Procesi i vetingut p\u00ebr Shal\u00ebn u krye nga trupa e drejtuar nga Olsi Komici, me relatore Brunilda Bekteshi dhe an\u00ebtare Firdes Shuli.<\/p>\n<p>Vendimi i zbardhur i KPK-s\u00eb tregon se gjyqtari Shala mori vler\u00ebsime pozitive p\u00ebr figur\u00ebn dhe profesionalizmin, nd\u00ebrsa arriti t\u00eb bindte trup\u00ebn gjykuese se nj\u00eb apartament i bler\u00eb n\u00eb vitin 2000 i p\u00ebrkiste n\u00eb t\u00eb v\u00ebrtet\u00eb tezes s\u00eb tij.<\/p>\n<p>KPK ka konstatuar fillimisht se Shala nuk e ka pasqyruar k\u00ebt\u00eb pasuri n\u00eb deklarat\u00ebn periodike vjetore t\u00eb vitit 2003. Gjithashtu, nuk ka sh\u00ebnuar n\u00eb deklarat\u00ebn periodike vjetore t\u00eb vitit 2004 shk\u00ebmbimin e apartamentit, shitjen, si dhe t\u00eb ardhurat e p\u00ebrfituara.<\/p>\n<p>Pasi Komisioni ka k\u00ebrkuar shpjegime, Shala ka deklaruar se kjo pasuri nuk ka qen\u00eb kurr\u00eb e tij, por e familjes s\u00eb tezes. Ai ka sqaruar se familja e tezes ishte vendosur n\u00eb v\u00ebshtir\u00ebsi financiare n\u00eb vitin 1996 p\u00ebr shkak t\u00eb borxheve q\u00eb kishte krijuar djali i saj nga falimentimi i nj\u00eb aktiviteti privat, i ngritur me vlera financiare t\u00eb marra hua.<\/p>\n<p>Ai ka dor\u00ebzuar n\u00eb KPK disa deklarata noteriale t\u00eb vitit 1996, ku pasqyrohej fakti se sht\u00ebpia q\u00eb familja e tezes kishte p\u00ebrfituar nga privatizimi, ishte shitur dy vite m\u00eb pas, pasi ishte l\u00ebn\u00eb si garanci p\u00ebr disa hua q\u00eb kishte marr\u00eb djali i saj p\u00ebr zhvillimin e nj\u00eb aktiviteti privat.<\/p>\n<p>Shala ka shpjeguar se n\u00eb dhjetor t\u00eb vitit 2000, tezja dhe bashk\u00ebshorti i saj kishin gjetur nj\u00eb mund\u00ebsi p\u00ebr t\u00eb bler\u00eb nj\u00eb apartament n\u00eb periferi t\u00eb qytetit t\u00eb Tiran\u00ebs me \u00e7mim 19 mij\u00eb USD dhe se kishin u kishin k\u00ebrkuar ndihm\u00eb financiare n\u00eb shum\u00ebn 1 milion lek\u00eb prind\u00ebrve t\u00eb tij, pasi nuk e disponin t\u00eb gjith\u00eb vler\u00ebn. Subjekti ka shtuar se p\u00ebr shkak se prind\u00ebrit dispononin vet\u00ebm 500 mij\u00eb lek\u00eb, u kan\u00eb k\u00ebrkuar ndihm\u00eb dy motrave t\u00eb tij, t\u00eb cilat s\u00eb bashku kan\u00eb plot\u00ebsuar shum\u00ebn 500 mij\u00eb lek\u00eb.<\/p>\n<p>Sipas shpjegimeve t\u00eb gjyqtarit Shala, kur ai ka shkuar n\u00eb Tiran\u00eb p\u00ebr t\u2019i dor\u00ebzuar tezes dhe bashk\u00ebshortit t\u00eb saj huan\u00eb prej 1 milion lek\u00ebsh q\u00eb i kishin dh\u00ebn\u00eb prind\u00ebrit, ata i kan\u00eb shprehur frik\u00ebn dhe hezitimin q\u00eb kishin p\u00ebr ta bler\u00eb banes\u00ebn n\u00eb emrin e tyre, p\u00ebr shkak t\u00eb detyrimeve t\u00eb pashlyera t\u00eb t\u00eb birit, q\u00eb i detyruan t\u00eb shisnin edhe banes\u00ebn e tyre t\u00eb m\u00ebparshme.<\/p>\n<p>\u201cN\u00eb k\u00ebto rrethana, ata m\u00eb k\u00ebrkuan q\u00eb kontrat\u00ebn p\u00ebr apartamentin q\u00eb kishin vendosur t\u00eb blinin ta regjistronin n\u00eb emrin tim, p\u00ebr t\u00eb qen\u00eb ata t\u00eb qet\u00eb, si dhe p\u00ebr t\u00eb siguruar borxhin e dh\u00ebn\u00eb nga ana e familjar\u00ebve t\u00eb mi&#8230; Pas k\u00ebsaj bisede kemi shkuar tek noteri dhe un\u00eb kam n\u00ebnshkruar kontrat\u00ebn e shitjes,\u201d ka shpjeguar Shala.<\/p>\n<p>Ai ka shtuar se disa dit\u00eb m\u00eb pas, ka l\u00ebshuar nj\u00eb prokur\u00eb t\u00eb posa\u00e7me, n\u00ebp\u00ebrmjet t\u00eb cil\u00ebs i ka dh\u00ebn\u00eb bashk\u00ebshortit t\u00eb tezes, shtetasit A. B., \u00e7do t\u00eb drejt\u00eb, p\u00ebrfshir\u00eb dhe tjet\u00ebrsimin mbi k\u00ebt\u00eb apartament dhe i ka k\u00ebrkuar q\u00eb sa m\u00eb t\u00eb shpejt ta kalonin pron\u00ebsin\u00eb n\u00eb em\u00ebr t\u00eb tyre. N\u00eb vendim sqarohet se Shala e ka dor\u00ebzuar prokur\u00ebn e posa\u00e7me t\u00eb janarit t\u00eb vitit 2001.<\/p>\n<p>\u201cN\u00eb shtator 2004, apartamenti ka kaluar edhe \u2018de jure\u2019 n\u00eb pron\u00ebsi t\u00eb shtetasit A. B., sipas kontrat\u00ebs s\u00eb shitjes nr. *** rep., nr. *** kol., dat\u00eb 29.9.2004, t\u00eb cil\u00ebn e kam n\u00ebnshkruar personalisht. N\u00eb k\u00ebt\u00eb kontrat\u00eb, si \u00e7mim \u00ebsht\u00eb vendosur shuma prej 1.000.000 lek\u00ebsh, q\u00eb ishte detyrimi q\u00eb tezja dhe bashk\u00ebshorti i saj kishin ndaj prind\u00ebrve t\u00eb mi dhe q\u00eb n\u00eb fakt ishte kthyer nga familja e tezes tek prind\u00ebrit e mi pothuajse plot\u00ebsisht, deri n\u00eb fund t\u00eb vitit 2003,\u201d ka th\u00ebn\u00eb gjyqtari.<\/p>\n<p>N\u00eb p\u00ebrfundim, trupi gjykues vler\u00ebson se subjekti n\u00eb asnj\u00eb rast nuk ka rezultuar titullar i k\u00ebsaj pasurie n\u00eb kontrat\u00ebn e energjis\u00eb elektrike dhe at\u00eb t\u00eb ujit. Gjitashtu, evidentohet fakti se gjith\u00eb dokumentacioni i dor\u00ebzuar nga Shala n\u00eb funksion t\u00eb shpjegimeve t\u00eb tij ka qen\u00eb i prodhuar n\u00eb koh\u00ebn reale.<\/p>\n<p>Komisioni e konsideron t\u00eb besuesh\u00ebm argumentin e subjektit se fillimisht ai e kishte v\u00ebn\u00eb apartamentin n\u00eb emrin e tij me q\u00ebllim q\u00eb t\u00eb mos b\u00ebhej edhe kjo pasuri objekt hipotekimi p\u00ebr t\u00eb grantuar kthimin e borxheve huadh\u00ebn\u00ebsve.<\/p>\n<p>Mosdeklarimin e k\u00ebsaj pasurie nga subjekti n\u00eb vitin 2003, trupi gjykues e konsideron si nj\u00eb veprim t\u00eb nd\u00ebrvarur nga situata, t\u00eb cil\u00ebn e vler\u00ebson objektive.
