Nd\u00ebrkoh\u00eb, nga hetimi administrativ nuk u identifikuan probleme p\u00ebr past\u00ebrtin\u00eb e figur\u00ebs dhe profesionalizimin. Treshja gjykuese e Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK, p\u00ebrb\u00ebhej nga Olsi Komici kryesues, Roland Ilia relator dhe Valbona Sanxhaktari an\u00ebtare. N\u00eb cil\u00ebsin\u00eb e v\u00ebzhguesit nd\u00ebrkomb\u00ebtar ishte e pranishme Maria Tuma.<\/p>\n<p>Sipas raportit t\u00eb Inspektoratit t\u00eb Lart\u00eb i Deklarimit dhe Kontrolli t\u00eb Pasurive e Konfliktit t\u00eb Interesit, ILDKPKI, gjyqtarja Hajro ka kryer deklarim t\u00eb pasakt\u00eb, por nuk ka kryer deklarim t\u00eb rrem\u00eb apo fshehje t\u00eb pasuris\u00eb, nuk gjendet n\u00eb kushtet e konfliktit t\u00eb interesit dhe ka burime t\u00eb ligjshme. Pasakt\u00ebsia \u00ebsht\u00eb konstatuar n\u00eb mos deklarimin e k\u00ebrkes\u00ebs p\u00ebr legalizimin e nj\u00eb prone.<\/p>\n<p>KPK e ka gjetur t\u00eb sakt\u00eb deklarimin e gjyqtares Hajro lidhur me apartamentin 1+1 me sip\u00ebrfaqe 46.m2 n\u00eb Shkod\u00ebr. Sipas relatorit t\u00eb \u00e7\u00ebshtjes, Roland Ilia, gjyqtarja Hajro ka deklaruar se kjo pron\u00eb \u00ebsht\u00eb marr\u00eb falas n\u00eb vitin 1998 si ish e p\u00ebrndjekur s\u00eb bashku me t\u00eb \u00ebm\u00ebn. Nga verifikimi i kryer nga komisioni, apartamenti n\u00eb fjal\u00eb rezulton se \u00ebsht\u00eb bler\u00eb nga Enti i Banesave n\u00eb vler\u00ebn 8 mij\u00eb USD. Por, n\u00eb kontrat\u00eb \u00ebsht\u00eb p\u00ebrcaktuar se, p\u00ebr shkak se ajo dhe e \u00ebma kan\u00eb qen\u00eb ish-t\u00eb persekutuara, banesa \u00ebsht\u00eb privatizuar falas.<\/p>\n<p>Nd\u00ebrkoh\u00eb, komisioni ngiti dyshime p\u00ebr shtes\u00ebn e nj\u00eb nj\u00ebsie tregtare. Sipas KPK-s\u00eb, p\u00ebr k\u00ebt\u00eb objekt me sip\u00ebrfaqe 22 m2, me vler\u00eb 2.5 milion\u00eb lek\u00eb t\u00eb p\u00ebrfituar nga privatizimi, subjekti ka kryer k\u00ebrkes\u00eb p\u00ebr shtes\u00eb 12 m2. Relatori Ilia theksoi se edhe pse aplikimi \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb vitin 2006, nuk \u00ebsht\u00eb miratuar ende legalizimi.<\/p>\n<p>Relatori Ilia pohoi gjithashtu se nga hetimi \u00ebsht\u00eb gjetur se subjekti e ka bler\u00eb objektin n\u00eb vitin 1992 n\u00eb vler\u00ebn e 4300 lek\u00eb. Komisioni ngriti dyshime p\u00ebr k\u00ebt\u00eb transaksion p\u00ebr shkak t\u00eb mosh\u00ebs s\u00eb gjyqtares, e cila n\u00eb at\u00eb koh\u00eb nuk i kishte mbushur 18 vje\u00e7e dhe se nuk ka pasur t\u00eb ardhura. Por, sipas komisionit, gjyqtarja Hajro ka deklaruar se procedurat e blerjes i ka ndjekur daja i saj.<\/p>\n<p>\u201cSubjekti pretendon se nuk ka pasur shtes\u00eb, por se jan\u00eb sh\u00ebnuar gabim metrat katror\u00eb\u201d, pohoi relatori Ilia. Ai shtoi se Aluizni ka kthyer p\u00ebrgjigje se nd\u00ebrtimi ishte kryer para vitit \u201991. Sipas Ilias, subjekti \u00ebsht\u00eb pyetur se p\u00ebrse ka k\u00ebrkuar legalizimin dhe jo rishikimin e kontrat\u00ebs s\u00eb privatizimit dhe se shpjegimet e saj do t\u00eb merren parash gjat\u00eb marrjes s\u00eb vendimit.<\/p>\n<p>P\u00ebr apartamentin me sip\u00ebrfaqe 85 m2 n\u00eb Tiran\u00eb, gjyqtarja Enkeledi Hajro ka deklaruar se \u00ebsht\u00eb bler\u00eb me kredi 70 mij\u00eb euro t\u00eb marr\u00eb n\u00eb vitin 2007 nga Alpha Bank, pasi banka mbulonte vet\u00ebm 70% t\u00eb vler\u00ebs s\u00eb objektit. Kjo kredi \u00ebsht\u00eb bler\u00eb m\u00eb pas nga Banka Komb\u00ebtare Tregtare n\u00eb vler\u00ebn e 8.6 milion\u00eb lek\u00ebve. Komisioni ka konstatuar se vlera e deklaruar e apartamentit ka qen\u00eb 82 mij\u00eb euro. Nd\u00ebrkoh\u00eb, ZVRPP Tiran\u00eb ka informuar komisionin se kjo pasuri \u00ebsht\u00eb bllokuar n\u00eb em\u00ebr t\u00eb BKT p\u00ebr kredin\u00eb 8.6 milion\u00eb lek\u00eb. Sipas komisionit, ka munges\u00eb t\u00eb v\u00ebrtetimit t\u00eb vler\u00ebs reale t\u00eb apartamentit, prej 82 mij\u00eb eurosh.<\/p>\n<p>Relatori Ilia pohoi se subjekti ka sqaruar se vlera reale \u00ebsht\u00eb 70 mij\u00eb euro, por kan\u00eb r\u00ebn\u00eb dakord me shit\u00ebsin e apartamentit t\u00eb sh\u00ebnohej 82 mij\u00eb euro q\u00eb banka t\u00eb mund t\u00eb debitonte 70% t\u00eb shum\u00ebs, shum\u00ebn prej 70 mij\u00eb euro. Sipas relatorit t\u00eb \u00e7\u00ebshtjes, subjekti konfirmoi si vler\u00eb reale t\u00eb apartamentit vler\u00ebn 70 mij\u00eb euro dhe si burim krijimi kredin\u00eb e marr\u00eb.<\/p>\n<p>Blerja e nj\u00eb automjetit tip \u201cHunday\u201d n\u00eb vitin 2015 n\u00eb vler\u00ebn e 20 mij\u00eb eurove nga bashk\u00ebshorti i gjyqtares me kontrat\u00eb leasing, \u00ebsht\u00eb konsideruar si e rregullt. Nd\u00ebrkoh\u00eb, nga verifikimet KPK ka rezultuar se n\u00eb vitin 2008 \u00ebsht\u00eb lidhur kontrat\u00eb leasing p\u00ebr blerjen e nj\u00eb makine tjet\u00ebr q\u00eb m\u00eb pas \u00ebsht\u00eb bler\u00eb n\u00eb vitin 2010 nga motra e bashk\u00ebshortit e cila ka paguar 3 mij\u00eb euro. Komisioni ka konstatuar se n\u00eb vitin 2010, nuk jan\u00eb deklaruar t\u00eb ardhurat e p\u00ebrfituara nga shtija e makin\u00ebs. Sipas relatorit Ilia, nj\u00eb tjet\u00ebr mjet tip Skoda i bler\u00eb n\u00eb vitin 2012 me kontrat\u00eb leasing, nuk ka rezultuar t\u00eb jet\u00eb deklaruar kur \u00ebsht\u00eb bler\u00eb. Ai pohoi se subjekti ka sqaruar se mjeti tip Skoda \u00ebsht\u00eb bler\u00eb nga motra e bashk\u00ebshortit duke paguar k\u00ebstin 5 mij\u00eb euro e pastaj 3 mij\u00eb euro. Komisioni ka identifikuar edhe nj\u00eb tjet\u00ebr automjet tip Benz q\u00eb \u00ebsht\u00eb p\u00ebrdorur nga subjekti i rivler\u00ebsimit. Nga verifikimi \u00ebsht\u00eb konstatuar se kjo makin\u00eb \u00ebsht\u00eb bler\u00eb nga nj\u00eb i af\u00ebrm n\u00eb vler\u00ebn e 700 mij\u00eb lek\u00ebve. Ilia pohoi se subjekti ka sqaruar se kishte dy vjet e gjysm\u00eb q\u00eb nuk e p\u00ebrdorte k\u00ebt\u00eb makin\u00eb.<\/p>\n<p>Nga likuiditetet jan\u00eb deklaruar dy kontrata kredie me afat 20 vje\u00e7ar p\u00ebr blerjen e apartamentit, nj\u00eb 3 milion dhe nj\u00eb 5 milion\u00eb lek\u00eb. Prej analiz\u00ebs finaniare komisioni ka konstatuar pamjaftueshm\u00ebri t\u00eb likuiditeteve. Gjithashtu, \u00ebsht\u00eb konstatuar munges\u00eb e burimeve financiare p\u00ebr vitet 2007, 2010, 2011 dhe 2014.<\/p>\n<p>Lidhur me past\u00ebrtin\u00eb e figur\u00ebs, Drejtoria e Sigurimit t\u00eb Informacionit t\u00eb Klasifikuar, DSIK, ka rekomanduar p\u00ebrshtatshm\u00ebrin\u00eb e Kryetares s\u00eb Gjykat\u00ebs s\u00eb Tiran\u00ebs, Enkeledi Hajro p\u00ebr vazhdimin e detyr\u00ebs. Relatori Ilia nuk evidentoi probleme edhe lidhur me kriterin e profesionalizimit.<\/p>\n<p>Vet\u00eb kryetarja e Gjykat\u00ebs s\u00eb Tiran\u00ebs, Enkeledi Hajro nuk preferoi t\u00eb jepte shpjegime gjat\u00eb seanc\u00ebs d\u00ebgjimore lidhur me gjetjet e komisionit, duke pohuar se u q\u00ebndronte atyre q\u00eb kishte paraqitur me shkrim.
