Foto: Vladimir Karaj.<\/figcaption><\/figure>\n<p>Izet Dushaj, gjyqtar i Gjykat\u00ebs s\u00eb Apelit t\u00eb Durr\u00ebsit u p\u00ebrball me nj\u00eb mori pyetjesh t\u00eb mart\u00ebn n\u00eb Komisionin e Pavarur t\u00eb Kualifikimit n\u00eb lidhje me shitjen e nj\u00eb apartamenti n\u00eb Bajram Curri dhe p\u00ebr blerjen e nj\u00eb apartamenti n\u00eb kryeqytet. Nga hetimi administrativ, Dushajt i ishin gjetur edhe nj\u00eb s\u00ebr\u00eb problemesh t\u00eb tjera dhe rezultonte sipas Komisionit me nj\u00eb bilanc negativ prej rreth 11 milion\u00eb lek\u00ebsh.<\/p>\n<p>Avokati i Dushajt, Eridan Shehu dhe ai vet\u00eb gjat\u00eb pyetjeve nga Komisioni i mohuan problemet dhe k\u00ebmb\u00ebngul\u00ebn se problemet q\u00eb dilnin nga nj\u00eb s\u00ebr\u00eb kontratash q\u00eb d\u00ebshmonin transaksione kontradiktore me nj\u00ebri-tjetrin nuk duheshin par\u00eb si penalizuese.<\/p>\n<p>Kryesuesja e trup\u00ebs q\u00eb hetoi Dushajn, Firdes Shuli vuri n\u00eb dukje q\u00eb n\u00eb fillim t\u00eb seanc\u00ebs se gjyqtari, me nj\u00eb karrier\u00eb t\u00eb filluar si ndihm\u00ebs gjyqtar n\u00eb vitit 1993 n\u00eb Tropoj\u00eb, ishte hetuar vet\u00ebm n\u00eb kriterin e pasuris\u00eb. Trupa kishte n\u00eb p\u00ebrb\u00ebrje edhe Olsi Komicin si an\u00ebtar dhe Pamela Qirkon si relatore.\u00a0 Branko Hrvatin ishte v\u00ebzhgues nd\u00ebrkomb\u00ebtar.<\/p>\n<p><strong>Kontratat p\u00ebr apartamentin n\u00eb Tiran\u00eb<\/strong><\/p>\n<p>Inspektorati i Lart\u00eb p\u00ebr Deklarimin dhe Kontrollin e Pasuris\u00eb dhe Konfliktit t\u00eb Interesit, ILDKPKI, e kishte gjetur pa probleme gjyqtarin Dushaj. Ky i fundit, si\u00e7 doli n\u00eb seanc\u00eb, ve\u00e7 kursimeve dhe t\u00eb ardhurave kishte deklaruar vet\u00ebm dy pasuri t\u00eb paluajtshme dhe dy makina.<\/p>\n<p>Por hetimet e KPK gjet\u00ebn si\u00e7 relatoi Qirko nj\u00eb mori problemesh n\u00eb transaksionet me dy pasurit\u00eb. Qirko tha se Dushaj kishte n\u00ebnshkruar nj\u00eb kontrat\u00eb porosie p\u00ebr nj\u00eb apartament n\u00eb Tiran\u00eb n\u00eb vitin 2007, por nuk e kishte deklaruar at\u00eb. Kontrata noteriale, si\u00e7 vuri n\u00eb dukje relatorja b\u00ebnte me dije se n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb ishte b\u00ebr\u00eb edhe pagesa e \u00e7mimit prej 60 mij\u00eb euro, p\u00ebr nj\u00eb apartament 98 metra dhe nj\u00eb shtes\u00eb 60 metra.<\/p>\n<p>Dushaj e kishte deklaruar apartamentin n\u00eb vitin 2008. Ai pretendonte n\u00eb deklarime se kishte paguar vet\u00ebm 50 mij\u00eb euro n\u00eb k\u00ebt\u00eb koh\u00eb dhe 10 mij\u00eb euro ishin dh\u00ebn\u00eb n\u00eb vitin 2011, kur ishte b\u00ebr\u00eb edhe kontrata p\u00ebrfundimtare.<\/p>\n<p>Komisioni megjithat\u00eb iu referua kontrat\u00ebs s\u00eb par\u00eb si kontrat\u00eb me vler\u00eb provuese. Qirko tha gjat\u00eb relatimit se gjyqtarit i kishin munguar n\u00eb k\u00ebt\u00eb vit burimet p\u00ebr shum\u00ebn 60 mij\u00eb euro. Qirko tha se burimet e deklaruara i p\u00ebrkisnin vitit 2008 dhe se ato nuk mund t\u00eb konsideroheshin p\u00ebr k\u00ebt\u00eb objekt.<\/p>\n<p>Relatorja po ashtu vuri n\u00eb dukje nd\u00ebr t\u00eb tjera se edhe burimet m\u00eb vete kishin probleme. Dushaj kishte referuar nj\u00eb dhurat\u00eb nga v\u00ebllai n\u00eb Britani prej 5 mij\u00eb paund, por nuk kishte sjell\u00eb sipas KPK prova t\u00eb t\u00eb ardhurave t\u00eb tij dhe q\u00ebndrimet n\u00eb vite rreth k\u00ebsaj dhurate ishin kontradiktore. Komisioni referoi se n\u00eb vitin 2014, v\u00ebllai kishte pretenduar n\u00eb nj\u00eb deklarim noterial se \u00e7do vit i kishte d\u00ebrguar 5 mij\u00eb paund dhurat\u00eb atij, por kjo ishte mohuar m\u00eb von\u00eb nga Dushaj.<\/p>\n<p>Nj\u00ebsoj me probleme rezultuan edhe kursimet e deklaruara si t\u00eb shpenzuara p\u00ebr mbulimin e vler\u00ebs s\u00eb apartamentit. Komisioni vuri n\u00eb dukje se Dushaj rezultonte me bilance negative n\u00eb vitet para blerjes dhe se kjo pamund\u00ebsonte krijimin e kursimeve n\u00eb blerjen e apartamentit.<\/p>\n<p>Eridan Shehu, mbrojt\u00ebsi i gjyqtarit n\u00eb seanc\u00eb tha se kishte sjell\u00eb prova shtes\u00eb n\u00eb lidhje me dhurat\u00ebn. Ai po ashtu pretendoi se KPK kishte llogaritur gabim t\u00eb ardhurat e gjyqtarit. Shehu k\u00ebmb\u00ebnguli se KPK kishte marr\u00eb referenc\u00eb t\u00eb gabuar minimumin jetik. Ai tha se referimi duhej t\u00eb b\u00ebhej mbi minimumin p\u00ebr rrethin e Tropoj\u00ebs, nd\u00ebrsa kund\u00ebrshtoi n\u00eb teori m\u00ebnyr\u00ebn si KPK b\u00ebnte llogarit\u00eb bazuar mbi sondazhet e INSTAT duke th\u00ebn\u00eb se nuk kishte asnj\u00eb vendim, ligj apo akt n\u00ebnligjor q\u00eb p\u00ebrcaktonte k\u00ebt\u00eb vler\u00eb.<\/p>\n<p><strong>Shitja e sht\u00ebpis\u00eb n\u00eb Bajram Curri<\/strong><\/p>\n<p>Si\u00e7 doli nga referimi i KPK-s\u00eb, problemi kryesor i gjyqtarit q\u00eb rezultonte vet\u00ebm p\u00ebr apartamentin n\u00eb Tiran\u00eb me nj\u00eb bilanc negativ prej 7.1 milion\u00eb lek\u00ebsh, ishte kontrata e shitjes s\u00eb nj\u00eb apartamenti n\u00eb Tropoj\u00eb.<\/p>\n<p>Gjyqtari kishte deklaruar shitjen n\u00eb vitin 2008 p\u00ebr \u00e7mimin 30 mij\u00eb euro. KPK tha se n\u00eb parim k\u00ebto t\u00eb ardhura nuk mund t\u00eb konsideroheshin se kishin sh\u00ebrbyer p\u00ebr apartamentin n\u00eb Tiran\u00eb duke iu referuar kontrat\u00ebs q\u00eb thoshte se ai ishte bler\u00eb nj\u00eb vit m\u00eb her\u00ebt dhe parat\u00eb ishin paguar menj\u00ebher\u00eb.<\/p>\n<p>Shehu n\u00eb mbrojtje t\u00eb klientit t\u00eb tij pretendoi se KPK duhej t\u2019i referohej kontrat\u00ebs s\u00eb dyt\u00eb t\u00eb b\u00ebr\u00eb n\u00eb vitin 2011 dhe jo asaj t\u00eb 2007. Ai tha se subjekti dhe shit\u00ebsja n\u00eb k\u00ebt\u00eb rast n\u00eb mir\u00ebbesim p\u00ebr shkak t\u00eb njohjes nuk i kishin \u201ckushtuar v\u00ebmendje\u201d pik\u00ebs dy t\u00eb kontrat\u00ebs n\u00eb t\u00eb cil\u00ebn thuhej se pagesat ishin kryer n\u00eb dit\u00ebn e n\u00ebnshkrimit. Ai tha se kontrata e vitit 2011 ishte m\u00eb e vlefshme dhe detajet e saj p\u00ebrputheshin me faturat e pagesave t\u00eb kryera.<\/p>\n<p>Por KPK vuri n\u00eb dukje se n\u00eb shitje e apartamentit n\u00eb Tropoj\u00eb kishte edhe nj\u00eb s\u00ebr\u00eb problemesh shtes\u00eb. N\u00eb vitin 2011, gjyqtari Dushaj kishte l\u00ebshuar prokur\u00eb n\u00eb em\u00ebr t\u00eb t\u00eb v\u00ebllait i cili me kontrat\u00eb noteriale ia kishte shitur k\u00ebt\u00eb apartament, nj\u00eb tjet\u00ebr bler\u00ebsi p\u00ebr 2.2 milion\u00eb lek\u00eb.<\/p>\n<p>Nj\u00eb kontrat\u00eb e ngjashme ishte b\u00ebr\u00eb n\u00eb vitin 2018, kur kontrata e vitit 2011 ishte prishur dhe apartamenti i ishte shitur s\u00ebrish bler\u00ebsit t\u00eb vitit 2008.<\/p>\n<p>Qirjako pyeti subjektin n\u00eb lidhje me k\u00ebto kontrata, q\u00eb n\u00eb fakt tregonin se apartamenti kishte qen\u00eb n\u00ebn zot\u00ebrimin e tij deri von\u00eb. Dusha pretendoi se k\u00ebto kontrata ishin b\u00ebr\u00eb p\u00ebr faktin se bler\u00ebsi i par\u00eb nuk kishte b\u00ebr\u00eb regjistrimin dhe kishte tentuar t\u00eb shmangte pagesat e gjobave q\u00eb rridhnin prej k\u00ebsaj.<\/p>\n<p>Ai tha se v\u00ebllai nuk kishte pasur tag\u00ebr p\u00ebr t\u00eb rishitur apartamentin dhe se kontrata e b\u00ebr\u00eb prej tij nuk kishte vler\u00eb. Dushaj pretendoi padijeni p\u00ebr sa kishte ndodhur, nd\u00ebrsa k\u00ebmb\u00ebnguli se shitja n\u00eb vitin 2011 prej 2.2 milion\u00eb lek\u00ebsh ishte b\u00ebr\u00eb nga bler\u00ebsi i par\u00eb te i dyti dhe ai ishte p\u00ebrfshir\u00eb p\u00ebrmes v\u00ebllait vet\u00ebm p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb regjistrimit n\u00eb hipotek\u00eb prej bler\u00ebsit t\u00eb par\u00eb.<\/p>\n<p><strong>Konflikti i interesit<\/strong><\/p>\n<p>Dushaj po ashtu dha vet\u00eb shpjegime mbi k\u00ebmb\u00ebnguljen e relatores sa i p\u00ebrket p\u00ebrdorimit t\u00eb nj\u00eb makine n\u00eb pron\u00ebsi fillimisht t\u00eb nj\u00eb personi q\u00eb ishte gjykuar nga Dushaj pes\u00eb vjet para marrjes s\u00eb makin\u00ebs n\u00eb p\u00ebrdorim.<\/p>\n<p>KPK vuri n\u00eb dukje se dyshohej p\u00ebr konflikt interesi. Relatorja vuri po ashtu n\u00eb dukje se gjyqtari kishte deklaruar se nuk kishte pasur \u00e7\u00ebshtje me k\u00ebt\u00eb person me inicialet L.A, por q\u00eb KPK kishte gjetur se ai kishte shqyrtuar nj\u00eb vendim rivendosje n\u00eb afat n\u00eb vitin 2006.<\/p>\n<p>Nga t\u00eb dh\u00ebnat e p\u00ebrmendura nga relatorja rezultonte se L.A ishte i d\u00ebnuar p\u00ebr vrasje. Ai kishte k\u00ebrkuar rivendosje n\u00eb afat t\u00eb apelimit, pasi ishte gjykuar n\u00eb munges\u00eb dhe nj\u00eb trup\u00eb pjes\u00eb e t\u00eb cil\u00ebs ishte Dushaj i kishte dh\u00ebn\u00eb t\u00eb drejt\u00eb. Komisioni tha se 5 vjet m\u00eb von\u00eb, Dushaj kishte marr\u00eb n\u00eb p\u00ebrdorim makin\u00ebn q\u00eb ishte n\u00eb pron\u00ebsi t\u00eb L.A.<\/p>\n<p>Dushaj dhe mbrojt\u00ebsi pretenduan se ai nuk kishte pasur dijeni p\u00ebr pron\u00ebsin\u00eb e makin\u00ebs, sepse at\u00eb e kishte marr\u00eb nga dikush tjet\u00ebr. Gjat\u00eb p\u00ebrgjigjeve t\u00eb pyetjeve t\u00eb relatores, Dushaj q\u00eb e kishte p\u00ebrdorur makin\u00ebn p\u00ebr t\u00eb udh\u00ebtuar n\u00eb Tropoj\u00eb nga Kosova tha se asnj\u00ebher\u00eb nuk kishte par\u00eb dokumentet e makin\u00ebs dhe as i kishte ndodhur t\u00eb kontrollohej. Ai tha se nuk mbante mend t\u00eb kishte b\u00ebr\u00eb akt p\u00ebrdorimi.<\/p>\n<p>Ai dhe avokati pretenduan po ashtu se duke qen\u00eb se kishte ndodhur pes\u00eb vjet pas dh\u00ebnies s\u00eb vendimit, q\u00eb sipas mbrojt\u00ebsit ishte thjesht administrativ, nuk mund t\u00eb kishte konflikt interesi.<\/p>\n<p>N\u00eb seanc\u00eb, KPK vuri n\u00eb dukje edhe nj\u00eb s\u00ebr\u00eb problemesh t\u00eb tjera financiare, n\u00eb lidheshin me t\u00eb ardhurat e bashk\u00ebshortes, disa dhurata p\u00ebr djalin n\u00eb shuma 3 mij\u00eb paund dhe 3 mij\u00eb euro nga t\u00eb af\u00ebrm dhe transaksionet n\u00eb lidhje me nj\u00eb makin\u00eb t\u00eb bler\u00eb.<\/p>\n<p>Qirko tha se nga hetimi Dushaj rezultoi me nj\u00eb bilanc negativ prej 11 milion\u00eb lek\u00ebsh. Avokati i gjyqtarit kund\u00ebrshtoi p\u00ebrfundimet dhe k\u00ebmb\u00ebnguli n\u00eb rillogaritje. Dushaj k\u00ebrkoi n\u00eb fund ri\u00e7elje t\u00eb hetimit dhe konfirmim n\u00eb detyr\u00eb.
