Nd\u00ebrkoh\u00eb, trupa e Kolegjit \u00ebsht\u00eb ndar\u00eb n\u00eb konkluzionin p\u00ebr fshehjen e apartamentit, ku pakica \u00e7mon se kjo rrethan\u00eb nuk q\u00ebndron.<\/p>\n<p>Gjyqtari i Lezh\u00ebs, Jak Ndoka u shkarkua nga detyra m\u00eb 24 n\u00ebntor 2021, pasi Komisioni i Pavarur i Kualifikimit, KPK konkludoi se ai ka nd\u00ebrmarr\u00eb hapa p\u00ebr t\u00eb fshehur ose paraqitur n\u00eb m\u00ebnyr\u00eb t\u00eb pasakt\u00eb pasurit\u00eb; se nuk ka shpjeguar bindsh\u00ebm burimin e krijimi t\u00eb tyre; si dhe ka c\u00ebnuar besimin e publikut tek drejt\u00ebsia me veprimet e tij n\u00eb transaksionet e kryera p\u00ebr nj\u00eb apartament.<\/p>\n<p>Ndoka ushtroi ankim duke pretenduar se n\u00eb Komisionin nuk i ishte ofruar proces i regullt ligjor, si dhe ngriti shkaqe kund\u00ebr konkluzioneve p\u00ebr pasurin\u00eb, kriterin e vet\u00ebm p\u00ebr t\u00eb cilin u p\u00ebrmbyll hetimi administrativ. Kolegji i ka gjetur t\u00eb pabazuara n\u00eb fakte dhe n\u00eb ligj shkaqet e ankimit t\u00eb subjektit t\u00eb rivler\u00ebsimit p\u00ebr shkelje procedurale dhe cenim t\u00eb s\u00eb drejt\u00ebs s\u00eb tij p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor.<\/p>\n<p><strong>Shkaqet p\u00ebr pasurin\u00eb<\/strong><\/p>\n<p>Komisioni ka ngritur dyshime se gjyqtari Ndoka ka deformuar t\u00eb v\u00ebrtet\u00ebn p\u00ebr \u00e7mimin e shitjes s\u00eb nj\u00eb apartamenti t\u00eb vjet\u00ebr me sip\u00ebrfaqe 68 m2 n\u00eb Lezh\u00eb duke n\u00ebnshkruar kat\u00ebr kontrata t\u00eb ndryshme, me q\u00ebllim justifikimin e burimeve financiare p\u00ebr blerjen e disa pasurive t\u00eb tjera n\u00eb vijim.<\/p>\n<p>Nga hetimi n\u00eb KPK jan\u00eb evidentuar dy aktmarr\u00ebveshje p\u00ebr shitjen e apartamentit t\u00eb n\u00ebnshkruara nga subjekti, nj\u00eb e dat\u00ebs 19 prill 2007 dhe tjetra e 24 prillit 2007, si dhe nj\u00eb kontrat\u00eb e shitblerjes s\u00eb pasuris\u00eb, po e dat\u00ebs 24 prill 2007 \u2013 ku n\u00eb t\u00eb tre k\u00ebto akte, \u00e7mimi i shitjes s\u00eb banes\u00ebs \u00ebsht\u00eb p\u00ebrcaktuar 5.3 milion\u00eb lek\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb, ASHK-ja Lezh\u00eb ka informuar se egziston dhe nj\u00eb kontrat\u00eb tjet\u00ebr shitblerje p\u00ebr k\u00ebt\u00eb apartament me dat\u00ebn 24 prill 2007, sipas s\u00eb cil\u00ebs subjekti ia ka shitur k\u00ebt\u00eb apartament shtetasit L. M. kundrejt \u00e7mimit prej 3 milion\u00eb lek\u00eb. Komisioni konstaton se detyrimet tatimore jan\u00eb shlyer vet\u00ebm p\u00ebr shum\u00ebn 3 milion\u00eb lek\u00eb dhe p\u00ebr k\u00ebt\u00eb arsye kjo vler\u00eb \u00ebsht\u00eb konsideruar n\u00eb analiz\u00ebn financiare.<\/p>\n<p>N\u00eb p\u00ebrfundim, Komisioni ka konkluduar se lidhja dhe n\u00ebnshkrimi i disa kontratave p\u00ebr t\u00eb nj\u00ebjt\u00ebn pasuri, me ndikim edhe n\u00eb burimet financiare p\u00ebr pasurit\u00eb e krijuara m\u00eb von\u00eb, c\u00ebnojn\u00eb besimin e publikut t\u00eb sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Subjekti ka pretenduar n\u00eb ankim se vlera e shitblerjes ka qen\u00eb 5.3 milion\u00eb lek\u00eb. Sipas tij, bler\u00ebsi L. M., n\u00eb momentin e regjistrimit t\u00eb pasuris\u00eb, ka paraqitur pran\u00eb ZVRPP-s\u00eb Lezh\u00eb nj\u00eb kontrat\u00eb shitblerjeje t\u00eb ndryshme nga ajo q\u00eb kan\u00eb paraqitur pal\u00ebt para noterit, me q\u00ebllim justifikimin e shum\u00ebs s\u00eb kredis\u00eb.<\/p>\n<p>Ai ka v\u00ebrejtuar se Komisioni ka marr\u00eb n\u00eb konsiderat\u00eb vet\u00ebm kontrat\u00ebn, e falsifikuar q\u00eb bler\u00ebsi L. M. ka paraqitur n\u00eb ZVRPP-n\u00eb Lezh\u00eb p\u00ebr regjistrimin e pron\u00ebs, si dhe nuk e ka thirrur k\u00ebt\u00eb person si d\u00ebshmitar dhe nuk ka kryer ekspertim p\u00ebr provat e paraqitura.<\/p>\n<p>Pas verifikimit t\u00eb akteve t\u00eb dor\u00ebzuara nga Ndoka, Kolegji vler\u00ebson se subjekti nuk arrin t\u00eb provoj\u00eb kalimin e shum\u00ebs 5.3 milion\u00eb lek\u00eb p\u00ebr llogari t\u00eb tij, me transaksione bankare apo cash.<\/p>\n<p>Po ashtu, vler\u00ebsohet se mbetet n\u00eb nivel deklaratativ pretendimi tjet\u00ebr i subjektit se, se nj\u00eb pjes\u00eb e t\u00eb ardhurave nga shitja e apartamentit i ka p\u00ebrfituar pas lidhjes se kontrat\u00ebs s\u00eb shitblerjes. \u201cGjithashtu, subjekti n\u00eb deklaratat periodike vjetore nuk jep asnj\u00eb t\u00eb dh\u00ebn\u00eb p\u00ebr pjes\u00ebn e mbetur nga pagesa e k\u00ebstit t\u00eb dyt\u00eb t\u00eb pretenduar nga shitja e apartamentit n\u00eb vler\u00ebn 2.300.000 lek\u00eb, pas p\u00ebrdorimit t\u00eb shum\u00ebs 1.500.000 lek\u00eb q\u00eb ka sh\u00ebrbyer si pages\u00eb p\u00ebr blerjen e apartamentit n\u00eb vitin 2008\u201d, konstaton KPA dhe e gjen t\u00eb drejt\u00eb konkluzionin e KPK q\u00eb ka konsideruar si t\u00eb ardhura t\u00eb ligjshme nga shitja e apartamentit vet\u00ebm vler\u00ebn 3 milion\u00eb lek\u00eb.<\/p>\n<p>\u201c[\u2026]Jo vet\u00ebm p\u00ebr shkak se subjekti nuk arrin t\u00eb provoj\u00eb p\u00ebrftimin e vler\u00ebs prej 5.300.000 lek\u00ebsh nga shitja e apartamentit, por edhe se nuk provon as pages\u00ebn e detyrimit tatimor p\u00ebr k\u00ebt\u00eb t\u00eb ardhur\u201d, argumenton KPA.<\/p>\n<p>Lidhur me pretendimin e p\u00ebr depozitimin e nj\u00eb kontrate t\u00eb falsifikuar n\u00eb ZVRPP nga bler\u00ebsi, Kolegji vler\u00ebson se subjekti i rivler\u00ebsimit duhej t\u2019u ishte drejtuar organeve kompetente q\u00eb n\u00eb momentin e konstatimit t\u00eb k\u00ebtij fakti n\u00eb faz\u00ebn e hetimit administrativ n\u00eb Komision.<\/p>\n<p>Sipas KPA, Ndoka nuk ka arritur t\u00eb shpjegoj\u00eb interesin dhe p\u00ebrfitimin e pal\u00ebs bler\u00ebse n\u00eb k\u00ebt\u00eb rast, pasi i vetmi p\u00ebrfitues nga ky veprim, ka qen\u00eb vet\u00eb ish-gjyqtari, i cili ka pasur detyrimin e pages\u00ebs s\u00eb tatimit p\u00ebr kalimin e pron\u00ebsis\u00eb.<\/p>\n<p>Nd\u00ebrkoh\u00eb, Kolegji vler\u00ebson ndryshe nga Komisioni lidhur me konkluzionin p\u00ebr c\u00ebnimin e besimit t\u00eb publikut tek drejt\u00ebsia. \u201cK\u00ebto veprime t\u00eb subjektit t\u00eb rivler\u00ebsimit nuk p\u00ebrfaq\u00ebsojn\u00eb nj\u00eb situat\u00eb faktike q\u00eb cenon besimin e publikut te subjekti i rivler\u00ebsimit si pjes\u00eb e sistemit t\u00eb drejt\u00ebsis\u00eb\u201d, shprehet KPA dhe shton se paraqitja e disa kontratave dhe ndikimi q\u00eb ka pasur ky veprim n\u00eb ligjshm\u00ebrin\u00eb e burimeve financiare p\u00ebr krijimin e pasuris\u00eb, jan\u00eb konsideruar nga Komisioni dhe konfirmuar prej Kolegjit si deklarim i rrem\u00eb nga ana e subjektit.<\/p>\n<p>Komisioni konstaton se subjekti nuk ka pasur burime t\u00eb ligjshme financiare p\u00ebr blerjen e nj\u00eb apartamenti me sip\u00ebrfaqe 108 m2 + nj\u00ebsi sh\u00ebrbimi me sip\u00ebrfaqe 20 m2 n\u00eb n\u00ebntor t\u00eb vitit 2007 n\u00eb Lezh\u00eb, p\u00ebrkat\u00ebsisht n\u00eb vlerat 3.2 milion\u00eb lek\u00eb dhe 600 mij\u00eb lek\u00eb, pasi vlera e konsideruar si e p\u00ebrfituar nga shitja e apartamentit t\u00eb m\u00ebparsh\u00ebm 3 milion\u00eb lek\u00eb \u00ebsht\u00eb vler\u00ebsuar e pamjaftueshme.<\/p>\n<p>Subjekti ka kund\u00ebrshtuar konkluzionin e KPK duke k\u00ebmb\u00ebngulur n\u00eb Kolegj se e ka shitur apartamentin n\u00eb shum\u00ebn 5.3 milion\u00eb lek\u00eb.<\/p>\n<p>Nisur nga analiza e kryer n\u00eb KPA q\u00eb \u00ebsht\u00eb konsideruar si e ardhur e ligjshme vet\u00ebm shuma 3 milion\u00eb lek\u00eb, \u00ebsht\u00eb konkluduar se subjekti arrin t\u00eb justifikoj\u00eb t\u00eb ardhurat p\u00ebr blerjen e apartamentit dhe nj\u00ebsis\u00eb s\u00eb sh\u00ebrbimit deri n\u00eb vler\u00ebn e t\u00eb ardhurave t\u00eb ligjshme t\u00eb p\u00ebrfituara nga shitja e apartamentit t\u00eb m\u00ebparsh\u00ebm, duke rezultuar me balanc\u00eb negative p\u00ebr krijimin e k\u00ebtyre dy pasurive, n\u00eb shum\u00ebn 859 mij\u00eb lek\u00eb.<\/p>\n<p>Situat\u00eb e ngjashme ka rezultuar dhe p\u00ebr blerjen e nj\u00eb apartamenti banimi me sip\u00ebrfaqe 87.4 m2 n\u00eb Sh\u00ebngjin t\u00eb Lezh\u00ebs n\u00eb vitin 2010 p\u00ebr \u00e7mimin 2.6 milion\u00eb lek\u00eb. Edhe n\u00eb k\u00ebt\u00eb rast si burim krijimi kryesor t\u00eb k\u00ebsaj pasurie, Ndoka ka deklaruar t\u00eb ardhurat e p\u00ebrfituara nga shitja e apartamentit 68 m2 n\u00eb vitin 2007, si dhe kursime nga t\u00eb ardhurat.<\/p>\n<p>N\u00eb deklarat\u00ebn \u201cveting\u201d, subjekti ka deklaruar t\u00eb ardhura n\u00eb shum\u00ebn 60 mij\u00eb lek\u00eb nga qiradh\u00ebnia e nj\u00ebsis\u00eb me sip\u00ebrfaqe 20 m2. N\u00eb vitet 208, 2009 dhe 2010, Ndoka ka deklaruar t\u00eb ardhura nga qiraja n\u00eb vler\u00ebn 200 mij\u00eb lek\u00eb n\u00eb vit.<\/p>\n<p>Komisioni ka ngritur dyshime se subjekti i rivler\u00ebsimit ka fshehur nj\u00eb pjes\u00eb t\u00eb nj\u00eb apartamenti me sip\u00ebrfaqe 103 m2 n\u00eb Tiran\u00eb. N\u00eb deklarat\u00ebn \u201cveting\u201d Ndoka ka sh\u00ebnuar se ky apartament \u00ebsht\u00eb porositur n\u00eb vitin 2012 kundrejt shum\u00ebs 60 mij\u00eb euro dhe si burim krijimi ka deklaruar kursimet cash t\u00eb periudh\u00ebs 2009-2011 dhe nj\u0451 pjes\u0451 t\u0451 vitit 2012, nd\u00ebrsa pjesa tjet\u0451r n\u00eb vler\u00ebn 45 mij\u00eb euro e paguar nga v\u00ebllai A. N. n\u00eb cil\u00ebsin\u00eb e bashk\u00ebpronarit, me kursime t\u00eb tij cash t\u00eb krijuara gjat\u0451 pun\u0451s n\u0451 shtetin grek, q\u0451 prej vitit 1992.<\/p>\n<p>Ndoka ka deklaruar p\u00ebrdorimin e k\u00ebtij apartamenti nga viti 2012 e n\u00eb vijim dhe shpenzime mobilimi. Kontrata e furnizimit me uj\u00eb ka rezultuar n\u00eb em\u00ebr t\u00eb tij, nd\u00ebrsa nuk \u00ebsht\u00eb provuar q\u00eb v\u00ebllai q\u00eb \u00ebsht\u00eb nj\u00ebkoh\u00ebsisht dhe bashk\u00ebpronar, t\u00eb ket\u00eb jetuar n\u00eb k\u00ebt\u00eb banes\u00eb, pasi prej vitesh e ka nd\u00ebrtuar jet\u00ebn e tij n\u00eb Greqi.<\/p>\n<p>Po ashtu, jan\u00eb gjetur mosp\u00ebrputhje t\u00eb pretendimeve t\u00eb Ndok\u00ebs lidhur me k\u00ebt\u00eb pasuri. Konkretisht, nuk \u00ebsht\u00eb v\u00ebrtetuar deklarimi i subjektit se ai disponon 25% t\u00eb k\u00ebsaj pasurie pasi nuk \u00ebsht\u00eb pasqyruar n\u00eb kontrat\u00eb, si dhe ka rezultuar i pav\u00ebrtet\u00eb pretendimi s\u00eb v\u00ebllai nuk disponon asnj\u00eb pasuri tjet\u00ebr, pasi ai ka bler\u00eb nj\u00eb apartament tjet\u00ebr n\u00eb Sh\u00ebngjin. Komisioni e ka vler\u00ebsuar t\u00eb paqart\u00eb mund\u00ebsin\u00eb e v\u00ebllait p\u00ebr t\u00eb investuar n\u00eb k\u00ebt\u00eb pasuri.<\/p>\n<p>Subjekti ka parashtruar se p\u00ebrdorimi i apartamentit prej tij ka qen\u00eb vet\u00ebm p\u00ebr periudh\u00ebn e shkoll\u00ebs s\u00eb f\u00ebmij\u00ebve, me miratimin dhe dijenin\u00eb e xhaxhait t\u00eb tyre. Ai ka shpjeguar se kontrata e ujit \u00ebsht\u00eb lidhur n\u00eb em\u00ebr t\u00eb tij, pasi i v\u00ebllai nuk ka pasur mund\u00ebsi t\u00eb vinte n\u00eb Shqip\u00ebri. Ndoka ka k\u00ebmb\u00ebngulur se t\u00eb ardhurat e v\u00ebllait jan\u00eb t\u00eb dokumentuara me prova shkresore dhe se nuk q\u00ebndron pretendimi i KPK-s\u00eb p\u00ebr pamund\u00ebsi financiare.<\/p>\n<p>Kolegji konstaton se t\u00eb vetmet akte mbi t\u00eb cilat subjekti bazon pretendimet e tij, mbi bashk\u00ebpron\u00ebsin\u00eb e apartamentit n\u00eb Tiran\u00eb, jan\u00eb kontrata e sip\u00ebrmarrjes, si dhe pagesat e kryera n\u00eb bank\u00eb, mbi baz\u00ebn e t\u00eb cilave ai pretendon se ka 25% t\u00eb apartamentit. \u201cSubjekti i rivler\u00ebsimit nuk arriti as t\u00eb argumentoj\u00eb se p\u00ebrse nuk \u00ebsht\u00eb arritur t\u00eb finalizohet minimalisht nj\u00eb kontrat\u00eb p\u00ebrfundimtare shitjeje p\u00ebr k\u00ebt\u00eb pasuri, duke konsideruar koh\u00ebn e gjat\u00eb t\u00eb p\u00ebrdorimit t\u00eb k\u00ebtij apartamenti nga familjar\u00ebt e tij\u201d shprehet KPA dhe vler\u00ebson se ekzistenca e kontrat\u00ebs me UKT-n\u00eb, deklarimet e subjektit t\u00eb rivler\u00ebsimit p\u00ebr shpenzime mobilimi dhe p\u00ebr p\u00ebrdorimin ekskluziv t\u00eb apartamentit nga f\u00ebmij\u00ebt e tij gjat\u00eb periudh\u00ebs s\u00eb shkoll\u00ebs, jan\u00eb indicie t\u00eb cilat \u00e7ojn\u00eb n\u00eb dyshime t\u00eb arsyeshme p\u00ebr nj\u00eb pasuri n\u00eb pron\u00ebsi vet\u00ebm t\u00eb subjektit t\u00eb rivler\u00ebsimit.<\/p>\n<p>N\u00eb vijim, KPA vler\u00ebson se edhe n\u00eb rast se subjekti do t\u00eb arrinte t\u00eb provonte me dokumentacion t\u00eb plot\u00eb justifikues t\u00eb ardhurat e t\u00eb v\u00ebllait, gjithsesi ai nuk arrin t\u00eb bind\u00eb se k\u00ebto t\u00eb ardhura jan\u00eb p\u00ebrdorur prej tij p\u00ebr blerjen e apartamentit. \u201cVet\u00ebm fakti i kryerjes s\u00eb dy pagesave nga v\u00ebllai i subjektit, nd\u00ebrkoh\u00eb q\u00eb nuk provohet asnj\u00eb lidhje tjet\u00ebr e tij me apartamentin n\u00eb fjal\u00eb, nuk provon bashk\u00ebpron\u00ebsin\u00eb e tij n\u00eb k\u00ebt\u00eb apartament\u201d, konstaton trupi gjykues i Kolegjit dhe \u00e7mon se Ndoka nuk arriti t\u00eb provoj\u00eb t\u00eb kund\u00ebrt\u00ebn e barr\u00ebs s\u00eb prov\u00ebs lidhur me fshehjen e k\u00ebtij apartamenti.<\/p>\n<p>Relatorja Mimoza Tasi ka shprehur mendim paralel lidhur me k\u00ebt\u00eb konkluzion t\u00eb shumic\u00ebs.
