Foto: Edmond Hoxhaj.<\/figcaption><\/figure>\n<p>Komisioni i Pavarur i Kualifikimit, KPK vendosi m\u00eb 21 tetor t\u00eb konfirmoj\u00eb n\u00eb detyr\u00eb prokurorin e Apelit Tiran\u00eb, Arben Qosja pasi shpjegimet dhe provat e dor\u00ebzuara prej k\u00ebtij t\u00eb fundit lidhur me nj\u00eb pjes\u00eb t\u00eb burimeve financiare q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr blerjen e apartamentit t\u00eb vet\u00ebm q\u00eb zot\u00ebron, u konsideruan t\u00eb besueshme edhe pse jan\u00eb debatuar mes an\u00ebtar\u00ebve t\u00eb trupit gjykues lidhur me ligjshm\u00ebrin\u00eb e tyre. Komisioni e ka shtrir\u00eb hetimin n\u00eb pronat fillestare t\u00eb familjes dhe rezultatet jan\u00eb gjetur n\u00eb harmoni me deklarimet e prokurorit Arben Qosja dhe provat e administruara gjat\u00eb hetimit. Qosja\u00a0u vler\u00ebsua pozitivisht edhe p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs dhe profesionalizmin.<\/p>\n<p>N\u00eb vitin 2005, prokurori Qosja ka bler\u00eb nj\u00eb apartament n\u00eb Tiran\u00eb, p\u00ebr vler\u00ebn 59 mij\u00eb euro. N\u00eb deklarat\u00ebn veting, ai ka sh\u00ebnuar si burime krijimi\u00a0vler\u00ebn e p\u00ebrfituar nga\u00a0shitja e apartamentit n\u00eb pron\u00ebsi t\u00eb n\u00ebn\u00ebs D. Q. n\u00eb gusht t\u00eb 2005-\u00ebs p\u00ebr \u00e7mimin 3.8 milion\u00eb lek\u00eb;\u00a0kursime nga paga pa nj\u00eb vler\u00eb t\u00eb p\u00ebrcaktuar dhe huamarrje n\u00eb vitin 2006 n\u00eb mas\u00ebn 20 mij\u00eb euro nga shtetasi N.S., pa kontrat\u00eb, pa interes dhe pa afat.<\/p>\n<p>Nd\u00ebrkoh\u00eb, n\u00eb vitin 2005 ai e ka deklaruar vler\u00ebn e shitjes s\u00eb apartamentit nga n\u00ebna n\u00eb shum\u00ebn 2 milion\u00eb lek\u00eb, vler\u00eb kjo q\u00eb pasqyrohet edhe n\u00eb kontrat\u00ebn e shit-blerjes. N\u00eb deklarat\u00ebn e po atij viti, Qosja ka pasqyruar lidhjen e kontrat\u00ebs paraprake dhe pagimin e vler\u00ebs prej 10 mij\u00eb euro nga \u00e7mimi total prej 59 mij\u00eb euro p\u00ebr apartamentin e ri, por nuk ka deklaruar n\u00eb rubrik\u00ebn p\u00ebrkat\u00ebse detyrimin e mbetur ndaj shoq\u00ebris\u00eb shit\u00ebse.<\/p>\n<p>N\u00eb 2006-\u00ebn, ka deklaruar rib\u00ebrjen e kontrat\u00ebs s\u00eb porosis\u00eb, lidhur me ndryshimin e sip\u00ebrfaqes s\u00eb apartamentit nga 99.8 m2 n\u00eb 83.4 m2, si dhe ndryshimin e \u00e7mimit nga 59 mij\u00eb euro n\u00eb 53 mij\u00eb euro, por nuk ka pasqyruar ndonj\u00eb pages\u00eb t\u00eb kryer ndaj shoq\u00ebris\u00eb shit\u00ebse.<\/p>\n<p>I pyetur lidhur me burimin e ligjsh\u00ebm p\u00ebr secil\u00ebn nga pagesat,\u00a0Qosja ka sqaruar se p\u00ebr shlyerjen e k\u00ebstit t\u00eb par\u00eb n\u00eb vler\u00ebn 10 mij\u00eb\u00a0euro n\u00eb qershor t\u00eb 2005-\u00ebs, ka p\u00ebrdorur kursimet e familjes t\u00eb krijuara nd\u00ebr vite. Ai ka pretenduar se ka pasur mund\u00ebsi kursimi pasi p\u00ebr mbulimin e nevojave t\u00eb tjera jan\u00eb p\u00ebrdorur t\u00eb ardhurat e realizuara nga shitja e kryer n\u00eb vitin 1999 t\u00eb dy pasurive t\u00eb paluajtshme n\u00eb em\u00ebr t\u00eb n\u00ebn\u00ebs s\u00eb tij, n\u00eb shum\u00ebn totale 1,4 milion\u00eb lek\u00eb.<\/p>\n<p>Qosja ka pranuar se p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb eksperienc\u00ebs, nuk e ka deklaruar n\u00eb vitin 2003 gjendjen cash n\u00eb shum\u00ebn p\u00ebraf\u00ebrsisht 1.3 milion\u00eb lek\u00eb deri n\u00eb 1.4 milion lek\u00eb. Ai ka shtuar se nj\u00eb vit m\u00eb von\u00eb nuk\u00a0i ka deklaruar kursimet cash p\u00ebr shkak se nuk kishte pasur ndryshim t\u00eb vler\u00ebs q\u00eb dispononte<\/p>\n<p>Komisioni nuk e ka p\u00ebrfshir\u00eb n\u00eb analiz\u00ebn financiare gjendjen cash p\u00ebr shkak t\u00eb mospasqyrimit\u00a0t\u00eb k\u00ebsaj vlere n\u00eb deklaratat periodike dhe prokurori Qosja ka rezultuar n\u00eb pamund\u00ebsi financiare n\u00eb shum\u00ebn 850 mij\u00eb lek\u00eb p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb.<\/p>\n<p>P\u00ebr pages\u00ebn e k\u00ebstit\u00a0t\u00eb dyt\u00eb n\u00eb vler\u00ebn 25 mij\u00eb euro t\u00eb kryer n\u00eb n\u00ebntor t\u00eb vitit 2005, subjekti\u00a0ka k\u00ebmb\u00ebngulur\u00a0se jan\u00eb p\u00ebrdorur t\u00eb ardhurat nga shitja e apartamentit nga n\u00ebna e tij n\u00eb Tiran\u00eb, n\u00eb vler\u00ebn 3,8 milion\u00eb lek\u00eb.<\/p>\n<p>Fillimisht, Komisioni ka analizuar burimet e krijimit t\u00eb apartamentit t\u00eb shitur nga n\u00ebna n\u00eb vitin 2005. Gjat\u00eb procesit t\u00eb rivler\u00ebsimit, Qosja ka shpjeguar se apartamenti me sip\u00ebrfaqe 50 m2 n\u00eb Tiran\u00eb, ishte bler\u00eb prej n\u00ebn\u00ebs n\u00eb vitin 1997 p\u00ebr shum\u00ebn 2 milion\u00eb lek\u00eb dhe si burime kishin sh\u00ebrbyer kursimet familjare dhe shuma 1.3 milion lek\u00eb si kompensim p\u00ebr shembjen e apartamentit q\u00eb zot\u00ebronin prind\u00ebrit n\u00eb Peshkopi, t\u00eb p\u00ebrfituar n\u00ebp\u00ebrmjet privatizimit n\u00eb vitin 1993.<\/p>\n<p>Komisioni evidenton se jan\u00eb v\u00ebrtetuar me dokumentacion ligjor deklarimet e subjektit t\u00eb rivler\u00ebsimit lidhur me dy apartamentet q\u00eb ka zot\u00ebruar familja e tij si dhe transaksionet e kryera.\u00a0Gjithashtu, \u00a0ka rezultuar se familja e subjektit kishte pasur mund\u00ebsi p\u00ebr blerjen e apartamentit n\u00eb Tiran\u00eb n\u00eb vitin 1997.<\/p>\n<p>N\u00eb vijim KPK ndalet n\u00eb diferenc\u00ebn mes \u00e7mimit 2 milion\u00eb lek\u00eb q\u00eb pasqyrohet n\u00eb kontrat\u00ebn e shitjes s\u00eb k\u00ebtij apartamenti dhe vler\u00ebs 3.8 milion\u00eb lek\u00eb t\u00eb pretenduar nga prokurori Qosja. Nga hetimi ka rezultuar se detyrimet tatimore jan\u00eb paguar vet\u00ebm p\u00ebr shum\u00ebn 2 milion\u00eb lek\u00eb.<\/p>\n<p>&#8220;Por, nga ana tjet\u00ebr \u00ebsht\u00eb konstatuar se n\u00eb llogari t\u00eb n\u00ebn\u00ebs s\u00eb subjektit t\u00eb rivler\u00ebsimit, znj. D. Q., pran\u00eb &#8216;Credins Bank&#8217;, n\u00eb t\u00eb nj\u00ebjt\u00ebn dat\u00eb me n\u00ebnshkrimin e kontrat\u00ebs s\u00eb shitblerjes 1.8.2005, \u00ebsht\u00eb transferuar shuma prej 3,800,000 lek\u00ebsh nga znj. A. V. (nj\u00ebri prej bler\u00ebsve t\u00eb apartamentit) me p\u00ebrshkrimin \u2018shlyerje detyrimi personal\u2019\u201d, konstaton KPK.<\/p>\n<p>Nga verifikimi i l\u00ebvizjeve n\u00eb llogarit\u00eb bankare, ka rezultuar se shuma prej 3,8 milion\u00eb lek\u00ebsh \u00ebsht\u00eb vendosur nga n\u00ebna e subjektit n\u00eb depozit\u00eb me afat 1-mujor dhe e gjith\u00eb kjo vler\u00eb \u00ebsht\u00eb t\u00ebrhequr prej saj nj\u00eb dit\u00eb p\u00ebrpara se prokurori Qosja t\u00eb paguante k\u00ebstin e dyt\u00eb n\u00eb shum\u00ebn 25 mij\u00eb euro.<\/p>\n<p>Qosja ka sqaruar se veprimet jan\u00eb kryer nga n\u00ebna e tij, duke qen\u00eb se apartamenti ishte i regjistruar n\u00eb em\u00ebr t\u00eb saj. Sipas tij, pal\u00ebt kan\u00eb r\u00ebn\u00eb dakord se vlera e banes\u00ebs do t\u00eb ishte 3,8 milion\u00eb lek\u00eb, nd\u00ebrkoh\u00eb q\u00eb \u00e7mimi i vendosur n\u00eb kontrat\u00eb mund t\u00eb jet\u00eb propozuar nga noteri apo nga pala bler\u00ebse.<\/p>\n<p>Ai ka dor\u00ebzuar si prov\u00eb nj\u00eb kopje t\u00eb gazet\u00ebs \u201c\u00c7el\u00ebsi\u201d t\u00eb dat\u00ebs 2 korrik 2005, nga ku \u00ebsht\u00eb konstatuar se n\u00eb publikimin p\u00ebr shitje t\u00eb apartamentit n\u00eb fjal\u00eb, vlera ishte p\u00ebrcaktuar 4 milion\u00eb lek\u00eb, i diskutuesh\u00ebm.<\/p>\n<p>Qosja ka depozituar nj\u00eb deklarat\u00eb noteriale t\u00eb bler\u00ebsve, e\u00a0gushtit 2020, ku ata shprehen se \u00e7mimi real i paguar\u00a0prej tyre ishte 3.8 milion\u00eb lek\u00eb. Gjithashtu, subjekti ka depozituar\u00a0dokumentacion p\u00ebr pages\u00eb e tatimit p\u00ebr diferenc\u00ebn prej 1,8 milion lek\u00ebsh.<\/p>\n<p>Komisioni ka verifikuar vler\u00ebn e apartamentit 50 m2 bazuar n\u00eb vler\u00ebn mesatare t\u00eb tregut, pre nga ka rezultuar se \u00e7mimi n\u00eb vitin 2005 do t\u00eb ishte 3 milion\u00eb e 857 mij\u00eb lek\u00eb, thuajse i nj\u00ebjt\u00eb me at\u00eb t\u00eb deklaruar nga subjekti.<\/p>\n<p>Duke mos konsideruar vler\u00ebn 1.8 milion\u00eb lek\u00eb, ka rezultuar balanc\u00eb negative n\u00eb shum\u00ebn 903 mij\u00eb lek\u00eb p\u00ebr k\u00ebstin e dyt\u00eb.\u00a0P\u00ebr k\u00ebstin e tret\u00eb nuk jan\u00eb gjetur probleme, pasi \u00ebsht\u00eb v\u00ebrtetuar mund\u00ebsia e huadh\u00ebn\u00ebsit p\u00ebr t\u00eb kursyer vler\u00ebn 20 mij\u00eb euro.<\/p>\n<p>N\u00eb analiz\u00ebn fillestare t\u00eb kryer nga KPK, duke mos p\u00ebrfshir\u00eb kursimet dhe vler\u00ebn 1.8 milion lek\u00eb, \u00ebsht\u00eb konkluduar pamund\u00ebsi financiare p\u00ebr blerjen e apartamentit, n\u00eb vler\u00ebn totale 1 milion e 753 mij\u00eb lek\u00eb.<\/p>\n<p>Por, bazuar n\u00eb rezultatet e hetimit administrativ, dy an\u00ebtaret e trupit gjykues, Genta Tafa Bungo dhe Suela Zhegu kan\u00eb ndryshuar q\u00ebndrim gjat\u00eb vendimmarrjes p\u00ebrfundimtare, duke e konsideruar vler\u00ebn 1.8 milion\u00eb lek\u00eb si burim t\u00eb ligjsh\u00ebm.<\/p>\n<p>P\u00ebr t\u00eb arritur n\u00eb k\u00ebt\u00eb konkluzion ato u referohen fakteve se, n\u00eb t\u00eb nj\u00ebjt\u00ebn dat\u00eb me n\u00ebnshkrimin e kontrat\u00ebs s\u00eb shitjes s\u00eb apartamentit, \u00ebsht\u00eb kaluar n\u00eb llogarin\u00eb bankare t\u00eb n\u00ebn\u00ebs s\u00eb subjektit vlera 3.8 milion\u00eb lek\u00eb dhe se kjo vler\u00eb \u00ebsht\u00eb t\u00ebrhequr nj\u00eb dit\u00eb para pages\u00ebs s\u00eb k\u00ebstit t\u00eb dyt\u00eb; deklarat\u00ebs s\u00eb bler\u00ebsve se \u00e7mimi i paguar prej tyre ka qen\u00eb 3.8 milion\u00eb lek\u00eb; pages\u00ebs s\u00eb tatimit n\u00eb 2020-\u00ebn; si dhe faktit se gjith\u00eb veprimet financiare, p\u00ebrfshi edhe ato t\u00eb formalizimit t\u00eb kontrat\u00ebs jan\u00eb kryer prej n\u00ebn\u00ebs s\u00eb subjektit.<\/p>\n<p>&#8220;&#8230;Efektivisht subjekti n\u00eb dat\u00ebn 5.11.2005 ka pasur shum\u00ebn prej 3,800,000 lek\u00ebsh, pavar\u00ebsisht n\u00ebse jan\u00eb paguar apo jo detyrimet tatimore. K\u00ebto t\u00eb ardhura mund t\u00eb ken\u00eb qen\u00eb t\u00eb paformalizuara, pasi nuk rezulton t\u00eb jen\u00eb paguar detyrimet tatimore, por jo t\u00eb paligjshme&#8221;, vler\u00ebson shumica e trupit gjykues.<\/p>\n<p>Bungo dhe Zhegu evidentojn\u00eb se n\u00eb Aneksin\u00a0e Kushtetut\u00ebs nuk p\u00ebrcaktohet se kur duhet t\u00eb jen\u00eb paguar detyrimet tatimore p\u00ebr t\u2019i konsideruar t\u00eb ardhurat e ligjshme.<\/p>\n<p>&#8220;P\u00ebr sa koh\u00eb nga ana e n\u00ebn\u00ebs s\u00eb subjektit jan\u00eb paguar detyrimet tatimore konform legjislacionit n\u00eb fuqi, si dhe nga ana e organeve p\u00ebrkat\u00ebse k\u00ebto pagesa jan\u00eb konsideruar t\u00eb rregullta, Komisioni nuk mund t\u2019i konsideroj\u00eb k\u00ebto t\u00eb ardhura jo t\u00eb ligjshme dhe t\u00eb mos i p\u00ebrfshij\u00eb n\u00eb analiz\u00eb financiare\u2026&#8221;, shprehet trupi gjykues dhe vijon se dispozitat\u00a0e legjislacionit tatimor nuk e pengojn\u00eb tatimpaguesin t\u00eb shlyej\u00eb detyrimet tatimore edhe me vones\u00eb.<\/p>\n<p>N\u00eb p\u00ebrfundim, Bungo dhe Zhegu kan\u00eb vendosur ta p\u00ebrfshijn\u00eb vler\u00ebn 1.8 milion\u00eb lek\u00eb si burim t\u00eb ligjsh\u00ebm n\u00eb analiz\u00ebn financiare, q\u00eb ka sjell\u00eb shuarjen e pamund\u00ebsis\u00eb finanicare 903 mij\u00eb lek\u00eb p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb. Mungesat e tjera financiare nuk jan\u00eb \u00e7muar t\u00eb mjaftueshme p\u00ebr shkarkimin nga detyra t\u00eb subjektit.<\/p>\n<p>Relatori Lulzim Hamitaj e mb\u00ebshtet vendimmarrjen p\u00ebrfundimtare t\u00eb shumic\u00ebs, por nuk bie dakord me njohjen si t\u00eb ligjshme t\u00eb t\u00eb ardhurave n\u00eb shum\u00ebn 1,8 milion\u00eb lek\u00eb.<\/p>\n<p>\u201cNdon\u00ebse nga k\u00ebndv\u00ebshtrimi substancial edhe kjo shum\u00eb ka rezultuar me burim t\u00eb provuar dhe t\u00eb qart\u00eb se rrjedh nga i nj\u00ebjti veprim juridik (shitja e pasuris\u00eb s\u00eb znj. D. Q.) \u2013 duke mbajtur n\u00eb v\u00ebmendje jurisprudenc\u00ebn e Kolegjit t\u00eb Posa\u00e7\u00ebm t\u00eb Apelimit, lidhur me moskonsiderimin me burim t\u00eb ligjsh\u00ebm t\u00eb shumave p\u00ebr t\u00eb cilat detyrimet tatimore nuk jan\u00eb shlyer p\u00ebrpara momentit t\u00eb paraqitjes s\u00eb deklarat\u00ebs Vetting \u2013 un\u00eb \u00e7moj se kjo shum\u00eb nuk mund t\u00eb cil\u00ebsohet si nj\u00eb e ardhur me burim t\u00eb ligjsh\u00ebm\u201d, arsyeton Hamitaj.<\/p>\n<p>Pavar\u00ebsisht k\u00ebtij q\u00ebndrimi, Hamitaj shprehet se mungesa financiare prej 903 mij\u00eb lek\u00ebsh q\u00eb ka rezultuar p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb, nuk mund t\u00eb konkurroj\u00eb n\u00eb penalizimin e subjektit me t\u00eb nj\u00ebjt\u00ebn forc\u00eb t\u00eb \u00e7do mungese financiare q\u00eb ka mbetur pa ndonj\u00eb burim t\u00eb provuar, p\u00ebr sa koh\u00eb q\u00eb de facto ka rezultuar me nj\u00eb burim financiar t\u00eb provuar.<\/p>\n<p>Ai konkludon se masa e munges\u00ebs formale t\u00eb burimeve financiare dhe pasakt\u00ebsit\u00eb nuk jan\u00eb t\u00eb mjaftueshme p\u00ebr shkarkimin e prokurorit Qosja.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>N\u00eb vendimin e\u00a0Komisionit t\u00eb Pavarur t\u00eb Kualifikimit debatohet mbi ligjshm\u00ebrin\u00eb e nj\u00eb pjese t\u00eb vler\u00ebs s\u00eb p\u00ebrfituar nga n\u00ebna e prokurorit Arben Qosja prej shitjes apartamentit t\u00eb m\u00ebparsh\u00ebm.
