Foto:Vladimir Karaj<\/figcaption><\/figure>\n<p>Komisioni i Pavarur i Kualifikimit, KPK vendosi m\u00eb 18 janar t\u00eb shkarkoj\u00eb nga detyra gjyqtarin e Gjykat\u00ebs s\u00eb Posa\u00e7me t\u00eb Shkall\u00ebs s\u00eb Par\u00eb p\u00ebr Korrupsionin dhe Krimin e Organizuar, Bib Ndreca, pasi u konstatuan probleme n\u00eb kontrat\u00ebn p\u00ebr kalimin e t\u00eb drejtave p\u00ebr nj\u00eb apartament n\u00eb Tiran\u00eb, si dhe pamund\u00ebsi financiare p\u00ebr kryerjen e k\u00ebtij investimi. Komisioni nuk konstaton probleme t\u00eb tjera p\u00ebr kriterin e pasuris\u00eb, nd\u00ebrsa e ka vler\u00ebsuar Ndrec\u00ebn pozitivisht p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs dhe profesionalizmin.<\/p>\n<p>Gjyqtari Bib Ndreca ka mbaruar Shkoll\u00ebn e Magjistratur\u00ebs n\u00eb vitin 2009 dhe \u00ebsht\u00eb em\u00ebruar fillimisht n\u00eb Gjykat\u00ebn e Tropoj\u00ebs. N\u00eb vitin 2013 u em\u00ebra kryetar i Gjykat\u00ebs s\u00eb Puk\u00ebs, nd\u00ebrsa n\u00eb vitin 2015 u dekretua si an\u00ebtar i Gjykat\u00ebs s\u00eb Shkall\u00ebs s\u00eb Par\u00eb p\u00ebr Krime t\u00eb R\u00ebnda.<\/p>\n<p>Trupi gjykues i KPK i kryesuar nga Xhensila Pine, me relatore Pamela Qirkon dhe Etleda \u00c7iftjan an\u00ebtare, konkludojn\u00eb se gjyqtari Ndreca duket se ka vepruar n\u00eb kund\u00ebrshtim me rregullat etik\u00ebs, pasi me veprime aktive ka marr\u00eb pjes\u00eb n\u00eb n\u00ebshkrimin e kontrat\u00ebs s\u00eb kalimit t\u00eb t\u00eb drejtave t\u00eb nj\u00eb apartamenti 1+1 me sip\u00ebrfaqe 84.6 m2 n\u00eb kryeqytet, n\u00eb munges\u00eb t\u00eb nj\u00ebr\u00ebs pal\u00eb.<\/p>\n<p>\u201c[\u2026]kontrat\u00eb e cila \u00ebsht\u00eb paraqitur n\u00eb institucionet publike, dhe se ngrihen dyshime t\u00eb arsyeshme p\u00ebr v\u00ebrtet\u00ebsin\u00eb e t\u00ebr\u00ebsis\u00eb s\u00eb k\u00ebsaj marr\u00ebdh\u00ebnie juridike \u2013 p\u00ebr kalimin e t\u00eb drejtave pasurore mbi apartamentin n\u00eb Tiran\u00eb,\u201d shprehet trupi gjykues i KPK dhe vler\u00ebson se gjyqtari Ndreca, ve\u00e7 munges\u00ebs s\u00eb burimeve, gjendet n\u00eb kushtet e deklarimit t\u00eb pasakt\u00eb dhe t\u00eb pamjaftuesh\u00ebm p\u00ebr k\u00ebt\u00eb pasuri.<\/p>\n<p>Komisioni ka arritur n\u00eb k\u00ebt\u00eb konkluzion pasi ka verifikuar sistemin TIMS, prej nga ka rezultuar se personi q\u00eb i ka kaluar Ndrec\u00ebs t\u00eb drejtat p\u00ebr apartamentin n\u00eb Tiran\u00eb, nuk \u00ebsht\u00eb ndodhur n\u00eb Shqip\u00ebri n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs.<\/p>\n<p>Ndreca ka sqaruar se apartamenti q\u00eb ai ka bler\u00eb n\u00eb vitn 2012, ishte porositur fillimisht nga shtetasi Sh.A. i cili ka hequr dor\u00eb kundrejt \u00e7mimit 40 mij\u00eb euro.<\/p>\n<p>Komisioni v\u00ebren se nga hetimi ka rezultuar se Sh.A. e ka porositur apartamentin me sip\u00ebrfaqe 84.6 m2 n\u00eb prill t\u00eb vitit 2007. Nd\u00ebrkoh\u00eb, m\u00eb 29 maj 2012, mes Ndrec\u00ebs n\u00eb cil\u00ebsin\u00eb e porosit\u00ebsit t\u00eb dyt\u00eb; Sh.A., n\u00eb cil\u00ebsin\u00eb e porosit\u00ebsit t\u00eb par\u00eb dhe shoq\u00ebris\u00eb nd\u00ebrtuese, \u00ebsht\u00eb lidhur kontrata p\u00ebr kalim t\u00eb drejtash p\u00ebr apartamentin n\u00eb fjal\u00eb.<\/p>\n<p>Sipas k\u00ebsaj kontrate, Sh.A., heq dor\u00eb nga kjo pasuri dhe b\u00ebhet kalimi i t\u00eb drejtave t\u00eb pron\u00ebsis\u00eb n\u00eb favor t\u00eb subjektit t\u00eb rivler\u00ebsimit, duke u b\u00ebr\u00eb dhe dor\u00ebzimi i apartamentit. Vlera e blerjes e deklaruar \u00ebsht\u00eb 40 mij\u00eb\u00a0euro dhe n\u00eb kontrat\u00eb pasqyrohet burimi i krijimit t\u00eb shum\u00ebs s\u00eb paguar nga subjekti i rivler\u00ebsimit, konkretisht shuma 35 mij\u00eb euro e marr\u00eb hua nga v\u00ebllai i tij, z. P.N., dhe shuma 5 mij\u00eb euro nga kursimet e tij personale.<\/p>\n<p>Bashk\u00eblidhur dokumentacionit t\u00eb dor\u00ebzuar nga subjekti i rivler\u00ebsimit p\u00ebr k\u00ebt\u00eb pasuri, \u00ebsht\u00eb konstatuar se deklarata \u00ebsht\u00eb plot\u00ebsuar me shkrim t\u00eb lir\u00eb dore nga shtetasi R.A., q\u00eb mban dat\u00ebn 29 maj 2012, sipas s\u00eb cil\u00ebs ai deklaron se ka marr\u00eb p\u00ebr llogari t\u00eb \u00c7., shum\u00ebn 40 mij\u00eb euro nga shitja e apartamentit.Komisioni ka kryer verifikime n\u00eb sistemin TIMS p\u00ebr shtetasin Sh.A., prej nga ka rezultuar se ai nuk ndodhej n\u00eb tetrorritorin shqiptar m\u00eb dat\u00eb 29 maj 2012, kur \u00ebsht\u00eb n\u00ebnshkruar kontrata.<\/p>\n<p>Trupi gjykues vler\u00ebson se konsiderohet absolutisht i pavlefsh\u00ebm veprimi juridik, i cili, p\u00ebr shkak t\u00eb shkeljes s\u00eb ligjit ose p\u00ebr shkak tjet\u00ebr t\u00eb parashikuar n\u00eb ligj, nuk ka fuqi juridike ose \u00ebsht\u00eb i paaft\u00eb t\u00eb sjell\u00eb pasojat juridike t\u00eb synuara nga pal\u00ebt.<\/p>\n<p>\u201c[\u2026]kontrata p\u00ebr kalim t\u00eb drejtash p\u00ebr blerjen e k\u00ebtij apartamenti nga subjekti i rivler\u00ebsimit \u00ebsht\u00eb veprim juridik i dyansh\u00ebm, p\u00ebr t\u00eb cilin mungon shfaqja e ligjshme e vullnetit, pasi shtetasi Sh.A., nuk gjendej n\u00eb territorin shqiptar n\u00eb momentin e n\u00ebnshkrimit t\u00eb saj\u201d, thekson KPK dhe konstaton se e gjith\u00eb marr\u00ebdh\u00ebnia p\u00ebr blerjen e pasuris\u00eb \u00ebsht\u00eb krijuar me shtetasin R.A., xhaxhain e Sh.A. dhe se kontrata \u00ebsht\u00eb n\u00ebnshkruar n\u00eb munges\u00eb t\u00eb pal\u00ebs tjet\u00ebr.\u00a0\u201cDuke konsideruar faktin se subjekti ka pasur njohuri t\u00eb mira ligjore, ngrihen dyshime t\u00eb arsyeshme p\u00ebr marr\u00ebdh\u00ebnien e tij me shtetasit e sip\u00ebrcituar dhe vet\u00ebbesimit t\u00eb tepruar p\u00ebr pagimin dhe dor\u00ebzimin e \u00e7mimit t\u00eb blerjes n\u00eb nj\u00eb shum\u00eb t\u00eb konsiderueshme nj\u00eb personi t\u00eb ndrysh\u00ebm nga ai i cili mbante t\u00eb drejtat reale mbi pasurin\u00eb objekt hetimi\u201d, konstaton Komisioni.N\u00eb vendim thuhet se gjyqtari Ndreca ka vepruar n\u00eb kund\u00ebrshtim me rregullat e etik\u00ebs, pasi me veprime aktive ka marr\u00eb pjes\u00eb n\u00eb n\u00ebnshkrimin e nj\u00eb kontrate n\u00eb munges\u00eb t\u00eb pal\u00ebs tjet\u00ebr dhe shfaqjes s\u00eb ligjshme t\u00eb vullnetit t\u00eb saj.<\/p>\n<p>\u201cKontrata, e cila \u00ebsht\u00eb paraqitur n\u00eb institucionet publike, ngre dyshime t\u00eb arsyeshme p\u00ebr v\u00ebrtet\u00ebsin\u00eb e t\u00ebr\u00ebsis\u00eb s\u00eb k\u00ebsaj marr\u00ebdh\u00ebnieje juridike\u201d, vler\u00ebson trupi gjykues.Pas kalimit t\u00eb barr\u00ebs s\u00eb prov\u00ebs, Ndreca ka pretenduar se Sh.A., ka qen\u00eb prezent n\u00eb momentin e n\u00ebnshkrimin e kontrat\u00ebs, duke pretenduar se sistemi TIMS nuk tregon gjith\u00e7ka dhe as nuk provon vendndodhjen.<\/p>\n<p>P\u00ebr t\u00eb mb\u00ebshtetur deklarimet e tij subjekti ka depozituar si dokumentacion provues deklarat\u00eb noteriale t\u00eb Sh.A., ku ky i fundit shprehet se ka qen\u00eb i pranish\u00ebm n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs; si edhe kat\u00ebr kartela dentare p\u00ebr trajtim pacient\u00ebsh, n\u00ebp\u00ebrmjet t\u00eb cilave pretendohet se ai ka trajtuar pacient\u00eb n\u00eb klinik\u00ebn e tij n\u00eb Tiran\u00eb, n\u00eb datat 12 maj 2012; 25 maj 2012; 29 maj 2012 dhe 30 maj 2012.<\/p>\n<p>Komisioni v\u00ebren se, pavar\u00ebsisht dokumenteve t\u00eb paraqitura nga Ndreca, nuk jan\u00eb depozituar prova p\u00ebr t\u00eb dh\u00ebnat e regjistrimit t\u00eb klinik\u00ebs s\u00eb Sh.A., apo t\u00eb dh\u00ebna t\u00eb pun\u00ebsimit t\u00eb tij n\u00eb k\u00ebt\u00eb periudh\u00eb.\u00a0\u201cP\u00ebr m\u00eb tep\u00ebr, nga verifikimi i faqes zyrtare t\u00eb QKB-s\u00eb, Komisioni konstatoi se z. Sh.A., figuron i regjistuar n\u00eb k\u00ebt\u00eb organ n\u00eb dat\u00ebn 28.8.2015\u201d, citohet n\u00eb vendim.<\/p>\n<p>Trupi gjykues i ka vler\u00ebsuar jo bind\u00ebse shpjegimet dhe provat e Ndrec\u00ebs dhe konkludon se ai nuk arriti t\u00eb provoj\u00eb tej \u00e7do dyshimi t\u00eb arsyesh\u00ebm q\u00eb shtetasi Sh.A., gjendej n\u00eb Shqip\u00ebri dhe se ishte i pranish\u00ebm n\u00eb momentin e n\u00ebnshkrimit t\u00eb kontrat\u00ebs.<\/p>\n<p>Si burim p\u00ebr blerjen e apartamentit kundrejt vler\u00ebs 40 mij\u00eb euro, gjyqtari Ndreca ka deklaruar kursime nd\u00ebr vite n\u00eb shum\u00ebn\u00a05 mij\u00eb euro; hua n\u00eb vler\u00ebn 35 mij\u00eb euro nga v\u00ebllai \u00a0dhe kredi bankare.<\/p>\n<p>Nga analiza financiare ka rezultuar se Ndreca ka pasur mund\u00ebsi p\u00ebr kursimin e vler\u00ebs 5000 euro, nd\u00ebrkoh\u00eb q\u00eb \u00ebsht\u00eb konkluduar se v\u00ebllai nuk ka patur burime financiare t\u00eb ligjshme p\u00ebr t\u00eb mund\u00ebsuar shum\u00ebn e dh\u00ebn\u00eb hua n\u00eb vler\u00ebn 5.5 milion\u00eb lek\u00eb n\u00eb favor t\u00eb subjektit t\u00eb rivler\u00ebsimit m\u00eb dat\u00ebn 29 maj 2012.<\/p>\n<p>\u201cBazuar n\u00eb analiz\u00ebn financiare\/ligjore t\u00eb burimeve t\u00eb krijimit (t\u00eb deklaruara nga subjekti) t\u00eb pasuris\u00eb objekt vler\u00ebsimi, trupi gjykues arrin n\u00eb p\u00ebrfundimin se subjekti i rivler\u00ebsimi nuk ka pasur burime financiare t\u00eb ligjshme t\u00eb mjaftueshme p\u00ebr t\u00eb justifikuar plot\u00ebsisht pages\u00ebn n\u00eb shum\u00ebn 40,000 euro, t\u00eb kryer n\u00eb dat\u00ebn 29.5.2012 p\u00ebr kalimin e t\u00eb drejtave mbi pasurin\u00eb e llojit \u2018apartament banimi\u2019\u201d, konkludon KPK.<\/p>\n<p>P\u00ebr disa pasuri tok\u00eb-ar\u00eb, t\u00eb p\u00ebrpjestuara me v\u00ebllez\u00ebrit n\u00eb vitin 2011, Komisioni nuk ka gjetur probleme. \u201c[\u2026]trupi gjykues vler\u00ebson se p\u00ebr sa koh\u00eb nuk jan\u00eb pasuri t\u00eb investuara nga subjekti i rivler\u00ebsimit apo t\u00eb regjistruara n\u00eb emrin e tij, p\u00ebr m\u00eb tep\u00ebr, duke qen\u00eb se ato jan\u00eb krijuar p\u00ebrpara fillimit t\u00eb detyr\u00ebs, kryerja e k\u00ebtyre investimeve dhe analizimi i burimeve financiare t\u00eb tyre, nuk mund t\u00eb jen\u00eb pjes\u00eb dhe nuk mund t\u00eb ndikojn\u00eb n\u00eb procesin e rivler\u00ebsimit dhe as n\u00eb vendimmarrjen p\u00ebrfundimtare p\u00ebr k\u00ebt\u00eb subjekt\u201d, citohet n\u00eb vendim.<\/p>\n<p>Pa probleme kan\u00eb rezultuar edhe dhurimi i nj\u00eb automjeti tip Benz nga v\u00ebllai n\u00eb janar t\u00eb vitit 2009, para se ai t\u00eb fillonte stazhin profesional, si dhe shitja e k\u00ebsaj makine n\u00eb vitin 2014 p\u00ebr vler\u00ebn 1.2 milion\u00eb lek\u00eb.
