Komisioni e ka p\u00ebrfunduar hetimin vet\u00ebm p\u00ebr kriterin e pasuris\u00eb.<\/p>\n<p>Gjyqtari Durim Hasa u mbrojt p\u00ebrpara KPK-s\u00eb me argumentin se mendonte si ishte nj\u00eb gjyqtar shum\u00eb i mir\u00eb dhe pretendoi se nuk e kishte nxjerr\u00eb ndonj\u00ebher\u00eb drejt\u00ebsin\u00eb n\u00eb shitje.<\/p>\n<p>Trupi gjykues q\u00eb po kryen pocesin e rivler\u00ebsimit p\u00ebr gjyqtarin Hasa kryesohet nga Firdes Shuli, me relatore Etleda \u00c7iftjan dhe an\u00ebtar Roland Ilian. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Branko Hrvatin.<\/p>\n<p>Durim Hasa e ka nisur karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1994 dhe ka punuar fillimisht si gjyqtar n\u00eb Gjykat\u00ebn e Skraparit. Prej vitit 2008, ai e ushtron funksionin n\u00eb Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Berat.<\/p>\n<p>Sipas KPK-s\u00eb, gjyqtari Hasa nuk e ka pasqyruar sakt\u00eb burimin e krijimit t\u00eb nj\u00eb apartamenti me sip\u00ebrfaqe 96.6 m2 n\u00eb Linz\u00eb t\u00eb Tiran\u00ebs, i bler\u00eb n\u00eb vitin 2007 kundrejt shum\u00ebs 19 109 euro. Ai ka deklaruar gjithashtu se ka shpenzuar 700 mij\u00eb lek\u00eb p\u00ebr mobilimin.<\/p>\n<p>Si burim t\u00eb k\u00ebsaj pasurie, Hasa ka deklaruar kursimet familjare, por relatorja \u00c7iftja tha se n\u00eb vitin 2006, subjekti kishte sh\u00ebnuar si burim edhe nj\u00eb hua prej 400 mij\u00eb lek\u00ebsh marr\u00eb nga v\u00ebllai dhe 1 milion lek\u00eb t\u00eb dhuruara nga babai.<\/p>\n<p>Sipas KPK, ai nuk ka v\u00ebrtetuar me dokumentacion ligjor t\u00eb ardhurat e v\u00ebllait dhe babait nga bujq\u00ebsia.<\/p>\n<p>P\u00ebr kursimet e deklaruara nga Hasa p\u00ebr periudh\u00ebn 1993-2003 n\u00eb shum\u00ebn totale 500 mij\u00eb lek\u00eb, KPK konstaton balanc\u00eb negative n\u00eb vler\u00ebn 825 mij\u00eb lek\u00eb. Balanc\u00eb negative n\u00eb shum\u00ebn 39 mij\u00eb lek\u00eb \u00ebsht\u00eb konstatuar edhe p\u00ebr kursimet n\u00eb vitin 2005.<\/p>\n<p>N\u00eb p\u00ebrfundim, Komisioni nuk ka p\u00ebrfshir\u00eb n\u00eb analiz\u00eb kursimet e deklaruara p\u00ebr vitet kur \u00ebsht\u00eb konkluduar balanc\u00eb negative si dhe huaja e marr\u00eb nga v\u00ebllai dhe dhurata nga i ati, prej nga ka rezultuar pamund\u00ebsi financiare p\u00ebr pages\u00ebn e vler\u00ebs 34 mij\u00eb euro n\u00eb vitin 2006 p\u00ebr porositjen e apartamentit dhe blerjen e orendive.<\/p>\n<p>Gjyqtari Hasa deklaroi n\u00eb seanc\u00eb se kishte dor\u00ebzuar dokumente q\u00eb v\u00ebrtetonin se v\u00ebllai kishte qen\u00eb i siguruar si bujk dhe se kjo v\u00ebrtetonte se kishte ushtruar k\u00ebt\u00eb aktivitet prej nga kishte p\u00ebrfituar t\u00eb ardhura t\u00eb konsiderueshme. Edhe p\u00ebr t\u00eb atin ai pretendoi se kishte pasur t\u00eb ardhura t\u00eb mjaftueshme p\u00ebr dhurimin e vler\u00ebs 1 milion lek\u00eb dhe solli n\u00eb v\u00ebmendje vlerat n\u00eb depozitat bankare t\u00eb babait.<\/p>\n<p>\u201cBujq\u00ebsia edhe n\u00eb Myzeqe nuk \u00ebsht\u00eb formalizuar, e jo m\u00eb n\u00eb nj\u00eb fshat t\u00eb Skraparit,\u201d u mbrojt subjekti n\u00eb seanc\u00eb.<\/p>\n<p>Pamund\u00ebsi financiare \u00ebsht\u00eb gjetur edhe p\u00ebr blerjen e nj\u00eb nj\u00ebsie sh\u00ebrbimi me sip\u00ebrfaqe 32.9 m2, n\u00eb t\u00eb nj\u00ebjtin pallat ku gjendet apartamenti, si burim krijjimi s\u00eb t\u00eb cil\u00ebs ka deklaruar t\u00eb ardhurat familjare dhe nj\u00eb kredi. \u00c7iftja evidentoi se Hasa ka deklaruar se e ka bler\u00eb k\u00ebt\u00eb pasuri n\u00eb shum\u00ebn shum\u00ebn 30 mij\u00eb euro, nd\u00ebrkoh\u00eb q\u00eb n\u00eb kontrat\u00eb \u00ebsht\u00eb pasqyruar \u00e7mimi 2.1 milion\u00eb lek\u00eb duke e konsideruar si mosp\u00ebrputhje.<\/p>\n<p>Relatorja Etleda \u00c7iftja n\u00ebnvizoi se p\u00ebr shpenzimin 2.1 milion\u00eb lek\u00eb t\u00eb pasqyruar n\u00eb kontrat\u00eb jan\u00eb p\u00ebrllogaritur si burim n\u00eb analiz\u00ebn financiare kursimet, nd\u00ebrsa p\u00ebr pjes\u00ebn e mbetur t\u00eb vler\u00ebs s\u00eb nj\u00ebsis\u00eb s\u00eb sh\u00ebrbimit \u00ebsht\u00eb konsideruar kredia. Nga analiza financiare jan\u00eb konkluduar pamund\u00ebsi financiare p\u00ebr pagesat e kryera n\u00eb vitin 2009, p\u00ebrkat\u00ebsisht n\u00eb shumat 441 mij\u00eb lek\u00eb dhe 211 lek\u00eb.<\/p>\n<p>Hasa deklaroi n\u00eb seanc\u00eb se \u00e7mimi i sh\u00ebnuar n\u00eb kontrat\u00eb nuk ishte real, pasi ishte dakord\u00ebsuar me shit\u00ebsin me q\u00ebllim p\u00ebrfitimin e kredis\u00eb q\u00eb do t\u00eb sh\u00ebrbente p\u00ebr shlyerjen e \u00e7mimit t\u00eb k\u00ebsaj pasurie.<\/p>\n<p>\u201cHartuam nj\u00eb kontrat\u00eb, q\u00eb p\u00ebr nga shuma ishte fiktive, por q\u00eb ishte e ligjshme p\u00ebr at\u00eb q\u00eb do realizonim. Banka nuk e pranoi, pasi kolaterali duhej t\u00eb ishte 130% dhe u detyrova e vendosa sht\u00ebpin\u00eb,\u201d tha gjyqtari.<\/p>\n<p>Mosp\u00ebrputhje n\u00eb deklarim KPK ka gjetur edhe p\u00ebr nj\u00eb garazh me sip\u00ebrfaqe 24.8 m2 t\u00eb ndodhur po n\u00eb Linz\u00eb t\u00eb Tiran\u00ebs, t\u00eb bler\u00eb p\u00ebr \u00e7mimin 5555 euro. \u00c7iftja tha se Hasa nuk ka deklaruar se e ka bler\u00eb garazhin n\u00eb bashk\u00ebpron\u00ebsi me shtetasin R.C., me pjes\u00eb takuese 50% secili.<\/p>\n<p>Komisioni konstaton pamund\u00ebsi financiare p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 55 m2 n\u00eb qytetin e Beratit n\u00eb vitin 2015 p\u00ebr \u00e7mimin 2.4 milion\u00eb lek\u00eb. Si burim krijimi p\u00ebr k\u00ebt\u00eb pasuri, Hasa ka deklaruar nj\u00eb kredi dhe t\u00eb ardhurat familjare.<\/p>\n<p>Nga analiza financiare ka rezultuar pamund\u00ebsi financiare n\u00eb shum\u00ebn 1.1 milion lek\u00eb p\u00ebr blerjen e k\u00ebsaj pasurie.<\/p>\n<p>Gjithashtu, Hasa \u00ebsht\u00eb gjetur n\u00eb pamund\u00ebsi n\u00eb shum\u00ebn 993 mij\u00eb edhe p\u00ebr blerjen e nj\u00eb autoveture tip Renault n\u00eb vitin 2011 p\u00ebr \u00e7mimin 2700 euro.<\/p>\n<p>Komisioni konstaton mosdeklarimin e dh\u00ebnies s\u00eb k\u00ebsaj huaje n\u00eb vitin 2004 si dhe kthimin e saj. Nd\u00ebrkoh\u00eb, \u00ebsht\u00eb konstatuar pamund\u00ebsi financiare p\u00ebr dh\u00ebnien e k\u00ebsaj vlere, pasi n\u00eb vitet 2004 dhe 2005 likujditetet jan\u00eb deklaruar n\u00eb form\u00ebn e cash-it.<\/p>\n<p>I pyetur nga relatorja \u00c7iftja n\u00ebse kishte shqyrtuar ndonj\u00eb \u00e7\u00ebshtje me personin q\u00eb i kishte dh\u00ebn\u00eb hua me interes, Hasa deklaroi se kishte shqyrtuar nj\u00eb mas\u00eb sigurimi. \u00c7iftja evidentoi se masa e leht\u00eb e vendosur prej tij ishte ndryshuar nga Apeli dhe se vendimi i ndryshuar ishte l\u00ebn\u00eb n\u00eb fuqi edhe nga Gjykata e Lart\u00eb.<\/p>\n<p>Hasa tha se kishte dh\u00ebn\u00eb vendim t\u00eb drejt\u00eb dhe se nuk kishte k\u00ebrkuar dor\u00ebheqjen nga gjykimi, pasi marr\u00ebdh\u00ebnia kishte ndodhur shum\u00eb vite m\u00eb par\u00eb dhe nuk e mbante mend.<\/p>\n<p><strong>Apartamentet n\u00eb \u00c7orovod\u00eb<\/strong><\/p>\n<p>Relatorja \u00c7iftja tha se jan\u00eb konstatuar rrethana kontradiktore t\u00eb subjektit p\u00ebr dy apartamente n\u00eb \u00c7orovod\u00eb. \u00a0Ajo shtoi se subjekti ka deklaruar se n\u00eb periudh\u00ebn \u201896-\u201898 ka jetuar n\u00eb nj\u00eb apartament me sip\u00ebrfaqe 78 m2 n\u00eb \u00c7orovod\u00eb, q\u00eb \u00ebsht\u00eb bler\u00eb \u2018de jure\u2019 n\u00eb vitin 1999.<\/p>\n<p>Ky apartament \u00ebsht\u00eb shitur n\u00eb vler\u00ebn e 2.2 milion\u00eb lek\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb, n\u00eb vitin 1996, subjekti ka bler\u00eb nj\u00eb apartament 1+1, por nuk e ka pasqyruar k\u00ebt\u00eb pasuri n\u00eb deklarat\u00ebn fillestare t\u00eb vitit 2003, si dhe ka sh\u00ebnuar adres\u00eb tjet\u00ebr banimi.<\/p>\n<p>Sipas relatores, subjekti ka shpjeguar p\u00ebr Komisionin se apartemnti 1+1 \u00ebsht\u00eb bler\u00eb n\u00eb vitin 1998 kundrejt shum\u00ebs 800 mij\u00eb lek\u00eb, por pa dokumente. Ajo shtoi se rezulton q\u00eb ky apartament t\u00eb jet\u00eb shk\u00ebmbyer me nj\u00eb tjet\u00ebr dhe apartamenti i p\u00ebrfituar nga k\u00ebmbimi \u00ebsht\u00eb shitur 1.8 milion\u00eb lek\u00eb n\u00eb vitin 2011.<\/p>\n<p>Komisioni konstaton se subjekti nuk e ka deklaruar k\u00ebmbimin e apartamenteve. \u201cNga analizimi i apartamenteve t\u00eb k\u00ebmbyera, subjekti ka ushtruar tagrat e pronarit kur nuk mund t\u00eb sillej si pronar, pasi ishte posedues pa letra,\u201d evidentoi \u00c7iftja.<\/p>\n<p>\u201cKa kryer veprime de facto q\u00eb sjellin c\u00ebnim t\u00eb etik\u00ebs s\u00eb magjistratit. Gjyqtari duhet t\u00eb shmang\u00eb \u00e7do sjellje q\u00eb c\u00ebnon figur\u00ebn e magjistratit,\u201d theksoi ajo dhe shtoi se Komisioni ka konsideruar n\u00eb analiz\u00ebn financiare vet\u00ebm dokumentacionin dhe transaksionet ligjore.<\/p>\n<p>Hasa deklaroi se gabimi q\u00eb mund t\u00eb kishte kryer p\u00ebr k\u00ebto pasuri kishte qen\u00eb mosdeklarimi.<\/p>\n<p>\u201cK\u00ebt\u00eb sht\u00ebpi e bleva p\u00ebr t\u00eb mbajtur peng shit\u00ebsin e sht\u00ebpis\u00eb. E bleva un\u00eb pa dokumenta. E gjith\u00eb ngat\u00ebrresa vjen nga blerja e k\u00ebsaj sht\u00ebpie n\u00eb \u201896 pa dokumenta, pa filluar deklarimi. Kur erdhi momenti deklarimit, nuk dija ca t\u00eb b\u00ebja.
