Foto: Edmond Hoxhaj.<\/figcaption><\/figure>\n<p>Prokurori i Apelit t\u00eb Tiran\u00ebs, Arben Qosja u p\u00ebrball t\u00eb h\u00ebn\u00ebn me Komisionin e Pavarur t\u00eb Kualifikimit. Procesi i vetingut p\u00ebr prokurorin Qosja po kryhet nga trupa e p\u00ebrb\u00ebr\u00eb nga Genta Tafa Bungo kryesuese, Lulzim Hamitaj relator dhe Suela Zhegu an\u00ebtare. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte i pranish\u00ebm Ferdinando Buatier.<\/p>\n<p>Arben Qosja e ka filluar karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1998 si oficer i Policis\u00eb Gjyq\u00ebsore. N\u00eb vitin 2004, Qosja u em\u00ebrua prokuror n\u00eb Prokurorin\u00eb e Tiran\u00ebs, nd\u00ebrsa prej vitit 2016 e ushtron funksionin n\u00eb Prokurorin\u00eb e Apelit t\u00eb Tiran\u00ebs.<\/p>\n<p>Relatori Lulzim Hamitaj tha n\u00eb seanc\u00ebn d\u00ebgjimore se prokurori Qosja rezultonte n\u00eb pamund\u00ebsi financiare p\u00ebr shlyerjen e dy k\u00ebsteve p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 90.86 m2 n\u00eb Tiran\u00eb n\u00eb vitin 2005, kundrejt vler\u00ebs 53 mij\u00eb euro. Gjithashtu, Komisioni konstatoi se Qosja kishte deklaruar shlyerjen e paradh\u00ebnies n\u00eb vler\u00ebn 10 mij\u00eb euro n\u00eb vitin 2005, por nuk kishte pasqyruar detyrimin e mbetur.<\/p>\n<p>Hamitaj shpjegoi se n\u00eb kontrat\u00ebn fillestare, vlera e apartamentit sh\u00ebnohej 59 mij\u00eb euro, nd\u00ebrkoh\u00eb q\u00eb n\u00eb vitin 2006, prokurori e kishte deklaruar ndryshimin e \u00e7mimit n\u00eb shum\u00ebn 53 mij\u00eb euro p\u00ebr shkak t\u00eb zvog\u00eblimit t\u00eb sip\u00ebrfaqes s\u00eb apartamentit n\u00eb 83 m2.<\/p>\n<p>Si burime krijimi t\u00eb k\u00ebsaj pasurie, Qosja ka deklaruar nj\u00eb hua n\u00eb vler\u00ebn 20 mij\u00eb euro t\u00eb marr\u00eb n\u00eb vitin 2006 pa interes dhe pa afat; 3.8 milion\u00eb lek\u00eb nga shitja e nj\u00eb apartamenti nga n\u00ebna e tij dhe kursime nga pagat.<\/p>\n<p>Sipas Komisionit, subjekti i rivler\u00ebsimit nuk ka deklaruar n\u00eb vitin 2005 pages\u00ebn e 25 mij\u00eb eurove n\u00eb favor t\u00eb shoq\u00ebris\u00eb nd\u00ebrtuese si dhe shlyrjen e 16 mij\u00eb eurove n\u00eb vitin 2006.<\/p>\n<p>Hamitaj shpjegoi se n\u00eb analiz\u00ebn financiare nuk \u00ebsht\u00eb p\u00ebrfshir\u00eb e gjith\u00eb vlera 3.8 milion\u00eb lek\u00eb e deklaruar si e p\u00ebrfituar nga n\u00ebna e subjektit nga shitja e apartamentit, pasi n\u00eb kontrat\u00ebn e shit-blerjes ka figuruar shuma 2 milion\u00eb lek\u00eb. Sipas tij, nuk \u00ebsht\u00eb p\u00ebrfshir\u00eb vlera 1.8 milion lek\u00eb q\u00eb p\u00ebrfaq\u00ebson diferenc\u00ebn mes \u00e7mimit t\u00eb deklaruar me at\u00eb t\u00eb pasqyruar n\u00eb kontrat\u00ebn e shit-blerjes.<\/p>\n<p>Nd\u00ebrkoh\u00eb, nuk jan\u00eb gjetur probleme lidhur me huan\u00eb 20 mij\u00eb euro, pasi huadh\u00ebn\u00ebsi ka rezultuar t\u00eb ket\u00eb pasur burime financiare t\u00eb ligjshme t\u00eb mjaftueshme dhe nuk \u00ebsht\u00eb evidentuar konflikt interesi mes tyre.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb analiz\u00ebs financiare p\u00ebr k\u00ebt\u00eb pasuri, Komisioni konstaton munges\u00eb t\u00eb burimeve financiare n\u00eb vler\u00ebn 850 mij\u00eb lek\u00eb p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb par\u00eb dhe pamund\u00ebsi n\u00eb shum\u00ebn 900 mij\u00eb lek\u00eb p\u00ebr pages\u00ebn e k\u00ebstit t\u00eb dyt\u00eb.<\/p>\n<p>Prokurori Arben Qosja deklaroi gjat\u00eb seanc\u00ebs d\u00ebgjimore se kishte dh\u00ebn\u00eb edhe m\u00eb par\u00eb shpjegime lidhur me \u00e7do gjetje t\u00eb Komisionit p\u00ebr mosmbulimin e dy k\u00ebsteve p\u00ebr shlyerjen e \u00e7mimit t\u00eb apartamentit.<\/p>\n<p>Ai k\u00ebrkoi q\u00eb KPK t\u00eb vler\u00ebsonte t\u00eb ardhurat e gjith\u00eb familjar\u00ebve q\u00eb prej vitit 1998.<\/p>\n<p>\u201cEdhe pse nuk jan\u00eb pasqyruar kursimet n\u00eb deklarat\u00ebn periodike, v\u00ebrtetohen burimet e ligjshme t\u00eb cilat jan\u00eb t\u00eb mjaftueshme p\u00ebr kursimet. Nuk mund t\u00eb p\u00ebrligjet mosp\u00ebrfshirja e mund\u00ebsis\u00eb s\u00eb kursimeve p\u00ebr k\u00ebstin e pare,\u201d tha Qosja dhe vijoi se n\u00eb deklarat\u00ebn veting kishte pasqyruar burimin e ligjsh\u00ebm q\u00eb kishte sh\u00ebrbyer p\u00ebr shlyerjen e k\u00ebtij detyrimi.<\/p>\n<p>Lidhur me konstatimin p\u00ebr pamund\u00ebsi t\u00eb shlyerjes s\u00eb k\u00ebstit t\u00eb dyt\u00eb, Qosja shpjegoi se shitja e apartamentit ishte kryer nga n\u00ebna.<\/p>\n<p>\u201cPas pages\u00ebs s\u00eb tatimit p\u00ebr vler\u00ebn reale t\u00eb p\u00ebrfituar nga shitja e k\u00ebtij apartamenti, duhet p\u00ebrfshir\u00eb gjith\u00eb kjo shum\u00eb n\u00eb analiz\u00ebn financiare\u201d, k\u00ebrkoi Qosja.<\/p>\n<p>Ai shtoi se n\u00eb deklarat\u00ebn veting kishte pasqyruar detyrimin e mbetur pa paguar dhe se gjith\u00e7ka ishte e sqaruar.<\/p>\n<p>Ka dokumente se vlera reale e shitjes \u00ebsht\u00eb t\u00ebrhequr nga n\u00ebna n\u00eb bank\u00eb dhe t\u00eb nes\u00ebrmen \u00ebsht\u00eb paguar k\u00ebsti i dyt\u00eb. \u201cGjykoj se nuk ka vend p\u00ebr balanc\u00eb negative,\u201d tha prokurori Qosja.<\/p>\n<p>I pyetur nga Hamitaj se p\u00ebrse nuk e ishte shlyer m\u00eb par\u00eb detyrimin tatimor p\u00ebr vler\u00ebn 1.8 milion\u00eb lek\u00eb, Qosja rip\u00ebrs\u00ebriti se shitja e apartamentit t\u00eb m\u00ebparsh\u00ebm ishte kryer nga n\u00ebna dhe se ai kishte qen\u00eb n\u00eb pamund\u00ebsi t\u00eb kryente korigjimin. Sipas subjektit t\u00eb rivlr\u00ebsimit, pas shitjes, bler\u00ebsit e kishin vendosur k\u00ebt\u00eb pasuri si barr\u00eb hipotekore dhe se kjo e b\u00ebnte t\u00eb pamundur p\u00ebr k\u00ebt\u00eb pal\u00eb q\u00eb t\u00eb paraqitej para noterit.<\/p>\n<p>\u201cPala bler\u00ebse e ka deklaruar se \u00e7mimi i shitjes ishte 3.8 milion\u00eb lek\u00eb. Nuk ka patur gj\u00eb p\u00ebr t\u00eb fshehur\u201d, pohoi Qosja dhe k\u00ebmb\u00ebnguli se kishte qen\u00eb gjithmon\u00eb kritik ndaj veprimit t\u00eb kryer lidhur me vler\u00ebn e shitjes n\u00eb kontrat\u00eb, ndryshe nga ajo reale.<\/p>\n<p>Komisioni konstaton mosdeklarimin periodik t\u00eb nj\u00eb magazine n\u00eb Peshkopi, q\u00eb figuron n\u00eb em\u00ebr t\u00eb n\u00ebn\u00ebs s\u00eb subjektit t\u00eb rivler\u00ebsimit, e p\u00ebrfituar n\u00ebp\u00ebrmjet privatizimit n\u00eb vitin 1992. Hamitaj sqaroi se Qosja ka pretenduar se nuk kishte kryer mosdeklarim t\u00eb k\u00ebsaj pasurie, pasi trualli ku gjendet magazina figuron ende me pronar \u201cshtet\u201d dhe se u ishte p\u00ebrmbajtur dokumenteve ligjor\u00eb n\u00eb deklarimet e tij.<\/p>\n<p>Nga hetimi administrativ ka rezultuar se prokurori Qosja ka pasur mund\u00ebsi financiare p\u00ebr blerjen e nj\u00eb autoveture tip Volks\u00ebagen n\u00eb vitin 2013, kundrejt vler\u00ebs 5670 euro + 162 mij\u00eb lek\u00eb p\u00ebr detyrimet doganore. Edhe p\u00ebr likujditetet e tij e t\u00eb bashk\u00ebshortes nuk jan\u00eb gjetur probleme.<\/p>\n<p>Hamitaj tha se nga analiza financiare e kryer prej vitit 2004, kur Qosja ka nisur detyr\u00ebn si prokuror e n\u00eb vazhdim\u00ebsi, bilanci mes t\u00eb ardhurave dhe shpenzimeve rezulton p\u00ebrgjith\u00ebsisht pozitiv.<\/p>\n<p>Sipas Komisionit, mbeten negative balancat p\u00ebr shlyerjen e dy k\u00ebsteve p\u00ebr apartamentin, p\u00ebrkat\u00ebsisht 850 mij\u00eb lek\u00eb n\u00eb vitin 2005 dhe 900 mij\u00eb lek\u00eb n\u00eb 2006-\u00ebn.<\/p>\n<p>Qosja pranoi se n\u00eb deklarimet e para kishte pasur paqart\u00ebsi dhe pasakt\u00ebsi. \u201cPor, nuk ka ndonj\u00eb q\u00ebllim pas tyre\u201d, theksoi ai.<\/p>\n<p>Prokurori Qosja u vler\u00ebsua pozitivisht p\u00ebr figur\u00ebn dhe profesionalizmin. Edhe p\u00ebr nj\u00eb \u00e7\u00ebshtje p\u00ebr \u201cdrejtim t\u00eb automjetit n\u00eb m\u00ebnyr\u00eb t\u00eb parregullt\u201d t\u00eb verifikuar nga KPK, p\u00ebr t\u00eb cil\u00ebn Qosja kishte vler\u00ebsuar se vendimi i Shkall\u00ebs s\u00eb Par\u00eb kishte qen\u00eb i rregullt dhe nuk kishte ushtruar rekurs, nuk u evidentuan probleme. Hamitaj tha se prokurori Qosja kishte njoftuar me shkrim drejtuesin e Prokuroris\u00eb s\u00eb Apelit p\u00ebr q\u00ebndrimin e tij. \u201cKomisioni i vler\u00ebson n\u00eb p\u00ebrputhje me detyr\u00ebn k\u00ebto veprime t\u00eb subjektit\u201d, tha Hamitaj dhe shtoi se n\u00eb 5 denoncimet e kryera nga publiku nuk jan\u00eb gjetur indicie.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb seanc\u00ebs d\u00ebgjimore, prokurori Arben Qosja tha se n\u00eb pun\u00ebn e tij 30 vje\u00e7are si prokuror dhe oficer i Policis\u00eb Gjyq\u00ebsore, gjithmon\u00eb e kishte ushtruar detyr\u00ebn me p\u00ebrgjegj\u00ebsi dhe n\u00eb korrekt\u00ebsi me ligjin. Ai shpjegoi se kishte filluar pun\u00eb si prokuror n\u00eb vitin 1991 dhe se kishte rifilluar n\u00eb \u201898-\u00ebn si oficer i Policis\u00eb Gjyq\u00ebsore.<\/p>\n<p>\u201cE gjith\u00eb pasuria e familjes sime, s\u00eb bashku me prind\u00ebrit \u00ebsht\u00eb 53 mij\u00eb euro dhe justifikohet ligjshm\u00ebria e saj.
