{"id":76740,"date":"2023-06-20T15:01:30","date_gmt":"2023-06-20T13:01:30","guid":{"rendered":"https:\/\/reporter.al\/vetingu\/komisioneri-kerkon-hetime-ne-kolegj-per-statusin-e-majlinda-andreas\/2023\/06\/20\/"},"modified":"2023-06-20T15:04:00","modified_gmt":"2023-06-20T13:04:00","slug":"komisioneri-kerkon-hetime-ne-kolegj-per-statusin-e-majlinda-andreas","status":"publish","type":"post","link":"https:\/\/reporter.al\/vetingu\/komisioneri-kerkon-hetime-ne-kolegj-per-statusin-e-majlinda-andreas\/2023\/06\/20\/","title":{"rendered":"Komisioneri k\u00ebrkon hetime n\u00eb Kolegj p\u00ebr statusin e Majlinda Andreas"},"content":{"rendered":"<p>Komisioneri Publik, Florian Ballhysa ankimoi t\u00eb mart\u00ebn m\u00eb 20 qershor vendimarrjen e Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK p\u00ebr shkarkimin nga detyra t\u00eb ish-gjyqtares s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, Majlinda Andrea, e cila nuk e ushtron funksionin prej vitit 2016, kur u akuzua p\u00ebr korrupsion dhe u d\u00ebnua nj\u00eb vit m\u00eb von\u00eb me 4 vjet burg, por q\u00eb u konvertua n\u00eb sh\u00ebrbim prove.<\/p>\n<p>KPK konstatoi se institucionet e drejt\u00ebsis\u00eb, p\u00ebr gjasht\u00eb vite radhazi nuk kishin ushtruar kompetencat e tyre p\u00ebr t\u2019i hequr Andreas statusin e magjistratit dhe vendimarrja p\u00ebr ta shkarkuar u konsiderua si nj\u00eb m\u00ebnyr\u00eb p\u00ebr t\u00eb zgjidhur p\u00ebrfundimisht statusin e saj t\u00eb magjistratit.<\/p>\n<p>Por Komisioneri Ballhysa e cil\u00ebson t\u00eb gabuar arsyetimin e Komisionit dhe vler\u00ebson se ushtrimi i kompetenc\u00ebs kushtetuese nga ana e institucioneve t\u00eb vetingut t\u00eb magjistrat\u00ebve n\u00eb p\u00ebrputhje me dispozitat kushtetuese dhe ligjore p\u00ebr funksionimin e duhur t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, \u00ebsht\u00eb detyrim q\u00eb duhet t\u00eb duhet t\u00eb reflektohet nga ata vet\u00eb t\u00eb par\u00ebt.<\/p>\n<p>Nga hetimi i kryer prej Komisionit, ka rezultuar se pas d\u00ebnimit t\u00eb Andreas, ish-Kryetari i\u00a0Gjykat\u00ebs s\u00eb Lart\u00eb i \u00ebsht\u00eb drejtuar Presidentit t\u00eb Republik\u00ebs dhe Ministrit t\u00eb Drejt\u00ebsis\u00eb p\u00ebr t\u00eb filluar procedurat p\u00ebr deklarimin e p\u00ebrfundimit t\u00eb mandatit t\u00eb saj. Kjo k\u00ebrkes\u00eb i \u00ebsht\u00eb kaluar p\u00ebr kompetenc\u00eb ish-K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb, por ky i fundit ka vendosur n\u00eb korrik t\u00eb vitit 2017 t\u00eb mos e miratoj\u00eb k\u00ebrkes\u00ebn e ish-kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb dhe \u00ebsht\u00eb propozuar q\u00eb t\u00eb kalohet p\u00ebr shqyrtim n\u00eb institucionin e Presidentit t\u00eb Republik\u00ebs.<\/p>\n<p>Ky institucion ka informuar Komisionin se korrespondenca e fundit lidhur me k\u00ebt\u00eb procedur\u00eb mban dat\u00ebn 3 gusht 2017, nd\u00ebrsa Inspektori i Lart\u00eb i Drejt\u00ebsis\u00eb, ILD ka sqaruar se nuk rezulton t\u00eb ket\u00eb nisur hetim disiplinor apo t\u00eb ket\u00eb paraqitur k\u00ebrkes\u00eb p\u00ebr procedim disiplinor pran\u00eb K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor.<\/p>\n<p>Komisioni konsideroi se n\u00eb kushtet kur ligji ka parashikuar se d\u00ebnimi penal i gjyqtar\u00ebve dhe prokuror\u00ebve \u00ebsht\u00eb shkak p\u00ebr mbarimin e statusit t\u00eb magjistratit, kjo pasoj\u00eb sjell\u00eb dhe shkakrimin nga detyra.<\/p>\n<p>\u201c\u2026Duke qen\u00eb se subjekti \u00ebsht\u00eb d\u00ebnuar p\u00ebr kryerjen e nj\u00eb vepre penale t\u00eb r\u00ebnd\u00eb, vler\u00ebson se gjendet n\u00eb kushtet e cenimit t\u00eb r\u00ebnd\u00eb t\u00eb besimit t\u00eb publikut, n\u00eb k\u00ebndv\u00ebshtrim t\u00eb nenit 61, pika 5 e ligjit nr. 84\/2016 dhe, p\u00ebr pasoj\u00eb, duhet t\u00eb marr\u00eb mas\u00ebn e shkarkimit\u201d, ka konkluduar KPK.<\/p>\n<p>Duke ju referuar situat\u00ebs faktike dhe ligjore n\u00eb rastin e ish-gjyqtares Andrea, Komisioneri Ballhysa n\u00ebnvizon se ligjv\u00ebn\u00ebsit jan\u00eb treguar t\u00eb kujdessh\u00ebm q\u00eb n\u00eb ndryshimet kushtetuese t\u00eb p\u00ebrcaktonin q\u00eb institucionet e rivler\u00ebsimit, ushtrimin e kompetenc\u00ebs s\u00eb tyre kushtetuese, ta kryenin n\u00eb harmoni t\u00eb plot\u00eb me institucionet e reja t\u00eb qeverisjes s\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb. \u201c\u2026K\u00ebto t\u00eb fundit, nuk pengoheshin t\u00eb p\u00ebrmbushnin detyrimet e tyre kushtetuese apo t\u00eb ishin n\u00eb kushtet e mbivendosjes s\u00eb kompetencave, lidhur me procesin disiplinor ndaj magjistrat\u00ebve n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb, gjat\u00eb ecuris\u00eb s\u00eb mandatit t\u00eb funksionimit t\u00eb institucioneve t\u00eb rivler\u00ebsimit\u201d, v\u00ebren Ballhysa dhe shton se Kushtetuta, shprehimisht, ka parashikuar se \u201cmoskalimi me sukses i procesit t\u00eb rivler\u00ebsimit p\u00ebrb\u00ebn shkak p\u00ebr mbarimin e menj\u00ebhersh\u00ebm t\u00eb ushtrimit t\u00eb detyr\u00ebs nga ana e magjistratit, krahas shkaqeve t\u00eb parashikuara n\u00eb Kushtetut\u00eb\u201d.<\/p>\n<p>\u201cKy formulim i qart\u00eb i k\u00ebsaj dispozite, u krijon mund\u00ebsin\u00eb t\u00eb dy juridiksioneve disiplinore, atij t\u00eb jasht\u00ebzakonsh\u00ebm (institucioneve t\u00eb rivler\u00ebsimit kalimtar) dhe atij t\u00eb zakonsh\u00ebm (Inspektor i Lart\u00eb i Drejt\u00ebsis\u00eb, K\u00ebshilla) t\u00eb funksionojn\u00eb nj\u00ebkoh\u00ebsisht n\u00eb ushtrim t\u00eb kompetenc\u00ebs p\u00ebrkat\u00ebse kushtetuese\u201d, arsyeton Komisioneri Publik dhe e cil\u00ebson si procedur\u00eb automatike veprimin e ILD-s\u00eb p\u00ebr t\u00eb k\u00ebrkuar n\u00eb k\u00ebshilla shkarkimin e magjistrat\u00ebve t\u00eb d\u00ebnuar penalisht me vendim t\u00eb form\u00ebs s\u00eb prer\u00eb.<\/p>\n<p>Ballhysa sjell n\u00eb v\u00ebmendje jurisupudenc\u00ebn e Kolegjit q\u00eb p\u00ebrcakton se n\u00eb rastin e d\u00ebnimit t\u00eb magjistrat\u00ebve me form\u00eb t\u00eb prer\u00eb p\u00ebr kryerjen e nj\u00eb krimi, duhet t\u00eb konkludohet me nj\u00eb vendim konstatues t\u00eb nd\u00ebrprerjes pa vendim p\u00ebrfundimtar t\u00eb procesit. N\u00eb rastin e Andreas, Komisioneri Publik konstaton se Komisioni duke interpretuar Kushtetut\u00ebn n\u00eb m\u00ebnyr\u00eb t\u00eb gabuar, ka konsideruar se Andrea g\u00ebzon statusin e magjistratit e p\u00ebr rrjedhoj\u00eb edhe t\u00eb subjektit t\u00eb rivler\u00ebsimit kalimtar.<\/p>\n<p>I gabuar cil\u00ebsohet n\u00eb ankim edhe intepretimi i dispozitave t\u00eb Aneksit t\u00eb Kushtetut\u00ebs dhe ligjit t\u00eb vetingut t\u00eb magjistrat\u00ebve, ku Komisioni ka bazuar p\u00ebrfundimin e tij se d\u00ebnimi i Andreas \u00ebsht\u00eb shkak q\u00eb lejon shqyrtimin n\u00eb themel t\u00eb procedur\u00ebs s\u00eb rivler\u00ebsimit p\u00ebr ish-gjyqtaren dhe lejon shkarkimin nga detyra p\u00ebr c\u00ebnim t\u00eb besimit t\u00eb publikut tek sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Sipas Ballhy\u00ebs, ushtrimi nga ana e Komisionit i kompetenc\u00ebs kushtetuese s\u00eb kryerjes s\u00eb procesit t\u00eb rivler\u00ebsimit duke sjell\u00eb shkarkimin e magjistratit t\u00eb d\u00ebnuar, nuk mund dhe nuk duhet t\u00eb z\u00ebvend\u00ebsoj\u00eb ardhjen e pasoj\u00ebs, p\u00ebr shkak t\u00eb mosveprimit t\u00eb ILD-s\u00eb dhe KLGJ-s\u00eb, t\u00eb cil\u00ebt Kushtetuta i detyron t\u00eb veprojn\u00eb n\u00eb rastin konkret.<\/p>\n<p>N\u00eb ankim thuhet se KPK ka pasur mund\u00ebsin\u00eb q\u00eb t\u00eb verifikonte dhe t\u00eb hetonte, n\u00eb vazhdim\u00ebsi, shkaqet q\u00eb kan\u00eb sjell\u00eb mosveprimin e ILD-s\u00eb dhe KLGj-s\u00eb p\u00ebr t\u00eb ushtruar kompetenc\u00ebn e tyre kushtetuese t\u00eb kryerjes s\u00eb hetimit dhe procedimit disiplinor me q\u00ebllim shkarkimin e Andreas.<\/p>\n<p>Komisioneri Publik \u00e7mon se juridiksioni kontrollues dhe rivler\u00ebsues i Kolegjit, do t\u00eb duhet t\u00eb ushtrohet pik\u00ebrisht p\u00ebr t\u00eb hetuar se cilat kan\u00eb qen\u00eb shkaqet e prezumuara ligjore, q\u00eb kan\u00eb sjell\u00eb si pasoj\u00eb mosveprimin e k\u00ebtyre institucioneve.<\/p>\n<p>Sipas Ballhys\u00ebs, n\u00eb rast se pas hetimit nga ana e Kolegjit, do t\u00eb rezultoj\u00eb se institucionet e juridiksionit t\u00eb zakonsh\u00ebm disiplinor kushtetues e kan\u00eb p\u00ebrmbushur detyrimin e tyre kushtetues dhe se \u00ebsht\u00eb dh\u00ebn\u00eb masa disiplinore e shkarkimit nga detyra p\u00ebr Andrean, procesi i rivler\u00ebsimit ndaj saj do t\u00eb duhet t\u00eb deklarohet i p\u00ebrfunduar, pa nj\u00eb vendim p\u00ebrfundimtar.<\/p>\n<p>Po ashtu, Komisioneri vler\u00ebson se edhe n\u00ebse rezulton se ILD dhe KLGJ jan\u00eb ende n\u00eb kushtet e mosveprimit, do t\u00eb duhet s\u00ebrish q\u00eb procedura e vetingut t\u00eb deklarohet e p\u00ebrfunduar, pa nj\u00eb vendim p\u00ebrfundimtar, p\u00ebr shkak t\u00eb humbjes s\u00eb statusit t\u00eb magjistratit.<\/p>\n<p>&nbsp;<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Komisioneri Publik, Florian Ballhysa ankimoi t\u00eb mart\u00ebn m\u00eb 20 qershor vendimarrjen e Komisionit t\u00eb Pavarur t\u00eb Kualifikimit, KPK p\u00ebr shkarkimin nga detyra t\u00eb ish-gjyqtares s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb, Majlinda Andrea, e cila nuk e ushtron funksionin prej vitit 2016, kur u akuzua p\u00ebr korrupsion dhe u d\u00ebnua nj\u00eb vit m\u00eb von\u00eb me 4 vjet burg, [&hellip;]<!-- AddThis Advanced Settings generic via filter on get_the_excerpt --><!-- AddThis Share Buttons generic via filter on get_the_excerpt --><\/p>\n","protected":false},"author":637,"featured_media":76741,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":[],"categories":[121,2],"tags":[427,272,103,476,243,112,101,848],"fifu_image_url":"https:\/\/www.reporter.al\/wp-content\/uploads\/2022\/06\/Trupa-e-KPA-gjate-nje-procesi.jpg","fifu_image_alt":"Trupa e Kolegjit t\u00eb Posa\u00e7\u00ebm t\u00eb Apelimit gjat\u00eb nj\u00eb procesi.
