Vendimi u mor me votat e shumic\u00ebs s\u00eb trup\u00ebs s\u00eb KPK, t\u00eb p\u00ebrb\u00ebr\u00eb nga kryesuesja Alma Faskaj dhe an\u00ebtarja Xhensila Pine. Relatorja e \u00e7\u00ebshtjes, Pamela Qirko doli n\u00eb pakic\u00eb duke \u00e7muar se Saliaj arriti nivel t\u00eb besuesh\u00ebm p\u00ebr t\u00eb tri kriteret e rivler\u00ebsimit dhe se duhej konfirmuar n\u00eb detyr\u00eb.<\/p>\n<p>Xhemal Saliaj e filloi karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 2003 si prokuror n\u00eb Prokurorin\u00eb e Beratit, ku ka ushtruar dhe funksionin e drejtuesit. Prej vitit 2013 e deri n\u00eb shkarkimin nga detyra, Saliaj e ushtroi funksionin n\u00eb Prokurorin\u00eb e Rrethit Vlor\u00eb.<\/p>\n<p><strong>Vler\u00ebsimet p\u00ebr pasurin\u00eb <\/strong><\/p>\n<p>Shumica ka arritur n\u00eb p\u00ebrfundimin se subjekti ka kryer deklarim t\u00eb pasakt\u00eb e t\u00eb pamjaftuesh\u00ebm lidhur me nj\u00eb apartament me sip\u00ebrfaqe 71.71 m2 n\u00eb Vlor\u00eb, si dhe se ka pasur munges\u00eb t\u00eb burimeve financiare p\u00ebr pages\u00ebn e \u00e7mimit dhe shlyerjen para kohe t\u00eb kredis\u00eb. Saliaj ka deklaruar se apartamentin e ka bler\u00eb n\u00eb vitin 2004 kundrejt \u00e7mimit 3.5 milion\u00eb lek\u00eb, me burim krijimi nj\u00eb kredi 35 mij\u00eb euro.<\/p>\n<p>Nga hetimi i Komisionit ka rezultuar se n\u00eb maj t\u00eb vitit 2004 \u00ebsht\u00eb lidhur kontrat\u00eb p\u00ebr kredin\u00eb 35 mij\u00eb euro me afat 10-vje\u00e7ar dhe \u00ebsht\u00eb dakord\u00ebsuar q\u00eb t\u00eb vendoset si garanci apartamenti q\u00eb do t\u00eb blihej dhe nj\u00eb tjet\u00ebr pasuri e subjektit me vler\u00eb prej 250 mij\u00eb lek\u00ebsh. Vlera e kredis\u00eb, n\u00eb mas\u00ebn 4.3 milion\u00eb lek\u00eb \u00ebsht\u00eb derdhur n\u00eb llogarin\u00eb e pal\u00ebs shit\u00ebse. Nd\u00ebrkoh\u00eb, n\u00eb dosjen e kredis\u00eb ka rezultuar se \u00ebsht\u00eb p\u00ebrcaktuar se borxhi prej 4.4 milion\u00eb lek\u00ebsh \u00ebsht\u00eb pjesa mbetur e detyrimit p\u00ebr blerjen e sht\u00ebpis\u00eb s\u00eb re tek firma e nd\u00ebrtimit. Po ashtu, \u00ebsht\u00eb sh\u00ebnuar se klienti ka paguar nj\u00eb shum\u00eb prej 15 mij\u00eb euro, nga t\u00eb cilat 10 mij\u00eb euro jan\u00eb pages\u00eb k\u00ebsti, nd\u00ebrsa 5000 euro p\u00ebr meremetime q\u00eb e nj\u00ebjta firm\u00eb nd\u00ebrtimi do t\u00eb b\u00ebj\u00eb tek apartamenti i ri.<\/p>\n<p>KPK e ka kryer analiz\u00ebn financiare paraprake duke konsideruar shpenzime p\u00ebr blerjen e apartamentit vler\u00ebn 50 mij\u00eb euro, sipas dokumentacionit t\u00eb administruar n\u00eb bank\u00eb. Kredia nuk \u00ebsht\u00eb p\u00ebrfshir\u00eb si burim, pasi \u00ebsht\u00eb disbursuar m\u00eb von\u00eb nga data kur \u00ebsht\u00eb n\u00ebnshkruar kontrata e shitblerjes, ku sh\u00ebnohej se gjith\u00eb vlera ishte shlyer. P\u00ebr rrjedhoj\u00eb, ka rezultuar bilanc negativ n\u00eb shum\u00ebn 6 milion\u00eb lek\u00eb.<\/p>\n<p>Komisioni i ka kaluar subjektit barr\u00eb prove p\u00ebr deklarim t\u00eb rrem\u00eb t\u00eb \u00e7mimit t\u00eb apartamentit, pasi vlera e sh\u00ebnuar n\u00eb kontrat\u00eb duket se \u00ebsht\u00eb fiktiv, i vendosur me marr\u00ebveshje mes pal\u00ebve.<\/p>\n<p>Subjekti ka shpjeguar se \u00e7mimi i paguar shit\u00ebsit \u00ebsht\u00eb kryer pas disbursimit t\u00eb kredis\u00eb. Ai ka theksuar se n\u00eb kontrat\u00eb \u00ebsht\u00eb sh\u00ebnuar se ishte shlyer \u00e7mimi, n\u00eb dakord\u00ebsi me pal\u00ebn shit\u00ebse, me q\u00ebllim q\u00eb apartamenti t\u00eb regjistrohej n\u00eb hipotek\u00eb n\u00eb em\u00ebr t\u00eb tij si kredimarr\u00ebs, pasi ishte kusht i panegociuesh\u00ebm i bank\u00ebs p\u00ebr dh\u00ebnien e huas\u00eb. Po ashtu, ai ka kund\u00ebrshtuar si t\u00eb pabazuar vendosjen e \u00e7mimit prej 50 mij\u00eb euro, duke pretenduar se vlera e vendosur n\u00eb dokumentacionin e administruar nga banka nuk p\u00ebrfaq\u00ebson q\u00ebndrimin zyrtar t\u00eb bank\u00ebs, pasi dokumenti \u00ebsht\u00eb i pan\u00ebnshkruar nga ndonj\u00eb punonj\u00ebs dhe i pavulosur.<\/p>\n<p>Por, shumica vler\u00ebson se subjekti nuk arriti t\u00eb provoj\u00eb t\u00eb kund\u00ebrt\u00ebn e barr\u00ebs s\u00eb prov\u00ebs lidhur me vler\u00ebn e deklaruar t\u00eb paguar p\u00ebr p\u00ebrfitimin e k\u00ebsaj pasurie, si dhe p\u00ebr pamund\u00ebsin\u00eb financiare t\u00eb konstatuar n\u00eb vitin 2004. Sipas shumic\u00ebs, edhe n\u00ebse n\u00eb analiz\u00ebn p\u00ebrfundimtare financiare t\u00eb kryer do t\u00eb merrte n\u00eb konsiderat\u00eb vler\u00ebn e kredis\u00eb s\u00eb p\u00ebrfituar pas pagimit t\u00eb pasuris\u00eb, si burim krijimi p\u00ebr apartamentin n\u00eb vler\u00ebn 4.4 milion\u00eb lek\u00eb, analiza financiare e subjektit do t\u00eb rezultonte me pamund\u00ebsi financiare p\u00ebr pagimin e shum\u00ebs 15 mij\u00eb euro po n\u00eb at\u00eb vit. Po ashtu, konkludohet se deklarimi i subjektit n\u00eb deklarat\u00ebn veting, mbi vler\u00ebn e p\u00ebrfitimit t\u00eb pasuris\u00eb, e vendos at\u00eb n\u00eb kushtet e deklarimit t\u00eb pasakt\u00eb dhe t\u00eb pamjaftuesh\u00ebm.<\/p>\n<p>Komisioni ka konstatuar se prokurori Saliaj nuk ka v\u00ebrtetuar mund\u00ebsin\u00eb p\u00ebr shylerjen e kredis\u00eb brenda tre viteve, me nj\u00eb hua 17 mij\u00eb euro t\u00eb marr\u00eb nga motra, pasi ka d\u00ebshtuar t\u00eb jet\u00eb bind\u00ebs mbi burimin e ligjsh\u00ebm t\u00eb k\u00ebsaj huaje.<\/p>\n<p>Qirko kund\u00ebrshton konkluzionin e shumic\u00ebs n\u00eb lidhje me p\u00ebrcaktimin e vler\u00ebs s\u00eb pasuris\u00eb n\u00eb shum\u00ebn 50 mij\u00eb euro, duke e konsideruar t\u00eb pabazuar n\u00eb prova. Ajo i cil\u00ebson n\u00eb harmoni me nj\u00ebra-tjetr\u00ebn shpjegimet dhe aktet e depozituara nga subjekti p\u00ebr t\u00eb kund\u00ebrshtuar barr\u00ebn e prov\u00ebs.<\/p>\n<p>\u201cNga analizimi i veprimeve dhe deklarimeve t\u00eb koh\u00ebs dhe n\u00eb munges\u00eb t\u00eb ndonj\u00eb akti tjet\u00ebr q\u00eb t\u00eb provoj\u00eb t\u00eb kund\u00ebrt\u00ebn, \u00e7mohet bind\u00ebs fakti se pasuria objekt vler\u00ebsimi ka pasur vler\u00ebn 3,500,000 lek\u00eb dhe se subjekti p\u00ebrtej k\u00ebsaj vlere i ka paguar shoq\u00ebris\u00eb s\u00eb nd\u00ebrtimit edhe vler\u00ebn e investimit t\u00eb mobilieve\u201d, vler\u00ebson Qirko dhe shton se \u00e7do lloj dyshimi tjet\u00ebr p\u00ebr \u00e7mimin, qoft\u00eb edhe i arsyesh\u00ebm, nuk do t\u00eb ishte i drejt\u00eb n\u00eb vler\u00ebsimin e subjektit n\u00ebse nuk do t\u00eb ishte i bazuar n\u00eb prova.<\/p>\n<p>Ajo v\u00ebren se shumica nuk \u00ebsht\u00eb bazuar n\u00eb akte zyrtare, por n\u00eb dokumente q\u00eb p\u00ebrmbajn\u00eb sh\u00ebnime t\u00eb punonj\u00ebsve t\u00eb bank\u00ebs, q\u00eb nuk kan\u00eb as ekstremitetet e nj\u00eb akti zyrtar.<\/p>\n<p>Qirko kund\u00ebrshton dhe konkluzionin e shumic\u00ebs p\u00ebr moskonsiderimin e huas\u00eb nga motra, duke sjell\u00eb n\u00eb v\u00ebmendje se Saliaj paraqiti akte shtes\u00eb q\u00eb jepnin informacion t\u00eb detajuar n\u00eb lidhje me t\u00eb ardhurat e akumuluara p\u00ebr shkak t\u00eb pun\u00ebsimit n\u00eb shtetin grek p\u00ebr periudh\u00ebn 2002 \u2013 2008, t\u00eb bashk\u00ebshortit t\u00eb huadh\u00ebn\u00ebses.<\/p>\n<p>N\u00eb p\u00ebrfundim relatorja Qirko vler\u00ebson se p\u00ebr shlyerjen e kredis\u00eb, subjekti gjendet me bilanc negativ n\u00eb shum\u00ebn 437 mij\u00eb lek\u00eb, q\u00eb bazuar n\u00eb parimin e proporcionalitetit dhe objektivitetit nuk mund t\u00eb sjell\u00eb penalizim.<\/p>\n<p>P\u00ebr blerjen e nj\u00eb apartamenti tjet\u00ebr n\u00eb vitin 2016 me burim t\u00eb ardhurat nga shitja e banes\u00ebs s\u00eb m\u00ebparshme, kursimet nga pagat dhe nj\u00eb kredi, nuk jan\u00eb gjetur probleme penalizuese.<\/p>\n<p>Shumica vler\u00ebson se prokurori Saliaj nuk arriti t\u00eb provonte se n\u00ebna ishte pronarja reale e nj\u00eb automjeti t\u00eb p\u00ebrdorur prej tij. Makina \u00ebsht\u00eb bler\u00eb n\u00eb em\u00ebr t\u00eb n\u00ebn\u00ebs n\u00eb vitin 2010, e cila p\u00ebr shkak t\u00eb gjendjes sh\u00ebndet\u00ebsore p\u00ebrfitonte nga statusi i invalidit paraplegjik dhe tetraplegjik. Komisioni konstaton pamund\u00ebsi t\u00eb n\u00ebn\u00ebs p\u00ebr blerjen e makin\u00ebs me t\u00eb ardhurat nga pensioni.<\/p>\n<p>Po ashtu, sipas shumic\u00ebs, subjekti i rivler\u00ebsimit ka p\u00ebrfituar nga statusi i n\u00ebn\u00ebs s\u00eb tij si invalide, me q\u00ebllim krijimin e leht\u00ebsirave fiskale p\u00ebr blerjen dhe g\u00ebzimin e k\u00ebsaj pasurie, duke sjell\u00eb p\u00ebr rrjedhoj\u00eb cenim t\u00eb etik\u00ebs dhe integritetit t\u00eb tij si prokuror. \u201c[\u2026]pasi kjo m\u00ebnyr\u00eb sjelljeje e zgjedhur prej tij duket se tregon nj\u00eb qasje t\u00eb caktuar n\u00eb raport me respektimin e ligjit, zbatimi i t\u00eb cilit \u00ebsht\u00eb detyr\u00eb themelore e magjistratit edhe jasht\u00eb ushtrimit t\u00eb funksionit t\u00eb tij\u201d, v\u00ebrejn\u00eb Faskaj dhe Pine dhe e kan\u00eb konsideruar k\u00ebt\u00eb rrethan\u00eb n\u00eb vler\u00ebsimin e p\u00ebrgjithsh\u00ebm.<\/p>\n<p>Qirko kund\u00ebrshton q\u00ebndrimin e shumic\u00ebs dhe \u00e7mon se n\u00ebna Saliajt ka pasur mund\u00ebsi p\u00ebr blerjen e mjetit, nga t\u00eb ardhurat e p\u00ebrfituara si invalide paraplegjike sipas ligjit, si dhe t\u00eb ardhurat e tjera nga pensioni i pleq\u00ebris\u00eb. Po ashtu, relatorja vler\u00ebson se subjekti ka pasur mund\u00ebsi financiare p\u00ebr krijimin e k\u00ebsaj pasurie n\u00eb vitin 2010.<\/p>\n<p>Ajo konstaton se subjekti nuk ka kryer fshehje t\u00eb pasuris\u00eb, pasi ai e ka deklaruar p\u00ebrdorimin e automjetit n\u00eb deklarat\u00ebn e rivler\u00ebsimit kalimtar, si dhe ka konfirmuar gjat\u00eb hetimit administrativ p\u00ebrdorimin e tij p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb.<\/p>\n<p>Qirko \u00e7mon se sa i p\u00ebrket kriterit t\u00eb pasuris\u00eb, mungesa e burimeve t\u00eb ligjshme n\u00eb shum\u00ebn prej 437 mij\u00eb lek\u00ebsh p\u00ebr mbylljen e parakohshme t\u00eb kredis\u00eb, nuk mund t\u00eb konsiderohet se e vendos subjektin n\u00eb kushtet e mosarritjes s\u00eb nj\u00eb niveli t\u00eb besuesh\u00ebm.<\/p>\n<p><strong>Vler\u00ebsimi t\u00ebr\u00ebsor<\/strong><\/p>\n<p>Nga analizimi dosjeve profesionale t\u00eb subjektit, shumica ka konstatuar se n\u00eb dy \u00e7\u00ebshtje ai nuk ka kryer veprimet hetimore ezauruese p\u00ebr t\u00eb provuar shkeljet e konstatuara, nd\u00ebrkoh\u00eb q\u00eb n\u00eb nj\u00eb rast tjet\u00ebr nuk jan\u00eb respektuar elementet e nj\u00eb procesi t\u00eb rregullt ligjor duke i mohuar personit n\u00eb hetim t\u00eb drejt\u00ebn p\u00ebr t\u00eb marr\u00eb avokat.<\/p>\n<p>Po ashtu, shumica vler\u00ebson se kur subjekti ka mbajtur funksionin e drejtuesit, nuk ka ushtruar detyr\u00ebn n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb dhe ezauruese.<\/p>\n<p>N\u00eb nj\u00eb rast konstatohet se Saliaj e ka ushtruar funksionin e tij n\u00eb kushtet e konfliktit t\u00eb interesit n\u00eb dukje.<\/p>\n<p>Megjith\u00ebse gjetjet n\u00eb kriterin profesional nuk vler\u00ebsohen penalizuese nga ana e shumic\u00ebs s\u00eb trup\u00ebs s\u00eb KPK, ato jan\u00eb konsideruar n\u00eb vler\u00ebsimin e p\u00ebrgjithsh\u00ebm, lidhur me c\u00ebnimin e besimit.<\/p>\n<p>Qirko ka dal\u00eb kund\u00ebr dhe p\u00ebr konstatimet n\u00eb aspektin profesional, duke i cil\u00ebsuar ato t\u00eb pabazuara.
