Foto: LSA<\/figcaption><\/figure>\n<p>M\u00eb 26 korrik 2019, Kolegji i Posa\u00e7\u00ebm i Apelimit vulosi me shkarkim karrier\u00ebn e gjat\u00eb t\u00eb kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, Xhezair Zaganjori dhe p\u00ebrforcoi nj\u00ebherazi disa precedent\u00eb p\u00ebr vazhdim\u00ebsin\u00eb e procesit t\u00eb vetingut t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve t\u00eb Shqip\u00ebris\u00eb.<\/p>\n<p>Nisur nga ankimimi i Komisionerit Publik, Florian Ballhysa dhe apeli kund\u00ebrshtues i ushtruar nga Zaganjori, Kolegji mori n\u00eb shqyrtim termin \u201cevazion fiskal i ligjsh\u00ebm\u201d i p\u00ebrdorur nga KPK, po aq sa pesh\u00ebn q\u00eb duhet t\u00eb z\u00ebn\u00eb n\u00eb proces deklaratat periodike t\u00eb pasuris\u00eb n\u00eb raport me deklarat\u00ebn \u201cveting\u201d.<\/p>\n<p>Kolegji b\u00ebri gjithashtu nj\u00eb interpretim shterues t\u00eb nenit D t\u00eb Kushtetut\u00ebs dhe nenit 61 t\u00eb ligjit \u201cp\u00ebr rivler\u00ebsimin kalimtar\u201d lidhur me aplikimin e konceptit t\u00eb dyfishit t\u00eb pasuris\u00eb s\u00eb ligjshme n\u00eb procesin e vetingut.<\/p>\n<p>Xhezair Zaganjori, ish-pedagog dhe diplomat, ishte nj\u00eb nd\u00ebr zyrtar\u00ebt m\u00eb t\u00eb lart\u00eb t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb n\u00eb Shqip\u00ebri. I zgjedhur n\u00eb Gjykat\u00ebn Kushtetuese n\u00eb vitin 2003 dhe n\u00eb Gjykat\u00ebn e Lart\u00eb n\u00eb vitin 2013, ai e kaloi vetingun n\u00eb shkall\u00eb t\u00eb par\u00eb p\u00ebrmes nj\u00eb vendimi t\u00eb diskutuesh\u00ebm t\u00eb trup\u00ebs gjyq\u00ebsore me kryetar Olsi Komici, relatore Pamela Qirko dhe an\u00ebtar Roland Ilia.<\/p>\n<p>Vendimi i KPK-s\u00eb u kund\u00ebrshtua p\u00ebrmes nj\u00eb rekomandimi t\u00eb ONM-s\u00eb, i pasuar nga ankimi i Komisionerit Publik, i cili n\u00eb tetor 2018 i k\u00ebrkoi Kolegjit shkarkimin e Zaganjorit me argumentin se nuk justifikonte pasurin\u00eb dhe nuk kishte paguar tatimet.<\/p>\n<p>Procesi i Zaganjorit n\u00eb shkall\u00ebn e dyt\u00eb t\u00eb vetingut zgjati 3 seanca dhe u gjykua nga trupa e drejtuar nga Albana Shtylla, me relatore Rezarta Schuetz dhe an\u00ebtar\u00eb Luan Daci, Sokol \u00c7omo dhe Natasha Mulaj.<\/p>\n<p>N\u00eb fund, Kolegji e p\u00ebrmbysi vendimin e KPK-s\u00eb, duke arritur n\u00eb p\u00ebrfundimin se kreu i Gjykat\u00ebs s\u00eb Lart\u00eb nuk arriti t\u00eb provoj\u00eb mbulimin me burime t\u00eb ligjshme p\u00ebr 4 pasuri t\u00eb patundshme n\u00eb Tiran\u00eb, kishte deklarim t\u00eb pasakt\u00eb t\u00eb burimit t\u00eb blerjes s\u00eb nj\u00eb apartamenti n\u00eb Durr\u00ebs si dhe munges\u00eb dokumentimi t\u00eb pages\u00ebs s\u00eb tatimeve p\u00ebr t\u00eb ardhurat e p\u00ebrfituara nga qirat\u00eb n\u00eb vitet 1999-2007.<\/p>\n<p>Sipas vendimit t\u00eb arsyetuar t\u00eb Kolegjit, Zaganjori ka kryer gjithashtu deklarim t\u00eb pasakt\u00eb t\u00eb shpenzimeve p\u00ebr shkollimin e djemve jasht\u00eb shtetit si dhe rezultoi n\u00eb pamund\u00ebsi financiare prej 2.9 milion\u00eb lek\u00ebsh n\u00eb vitet 2012 dhe 2014.<\/p>\n<p><strong>\u00a0\u2018Evazioni i ligjsh\u00ebm\u2019 sfidon logjik\u00ebn \u00a0<\/strong><\/p>\n<p>N\u00eb ankimin e vendimit p\u00ebr Zaganjorin, Komisioneri Publik, Florian Ballhysa argumentoi se Komisioni \u00ebsht\u00eb mb\u00ebshtetur n\u00eb arsyetime t\u00eb gabuara lidhur me p\u00ebrmbajtjen dhe zbatimin e dispozitave kushtetuese sa i p\u00ebrket pages\u00ebs s\u00eb taksave dhe tatimeve si dhe zhvler\u00ebsimit t\u00eb deklaratave periodike t\u00eb pasuris\u00eb n\u00eb raport me deklarat\u00ebn \u201cveting\u201d.<\/p>\n<p>Komisioneri e gjeti gjithashtu t\u00eb pamb\u00ebshtetur vler\u00ebsimin e Komisionit se subjekti kishte shfryt\u00ebzuar boshll\u00ebkun ligjor n\u00ebp\u00ebrmjet kontratave fiktive, duke shmangur detyrimet tatimore dhe duke kryer \u201cevazion tatimor t\u00eb ligjsh\u00ebm\u201d.<\/p>\n<p>Konkluzionin e KPK-s\u00eb p\u00ebr \u201cevazion fiskal t\u00eb ligjsh\u00ebm\u201d e kund\u00ebrshtoi edhe Zaganjori n\u00eb apelin e tij kund\u00ebrshtues p\u00ebrball\u00eb Kolegjit, duke e cil\u00ebsuar at\u00eb t\u00eb pabazuar n\u00eb ligj dhe n\u00eb prova. Megjithat\u00eb, Zaganjori mbrojti iden\u00eb se vendimi i KPK-s\u00eb bazohej n\u00eb nenin D t\u00eb Kushtetut\u00ebs si dhe ishte n\u00eb p\u00ebrputhje me Komentarin mbi Reform\u00ebn Kushtetuese n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n<p>\u201cMbrojtja e ligjit fiskal nuk ka lidhje me procesin e rivler\u00ebsimit, megjith\u00ebse ligjv\u00ebn\u00ebsi p\u00ebr nj\u00ebrin prej shkaqeve t\u00eb prezumimit t\u00eb pasuris\u00eb s\u00eb paligjshme ka shquar mospagimin e detyrimeve fiskale n\u00eb m\u00eb pak se gjysm\u00ebn e t\u00eb gjith\u00eb pasuris\u00eb,\u201d citohet pretendimi i Zaganjorit n\u00eb vendimin e KPA-s\u00eb.<\/p>\n<p>N\u00eb vendimin e arsyetuar, Kolegji ndalet n\u00eb termin \u201cevazion tatimor i ligjsh\u00ebm\u201d, i p\u00ebrdorur nga KPK n\u00eb justifikimin e kat\u00ebr pasurive t\u00eb patundshme t\u00eb Zaganjorit, duke e konsideruar at\u00eb nj\u00eb koncept q\u00eb mund t\u00eb krijoj\u00eb keqkuptime dhe t\u2019u ler\u00eb vend interpretimeve t\u00eb pasakta n\u00eb vler\u00ebsimin e pasuris\u00eb s\u00eb subjekteve t\u00eb tjera.<\/p>\n<p>\u201cTermi evazion tatimor i ligjsh\u00ebm mungon n\u00eb normimin ligjor n\u00eb koncept dhe p\u00ebrmbajtje dhe p\u00ebr m\u00eb tep\u00ebr, zgjedhja e k\u00ebtij termi sfidon logjik\u00ebn,\u201d thuhet n\u00eb vendimin e KPA-s\u00eb.<\/p>\n<p>Duke iu referuar frengjishtes, KPA argumenton se termi evazion p\u00ebrkufizon nj\u00eb form\u00eb negative t\u00eb vepruari p\u00ebr t\u2019iu shmangur detyrimeve tatimore t\u00eb p\u00ebrcaktuara nga ligji, q\u00eb sipas trup\u00ebs \u00ebsht\u00eb e sanksionueshme administrativisht dhe penalisht dhe p\u00ebr rrjedhoj\u00eb, nuk mund t\u00eb jet\u00eb i ligjsh\u00ebm.<\/p>\n<p>Trupi gjyq\u00ebsor i KPA-s\u00eb rr\u00ebzon edhe argumentimin e Komisionit mbi t\u00eb ashtuquajturin boshll\u00ebk n\u00eb legjislacionin e koh\u00ebs p\u00ebr \u00e7mimet e referenc\u00ebs n\u00eb shitjen e pasurive t\u00eb paluajtshme si dhe pretendimin e Zaganjorit se kontratat e shitjes ishin fiktive dhe p\u00ebr rrjedhoj\u00eb, absolutisht t\u00eb pavlefshme.<\/p>\n<p>\u201cKy i fundit [legjilsacioni i koh\u00ebs]\u00a0 parashikon me holl\u00ebsi detyrimet e pal\u00ebve kontraktore p\u00ebr t\u00eb deklaruar vler\u00ebn reale t\u00eb transaksionit t\u00eb pasuris\u00eb dhe detyrimin e ZVRPP-s\u00eb, n\u00eb cil\u00ebsin\u00eb e agjentit tatimor, p\u00ebr vjeljen e detyrimit tatimor,\u201d argumenton KPA.<\/p>\n<p>\u201cPretendimi p\u00ebr pavlefshm\u00ebri absolute t\u00eb kontratave t\u00eb shitblerjes nuk rezulton t\u00eb jet\u00eb b\u00ebr\u00eb objekt shqyrtimit gjyq\u00ebsor dhe nga dokumentacioni i administruar nuk rezulton asnj\u00eb e dh\u00ebn\u00eb q\u00eb shit\u00ebsi apo bler\u00ebsi t\u00eb ken\u00eb paraqitur padi n\u00eb gjykat\u00eb me k\u00ebt\u00eb objekt k\u00ebrkimi. P\u00ebr rrjedhoj\u00eb, pretendimi i subjektit t\u00eb rivler\u00ebsimit nuk q\u00ebndron,\u201d thuhet gjithashtu n\u00eb vendim.<\/p>\n<p><strong>Dyfishi i pasuris\u00eb <\/strong><\/p>\n<p>Kolegji i Posa\u00e7\u00ebm i Apelimit ka interpretuar edhe dy pretendime t\u00eb Zaganjorit, t\u00eb pranuara nga Komisioni n\u00eb shkall\u00eb t\u00eb par\u00eb lidhur me rolin q\u00eb kan\u00eb deklaratat periodike t\u00eb dor\u00ebzuara n\u00eb ILDKPKI n\u00eb raport me deklarat\u00ebn \u201cveting\u201d si dhe konceptin e dyfishit t\u00eb pasuris\u00eb s\u00eb ligjshme.<\/p>\n<p>N\u00eb justifikimin e 4 pasurive t\u00eb patundshme t\u00eb Zaganjorit, KPK argumentoi se veprimet me k\u00ebto prona ishin kryer jasht\u00eb periudh\u00ebs s\u00eb rivler\u00ebsimit t\u00eb subjektit dhe p\u00ebr rrjedhoj\u00eb nuk mund t\u00eb konkludohet p\u00ebr shkelje ligjore q\u00eb \u00e7ojn\u00eb n\u00eb shkarkimin e subjektit.<\/p>\n<p>Por KPA nuk pajtohet me k\u00ebt\u00eb argumentimin t\u00eb Komisionit, duke e quajtur edhe at\u00eb alogjik.<\/p>\n<p>\u201cLegjislacioni i posa\u00e7\u00ebm p\u00ebr rivler\u00ebsimin kalimtar nuk vendos kritere kohore lidhur me provueshm\u00ebrin\u00eb e ligjshm\u00ebris\u00eb s\u00eb burimeve\u2026.P\u00ebr m\u00eb tep\u00ebr, vendosja e kritereve kohore do t\u00eb ishte alogjike dhe do t\u00eb binte ndesh me konceptin e rivler\u00ebsimit, i cili p\u00ebr nga natyra n\u00ebnkupton kontrollin e veprimeve t\u00eb ndodhura n\u00eb t\u00eb shkuar\u00ebn,\u201d thuhet n\u00eb vendim.<\/p>\n<p>Kolegji argumenton m\u00eb tej se neni 32, pika 5 e ligjit \u201cp\u00ebr rivler\u00ebsimin kalimtar\u201d u jep deklaratave periodike cil\u00ebsin\u00eb e prov\u00ebs dhe krahasimi i deklarat\u00ebs \u201cveting\u201d me ato t\u00eb m\u00ebparshmet konsiderohet si mjet q\u00eb sh\u00ebrben p\u00ebr t\u00eb ndjekur ecurin\u00eb dhe v\u00ebrtet\u00ebsin\u00eb e deklarimeve t\u00eb subjektit.<\/p>\n<p>Kolegji b\u00ebn gjithashtu nj\u00eb analiz\u00eb t\u00eb pikave 3 dhe 4 t\u00eb nenit D t\u00eb Kushtetut\u00ebs, t\u00eb harmonizuara me pikat 1 dhe 3 t\u00eb nenit 61 t\u00eb ligjit t\u00eb vetingut dhe arrin n\u00eb p\u00ebrfundimin se shkelja e pik\u00ebs 1 \u201cdeklarimi m\u00eb shum\u00eb se dyfishi i pasuris\u00eb s\u00eb ligjshme\u201d parashikon nj\u00eb rast specifik dhe t\u00eb pavarur\u00a0 nga shkelja e pik\u00ebs 3 q\u00eb parashikon \u201cpamjaftueshm\u00ebrin\u00eb e deklarimit t\u00eb pasuris\u00eb\u201d.<\/p>\n<p>\u201cT\u00eb dyja k\u00ebto raste rrjedhin nga situata specifike t\u00eb ve\u00e7anta dhe nuk mund t\u00eb konsiderohen se zbatohen n\u00eb m\u00ebnyr\u00eb kumulative,\u201d argumenton trupa gjykuese.<\/p>\n<p><strong>Mendimi paralel i kryesueses <\/strong><\/p>\n<p>Trupi gjykues i Kolegjit nuk ka qen\u00eb unanim p\u00ebr t\u00eb gjitha \u00e7\u00ebshtjet e trajtuara n\u00eb \u00e7\u00ebshtjen e Zaganjorit. Momenti ligjor i fitimit t\u00eb pron\u00ebsis\u00eb mbi 4 pasurit\u00eb e patundshme t\u00eb p\u00ebrb\u00ebra nga nj\u00eb apartament, nj\u00eb bibliotek\u00eb, nj\u00eb bodrum dhe nj\u00eb zyr\u00eb n\u00eb rrug\u00ebn \u201cDed\u00eb Gjo Luli\u201d n\u00eb Tiran\u00eb ka ndar\u00eb n\u00eb nj\u00eb mendim paralel kryetaren e trupit gjykues, Albana Shtylla.<\/p>\n<p>Lidhur me k\u00ebto pasuri, Zaganjori kund\u00ebrshtoi ankimin e Komisionerit Publik dhe sqaroi se prona \u00ebsht\u00eb zhvilluar urbanisht n\u00eb vitin 1997 dhe pron\u00ebsia reale mbi to \u00ebsht\u00eb fituar n\u00eb vitin 1997 dhe jo n\u00eb vitin 2001, kur jan\u00eb n\u00ebnshkruar kontratat \u201cfiktive\u201d t\u00eb shitblerjes.<\/p>\n<p>Pretendimet e Zaganjorit u pranuan n\u00eb shkall\u00eb t\u00eb par\u00eb, por shumica n\u00eb Kolegj kritikon Komisionin p\u00ebr tejkalim t\u00eb kompetencave n\u00eb k\u00ebt\u00eb konkluzion. Kolegji vler\u00ebson se pretendimi i Zaganjorit dhe arsyetimi i KPK-s\u00eb se pron\u00ebsia daton nga viti 1997 mbeten n\u00eb nivel deklarativ, p\u00ebrball\u00eb kontratave t\u00eb shit-blerjes s\u00eb vitit 2001, q\u00eb konsiderohen prova t\u00eb pakontestueshme.<\/p>\n<p>Kolegji vler\u00ebson gjithashtu se p\u00ebrmes arsyetimit t\u00eb vet, KPK k\u00ebrkon t\u00eb vendos\u00eb se cila \u00ebsht\u00eb m\u00ebnyra e fitimit t\u00eb pron\u00ebsis\u00eb \u2013nj\u00eb trajtim q\u00eb kryhet n\u00eb rrug\u00eb gjyq\u00ebsore dhe sipas Kolegjit nuk \u00ebsht\u00eb n\u00eb kompetenc\u00ebn e institucioneve t\u00eb vetingut.<\/p>\n<p>\u201c\u2026konkluzioni i Komisionit q\u00eb hodhi posht\u00eb kontratat e shitblerjes mb\u00ebshtetur vet\u00ebm n\u00eb deklaratat e subjektit tejkalon kompetenc\u00ebn e Komisionit apo t\u00eb nj\u00eb institucioni t\u00eb rivler\u00ebsimit kalimtar,\u201d thuhet n\u00eb vendimin e KPA-s\u00eb.<\/p>\n<p>\u201cP\u00ebr rrjedhoj\u00eb, trupi gjykues i Kolegjit vler\u00ebson se kjo m\u00ebnyr\u00eb interpretimi \u00ebsht\u00eb n\u00eb tejkalim t\u00eb kompetencave q\u00eb Kushtetuta dhe ligji nr. 84\/2016 u kan\u00eb dh\u00ebn\u00eb institucioneve t\u00eb rivler\u00ebsimit,\u201d thuhet n\u00eb vendim.<\/p>\n<p>Ndryshe nga shumica e KPA-s\u00eb, kryesuesja Albana Shtylla b\u00ebn nj\u00eb vler\u00ebsim t\u00eb ndrysh\u00ebm t\u00eb situat\u00ebs faktive t\u00eb 4 pasurive t\u00eb paluajtshme.<\/p>\n<p>\u201cKontratat e shitblerjes t\u00eb dat\u00ebs 6.10.2001 rikonfirmojn\u00eb situat\u00ebn faktike q\u00eb ekzistonte para n\u00ebnshkrimit t\u00eb tyre\u2026,\u201d vler\u00ebson Shtylla, e cila evidenton kontradikta edhe n\u00eb argumentimin e an\u00ebtar\u00ebve t\u00eb tjer\u00eb t\u00eb Kolegjit, q\u00eb ka pranuar tashm\u00eb investimin e kryer nga subjekti.<\/p>\n<p>N\u00eb mendimin e saj paralel, Shtylla pranon mund\u00ebsin\u00eb q\u00eb Zaganjori mund t\u00eb p\u00ebrfitonte t\u00eb ardhura nga qiraja para vitit 2001, por sipas saj ato nuk mund t\u00eb konsiderohen t\u00eb ligjshme pasi nuk u dokumentua pagesa e tatimeve.<\/p>\n<p>Shtylla bie gjithashtu dakord me pjes\u00ebn tjet\u00ebr t\u00eb trup\u00ebs se subjekti nuk provoi gjithashtu se investimet e kryera p\u00ebr 4 pasurit\u00eb deri n\u00eb vitin 1999 buronin nga t\u00eb ardhura t\u00eb ligjshme.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Kolegji i Posa\u00e7\u00ebm i Apelimit e quajti konkluzionin e KPK-s\u00eb se kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb kishte kryer \u201cevazion tatimor t\u00eb ligjsh\u00ebm\u201d nj\u00eb term q\u00eb sfidon logjik\u00ebn, nd\u00ebrkoh\u00eb q\u00eb interpretoi pesh\u00ebn e deklaratave periodike n\u00eb proces si dhe p\u00ebrcaktimin p\u00ebr dyfishin e pasuris\u00eb s\u00eb ligjshme.<!-- AddThis Advanced Settings generic via filter on get_the_excerpt --><!-- AddThis Share Buttons generic via filter on get_the_excerpt --><\/p>\n","protected":false},"author":7,"featured_media":75784,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[13,415,114,473],"tags":[272,103,112],"fifu_image_url":"https:\/\/www.reporter.al\/wp-content\/uploads\/Zaganjori-KPA.jpg","fifu_image_alt":"Kryetari i Gjykat\u00ebs s\u00eb Lart\u00eb, Xhezair Zaganjori gjat\u00eb nj\u00eb seance t\u00eb  Kolegjit t\u00eb Posa\u00e7\u00ebm t\u00eb Apelimit (KPA).
