vler\u00ebsimi m\u00eb t\u00eb gjer\u00eb dhe m\u00eb
