Pasi u betua se do t\u00eb thoshte vet\u00ebm t\u00eb v\u00ebrtet\u00ebn, Kad\u00ebna dukej i qet\u00eb teksa iu dha p\u00ebrgjigje pyetjeve t\u00eb drejtuara nga Kolegji, v\u00ebzhguesi nd\u00ebrkomb\u00ebtar Steven Kessler dhe subjekti i rivler\u00ebsimit, duke p\u00ebrdorur edhe terma juridik\u00eb dhe financiar\u00eb gjat\u00eb shpjegimeve.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb fund t\u00eb seanc\u00ebs q\u00eb zgjati m\u00eb shum\u00eb se 6 or\u00eb, trupa vendosi t\u00eb kryej\u00eb ekspertimin e kopjes origjinale t\u00eb kontrat\u00ebs paraprake dhe asaj t\u00eb revokimit, si dhe t\u00eb mandat pagesave t\u00eb depozituara nga Kad\u00ebna &#8211; p\u00ebr t\u00eb konkluduar n\u00ebse ato jan\u00eb n\u00ebnshkruar edhe nga gjyqtari Sokol Ngresi n\u00eb cil\u00ebsin\u00eb e pal\u00ebs bler\u00ebse, apo n\u00ebse firma e tij \u00ebsht\u00eb falsifikuar ashtu si ai pretendon.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sokol Ngresi e ka filluar karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb fillim t\u00eb viteve 2000 dhe punon prej vitit 2005 n\u00eb Gjykat\u00ebn e Apelit t\u00eb Vlor\u00ebs. Ai u konfirmua n\u00eb detyr\u00eb nga Komisioni i Pavarur i Kualifikimit n\u00eb dhjetor 2020, me argumentin se bilancet negative ishin t\u00eb vogla dhe t\u00eb pamjaftueshme p\u00ebr t\u00eb vendosur mas\u00eb disiplinore. Vendimi i Komisionit u ankimua nga komisioneri Florian Ballhysa, i cili argumenton se Ngresi ka b\u00ebr\u00eb deklarim t\u00eb pamjaftuesh\u00ebm p\u00ebr gjendjen e kursimeve cash n\u00eb vitin 2003 dhe p\u00ebr blerjen e dy automjeteve.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gjat\u00eb procesit n\u00eb KPA, Sokol Ngresi u p\u00ebrball me disa denoncime q\u00eb ngren\u00eb dyshime se ai kishte fshehur nj\u00eb kontrat\u00eb paraprake p\u00ebr blerjen e nj\u00eb apartamenti n\u00eb Vlor\u00eb n\u00eb vitin 2014, tre pagesa dhe kontrat\u00ebn e revokimit t\u00eb vitit 2015. K\u00ebto dyshime u konfirmuan nga dokumentet e d\u00ebrguara prej shoq\u00ebris\u00eb nd\u00ebrtuese \u201cAfa Konstruksion\u201d, por Ngresi i ka quajtur t\u00eb falsifikuara dhe ka pretenduar se gjith\u00e7ka b\u00ebhej p\u00ebr shkak se mund t\u00eb kishte c\u00ebnuar intresat e administratorit t\u00eb k\u00ebsaj shoq\u00ebrie dhe t\u00eb \u201cxhelozis\u00eb\u201d dhe \u201clig\u00ebsis\u00eb\u201d s\u00eb nj\u00eb ish-kolegeje t\u00eb Apelit Vlor\u00eb e shkarkuar nga detyra, p\u00ebr t\u00eb cil\u00ebn kishte deklaruar m\u00eb par\u00eb se ajo kishte lidhje t\u00eb ngushta me Kad\u00ebn\u00ebn.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gjat\u00eb seanc\u00ebs t\u00eb enjten, Ngresi dor\u00ebzoi si prova dy v\u00ebrtetime t\u00eb marra nga Prokuroria e Vlor\u00ebs dhe Drejtoria e Tatimeve t\u00eb k\u00ebtij Qyteti. Ai pohoi se prokuroria sqaron se ka regjistruar procedim penal lidhur me kall\u00ebzimin e kryer prej tij p\u00ebr falsifkimin e kontrat\u00ebs paraprake p\u00ebr blerjen e nj\u00eb apartamenti tek \u201cAfa Konstruksion\u201d dhe se \u00e7\u00ebshtja \u00ebsht\u00eb duke u hetuar. Sipas Ngresit, me shkres\u00ebn e tatimeve arrihej t\u00eb provohej se pagesat e pretenduara nga firma nd\u00ebrtuese se jan\u00eb kryer prej tij, si dhe kthimi i vler\u00ebs pas revokimit t\u00eb kontrat\u00ebs, nuk rezulton e pasqyruar n\u00eb librat e shit-blerjes s\u00eb k\u00ebsaj shoq\u00ebrie.\u00a0<\/span><\/p>\n<p><b>\u2018Miq\u00ebsia\u2019 dhe \u2018sh\u00ebrbimet\u2019<\/b><\/p>\n<p><span style=\"font-weight: 400;\">I pyetur nga kryesuesja e trupit gjykues, Albana Shtylla lidhur me njohjen dhe marrdh\u00ebnien q\u00eb ai ka pasur me Ngresin, Kad\u00ebna pohoi se nuk i mbante mend ekzakt\u00ebsisht rrethanat n\u00eb t\u00eb cilat ishin njohur, por shtoi se frekuentonin shoq\u00ebri t\u00eb p\u00ebrbashk\u00ebt dhe se marrdh\u00ebnia mes tyre kishte qen\u00eb shoq\u00ebrore.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna u pyet edhe lidhur me nj\u00eb email ku Ngresi i ka d\u00ebrguar <\/span><span style=\"font-weight: 400;\">nj\u00eb ankim p\u00ebr llogari t\u00eb shoq\u00ebris\u00eb nd\u00ebrtuese \u201cAfa Konstruksion\u201d, q\u00eb i \u00ebsht\u00eb njohur m\u00eb par\u00eb Kolegjit nga kjo kompani s\u00eb bashku me dokumentacionin e kontrat\u00ebs. Shtylla e pyeti d\u00ebshmitarin n\u00ebse <\/span><span style=\"font-weight: 400;\">kishte pasur dijeni p\u00ebr konsultimet e ish-avokatit t\u00eb tij t\u00eb ndjer\u00eb me subjektin e rivler\u00ebsimit, por Kad\u00ebna tha se nuk mund t\u00eb jepte nj\u00eb p\u00ebrgjigje p\u00ebr k\u00ebt\u00eb gj\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ai mohoi q\u00eb subjekti t\u00eb kishte qen\u00eb ndonj\u00ebher\u00eb avokat i tij apo i shoq\u00ebris\u00eb q\u00eb zot\u00ebron, por shpjegoi se ishte konsultuar me t\u00eb. Kad\u00ebna vijoi se i kishte k\u00ebrkuar ndihm\u00eb p\u00ebr ankimin ndaj nj\u00eb gjobe q\u00eb kishte marr\u00eb, pasi kishte besim tek profesionalizmi i Ngresit. Sipas tij, e kishte k\u00ebrkuar k\u00ebt\u00eb nder n\u00eb telefon dhe se subjekti ia kishte nisur ankimin e punuar me email. \u201c[\u2026]M\u00eb njoftuan dit\u00ebn e fundit dhe zot\u00ebria m\u00eb ndimoi p\u00ebr ankimin q\u00eb ma ka nisur me email dhe ia di p\u00ebr nder\u201d, shpjegoi Kand\u00ebna.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ngresi pohoi n\u00eb seanc\u00eb se emaili ishte d\u00ebrguar dit\u00ebn q\u00eb ishte dh\u00ebn\u00eb vendimi dhe se ia kishte k\u00ebrkuar avokati i ndjer\u00eb i d\u00ebshmitarit, q\u00eb i kishte th\u00ebn\u00eb vet\u00ebm t\u2019i hidhte nj\u00eb sy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Subjekti k\u00ebmb\u00ebnguli n\u00eb seanc\u00eb se ve\u00e7 nj\u00eb email-i nuk kishte ndonj\u00eb komunikim tjet\u00ebr mes tyre, por Kad\u00ebna tha se n\u00ebse do t\u00eb verifikoheshin tabulatet telefonike do t\u00eb v\u00ebrtetohej se kishin pasur komunikime.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb fund Ngresi e pyti Kand\u00ebn\u00ebn n\u00ebse kishte qen\u00eb n\u00eb sht\u00ebpin\u00eb e tij n\u00eb shkurt t\u00eb vitit 2019 kur kishte nd\u00ebrruar jet\u00eb n\u00ebna. \u201cKam qen\u00eb edhe n\u00eb sht\u00ebpi, edhe n\u00eb varrim\u201d, u p\u00ebrgjigj Kad\u00ebna.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna nuk dha p\u00ebrgjigje p\u00ebr nj\u00eb pyetje t\u00eb Ngresit se \u00e7afr\u00eb lidhje kishte me z.Alaudin Malaj dhe Znj.Klodiana Gjyzari.\u00a0<\/span><\/p>\n<p><b>D\u00ebshmia p\u00ebr kontrat\u00ebn e apartamentit<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Lidhur me kontratat dhe mandat-pagesat d\u00ebshmitari shpjegoi se ato kryheshin n\u00eb zyrat e shoq\u00ebris\u00eb dhe se jan\u00eb n\u00ebnshkruar mes tij n\u00eb cil\u00ebsin\u00eb e titullarit t\u00eb shoq\u00ebris\u00eb dhe t\u00eb klientit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna deklaroi se kontrata paraprake e shitjes ishte n\u00ebnshkruar mes tij dhe Ngresit n\u00eb nj\u00eb pasdite, rreth or\u00ebs 18:00, pasi subjekti i rivler\u00ebsimit ishte n\u00eb pun\u00eb gjat\u00eb gjith\u00eb dit\u00ebs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pyetjes se p\u00ebrse kontratat nuk ishin n\u00ebnshkruar para noterit, Kad\u00ebna pohoi se shoq\u00ebria e tij kishte krijuar besueshm\u00ebri p\u00ebr shkak t\u00eb aktivitetit 15 vje\u00e7ar dhe faktit se kishte nd\u00ebrtuar 20 pallate. \u201cPo dor\u00ebzoj edhe kontrata t\u00eb tjera t\u00eb ngjashme q\u00eb jan\u00eb n\u00ebnshkruar n\u00eb zyr\u00eb, por k\u00ebrkoj q\u00eb t\u00eb anonimizohen dhe t\u00eb ruhet anonimati i personave t\u00eb tjer\u00eb\u201d, theksoi Kad\u00ebna.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr mosdeklarimin n\u00eb tatime t\u00eb pagesave t\u00eb kryera, ai pretendoi se financieri q\u00eb kryente bilancin deklaronte gjith\u00eb shum\u00ebn e akumuluar dhe jo pagesat e secilit prej klient\u00ebve. \u201cDita kur kam kthyer shum\u00ebn e paguar prej subjektit korespondon me at\u00eb t\u00eb mandatit bankar\u201d, pohoi\u00a0 Kad\u00ebna.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pasi u njoh me aktet e dor\u00ebzuara nga subjekti dhe Kad\u00ebna, Kolegji e pyeti k\u00ebt\u00eb t\u00eb fundit p\u00ebr negicimin e kryer p\u00ebr apartamentin.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna sqaroi se subjekti e kishte par\u00eb apartamentin disa her\u00eb dhe se i kishte p\u00eblqyer. Sipas tij, m\u00eb von\u00eb kishin diskutuar p\u00ebr \u00e7mimin dhe ishin dakor\u00ebduar.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I pyetur se cil\u00ebt persona kishin akses n\u00eb kopjet origjinale, Kad\u00ebna tha se kishte vet\u00ebm ai, sekretarja dhe noterja.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">M\u00eb pas Kad\u00ebna ju p\u00ebrgjigj pyetjeve t\u00eb Ngresit, n\u00ebse mbanin regjist\u00ebr p\u00ebr kontratat e n\u00ebnshkruara n\u00eb zyr\u00eb. Ai tha se kishin databaz\u00eb elektronike p\u00ebr t\u00eb gjith\u00eb klient\u00ebt, nga viti 2005 e n\u00eb vijim. Ai shpjegoi se numri i repertorit sh\u00ebnohej sipas renditjes dhe shtoi se nuk mbanin regjistra fizik\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Edhe Kryesuesja Shtylla k\u00ebrkoi shpjegime p\u00ebr databaz\u00ebn dhe Kad\u00ebna sqaroi se p\u00ebr \u00e7do objekt kishin nd\u00ebrtuar nj\u00eb databz\u00eb, pasi ishte m\u00eb e thjesht\u00eb p\u00ebr t\u2019u menaxhuar.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ngresi evidentoi se mandat-pagesat e dor\u00ebzuara nga d\u00ebshmitari jan\u00eb n\u00eb format A4 dhe e pyeti n\u00ebse p\u00ebrdornin format\u00eb t\u00eb tjer\u00eb mandatesh. Sipas Kad\u00ebn\u00ebs, 99% e mandateve ishin n\u00eb format A4 p\u00ebr shkak se i printonte financierja n\u00eb zyr\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I pytetur se p\u00ebrse pagesat nuk ishin kryer n\u00ebp\u00ebrmjet bank\u00ebs, Kad\u00ebna sqaroi se nuk kishte pse t\u00eb ark\u00ebtonte shuma q\u00eb ishin marr\u00eb brenda kufijve t\u00eb ligjit.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ai vijoi se nuk i kujtohej q\u00eb subjekti t\u00eb kishte pasur tendenc\u00eb p\u00ebr ta fshehur pasurin\u00eb duke kryer pagesat n\u00eb zyr\u00eb. \u201cM\u00eb ka th\u00ebn\u00eb se do t\u00eb aplikonte p\u00ebr viz\u00eb n\u00eb Kanada dhe se donte ta paraqiste k\u00ebt\u00eb dokument\u201d, tha Kad\u00ebna.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ngresi e kund\u00ebrshtoi k\u00ebt\u00eb th\u00ebnie t\u00eb Kad\u00ebn\u00ebs. Ai pranoi se nj\u00eb i af\u00ebrm i kishte p\u00ebr ftes\u00eb p\u00ebr nj\u00eb vizit\u00eb p\u00ebr n\u00eb Kanada dhe se kishte aplikuar p\u00ebr viz\u00eb, q\u00eb nuk i ishin mund\u00ebsuar &#8211; por theksoi se n\u00ebse do t\u2019i duhej nj\u00eb gj\u00eb e till\u00eb, kishte prenotuar nj\u00eb vit m\u00eb par\u00eb nj\u00eb apartament tek nj\u00eb shoq\u00ebri tjet\u00ebr dhe se nuk kishte pse ti nevojitej nj\u00eb kontrat\u00eb tjet\u00ebr p\u00ebr garanci.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lidhur me faktin e konstatuar nga Ngresi se, n\u00eb kontrat\u00eb thuhej se apartamenti gjendet n\u00eb katin e 9-t\u00eb t\u00eb banimit, nd\u00ebrkoh\u00eb q\u00eb leja ishte dh\u00ebn\u00eb p\u00ebr 8 kate banimi, Kad\u00ebna deklaroi se kishte nd\u00ebrtuar nj\u00eb kat shtes\u00eb pasi kishte dal\u00eb ligji p\u00ebr legalzimin dhe favorizohej ta b\u00ebnte k\u00ebt\u00eb gj\u00eb. Ai shtoi n\u00eb seanc\u00eb se kishte aplikuar p\u00ebr legalizim dhe e kishte regjistruar edhe shtes\u00ebn.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna dha p\u00ebrgjigje edhe p\u00ebr konstatimin tjet\u00ebr t\u00eb Ngresit, se n\u00eb kontrat\u00eb nuk kishte n\u00ebnshkruar investitori tjet\u00ebr. Sipas tij, n\u00eb t\u00eb gjitha rastet firmos titullari dhe jo investitori tjet\u00ebr.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ai shtoi se kishte aplikuar p\u00ebr legalizim n\u00eb vitin 2011 kur kishte p\u00ebrfunduar nd\u00ebrtimi i objektit, nd\u00ebrsa punimet e brendshme mund t\u00eb vazhdonin pasi nuk kishin lidhje me procesin e legalizimit. Sipas Kad\u00ebn\u00ebs at\u00eb apartament e zot\u00ebron aktualisht ai dhe se aty nuk jeton askush.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ngresi pretendoi se kontrata noteriale e dor\u00ebzuar nga subjekti lidhur me kontratat e n\u00ebnshkruara p\u00ebr apartamentin dhe pagesat duhej t\u00eb ishte kryer n\u00eb prani t\u00eb t\u00eb dy pal\u00ebve. Kad\u00ebna pohoi se n\u00eb k\u00ebt\u00eb rast ishte legalizuar kopja origjinale q\u00eb kishin n\u00ebnshkruar n\u00eb zyr\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Subjekti evidentoi gjithashtu, se n\u00eb kontrat\u00ebn e noterizuar t\u00eb vendosur n\u00eb dispozicion t\u00eb Kolegjit t\u00eb enjten, mungonin nj\u00eb pjes\u00eb e akteve t\u00eb praktik\u00ebs, mungesa p\u00ebr t\u00eb cilat Kad\u00ebna tha se ato nuk e d\u00ebmtonin kontrat\u00ebn.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr konstatimin e Ngresit se n\u00eb dokumentacionin e kontrat\u00ebs nuk ishte bashk\u00ebngjitur kopje e kart\u00ebs s\u00eb tij t\u00eb identitetit t\u00eb asaj kohe, Kad\u00ebna pohoi se kjo mund t\u00eb kishte ndodhur nga veprimet e sekretares.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna u pyet nga p\u00ebrfaq\u00ebsuesi i ONM-s\u00eb, Steven Kessler se si kishte mund\u00ebsi q\u00eb i kujtoheshin kaq mir\u00eb detajet e nj\u00eb kontrate t\u00eb shtat\u00eb viteve m\u00eb par\u00eb dhe se si e kishte sht\u00ebn\u00eb denoncuesi n\u00eb dor\u00eb kopjen e k\u00ebsaj kontrate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kad\u00ebna tha se nuk mbante mend \u00e7do detaj, por se ve\u00e7 \u00e7far\u00eb kishte memorizuar, i referohej edhe kontrat\u00ebs. \u201cNuk \u00ebsht\u00eb nj\u00eb klient i zakonsh\u00ebm dhe kemi pasur shoq\u00ebri\u201d, shtoi ai dhe konfirmoi se kontratat ishin t\u00eb nj\u00ebjta me ato t\u00eb serivirua nga denoncuesi.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cPor denoncimi nuk \u00ebsht\u00eb kryer nga un\u00eb.
