Foto: Vladimir Karaj.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Prokurori Isa Jata u konfirmua n\u00eb detyr\u00eb nga Komisioni i Pavarur i Kualifikimit m\u00eb 15 korrik, pasi pasakt\u00ebsit\u00eb n\u00eb deklarimet e pasuris\u00eb dhe balancat negative n\u00eb tre vite nuk u konsideruan penalizuese. N\u00eb vendimin e arsyetuar n\u00eb KPK-s\u00eb konkludohet se Jata nuk \u00ebsht\u00eb p\u00ebrpjekur t\u00eb fsheh\u00eb apo t\u00eb paraqes\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb pasurit\u00eb n\u00eb pron\u00ebsi, n\u00eb zot\u00ebrim ose n\u00eb p\u00ebrdorim t\u00eb tij. Gjithashtu, evidentohet se ai ka qen\u00eb bashk\u00ebpunues dhe i hapur gjat\u00eb hetimit administrativ, duke pranuar edhe pasakt\u00ebsit\u00eb n\u00eb deklarime. Nd\u00ebrkoh\u00eb, prokurori Jata mori vler\u00ebsim pozitiv p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs dhe profesionalizmin.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Isa Jata ka nj\u00eb karrier\u00eb t\u00eb gjat\u00eb n\u00eb sistemin e drejt\u00ebsis\u00eb, ku punon prej vitit 1994. P\u00ebr m\u00eb shum\u00eb se nj\u00eb dekad\u00eb, Jata e ka ushtruar funksionin n\u00eb Prokurorin\u00eb e P\u00ebrgjithshme, nd\u00ebrsa prej vitit 2015 punon si prokuror n\u00eb Prokurorin\u00eb e Tiran\u00ebs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Komisioni nuk ka gjetur probleme p\u00ebr nj\u00eb apartament t\u00eb bler\u00eb n\u00eb vitin 1995 me nj\u00eb kredi p\u00ebr strehim t\u00eb p\u00ebrfituar at\u00ebher\u00eb nga Enti Komb\u00ebtar i Banesave, EKB. Nd\u00ebrkoh\u00eb, q\u00eb \u00ebsht\u00eb konstatuar kryerja e kontratave formale p\u00ebr nj\u00eb apartament me sip\u00ebrfaqe 53 m2 n\u00eb Golem t\u00eb Kavaj\u00ebs, t\u00eb bler\u00eb n\u00eb vitin 2010 nga subjekti kundrejt vler\u00ebs 30 mij\u00eb euro.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cPavar\u00ebsisht se sipas deklarat\u00ebs noteriale, apartamenti \u00ebsht\u00eb bler\u00eb nga shtetasi A. D., faktikisht, p\u00ebr shkak t\u00eb mospasjes t\u00eb nj\u00eb kontrate shitblerjeje nd\u00ebrmjet k\u00ebtij t\u00eb fundit dhe investitorit, shoq\u00ebris\u00eb \u2018***\u2019sh.p.k., nga ana ime \u00ebsht\u00eb hartuar edhe nj\u00eb kontrat\u00eb sip\u00ebrmarrjeje nr. ***, p\u00ebrpara noteres M. Sh. .\u201d, ka sqaruar prokurori Jata n\u00eb deklarat\u00ebn veting dhe ka theksuar se kontrata me shoq\u00ebrin\u00eb nd\u00ebrtuese \u00ebsht\u00eb p\u00ebrpiluar vet\u00ebm p\u00ebr arsye t\u00eb pamund\u00ebsis\u00eb s\u00eb lidhjes s\u00eb nj\u00eb kontrate shitjeje p\u00ebrfundimtare, pasi apartamenti ishte i pahipotekuar. Jata ka shtuar se apartamenti \u00ebsht\u00eb ende n\u00eb proces legalizimi.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Komisioni ka konstatuar se n\u00eb t\u00eb nj\u00ebjt\u00ebn dat\u00eb, m\u00eb 11 maj 2010 jan\u00eb n\u00ebnshkruar disa akte noteriale me pal\u00eb subjektin e rivler\u00ebsimit, shit\u00ebsin A.D. dhe shoq\u00ebrin\u00eb nd\u00ebrtuese, me q\u00ebllim tjet\u00ebrsimin e t\u00eb drejtave reale t\u00eb apartamentit. K\u00ebshtu, A.D. ka revokuar kontrat\u00ebn e blerjes; ka n\u00ebnshkruar kontrat\u00ebn noteriale me prokurorin Isa Jata dhe ky i fundit ka lidhur me shoq\u00ebrin\u00eb nd\u00ebrtuese kontrat\u00eb sip\u00ebrmarrje.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cDeklarohet se ky akt \u00ebsht\u00eb veprim formal\/fiktiv, pasi n\u00eb fakt ky apartament i \u00ebsht\u00eb shitur z. Isa Jata nga shtetasi A.D. kundrejt shum\u00ebs 30,000 euro. Ky veprim b\u00ebhet p\u00ebr faktin se objekti \u00ebsht\u00eb i paregjistruar dhe p\u00ebr t\u00eb qen\u00eb m\u00eb i garantuar z. Isa Jata\u201d, citohet n\u00eb vendimin e KPK.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I pyetur nga KPK, Jata ka shpjeguar se, ashtu si dhe \u00ebsht\u00eb pasqyruar n\u00eb deklarat\u00ebn noteriale p\u00ebr blerjen e apartamentit, ai i ka likujduar shtetasit A.D. shum\u00ebn 30 mij\u00eb euro, nd\u00ebrsa kontrata me shoq\u00ebrin\u00eb nd\u00ebrtuese ka qen\u00eb formale, p\u00ebr shkak t\u00eb pamund\u00ebsis\u00eb s\u00eb lidhjes s\u00eb nj\u00eb kontrate shitje p\u00ebrfundimtare pasi apartamenti ka qen\u00eb i pahipotekuar.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Komisioni ka hetuar edhe lidhur me \u00e7mimin e blerjes 30 mij\u00eb euro, q\u00eb ka rezultuar m\u00eb i lart\u00eb se referencat e EKB-s\u00eb, duke p\u00ebrjshtuar dyshimet p\u00ebr trajtim preferencial. Po ashtu nuk \u00ebsht\u00eb konstatuar konflikt interesi mes pal\u00ebve n\u00eb k\u00ebto transaksione.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb p\u00ebrfundim Komisioni konstaton se aktet noteriale t\u00eb n\u00ebnshkruara p\u00ebr kalimin e pron\u00ebsis\u00eb s\u00eb pasuris\u00eb objekt gjykimi d\u00ebshmojn\u00eb se, kushtet e munges\u00ebs s\u00eb dokumentacionit t\u00eb pron\u00ebsis\u00eb s\u00eb shtetasit A. D. mbi k\u00ebt\u00eb apartament, kan\u00eb b\u00ebr\u00eb q\u00eb subjekti i rivler\u00ebsimit t\u00eb lidh kontrata formale, ashtu si\u00e7 edhe \u00ebsht\u00eb parashikuar dhe pasqyruar n\u00eb aktet noteriale t\u00eb n\u00ebnshkruara n\u00eb 2010-\u00ebn.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMjeti ligjor i zgjedhur nga subjekti, pra t\u00ebr\u00ebsia e akteve t\u00eb n\u00ebnshkruara prej tij, me q\u00ebllim rregullimin e situat\u00ebs juridike, nuk parashtrojn\u00eb problematika, t\u00eb cilat t\u00eb \u00e7ojn\u00eb n\u00eb nj\u00eb deklarim t\u00eb pamjaftuesh\u00ebm dhe t\u00eb pasakt\u00eb t\u00eb subjektit p\u00ebr k\u00ebt\u00eb pasuri\u201d, vler\u00ebson trupi gjykues dhe v\u00ebren se subjekti e ka pasqyruar n\u00eb m\u00ebnyr\u00eb t\u00eb sakt\u00eb dhe t\u00eb plot\u00eb n\u00eb deklaratat periodike situat\u00ebn juridike t\u00eb tij p\u00ebr p\u00ebrfitimin e k\u00ebtij apartamenti.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTrupi gjykues \u00e7mon se nuk \u00ebsht\u00eb objekt i k\u00ebtij gjykimi se cila do t\u00eb ishte rruga ligjore t\u00eb cil\u00ebn duhet t\u00eb ndiqte subjekti p\u00ebr t\u00eb eliminuar n\u00ebnshkrimin e akteve, t\u00eb cil\u00ebsuar prej tij si formale\u201d, citohet n\u00eb vendim.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sipas trupit gjykues, k\u00ebto konstatime p\u00ebrb\u00ebjn\u00eb elemente q\u00eb lidhen me an\u00ebn etike t\u00eb magjistratit dhe se n\u00eb p\u00ebrfundim t\u00eb gjykimit do t\u00eb vler\u00ebsohet n\u00eb t\u00ebr\u00ebsi dhe harmoni me t\u00eb gjitha provat dhe faktet e tjera. Komisioni arrin n\u00eb konkluzionin se problemet e konstatuara nuk krijojn\u00eb dyshime n\u00eb drejtim t\u00eb pamjaftueshm\u00ebris\u00eb s\u00eb deklarimit t\u00eb subjektit p\u00ebr k\u00ebt\u00eb pasuri n\u00eb drejtim t\u00eb m\u00ebnyr\u00ebs s\u00eb p\u00ebrfitimit t\u00eb saj. KPK i ka gjetur pa probleme dhe deklarimet e Jat\u00ebs p\u00ebr shlyerjen k\u00ebsteve t\u00eb aparamentit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nga hetimi administrativ kan\u00eb rezultuar mosp\u00ebrputhje n\u00eb gjendjen cash t\u00eb deklaratave vjetore me deklarat\u00ebn veting. Komisioni i ka p\u00ebrllogaritur deklarimet nd\u00ebr vite t\u00eb cash-it si shtesa t\u00eb kursimeve nd\u00ebr vite dhe nga analiza financisare 2013-2016, ka rezultuar nj\u00eb gjendje totale n\u00eb shum\u00ebn 5.1 milion\u00eb lek\u00eb. Nd\u00ebrkoh\u00eb, n\u00eb deklarat\u00ebn veting n\u00eb janar t\u00eb vitit 2007, subjekti ka deklaruar gjendje n\u00eb banes\u00eb n\u00eb shum\u00ebn 450 mij\u00eb lek\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Jata ka shpjeguar se n\u00eb m\u00ebnyr\u00ebn e deklarimit t\u00eb gjendjes cash i \u00ebsht\u00eb referuar gjendjes aktuale n\u00eb banes\u00eb n\u00eb momentin e deklarimit. \u201cKy deklarim nuk krijon keqkuptime dhe \u00ebsht\u00eb i qart\u00eb q\u00eb n\u00eb k\u00ebto periudha un\u00eb i referohem gjendjes s\u00eb cashit dhe jo shtesave progresive t\u00eb tyre\u201d, ka argumentuar.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201c[\u2026]P\u00ebr asnj\u00eb rrethan\u00eb ekonomike, logjike dhe ligjore nuk mund t\u00eb zot\u00ebrohej nga un\u00eb dhe t\u00eb mos deklarohej n\u00eb deklarat\u00ebn Vetting\u201d, ka deklaruar ai dhe ka sqaruar se n\u00eb kushtet kur vajza studionte jasht\u00eb shtetit kan\u00eb qen\u00eb t\u00eb shtr\u00ebnguar n\u00eb sakrifica ekonomike p\u00ebr t\u00eb p\u00ebrballuar shpenzimet dhe nuk mund t\u00eb dispononte nj\u00eb gjendje cash n\u00eb shuma t\u00eb tilla.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cDisponimi i nj\u00eb shume mbi 1,500,000 lek\u00ebsh ishte i ndaluar dhe ishte i detyruesh\u00ebm depozitimi n\u00eb institucionet bankare t\u00eb \u00e7do shum\u00eb mbi 1,500,000 lek\u00eb\u201d, ka vijuar argumentimin Jata. Nd\u00ebrkoh\u00eb, ai ka pranuar pasakt\u00ebsit\u00eb n\u00eb deklarimet e gjendjes cash n\u00eb disa vite.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb analiz\u00ebn e deklarimeve t\u00eb gjendjes cash, trupi gjykues i konsideron ato konfuze p\u00ebrball\u00eb detyrimit ligjor dhe \u00e7mon se subjekti i rivler\u00ebsimit ka detyrimin q\u00eb t\u00eb deklaroj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb sakt\u00eb dhe konform ligjit likuiditetet cash jasht\u00eb sistemit bankar. Megjithat\u00eb, n\u00eb analiz\u00ebn financiare KPK ka marr\u00eb n\u00eb konsiderat\u00eb deklarimet e b\u00ebra nga subjekti si gjendje likuiditeti cash n\u00eb deklarimet periodike, nisur nga fakti se jan\u00eb kryer n\u00eb koh\u00eb reale.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Duke mbajtur n\u00eb v\u00ebmendje se Jata ka paraqitur q\u00ebndrim reflektues dhe bashk\u00ebpunues n\u00eb lidhje me \u00e7do pasakt\u00ebsi dhe paqart\u00ebsi gjat\u00eb hetimit, trupi gjykues ka \u00e7muar q\u00eb moskonsitenc\u00ebn dhe mosp\u00ebrputhjen n\u00eb deklarimeve t\u00eb Jat\u00ebs p\u00ebr gjendjet cash t\u2019i vler\u00ebsoj\u00eb n\u00eb t\u00ebr\u00ebsi dhe n\u00eb harmoni me t\u00eb gjitha provat dhe rrethanat e tjera q\u00eb kan\u00eb rezultuar nga procesi rivler\u00ebsimit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nga analiza financiare e p\u00ebrgjithshme p\u00ebr periudh\u00ebn 2003-2016 kan\u00eb rezultuar balanca negative n\u00eb vitet 2014, 2015 dhe 2016 n\u00eb shum\u00ebn totale 1 milion e 174 mij\u00eb lek\u00eb, vler\u00eb q\u00eb \u00ebsht\u00eb konsideruar jo pnelaizuese prej trupit gjykues.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb vendimmarrjen p\u00ebrfundimtare, Komisioni \u00e7mon t\u00eb vler\u00ebsoj\u00eb n\u00eb respektimim t\u00eb parimit t\u00eb proprocionalitetit dhe duke iu referuar jurispudenc\u00ebs s\u00eb Kolegjit t\u00eb Posa\u00e7\u00ebm t\u00eb Apelimit, konkludon se pasakt\u00ebsit\u00eb n\u00eb deklarime nuk mund t\u00eb konsiderohen si shkelje shkarkuese.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cN\u00eb rastin konkret, nga hetimi dhe nga analiza e provave t\u00eb administruara nuk rezultoi q\u00eb pasakt\u00ebsit\u00eb n\u00eb deklarimet periodike vjetore t\u00eb ken\u00eb pasur p\u00ebr q\u00ebllim fshehjen e ndonj\u00eb pasurie apo tregimin jo sakt\u00eb t\u00eb t\u00eb dh\u00ebnave, me q\u00ebllim p\u00ebr t\u00eb justifikuar ligjshm\u00ebrin\u00eb e burimeve dhe t\u00eb krijimit t\u00eb pasurive\u201d, konstaton trupi gjykues dhe \u00e7mon se subjekti nuk gjendet as n\u00eb kushtet e c\u00ebnimit t\u00eb besimit t\u00eb publikut tek drejt\u00ebsia.<\/span><\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Q\u00ebndrimi bashk\u00ebpunues dhe deklarimi n\u00eb koh\u00eb reale i nj\u00eb kontrate porosie formale p\u00ebr nj\u00eb apartament pasi nuk dispononte hipotek\u00eb, kan\u00eb qart\u00ebsuar e bindur Komisionin se prokurori i Tiran\u00ebs Isa Jata nuk \u00ebsht\u00eb p\u00ebrpjekur t\u00eb fsheh\u00eb apo paraqes\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb pasurit\u00eb e tij me q\u00ebllim p\u00ebr t\u00eb justifikuar ligjshm\u00ebrin\u00eb e burimeve t\u00eb krijimit t\u00eb [&hellip;]<!-- AddThis Advanced Settings generic via filter on get_the_excerpt --><!-- AddThis Share Buttons generic via filter on get_the_excerpt --><\/p>\n","protected":false},"author":637,"featured_media":72669,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[13,117,362],"tags":[524,118,149,122],"fifu_image_url":"https:\/\/www.reporter.al\/wp-content\/uploads\/Isa-Jata-pas-seances.jpg","fifu_image_alt":"Prokurori Isa Jata pas seanc\u00ebs d\u00ebgjimore n\u00eb KPK.
