Po ashtu, u konkludua se me veprimet dhe mosveprimet e tij n\u00eb marrdh\u00ebnien me nj\u00eb apartament q\u00eb ka filluar ta p\u00ebrdor\u00eb pa kund\u00ebrshp\u00ebrblim, gjasht\u00eb vjet\u00eb para se ta blinte, kishte c\u00ebnuar besimin e publikut te drejt\u00ebsia.<\/p>\n<p>Nd\u00ebrkoh\u00eb, Kostandini u vler\u00ebsua pozitivisht n\u00eb kriterin e figur\u00ebs dhe se \u00ebsht\u00eb \u201ci aft\u00eb\u201d profesionalisht.<\/p>\n<p>Arben Kostandini e ka filluar karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1993 dhe punoi prej m\u00eb shum\u00eb se dy dekadash si gjyqtar i Gjykat\u00ebs s\u00eb Rrethit Tiran\u00eb. Procesi i tij i vetingut u krye nga trupa e kryesuar nga Xhensila Pine, me relator Olsi Komicin dhe an\u00ebtare Firdes Shulin.<\/p>\n<p>Si burime krijimi p\u00ebr nj\u00eb apartament me sip\u00ebrfaqe 75.2 m2 n\u00eb dhe shtes\u00eb an\u00ebsore me sip\u00ebrfaqe 40 m2 n\u00eb zon\u00ebn e njohur si \u201cShallvaret\u201d n\u00eb Tiran\u00eb, subjekti ka deklaruar kontrat\u00ebn e privatizimit t\u00eb vitit 1993; trash\u00ebgimi nga babai me vendim t\u00eb Gjykat\u00ebs s\u00eb Tiran\u00ebs e vitit 2011; trash\u00ebgimi e n\u00ebn\u00ebs sipas nj\u00eb akti noteroial t\u00eb vitit 2015, si dhe kontrat\u00eb dhurimi po e vitit 2015, nga v\u00ebllai R.K.. Kostandini ka deklaruar se shtesa an\u00ebsore \u00ebsht\u00eb paguar nga prind\u00ebrit.<\/p>\n<p>Lidhur me k\u00ebt\u00eb pasuri, KPK i ka kaluar subjektit barr\u00eb prove p\u00ebr mosdokumentimin e vitit t\u00eb nd\u00ebrtimit t\u00eb shtes\u00ebs s\u00eb pallatit, se nuk ka deklaruar n\u00eb vitin 2006 e n\u00eb vijim shtes\u00ebn an\u00ebsore dhe vler\u00ebn e saj; se nuk ka sh\u00ebnuar n\u00eb deklarat\u00ebn \u201cveting\u201d vler\u00ebn e investimit t\u00eb shtes\u00ebs an\u00ebsore; si dhe se s\u00eb bashku me prind\u00ebrit e tij nuk kan\u00eb pasur mund\u00ebsi financiare p\u00ebr nd\u00ebrtimin e k\u00ebsaj shtese n\u00eb vitin 2006, pasi rezultojn\u00eb me balanc\u00eb negative n\u00eb shum\u00ebn 931 mij\u00eb lek\u00eb.<\/p>\n<p>Kostandini ka deklaruar se nd\u00ebrtimi i shtes\u00ebs \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb vitet 1996-1997, duke e mb\u00ebshtetur k\u00ebt\u00eb pretendim n\u00eb disa ortofoto; pamje nga google; si dhe aktekspertim t\u00eb vitit 2023 nga gjeodet dhe vler\u00ebsues, sipas t\u00eb cilit shtetsa an\u00ebsore e pallatit \u00ebsht\u00eb nd\u00ebrtuar para \u201999-\u00ebs.<\/p>\n<p>Lidhur me mosdeklarimin, subjekti ka shpjeguar se legalizimi i shtes\u00ebs \u00ebsht\u00eb kryer n\u00eb 2021-in dhe se n\u00eb vitet e m\u00ebparshme, ky nd\u00ebrtim nuk p\u00ebrb\u00ebnte detyrim p\u00ebr deklarim. P\u00ebr mosdeklarimin e vler\u00ebs, ka shpjeguar se me procedurat e nd\u00ebrtimit jan\u00eb marr\u00eb prind\u00ebrit e p\u00ebr rrjedhoj\u00eb nuk dispononte dokumente apo fatura p\u00ebr pagesat e kryer, si dhe as p\u00ebr vler\u00ebn totale t\u00eb investimit.<\/p>\n<p>Komisioni vler\u00ebson se subjekti arriti t\u00eb provoj\u00eb se shtesa \u00ebsht\u00eb nd\u00ebrtuar n\u00eb vitet 1996 &#8211; 1997. Nd\u00ebrkoh\u00eb, \u00e7mohet se kjo pasuri duhej t\u00eb ishte deklaruar prej vitit 2003. Pas rishikimit t\u00eb analiz\u00ebs finaciare, bilanci negativ \u00ebsht\u00eb rrudhur, por s\u00ebrish ka mbetur n\u00eb mas\u00ebn 184 mij\u00eb lek\u00eb.<\/p>\n<p>Problemet m\u00eb t\u00eb shumta q\u00eb ka konkluduar Komisioni p\u00ebr Kostandinin, kan\u00eb t\u00eb b\u00ebjn\u00eb me nj\u00eb tjet\u00ebr apartament n\u00eb zon\u00ebn e \u201cShallvareve\u201d me sip\u00ebrfaqe 126 m2, t\u00eb bler\u00eb n\u00eb vitin 2016 kundrejt \u00e7mimit 9.5 milion\u00eb lek\u00eb. Si burime t\u00eb k\u00ebsaj pasurie, subjekti ka deklaruar kursime n\u00eb vler\u00ebn 7 milion\u00eb lek\u00eb dhe kredi n\u00eb shum\u00ebn 2.5 milion\u00eb lek\u00eb.<\/p>\n<p>N\u00eb pyet\u00ebsorin standard, Kostandini ka deklaruar se e ka pasur n\u00eb p\u00ebrdorim pa pages\u00eb k\u00ebt\u00eb apartament, nga data 1 dhjetor 2010 deri m\u00eb 23 shtator 2016. Po ashtu, nga hetimi \u00ebsht\u00eb konfirmuar se konsumi sh\u00ebrbimeve n\u00eb k\u00ebt\u00eb banes\u00eb ka filluar n\u00eb shtator t\u00eb 2010-\u00ebs. Por, KPK ka gjetur se subjekti nuk e ka deklaruar gjat\u00eb k\u00ebtyre viteve si pasuri n\u00eb p\u00ebrdorim apo si adres\u00eb banimi.<\/p>\n<p>N\u00eb vijim, Komisioni v\u00ebren se sipas referencave t\u00eb EKB-s\u00eb p\u00ebr vitin 2016, \u00e7mimi i blerjes s\u00eb apartamentit duhej t\u00eb ishte n\u00eb total 17.5 milion\u00eb lek\u00eb dhe jo 9.5 milion\u00eb lek\u00eb.<\/p>\n<p>KPK ka konstatuar se subjekti nuk ka sh\u00ebnuar n\u00eb deklarimet vjetore dhe n\u00eb at\u00eb \u201cveting\u201d trajtimin preferencial nga shoq\u00ebria nd\u00ebrtuese lidhur me dh\u00ebnien n\u00eb p\u00ebrdorimin e k\u00ebtij apartamenti pa pages\u00eb p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb, si dhe as p\u00ebr \u00e7mimin e blerjes gati dyfish m\u00eb t\u00eb ul\u00ebt se ai i referenc\u00ebs.<\/p>\n<p>Kostandini ka shpjeguar se me drejtuesit e shoq\u00ebris\u00eb njihen q\u00eb f\u00ebmij\u00eb dhe kan\u00eb miq\u00ebsi shoq\u00ebrore e familjare, p\u00ebrfshir\u00eb edhe ortakun tjet\u00ebr.<\/p>\n<p>Ai ka th\u00ebn\u00eb se bazuar n\u00eb k\u00ebt\u00eb miq\u00ebsi, ka porositur verbalisht apartamentin q\u00eb e ka marr\u00eb n\u00eb p\u00ebrdorim n\u00eb dhjetor t\u00eb 2010-\u00ebs, derisa t\u00eb plot\u00ebsonin parat\u00eb dhe t\u00eb lidhnin kontrat\u00ebn e shitjes n\u00eb vitin 2016.<\/p>\n<p>Po ashtu, ka shpjeguar se nuk ka \u00e7muar ta deklaronte p\u00ebrdorimin e apartamentit, meqen\u00ebse marr\u00ebdh\u00ebnia ishte verbale dhe do ta deklaronte pasi t\u00eb hartohej kontrata e shitjes.<\/p>\n<p>P\u00ebr t\u00eb mb\u00ebshtetur pretendimet e tij, Kostandini ka depozituar n\u00eb Komision nj\u00eb deklarat\u00eb noteriale t\u00eb vitit 2020, ku p\u00ebrfaq\u00ebsuesja ligjore e shoq\u00ebris\u00eb nd\u00ebrtuese deklaron se p\u00ebr shkak t\u00eb marr\u00ebdh\u00ebnieve shoq\u00ebrore shum\u00eb t\u00eb mira kan\u00eb lidhur marr\u00ebveshjen verbale p\u00ebr p\u00ebrdorimin e apartamentit pa pages\u00eb deri n\u00eb shitjen e tij, pasi subjekti nuk e kishte vler\u00ebn e plot\u00eb n\u00eb dhjetor t\u00eb 2010-\u00ebs, kur dhe e mori n\u00eb p\u00ebrdorim.<\/p>\n<p>Gjyqtari Kostandini ka k\u00ebmb\u00ebngulur se nuk ka pasur trajtim preferencial n\u00eb lidhje me \u00e7mimin e shitjes s\u00eb apartamentit, p\u00ebrve\u00e7se l\u00ebnies n\u00eb p\u00ebrdorim deri n\u00eb pagimin e vler\u00ebs. Ai ka theksuar se edhe KPK nuk ka konstatuar situat\u00eb konflikti interesi mes tij dhe pal\u00ebs shit\u00ebse. P\u00ebr t\u00eb provuar pretendimin e tij p\u00ebr munges\u00ebn e trajtimit preferencial, ka depozituar disa kontrata shitjeje apartamenti t\u00eb ngjashme, n\u00eb t\u00eb nj\u00ebjtin pallat.<\/p>\n<p>Por, KPK konstaton se \u00e7mimi p\u00ebr met\u00ebr katror i k\u00ebtyre apartamenteve varion nga 97 mij\u00eb lek\u00eb deri n\u00eb 11 mij\u00eb lek\u00eb, nd\u00ebrsa \u00e7mimi i banes\u00ebs q\u00eb ka bler\u00eb subjekti \u00ebsht\u00eb rreth 75 mij\u00eb lek\u00eb.<\/p>\n<p>\u201cPra, \u00e7mimi i apartamentit q\u00eb ka bler\u00eb subjekti \u00ebsht\u00eb jo vet\u00ebm m\u00eb i ul\u00ebt se \u00e7mimi referenc\u00eb i EKB-s\u00eb, por edhe m\u00eb i lir\u00eb se \u00e7mimi i kontratave t\u00eb ngjashme, fakt ky q\u00eb e vendos subjektin n\u00eb kushtet e nj\u00eb trajtimi preferencial nga shoq\u00ebria \u201c***\u201d sh.p.k., pavar\u00ebsisht nga marr\u00ebdh\u00ebnia shoq\u00ebrore q\u00eb ata pretendojn\u00eb\u201d, vler\u00ebson KPK.<\/p>\n<p>Komisioni nuk e vler\u00ebson bind\u00ebs pretendimin e subjektit se ai nuk gjendet p\u00ebrpara trajtimit preferencial. Duke iu referuar jurispudenc\u00ebs s\u00eb Kolegjit, KPK vler\u00ebson se trajtimi preferencial jo domosdoshm\u00ebrisht lidhet me konfliktin e interesit dhe mund t\u00eb ekzistoj\u00eb edhe pa provuar gjendjen e k\u00ebtij konflikti.<\/p>\n<p>Bazuar n\u00eb pretendimet e subjektit n\u00eb prap\u00ebsime se, p\u00ebr \u00e7mimin \u00ebsht\u00eb dakord\u00ebsuar me miqt\u00eb e tij n\u00eb vitin 2005, nd\u00ebrsa n\u00eb pyet\u00ebsorin nr.3 ka deklaruar se \u00ebsht\u00eb dakord\u00ebsuar n\u00eb 2006-\u00ebn, si dhe n\u00eb faktin se administraorja e shoq\u00ebris\u00eb nuk ka deklaruar asgj\u00eb n\u00eb lidhje me dakord\u00ebsin\u00eb e \u00e7mimit, Komisioni vler\u00ebson se duken si p\u00ebrpjekje p\u00ebr deklaruar nj\u00eb vit sa m\u00eb t\u00eb hersh\u00ebm t\u00eb dakord\u00ebsimit, me q\u00ebllim justifikimin e \u00e7mimit t\u00eb ul\u00ebt n\u00eb krahasim me vitet m\u00eb pas.<\/p>\n<p>Nisur nga sqarimi i Kostandinit n\u00eb seanc\u00ebn d\u00ebgjimore, se jo vet\u00ebm ka filluar t\u00eb banoj\u00eb n\u00eb k\u00ebt\u00eb apartament n\u00eb 2010-\u00ebn, por dhe e ka p\u00ebrshtatur dhe arreduar sipas d\u00ebshir\u00ebs s\u00eb tij, Komisioni vler\u00ebson se duket se subjekti kishte sigurin\u00eb q\u00eb ky apartament tashm\u00eb ishte i tij dhe \u201cpo sillej n\u00eb nj\u00eb aspekt si pronar i tij\u201d.<\/p>\n<p>\u201cMosdeklarimi i k\u00ebsaj marr\u00ebdh\u00ebnieje dhe p\u00ebrpjekja p\u00ebr ta justifikuar me shkakun se nuk kishte nj\u00eb dokument t\u00eb shkruar, mund t\u00eb konsiderohet si p\u00ebrpjekje e subjektit p\u00ebr t\u00eb shmangur p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr mosdeklarimin e k\u00ebsaj marr\u00ebdh\u00ebnieje nd\u00ebr vite\u201d\u201d, vler\u00ebson KPK.<\/p>\n<p>Nga analiza financiare ka rezultuar pamund\u00ebsi financiare n\u00eb shum\u00ebn rreth 3.4 milion\u00eb lek\u00eb p\u00ebr kursimin e shum\u00ebs 7 milion\u00eb lek\u00eb q\u00eb ka sh\u00ebrbyer p\u00ebr pages\u00ebn e nj\u00eb pjese t\u00eb \u00e7mimit t\u00eb apartamentit. P\u00ebr burimin e dyt\u00eb, kredin\u00eb 2.5 milion\u00eb lek\u00eb nuk jan\u00eb gjetur probleme.<\/p>\n<p>N\u00eb p\u00ebrfundim t\u00eb hetimit t\u00eb k\u00ebsaj pasurie, Komisioni konkludon se q\u00ebndron dyshimi i arsyesh\u00ebm se subjekti ka nd\u00ebrmarr\u00eb hapa p\u00ebr t\u00eb fshehur nd\u00ebr vite marr\u00ebdh\u00ebnien me k\u00ebt\u00eb apartament, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb burimeve t\u00eb mjaftueshme financiare dhe se e ka formalizuar at\u00eb vet\u00ebm n\u00eb vitin 2016, p\u00ebr efekt t\u00eb procesit t\u00eb rivler\u00ebsimit. \u201cVeprime k\u00ebto q\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e tyre t\u00eb krijojn\u00eb bindjen se subjekti i rivler\u00ebsimit ka cenuar besimin e publikut tek drejt\u00ebsia\u201d, citohet n\u00eb vendim.<\/p>\n<p>Nga analiza financiare p\u00ebrfundimtare p\u00ebr 2003 \u2013 2016, gjyqtari Kostandini \u00ebsht\u00eb gjetur me bilanc negativ n\u00eb vler\u00ebn totale 7 milion\u00eb lek\u00eb.<\/p>\n<p>&nbsp;<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Komisioni i Pavarur t\u00eb Kualifikimit, KPK, vendosi m\u00eb 15 mars 2023 t\u00eb shkarkoj\u00eb nga detyra gjyqtarin e Tiran\u00ebs, Arben Kostandini p\u00ebr deklarim t\u00eb pasakt\u00eb e t\u00eb pamjaftuesh\u00ebm n\u00eb kriterin e pasuris\u00eb.
