{"id":77422,"date":"2023-10-13T14:43:10","date_gmt":"2023-10-13T12:43:10","guid":{"rendered":"https:\/\/reporter.al\/vetingu\/prokurori-kujtim-bashaj-u-perball-me-barre-prove-per-bilancet-negative\/2023\/10\/13\/"},"modified":"2023-11-21T12:19:23","modified_gmt":"2023-11-21T11:19:23","slug":"prokurori-kujtim-bashaj-u-perball-me-barre-prove-per-bilancet-negative","status":"publish","type":"post","link":"https:\/\/reporter.al\/vetingu\/prokurori-kujtim-bashaj-u-perball-me-barre-prove-per-bilancet-negative\/2023\/10\/13\/","title":{"rendered":"Prokurori Kujtim Bashaj u p\u00ebrball me barr\u00eb prove p\u00ebr bilancet negative"},"content":{"rendered":"<p>Prokurori Kujtim Bashaj, u p\u00ebrball t\u00eb premten n\u00eb Komisionin e Pavarur t\u00eb Kualifikimit me nj\u00eb s\u00ebr\u00eb pyetjesh t\u00eb lidhura kryesisht me blerjen e nj\u00eb apartamenti n\u00eb vitin 2005 dhe burimin e t\u00eb ardhurave p\u00ebr k\u00ebt\u00eb apartament.<\/p>\n<p>KPK q\u00eb pas hetimit i ka kaluar Bashajt barr\u00eb prove p\u00ebr mbi 12 milion\u00eb lek\u00eb bilanc negativ, vuri po ashtu n\u00eb dukje se ai nuk kishte deklaruar plot\u00ebsisht pasurin\u00eb dhe kishte dh\u00ebn\u00eb deklarime kontradiktore.<\/p>\n<p>Sipas hetimit t\u00eb trup\u00ebs s\u00eb kryesuar nga Olsi Komici, me relatore Firdes Shuli dhe an\u00ebtare Valbona Sanxhaktari, Bashaj ishte p\u00ebrfshir\u00eb n\u00eb nj\u00eb s\u00ebr\u00eb transaksionesh dhe p\u00ebr nj\u00eb pjes\u00eb prej tyre nuk kishte dokumentacion. \u201cJu keni marr\u00eb hua p\u00ebr t\u00eb shlyer kredit\u00eb dhe kredi p\u00ebr t\u00eb shlyer huat\u00eb\u201d, tha Shuli gjat\u00eb seanc\u00ebs, duke v\u00ebn\u00eb n\u00eb dukje se ai nuk kishte shpjeguar k\u00ebt\u00eb pyetje n\u00eb pyet\u00ebsor.<\/p>\n<p>Bashaj q\u00eb u mbrojt duke v\u00ebn\u00eb n\u00eb dukje kryesisht faktin q\u00eb kishte punuar larg banes\u00ebs dhe koh\u00ebn kur kishin ndodhur transaksionet, shpjegoi para trup\u00ebs se kredia e marr\u00eb p\u00ebr t\u00eb shlyer huan\u00eb ishte b\u00ebr\u00eb n\u00eb nj\u00eb koh\u00eb kur ishte transferuar nga La\u00e7i n\u00eb Shkod\u00ebr, ai tha se nuk donte q\u00eb huadh\u00ebn\u00ebsi t\u00eb mendonte q\u00eb po i shmangej detyrimit. Bashaj kund\u00ebrshtoi edhe bilancet negative duke pretenduar se apartamenti nuk ishte paguar si\u00e7 p\u00ebrshkruhej n\u00eb kontrat\u00eb, por p\u00ebr shkak t\u00eb miq\u00ebsis\u00eb me shit\u00ebsin kontrata ishte b\u00ebr\u00eb e till\u00eb p\u00ebr t\u2019i mund\u00ebsuar atij t\u00eb hipotekonte banes\u00ebn dhe merrte kredi p\u00ebr k\u00ebt\u00eb.<\/p>\n<p>Kujtim Bashaj e nisi karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 1998 dhe punoi fillimisht si prokuror i Prokuroris\u00eb s\u00eb Kurbinit. N\u00eb vitin 2007, Bashaj u transferua n\u00eb Prokurorin\u00eb e Shkodr\u00ebs, nd\u00ebrsa prej vitit 2012 e ushtron funksionin n\u00eb Prokurorin\u00eb pran\u00eb Rrethit Gjyq\u00ebsor Durr\u00ebs.<\/p>\n<p><strong>Dyshimet mbi pasurin\u00eb<\/strong><\/p>\n<p>Relatorja Firdes Shuli vuri n\u00eb dukje gjat\u00eb relatimit se Bashaj kishte bler\u00eb nj\u00eb apartament n\u00eb vitin 2005, por se rrethanat rreth k\u00ebsaj blerje nuk ishin t\u00eb qart\u00eb, p\u00ebr shkak t\u00eb kontratave t\u00eb ndryshme, \u00e7mimeve t\u00eb ndryshme dhe deklarimeve kontradiktore.<\/p>\n<p>Shuli tha se apartamenti ishte prenotuar me kontrat\u00eb pororsie sipas t\u00eb cil\u00ebs shum\u00eb ishte paguar, p\u00ebr vler\u00ebn 67 mij\u00eb lek\u00eb dhe sip\u00ebrfaqe 142 metra. Por m\u00eb pas n\u00eb kontrat\u00ebn e shitjes vlera ishte ulur n\u00eb 52 mij\u00eb euro dhe sip\u00ebrfaqja n\u00eb 131 metra. N\u00eb deklarime Bashaj, kishte pretenduar se \u00e7mimi ishte ulur p\u00ebr shkak t\u00eb uljes s\u00eb sip\u00ebrfaqes. Ai kishte pretenduar se diferenca n\u00eb \u00e7mim i ishte dh\u00ebn\u00eb nga kompania si garazh dhe nj\u00eb pjes\u00eb 7 mij\u00eb uro ishte kthyer n\u00eb cash.<\/p>\n<p>Por Shuli ngriti dyshime mbi k\u00ebt\u00eb proces. Relatorja tha se sip\u00ebrfaqja e sh\u00ebnuar n\u00eb kontrat\u00ebn e shitjes dhe certifikat\u00eb hipotekore ishte thjesht\u00eb heqja e sip\u00ebrfaqes s\u00eb p\u00ebrbashk\u00ebt. Ajo vuri n\u00eb dukje se blerja e garazheve ishte n\u00eb nj\u00eb kontrat\u00eb m\u00eb vete, n\u00eb t\u00eb cil\u00ebn nuk p\u00ebrmendej fakti q\u00eb ishin paguar me diferenc\u00ebn n\u00eb \u00e7mimin e apartamentit.<\/p>\n<p>Ajo po ashtu pretendoi se Bashaj nuk e kishte deklaruar kthimin pas t\u00eb shum\u00ebs 7 mij\u00eb euro edhe pse ky ishte detyrim.<\/p>\n<p>Bashaj i cil\u00ebsoi problemet e gjetura si anomali dhe vet\u00ebm n\u00eb dukje t\u00eb parregullta, nd\u00ebrsa i shpjegoi transaksionet me marr\u00ebdh\u00ebnien e ngusht\u00eb me nd\u00ebrtuesin. Ai i pretendoi se n\u00eb k\u00ebto veprime kishte ndikuar fakti q\u00eb ai kishte punuar larg sht\u00ebpis\u00eb.<\/p>\n<p>I pyetur specifikisht p\u00ebr mosdeklarimin e shum\u00ebs s\u00eb kthyer Bashaj tha se e kishte marr\u00eb at\u00eb pjes\u00eb pjes\u00eb., duke pretenduar se gjithmon\u00eb kthimet kishin qen\u00eb n\u00ebn shum\u00ebn 300 mij\u00eb lek\u00eb, q\u00eb ishte detyrim p\u00ebr t\u00eb deklaruar.<\/p>\n<p>Megjithat\u00eb KPK vuri n\u00eb dukje se nga analiza financiare ai rezultonte me bilanc negativ p\u00ebr dy periudha. E para deri n\u00eb vitin 2005 lidhur me blerjen e nj\u00eb apartamenti n\u00eb vitin 2001 q\u00eb shkonte n\u00eb disa qindra mij\u00eb lek\u00eb. Nd\u00ebrsa e dyta nga viti 2005 deri n\u00eb vitin 2016 shkonte n\u00eb minus 12.5 milion lek\u00eb dhe ndikohej kryesisht nga mos njohja si t\u00eb ardhura t\u00eb p\u00ebrfitimeve nga shitja e apartamentit, disa huave dhe disa transaksioneve me kredi.<\/p>\n<p>Sipas relatimit Bashaj nuk kishte deklaruar qart\u00ebsisht huat\u00eb dhe as m\u00ebnyr\u00ebn e kthimit t\u00eb tyre dhe se shpesh n\u00eb deklarime ai rezultonte kontradiktor\u00eb. KPK vuri n\u00eb dukje se fillimisht burimi i nj\u00eb shume p\u00ebr t\u00eb shlyer nj\u00eb kredi ishte deklaruar nga pagat, por m\u00eb pas n\u00eb deklarimin veting Bashaj kisnhte ndryshuar q\u00ebndrim dhe pretendoi se kjo shum\u00eb ishte marr\u00eb hua nga bashk\u00ebshortja.<\/p>\n<p>Nga relatimi rezultonte se Bashaj kishte marr\u00eb disa her\u00eb kredi dhe hua, q\u00eb ve\u00e7 blerjes s\u00eb apartamentit kishin sh\u00ebrbyer p\u00ebr t\u00eb shlyer nj\u00ebra tjetr\u00ebn.<\/p>\n<p>Bashajt po ashtu iu k\u00ebrkuan shpjegime p\u00ebr blerjen dhe p\u00ebrdorimin e makinave, sidomos sa i p\u00ebrket nj\u00eb mjeti n\u00eb em\u00ebr t\u00eb s\u00eb motr\u00ebs, por q\u00eb ishte p\u00ebrdorur prej tij vazhdimisht. KPK po ashtu i k\u00ebrkoi Bashajt shpjegime n\u00eb lidhje me nj\u00eb adres\u00eb t\u00eb prind\u00ebrve dhe motr\u00ebs n\u00eb Tiran\u00eb. Bashaj k\u00ebmb\u00ebnguli se transferimi ishte b\u00ebr\u00eb gabimisht nga gjendja civile dhe se m\u00eb pas ishte korrigjuar, por Shuli gjat\u00eb pyetjeve i vuri n\u00eb dukje se ai nuk kishte b\u00ebr\u00eb asnj\u00eb p\u00ebrpjekje p\u00ebr ta sqaruar k\u00ebt\u00eb me zyrat e gjendjes civile n\u00eb Tiran\u00eb dhe Tropoj\u00eb.<\/p>\n<p>N\u00eb fund t\u00eb seanc\u00ebs Bashaj, q\u00eb tha se e respektonte hetimin e KPK, k\u00ebrkoi q\u00eb t\u00eb konfirmohej n\u00eb detyr\u00eb.
