Subjekti u paraqit n\u00eb KPK s\u00eb bashku me p\u00ebrfaq\u00ebsuesen ligjore, Antoneta Sevdari.<\/p>\n<p>Trupi gjykues i KPK q\u00eb po kryen vetingun p\u00ebr prokurorin Dyla kryesohet nga Brunilda Bekteshi, me relatore Firdes Shulin dhe an\u00ebtare Suela Zhegun. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Francesco Ciardi.<\/p>\n<p>Dyla e ka filluar karrier\u00ebn si prokuror n\u00eb vitin 2001 n\u00eb Prokurorin\u00eb e Rrethit Gjyq\u00ebsor Mat. N\u00eb vitin 2008 ai \u00ebsht\u00eb transferuar p\u00ebr t\u00eb kryer funksionin n\u00eb Prokurorin\u00eb e Lushnj\u00ebs.<\/p>\n<p>Relatorja e \u00e7\u00ebshtjes, Firdes Shuli tha n\u00eb fillim t\u00eb seanc\u00ebs se hetimi administrativ p\u00ebr prokurorin Dyla \u00ebsht\u00eb p\u00ebrfunduar vet\u00ebm p\u00ebr kriterin e pasuris\u00eb.<\/p>\n<p>Debati n\u00eb KPK u dominua nga nj\u00eb kontrat\u00eb huaje me interes e n\u00ebnshkruar mes prokurorit Dyla dhe nj\u00eb biznesmeni n\u00eb vitin 2016. Sipas relatimit, subjekti kishte dh\u00ebn\u00eb hua 50 mij\u00eb euro me afat 5-vje\u00e7ar dhe huamarr\u00ebsi duhej t\u2019i kthente p\u00ebrve\u00e7 shum\u00ebs s\u00eb marr\u00eb edhe interesa n\u00eb vler\u00ebn e 60 mij\u00eb eurove n\u00eb fund t\u00eb vitit 2021.<\/p>\n<p>Nisur nga interesi i lart\u00eb i dakord\u00ebsuar mes pal\u00ebve, Komisioni e ka pyetur Dyl\u00ebn p\u00ebr t\u00eb sqaruar situat\u00ebn e k\u00ebtij transaksioni, i cili ka shpjeguar se huamarr\u00ebsi nuk mund t\u00eb merrte kredi pasi ishte konsideruar debitor i keq prej bankave &#8211; fakt q\u00eb \u00ebsht\u00eb konkluduar edhe nga Komisioni gjat\u00eb hetimit administrativ.<\/p>\n<p>Sipas sqarimeve t\u00eb Dyl\u00ebs, biznesmeni kishte vendosur si garanci p\u00ebr huan\u00eb nj\u00eb apartament me sip\u00ebrfaqe 150 m2 n\u00eb Kavaj\u00eb n\u00eb proces legalizimi. Ai ka shtuar se s\u00eb bashku me k\u00ebt\u00eb pasuri, A.K. kishte porositur tek nj\u00eb shoq\u00ebri nd\u00ebrtuese edhe disa prona t\u00eb tjera q\u00eb n\u00eb vler\u00ebn totale kapin shifr\u00ebn 500 mij\u00eb euro.<\/p>\n<p>Komisioni vler\u00ebsoi se \u00e7mimi i apartamentit t\u00eb l\u00ebn\u00eb si garanci kap vler\u00ebn 116 mij\u00eb eurove, q\u00eb \u00ebsht\u00eb e p\u00ebraf\u00ebrt me shum\u00ebn e dh\u00ebn\u00eb hua prej subjektit 50 mij\u00eb euro + 60 mij\u00eb euro q\u00eb pritet t\u00eb p\u00ebrfitoj\u00eb nga interesat. Bazuar edhe n\u00eb deklarimet e subjektit, ai jeton prej vitit 2016 n\u00eb apartamentin e l\u00ebn\u00eb si garanci, pa kund\u00ebrshp\u00ebrblim.<\/p>\n<p>Komisioni i ka kaluar Dyl\u00ebs barr\u00ebn e prov\u00ebs p\u00ebr interesin e lart\u00eb t\u00eb dh\u00ebnies s\u00eb huas\u00eb q\u00eb u cil\u00ebsua shum\u00eb her\u00eb m\u00eb t\u00eb lart\u00eb nga ai i sistemit bankar; p\u00ebr faktin se ai ka filluar t\u00eb jetoj\u00eb n\u00eb apartamentin e huamarr\u00ebsit duke b\u00ebr\u00eb q\u00eb t\u00eb humbas\u00eb nocioni i ganrancis\u00eb dhe lidhur me vler\u00ebn e tregut t\u00eb apartamentit \u00ebsht\u00eb thuajse e nj\u00ebjt\u00eb me shum\u00ebn q\u00eb pritet t\u00eb marr\u00eb Dyla prej huamarr\u00ebsit.<\/p>\n<p>\u201cPavar\u00ebsisht se huamarr\u00ebsi mund t\u00eb ket\u00eb pasur nevoj\u00eb p\u00ebr likujditete, rezulton q\u00eb ai t\u00eb humbas\u00eb rreth 60 mij\u00eb euro p\u00ebr interesat dhe t\u00eb mos ket\u00eb p\u00ebrfituar qiran\u00eb e apartamentit,\u201d tha Shuli.<\/p>\n<p>Relatorja ngriti dyshime se Dyla e kishte bler\u00eb apartamentin kundrejt \u00e7mimit 110 mij\u00eb euro n\u00eb vitin 2016 dhe se kjo shum\u00eb ishte p\u00ebrfshir\u00eb si shpenzim n\u00eb analiz\u00ebn financiare t\u00eb atij viti. Sipas KPK-s\u00eb, kontrata e huas\u00eb \u00ebsht\u00eb \u2018de facto\u2019 kontrat\u00eb e shitjes s\u00eb apartamentit.<\/p>\n<p>Dyla u mbrojt m\u00eb s\u00eb shumti n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsues s\u00eb tij ligjore, avokates Antoneta Sevdari, e cila k\u00ebrkoi q\u00eb t\u00eb respektohej prezumimi i pafaj\u00ebsis\u00eb.<\/p>\n<p>Ajo theksoi se indiciet duhet t\u00eb jen\u00eb t\u00eb sakta q\u00eb t\u00eb mos kund\u00ebrshtohen. Sipas Sevdarit, kontrata e huas\u00eb \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Kodin Ciivil dhe \u00ebsht\u00eb e barabart\u00eb me ligjin.<\/p>\n<p>Ajo kund\u00ebrshtoi edhe konstatimin p\u00ebr interesa m\u00eb t\u00eb larta nga ato t\u00eb bankave n\u00eb k\u00ebt\u00eb huadh\u00ebnie dhe solli n\u00eb v\u00ebmendje se Fondi \u201cBesa\u201d i ka interesat vjetore n\u00eb nivelin minimal 24% dhe 28% n\u00eb nivelin maksimal.<\/p>\n<p>Sevdari u shpreh se sh\u00ebnimi n\u00eb kontrat\u00ebn e huadh\u00ebnies se apartamenti do t\u00eb vendosej si garanci ishte m\u00eb shum\u00eb nj\u00eb marr\u00ebveshje, pasi ishte pron\u00eb q\u00eb nuk disponon hipotek\u00eb. Sipas saj, nj\u00eb pron\u00eb e till\u00eb nuk lihet dot si garanci n\u00eb bank\u00eb.<\/p>\n<p>\u201cInteresi \u00ebsht\u00eb i lart\u00eb, por edhe risku ka qen\u00eb i lart\u00eb, pasi A.K. rezultonte t\u00eb ishte cil\u00ebsuar si debitor i keq prej bankave,\u201d tha Sevdari dhe shtoi se A.K. ka marr\u00eb hua t\u00eb menj\u00ebhershme dhe pa procedura.<\/p>\n<p>Sipas saj, A.K. kishte nevoj\u00eb p\u00ebr likujditet dhe ai kishte pritshm\u00ebri q\u00eb nga gjyqet do t\u00eb fitonte rreth 23 milion\u00eb euro dhe nuk do t\u00eb kishte ndonj\u00eb ndikim shuma 110 mij\u00eb euro. Ajo vijoi se, n\u00eb kushtet kur p\u00ebr huadh\u00ebnien nuk kishte asnj\u00eb garanci juridike, Dyla ishte vendosur t\u00eb jetonte tek apartamenti, pasi duke jetuar aty do t\u00eb kishte nj\u00eb garanci m\u00eb shum\u00eb.<\/p>\n<p>\u201cN\u00ebse ky apartament do t\u00eb legalizohej, huamarr\u00ebsi mund t\u2019ia shiste dikujt tjet\u00ebr. Subjekti nuk kishte asnj\u00eb garanci,\u201d tha Sevdari.<\/p>\n<p>Mbrojt\u00ebsja e subjektit kund\u00ebrshtoi edhe vler\u00ebn e p\u00ebrcaktuar nga KPK p\u00ebr apartamentin n\u00eb shum\u00ebn 116 mij\u00eb euro. Sipas saj, nga ekspertimi i kryer nga nj\u00eb ekspert i pavarur vlera ishte rreth 88 mij\u00eb euro.<\/p>\n<p>Vet\u00eb prokurori Dyla solli n\u00eb v\u00ebmendje se n\u00eb kontrat\u00ebn e huadh\u00ebnies ishte p\u00ebrcaktuar se n\u00eb rast t\u00eb moshlyerjes s\u00eb huas\u00eb dhe interesave, ai mund t\u00eb kompesohej edhe me ndonj\u00eb pasuri tjet\u00ebr q\u00eb zot\u00ebronte huamarr\u00ebsi. \u201cParashikimi n\u00eb kontrat\u00eb se mund t\u00eb me jepej edhe nj\u00eb sht\u00ebpi tjet\u00ebr e rr\u00ebzon dyshimin se e kam bler\u00eb at\u00eb apartament,\u201d pohoi subjekti.<\/p>\n<p>\u201cPo shpjegoj marr\u00ebdh\u00ebnien me at\u00eb person. Ai m\u00eb k\u00ebrkoi hua kursimet dhe ishte ai q\u00eb e p\u00ebrcaktoi interesin, bazuar n\u00eb pritshm\u00ebrit\u00eb e tij nga gjyqet. Un\u00eb k\u00ebrkova t\u00eb binim dakord p\u00ebr interesat n\u00eb euro dhe shpresoj q\u00eb t\u00eb mos p\u00ebrballem n\u00eb dyert e gjykatave p\u00ebr kthimin e huas\u00eb\u201d, vijoi Dyla.<\/p>\n<p>Pyetjes s\u00eb v\u00ebzhguesit t\u00eb ONM, n\u00ebse kishte analizuar situat\u00ebn e proceseve gjyq\u00ebsore t\u00eb A.K. subjekti iu p\u00ebrgjigj negativisht.<\/p>\n<p>\u201cUn\u00eb e njoh si qytetar t\u00eb Kavaj\u00ebs dhe si biznesmen. N\u00eb marr\u00ebdh\u00ebniet e tij me nj\u00eb kompani italiane nuk kam pasur lidhje,\u201d tha ai the theksoi se dyshimet e KPK-s\u00eb nuk mb\u00ebshteten n\u00eb asnj\u00eb prov\u00eb.<\/p>\n<p>Megjith\u00ebse Dyla nuk ka deklaruar n\u00eb vitin 2016 pak\u00ebsimin e gjendjes cash p\u00ebr shkak t\u00eb huadh\u00ebnies, n\u00eb rubrik\u00ebn t\u00eb dh\u00ebna kofidenciale ai ka pasqyruar kontrat\u00ebn e huas\u00eb. Shuli sqaroi se subjekti ka pretenduar se mosdeklarimi i pak\u00ebsimit t\u00eb cash-it ka qen\u00eb nj\u00eb pasakt\u00ebsi q\u00eb nuk mund ta penalizoj\u00eb at\u00eb.<\/p>\n<p>Komisioni ka analizuar mund\u00ebsin\u00eb e krijimit t\u00eb gjendjes cash 50 mij\u00eb euro t\u00eb mbajtur n\u00eb banes\u00eb, prej nga \u00ebsht\u00eb konstatuar pamund\u00ebsi financiare n\u00eb shum\u00ebn 5.6 milion\u00eb lek\u00eb p\u00ebr krijimin e atyre kursimeve.<\/p>\n<p>Sipas Shulit, subjekti ka deklaruar n\u00eb vite gjendje t\u00eb ndryshme cash-i. Megjith\u00ebse Dyla ka pretenduar se ka pasqyruar n\u00eb deklaratat periodike vet\u00ebm shtesat e gjendjes cash p\u00ebr \u00e7do vit, Komisioni i ka konsideruar ato si kursime n\u00eb total.<\/p>\n<p>Pamund\u00ebsi financiare \u00ebsht\u00eb konstatuar edhe p\u00ebr blerjen e nj\u00eb automjeti tip Benz n\u00eb shum\u00ebn 8000 euro n\u00eb vitin 2010. Shuli shpjegoi se subjekti ka rezultuar me balanc\u00eb negative n\u00eb shum\u00ebn 570 mij\u00eb lek\u00eb p\u00ebr blerjen e k\u00ebsaj makine n\u00eb 2010-\u00ebn. Sipas relatores, Dyla e ka kund\u00ebrshtuar k\u00ebt\u00eb rezulatat duke pretenduar se e ka kryer blerjen e mjetit n\u00eb vitin 2011.<\/p>\n<p>Nga analiza financiare e p\u00ebrgjithshme ka rezultuar nj\u00eb bilanc negativ prej 14.4 milion\u00eb lek\u00ebsh, e ndikuar kjo edhe nga llogaritja e vler\u00ebs 110 mij\u00eb euro p\u00ebr apartamentin. Analiza financiare e KPK u kund\u00ebrshtua nga Dyla dhe avokatja Sevdari. Ata e cil\u00ebsuan si t\u00eb pabazuar konsiderimin si shpenzim t\u00eb vler\u00ebs 110 mij\u00eb euro n\u00eb vitin 2016.<\/p>\n<p>Gjithashtu, ata theksuan se p\u00ebr \u00e7do vit ishin deklaruar shtesat e gjendjes cash dhe jo gjendjen totale. Subjekti pretendoi se nga analiza financiare, n\u00ebse konsiderohen gjendjet cash si shtesa t\u00eb \u00e7do viti, at\u00ebher\u00eb ai rezulton me balanc\u00eb pozitive p\u00ebr krijimin e shum\u00ebs 50 mij\u00eb euro dhe shpenzimet.<\/p>\n<p>N\u00eb seanc\u00eb u evidentua paqart\u00ebsi edhe p\u00ebr p\u00ebrdorimin e nj\u00eb apartamenti n\u00eb Kavaj\u00eb p\u00ebr periudh\u00ebn 2012-2015, pa kund\u00ebrshp\u00ebrblim. Sipas Shulit, Dyla ka deklaruar se apartamentin ia kishte l\u00ebn\u00eb n\u00eb p\u00ebrdorim shtetasi B.M. me t\u00eb cilin kishte miq\u00ebsi, megjith\u00ebse ka rezultuar se banesa ishte n\u00eb pron\u00ebsi t\u00eb v\u00ebllait t\u00eb tij, shtetasit F.M.. Subjekti ka shpjeguar se F.M. ishte n\u00eb gjendje t\u00eb mir\u00eb ekonomike dhe ishte dakord\u00ebsuar ta p\u00ebrdorte apartamentin pa paguar qira.<\/p>\n<p>N\u00eb k\u00ebt\u00eb rast nuk \u00ebsht\u00eb gjetur konflikt interesi, por Komisioni e konsideron t\u00eb paqart\u00eb p\u00ebrdorimin e apartamentit p\u00ebr disa vite, pa kund\u00ebrshp\u00ebrblim.
