Ajo tha se u q\u00ebndron gjith\u00eb shkaqeve t\u00eb ankimit dhe k\u00ebrkoi q\u00eb n\u00eb p\u00ebrfundim t\u00eb shqyrtimit t\u00eb \u00e7\u00ebshtjes, Kolegji t\u00eb vendosi t\u2019i ndaloj\u00eb Tet\u00ebs em\u00ebrimin n\u00eb sistemin e drejt\u00ebsis\u00eb p\u00ebr 15 vjet.<\/p>\n<p>Teta e konsideroi t\u00eb pabazuar ankimin e Komisioneres, duke pretenduar se nuk ishte i bazuar n\u00eb prova, n\u00eb ligj dhe as n\u00eb jurispudenc\u00ebn e KPA.<\/p>\n<p>Periand Teta ka ushtruar funksionin e ndihm\u00ebsit ligjor n\u00eb Gjykat\u00ebn e Lart\u00eb, prej shkurtit 2014 deri n\u00eb korrik t\u00eb 2017-\u00ebs, kur \u00ebsht\u00eb liruar nga detyra me me urdh\u00ebr t\u00eb ish-kryetarit t\u00eb at\u00ebhersh\u00ebm. Urdh\u00ebri lirimit ka ardhur nj\u00eb pasi Teta ka k\u00ebrkuar t\u00eb ij\u00eb p\u00ebr vijueshm\u00ebrin\u00eb e pun\u00ebs s\u00eb tij, n\u00eb kushtet q\u00eb gjyqtares pran\u00eb t\u00eb cil\u00ebs punonte si k\u00ebshilltar, i kishte p\u00ebrfunduar mandate n\u00eb qershor t\u00eb vitit 2016.<\/p>\n<p>KPK ka konstatuar se Teta ka dh\u00ebn\u00eb p\u00eblqimin n\u00eb m\u00ebnyr\u00eb t\u00eb heshtur p\u00ebr nd\u00ebrprerjen e kontrat\u00ebs s\u00eb tij t\u00eb pun\u00ebs si ndihm\u00ebs ligjor, pasi nuk e ka ankimuar at\u00eb n\u00eb gjykat\u00eb.<\/p>\n<p>Megjithat\u00eb Teta i \u00ebsht\u00eb drejtuar ILDKPKI-s\u00eb, duke parashtruar k\u00ebrkes\u00ebn p\u00ebr t&#8217;iu n\u00ebnshtruar procesit t\u00eb rivler\u00ebsimit vullnetarisht si ish-k\u00ebshilltar, pasi plot\u00ebsonte kriterin trevje\u00e7ar t\u00eb pun\u00ebsimit q\u00eb i jepte statusin si ndihm\u00ebs ligjor.<\/p>\n<p>Pas fillimit t\u00eb hetimit administrativ p\u00ebr Tet\u00ebn, Komisioni i ka k\u00ebrkuar Gjykat\u00ebs s\u00eb Lart\u00eb informacion p\u00ebr pagesat e tij, prej nga ka rezultuar se periudha efektive e pun\u00ebsimit kur \u00ebsht\u00eb trajtuar me rrog\u00eb, rezultonte nga data 3 shkurt 2014, deri m\u00eb 18 korrik 2016.<\/p>\n<p>P\u00ebr shkak se nuk provohej q\u00eb ai t\u00eb kishte punuar si ndihm\u00ebs ligjor p\u00ebr tre vjet, Komisioni \u00e7moi se Teta nuk b\u00ebn pjes\u00eb n\u00eb kategorin\u00eb e subjekteve t\u00eb rivler\u00ebsimit ex officio dhe as nuk mund t\u00eb trajtohet si ish-k\u00ebshilltar ligjor, duke arritur n\u00eb konkluzionin se ai nuk ishte objekt i ligjit t\u00eb vetingut.p\u00ebr rrjedhoj\u00eb, m\u00eb 28 prill 2023 u vendos deklarimi i p\u00ebrfundimit t\u00eb procesit t\u00eb rivler\u00ebsimit, pa nj\u00eb vendim p\u00ebrfundimtar.<\/p>\n<p>Komisionerja Nino vler\u00ebson se vendimi i Komisionit nuk \u00ebsht\u00eb i drejt\u00eb dhe i bazuar, pasi arsyetimi i fakteve dhe rrethanave ligjore \u00ebsht\u00eb jo i qart\u00eb dhe i pamjaftuesh\u00ebm p\u00ebr shmangien e zbatimit t\u00eb nenit G t\u00eb aneksit t\u00eb Kushtetu\u00ebs, ku p\u00ebrcaktohet se n\u00eb rastet e dor\u00ebheqjeve t\u00eb subjekteve t\u00eb rivler\u00ebsimit, vendoset dhe sanksioni q\u00eb u ndalon rikthimin n\u00eb sistemin e drejt\u00ebsis\u00eb gjat\u00eb 15 viteve t\u00eb ardhshme.<\/p>\n<p>Nino v\u00ebren se nga aktet e p\u00ebrcjella nga KLGj, nuk konfirmohet nj\u00eb k\u00ebrkes\u00eb formale me shkrim e subjektit p\u00ebr dor\u00ebheqje nga funksioni i ndihm\u00ebsit ligjor, por nj\u00eb shkres\u00eb e tij e korrikut 2017, drejtuar pun\u00ebdh\u00ebn\u00ebsit mbi vijueshm\u00ebrin\u00eb e marr\u00ebdh\u00ebnieve t\u00eb tij t\u00eb pun\u00ebs. N\u00eb vijim t\u00eb saj, po n\u00eb korrik t\u00eb vitit 2017, ka dal\u00eb urdh\u00ebri i Kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb p\u00ebr p\u00ebrfundimin e kontrat\u00ebs s\u00eb pun\u00ebs t\u00eb Periand Tet\u00ebs dhe lirimin e tij nga detyra.<\/p>\n<p>Komisionerja Publike vler\u00ebson se urdh\u00ebri p\u00ebr lirimin e Tet\u00ebs nga detyra, p\u00ebr shkak t\u00eb ndryshimeve ligjore, nuk p\u00ebrb\u00ebn arsye p\u00ebr p\u00ebrfundimin e marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs s\u00eb tij. sipas saj, akti p\u00ebr lirimin e subjektit nga detyra \u00ebsht\u00eb nxjerr\u00eb n\u00eb munges\u00eb t\u00eb kompetenc\u00ebs s\u00eb kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb dhe nuk ka sjell\u00eb asnj\u00eb pasoj\u00eb juridike dhe p\u00ebr rrjedhoj\u00eb Teta nuk e ka humbur statusin e ndihm\u00ebsit ligjor dhe nd\u00ebrprer\u00eb marr\u00ebdh\u00ebnien e pun\u00ebs p\u00ebr shkak t\u00eb k\u00ebtij urdhri.<\/p>\n<p>Ajo solli n\u00eb v\u00ebmendje t\u00eb Kolegjit, se pas largimit nga kjo detyr\u00eb, Teta \u00ebsht\u00eb em\u00ebruar me p\u00eblqimin e tij n\u00eb pozicionin e ri t\u00eb Inspektorit pran\u00eb Drejtoris\u00eb s\u00eb Inspektimit Gjyq\u00ebsor, n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb.<\/p>\n<p>Duke iu referuar jurisprudenc\u00ebs s\u00eb KPA, Nino tha se vler\u00ebsimi i urdhrit t\u00eb kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb lidhur me marr\u00ebdh\u00ebnien e pun\u00ebsimit t\u00eb subjektit, si ndihm\u00ebs ligjor \u00ebsht\u00eb paralel dhe, p\u00ebr pasoj\u00eb, pa asnj\u00eb pesh\u00eb mbi faktin q\u00eb Teta e kishte fituar k\u00ebt\u00eb cil\u00ebsi n\u00eb m\u00ebnyr\u00eb t\u00eb shprehur n\u00eb parashikimet kushtetuese.<\/p>\n<p>Sipas saj, Komisioni kishte kompetenc\u00ebn p\u00ebr t\u00eb konstatuar se efektet e urdhrit p\u00ebr lirimin e Tet\u00ebs nga detyra, nuk ndikonin n\u00eb ecurin\u00eb e procesit t\u00eb rivler\u00ebsimit t\u00eb tij. Ajo theksoi se vendimi i KPK nuk gjen mb\u00ebshtetje n\u00eb q\u00ebllimin e legjislatorit q\u00eb ndihm\u00ebsit ligjor\u00eb t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb t\u2019i n\u00ebnshtrohen procesit t\u00eb rivler\u00ebsimit.<\/p>\n<p>\u201cLegjislacioni q\u00eb normon procesin e rivler\u00ebsimit parashikon qart\u00ebsisht se institucionet e rivler\u00ebsimit duhet t\u00eb rivler\u00ebsojn\u00eb subjektet e p\u00ebrcaktuara shprehimisht n\u00eb nenin 179\/b, t\u00eb Kushtetut\u00ebs. N\u00eb rast se k\u00ebto subjekte vendosin t\u00eb mos i n\u00ebnshtrohen k\u00ebtij procesi, at\u00ebher\u00eb ata p\u00ebrjashtohen nga mund\u00ebsia e em\u00ebrimit n\u00eb disa prej organeve t\u00eb drejt\u00ebsis\u00eb, p\u00ebr nj\u00eb periudh\u00eb 15-vje\u00e7are, sipas p\u00ebrcaktimeve n\u00eb pik\u00ebn 2, t\u00eb nenit G, t\u00eb aneksit t\u00eb Kushtetut\u00ebs\u201d, pohoi Nino.<\/p>\n<p>Ndryshe nga KPK, Komisionerja vler\u00ebson se mungesa e nj\u00eb akti formal t\u00eb shprehjes s\u00eb vullnetit p\u00ebr dor\u00ebheqje nga detyra, nuk mund ta p\u00ebrjashtojn\u00eb Tet\u00ebn nga p\u00ebrcaktimi i nenit G t\u00eb Aneksit t\u00eb Kushtetut\u00ebs. Ajo vler\u00ebson se subjekti e ka shprehur vullnetin e tij p\u00ebr dor\u00ebheqje nga detyra e ndihm\u00ebsit ligjor n\u00eb Gjykat\u00ebn e Lart\u00eb, pasi nuk e ka kund\u00ebrshtuar ligj\u00ebrisht urdh\u00ebrin e kryetarit t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb p\u00ebr lirimin nga detyra, si dhe p\u00ebr arsye se ka shfaqur vullnetin duke pranuar detyr\u00ebn e inspektorit n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb.<\/p>\n<p>N\u00eb p\u00ebrfundim, Nino argumentoi se Teta ka ushtruar t\u00eb drejtat e tij, duke b\u00ebr\u00eb nj\u00eb zgjedhje personale e shprehur vullnetin e pavesur p\u00ebr nd\u00ebrprerjen e procesit t\u00eb rivler\u00ebsimit, q\u00eb n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb dhe zgjedhje p\u00ebr t\u00eb pasur ndalimin ligjor q\u00eb parashikon neni G i Aneksit t\u00eb Kushtetut\u00ebs.<\/p>\n<p>Ajo i k\u00ebrkoi Kolegjit ndryshimin e vendimit t\u00eb KPK dhe ve\u00e7 nd\u00ebprerjes s\u00eb vetingut p\u00ebr Tet\u00ebn, t\u00eb vendoset edhe ndalimi i tij p\u00ebr t\u2019u em\u00ebruar gjyqtar ose prokuror i \u00e7do niveli, an\u00ebtar i K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor ose i K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Prokuroris\u00eb, Inspektoratit t\u00eb Lart\u00eb t\u00eb Drejt\u00ebsis\u00eb ose Prokuror i P\u00ebrgjithsh\u00ebm, p\u00ebr nj\u00eb periudh\u00eb 15-vje\u00e7are.<\/p>\n<p>Perian Teta deklaroi n\u00eb seanc\u00eb se pasi \u00ebsht\u00eb njohur me ankimin e Ninos, vler\u00ebson se \u00ebsht\u00eb i pamb\u00ebshtetur n\u00eb prova dhe n\u00eb ligj, se \u00ebsht\u00eb ngritur mbi shkaqe apriori. Sipas tij, n\u00eb ankim mungon arsyetimi dhe analiza ligjore. Po ashtu, k\u00ebmb\u00ebnguli se shkaqet jan\u00eb t\u00eb pamb\u00ebshtetura n\u00eb jurispudenc\u00ebn e KPA.<\/p>\n<p>Ai shpjegoi se kur gjyqtares p\u00ebr t\u00eb cil\u00ebn punonte si k\u00ebshilltar i kishte p\u00ebrfunduar mandati n\u00eb qershor t\u00eb 2016-\u00ebs, nuk kishte patur ndonj\u00eb reagim p\u00ebr vijim\u00ebsin\u00eb e pun\u00ebs s\u00eb tij dhe p\u00ebr k\u00ebt\u00eb arsye kishte b\u00ebr\u00eb nj\u00eb shkres\u00eb drejtuar kryetarit, duke k\u00ebkruar t\u00eb dinte se \u00e7far\u00eb do t\u00eb b\u00ebhej me t\u00eb.<\/p>\n<p>Sipas Tet\u00ebs, pas k\u00ebsaj shkrese kishte dal\u00eb urdh\u00ebri p\u00ebr lirimin e tij nga detyra dhe n\u00eb k\u00ebto kushte u ishte drejtuar institucioneve p\u00ebrkat\u00ebse se si do t\u00eb veprohej n\u00eb kushtet kur kontrata e pun\u00ebs kishte p\u00ebrfunduar n\u00eb m\u00ebnyr\u00eb natyrale, pasi ishte p\u00ebrfunduar mandati an\u00ebtares s\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb.<\/p>\n<p>Teta deklaroi se kishte k\u00ebrkuar q\u00eb t\u00eb vijohej procesi i vetingut ndaj tij si subjekti rivler\u00ebsimi ose si ish subjekt. Ai v\u00ebrejti s ndryshe nga sa pretendonte Nino, kishte b\u00ebr\u00eb k\u00ebrkes\u00eb padi p\u00ebr largimin nga puna n\u00eb Gjykat\u00ebn Administrative, e cila e kishte kaluar p\u00ebr kompetenc\u00eb n\u00eb Gjykat\u00ebn e Tiran\u00ebs, Dhoma Civile. Teta tha se kjo gjykat\u00eb e kishte rr\u00ebzuar k\u00ebrkes\u00ebpadin\u00eb e tij dhe se vijonte t\u00eb priste gjykimin n\u00eb Apel.<\/p>\n<p>N\u00eb vijim, ai pohoi se p\u00ebr arsye se puna kishte p\u00ebrfunduar p\u00ebr shkaqe t\u00eb natyrshme, kishte filluar pun\u00eb n\u00eb inistrin\u00eb e Drejt\u00ebsis\u00eb.<\/p>\n<p>Teta e kund\u00ebrshtoi q\u00ebndrimin e Ninos se vendimi i KPK ishte i paarsyetuar. Ai argumentoi se KPK e ka kryer arsyetimin formalisht, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb statusit t\u00eb rivler\u00ebsimit. Teta k\u00ebmb\u00ebnguli se nuk e g\u00ebzonte statusin ex officio dhe p\u00ebr rrjedhoj\u00eb, n\u00eb k\u00ebt\u00eb rast gjendej para nj\u00eb vendimarrje pa vendim p\u00ebfundimtar.<\/p>\n<p>Ai theksoi se n\u00eb k\u00ebt\u00eb situat\u00eb, institucionet e vetingut nuk mund t\u00eb vijojn\u00eb me k\u00ebrkime t\u00eb tjera p\u00ebr t\u00eb aplikuar sanksionin e p\u00ebrcaktuar n\u00eb nenin G t\u00eb Aneksit t\u00eb Kushtetut\u00ebs.<\/p>\n<p>Teta solli n\u00eb v\u00ebmendje jurispudenc\u00ebn e KPA dhe se ishte shprehur p\u00ebr vijimin e procesit t\u00eb vetingut ndaj tij. Sipas subjektit, n\u00eb dy raste t\u00eb ngjashme, Komisoneri nuk kishte kryer ankim.
