Kolegji vler\u00ebson se shkarkimi i gjyqtares \u00c7ela duhet l\u00ebn\u00eb n\u00eb fuqi p\u00ebr shkak t\u00eb pamund\u00ebsis\u00eb financiare dhe gjendjes s\u00eb saj n\u00eb kushtet e konfliktit t\u00eb interesit. Nd\u00ebrkoh\u00eb q\u00eb nuk shprehet lidhur me konkluzionin e KPK, q\u00eb n\u00eb vler\u00ebsimin t\u00ebr\u00ebsor konstatoi se subjekti gjendej n\u00eb kushtet e c\u00ebnimit t\u00eb besimit t\u00eb publikut,<\/p>\n<p>Herila \u00c7ela e filloi karrier\u00ebn n\u00eb sistemin e drejt\u00ebsis\u00eb n\u00eb vitin 2003 dhe punoi p\u00ebr dy dekada pran\u00eb Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Vlor\u00eb. Vendimet e gjyqtares Herila \u00c7ela u b\u00ebn\u00eb dy her\u00eb objekt i k\u00ebrkesave t\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb p\u00ebr procedimin disiplinor t\u00eb saj dhe n\u00eb vitin 2014 i\u2019u vendos masa \u201cv\u00ebrejtje me paralajm\u00ebrim\u201d, por kjo mas\u00eb u rr\u00ebzua nga Gjykata Administrative e Apelit. Po ashtu me vendim gjykate u rr\u00ebzua dhe nj\u00eb gjov\u00eb e ILDKPKI-s\u00eb p\u00ebr gjendjen n\u00eb kushtet e konfliktit t\u00eb interesit, por KPA vler\u00ebsoi se legjislacioni e p\u00ebrcakton qart\u00eb \u00ebsht\u00eb nj\u00eb gjendje e till\u00eb, q\u00eb n\u00eb k\u00ebt\u00eb rast konsideroi se \u00ebsht\u00eb e provuar nga aktet e administruara.<\/p>\n<p><strong>Munges\u00eb burimesh<\/strong><\/p>\n<p>Komisioni ka arritur n\u00eb konkluzionin se gjyqtarja \u00c7ela dhe personat e lidhur me t\u00eb kan\u00eb pasur munges\u00eb t\u00eb burimeve t\u00eb ligjshme p\u00ebr krijimin e dy depozitave n\u00eb vlerat 944 mij\u00eb lek\u00eb dhe 630 mij\u00eb lek\u00eb n\u00eb vitin 2006, pasi ka rezultuar bilanc negativ n\u00eb shum\u00ebn 1 milion lek\u00eb.<\/p>\n<p>Ashtu si dhe gjat\u00eb hetimit administrativ n\u00eb KPK, subjekti ka mbajtur t\u00eb nj\u00ebjtin q\u00ebndrim, duke pretenduar se si burim krijimi p\u00ebr k\u00ebto depozita kan\u00eb sh\u00ebrbyer kursimet e prind\u00ebrve t\u00eb saj, si dhe ark\u00ebtimi i shum\u00ebs 1 milion lek\u00eb nga shitja e truallit n\u00eb pron\u00ebsi t\u00eb n\u00ebn\u00ebs. Ajo ka shpjeguar se vlera monetare p\u00ebr shitjen e truallit \u00ebsht\u00eb p\u00ebrfituar p\u00ebrpara lidhjes s\u00eb kontrat\u00ebs s\u00eb shitjes t\u00eb n\u00ebnshkruar n\u00eb mars t\u00eb 2007-\u00ebs.<\/p>\n<p>Bazuar n\u00eb aktet e administruara, Kolegji vler\u00ebson se mbeten n\u00eb nivel deklarativ pretendimet e subjektit se likujdimi i \u00e7mimit p\u00ebr shitjen e truallit \u00ebsht\u00eb kryer n\u00eb shtator t\u00eb vitit 2006 dhe jo n\u00eb mars t\u00eb 2007-\u00ebs, kur \u00ebsht\u00eb n\u00ebnshkruar kontrata. Po ashtu, kan\u00eb mbetur pa pesh\u00eb p\u00ebrcaktuese dhe pretendimet se kishte mund\u00ebsi p\u00ebr t\u00eb investuar n\u00eb k\u00ebto depozita nga t\u00eb ardhurat e biznesit t\u00eb bashk\u00ebshortit, pasi burimi i deklaruar nga vet\u00eb subjekti ka qen\u00eb \u201cdhurat\u00eb nga prind\u00ebrit\u201d. P\u00ebr rrjedhoj\u00eb, edhe KPA vler\u00ebson se gjyqtarja. \u00c7ela dhe personat e lidhur kan\u00eb qen\u00eb n\u00eb pamund\u00ebsi p\u00ebr krijimin e k\u00ebtyre depozitave n\u00eb vitin 2006.<\/p>\n<p>KPK ka konstatuar pamund\u00ebsi n\u00eb shum\u00ebn 848 mij\u00eb lek\u00eb, edhe p\u00ebr nj\u00eb depozit\u00eb tjet\u00ebr n\u00eb vler\u00ebn 539 mij\u00eb lek\u00eb, me burim t\u00eb deklaruar t\u00eb ardhurat gjat\u00eb periudh\u00ebs 1997-2003.<\/p>\n<p>\u00c7ela ka theksuar se depozita \u00ebsht\u00eb krijuar para em\u00ebrimit t\u00eb saj n\u00eb detyr\u00eb. Ajo ka k\u00ebrkuar q\u00eb n\u00eb analiz\u00eb t\u00eb p\u00ebrfshihen t\u00eb ardhurat nga biznesi bashk\u00ebshortit, duke shpjeguar se k\u00ebto t\u00eb ardhura nuk i ka pasqyruar n\u00eb deklarat\u00ebn veting p\u00ebr shkak t\u00eb v\u00ebshtir\u00ebsis\u00eb q\u00eb kishte hasur n\u00eb deklarim.<\/p>\n<p>Lidhur me faktin se kjo pasuri \u00ebsht\u00eb krijuar para fillimit t\u00eb detyr\u00ebs, Kolegji sjell n\u00eb v\u00ebmendje se standardi i kontrollit i vendosur n\u00eb kuad\u00ebr t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi, k\u00ebrkon verifkimin e plot\u00eb t\u00eb pasurive t\u00eb deklaruara dhe nuk e kufizon at\u00eb n\u00eb pasuri t\u00eb krijuara para apo pas em\u00ebrimit n\u00eb detyr\u00eb t\u00eb magjistratit.<\/p>\n<p>Nga analiza financiare p\u00ebr t\u00eb ardhurat p\u00ebr periudh\u00ebn 1997-2003, ka rezultuar se subjekti i rivler\u00ebsimit ka pasur munges\u00eb t\u00eb burimeve t\u00eb ligjshme p\u00ebr t\u00eb p\u00ebrballuar shpenzimet dhe gjithashtu p\u00ebr t\u00eb krijuar kursime, duke rezultuar me bilanc negativ n\u00eb mas\u00ebn prej 847 mij\u00eb lek\u00ebsh. KPA ka kryer edhe nj\u00eb analiz\u00eb alternative, duke p\u00ebrllogaritur fitimin e mundsh\u00ebm nga aktiviteti i bashk\u00ebshortit si person fizik, me marzh fitimi 30% mbi xhiron e parashikuar n\u00eb flet\u00ebn e njoftimit t\u00eb tatimit, por s\u00ebrish ka rezultuar pamund\u00ebsi financiare.<\/p>\n<p>Gjyqtarja \u00c7ela \u00ebsht\u00eb gjetur me bilanc negativ n\u00eb shum\u00ebn 2.1 milion\u00eb lek\u00eb, edhe p\u00ebr dy depozita t\u00eb tjera n\u00eb vlerat 2.8 milion\u00eb lek\u00eb dhe 2.7 milion\u00eb lek\u00eb. Sipas KPK, ajo ka rezultuar n\u00eb pamund\u00ebsi p\u00ebr krijimin e k\u00ebtyre depozitave n\u00eb vitin 2004 dhe p\u00ebr shtimin e likujditeteve dhe kryerjen e shpenzimeve n\u00eb 2010-\u00ebn.<\/p>\n<p>Subjekti ka pretenduar se, megjith\u00ebse KPK ka njohur t\u00eb ardhurat nga aktiviteti privat i bashk\u00ebshortit, nuk jep asnj\u00eb argument p\u00ebrse nuk i njeh t\u00eb ardhurat p\u00ebr vitin 2003. Ajo ka n\u00ebnvizuar se ka paraqitur t\u00eb nj\u00ebjtin dokumentacion p\u00ebr t\u00eb v\u00ebrtetuar ushtrimin e aktivitetit t\u00eb personit fizik nga bashk\u00ebshorti, n\u00eb t\u00eb tri k\u00ebto vite.<\/p>\n<p>Duke iu referuar argumenteve t\u00eb subjektit se pasakt\u00ebsit\u00eb n\u00eb deklarime nuk mund t\u00eb sjellin pasoja kur jan\u00eb t\u00eb pashoq\u00ebruara me pamund\u00ebsi financiare, Kolegji konstaton se n\u00eb k\u00ebt\u00eb rast faktet tregojn\u00eb nj\u00eb tjet\u00ebr realitet. Sipas KPA, n\u00eb rastin e procesit t\u00eb rivler\u00ebsimit t\u00eb \u00c7el\u00ebs, ka rezultuar se t\u00eb ardhurat e pretenduara nuk jan\u00eb deklaruar n\u00eb deklarat\u00ebn e pasuris\u00eb veting e n\u00eb deklaratat periodike, si dhe nuk jan\u00eb provuar me dokumentacion justifikues ligjor.<\/p>\n<p>Po ashtu, p\u00ebr nj\u00eb dhurim nga prind\u00ebrit si burim p\u00ebr shtimin e depozitave n\u00eb vitin 2010, q\u00eb konstatohet se \u00ebsht\u00eb deklaruar nga subjekti p\u00ebr her\u00eb t\u00eb par\u00eb pas kalimit t\u00eb barr\u00ebs s\u00eb prov\u00ebs n\u00eb KPK, Kolegji vler\u00ebson se ka mbetur n\u00eb nivel deklarativ.<\/p>\n<p>\u201cKjo vler\u00eb, p\u00ebrve\u00e7se nuk \u00ebsht\u00eb deklaruar n\u00eb deklarat\u00ebn e pasuris\u00eb vetting apo deklaratat periodike vjetore si burim i krijimit t\u00eb k\u00ebtyre depozitave, \u00ebsht\u00eb deklaruar p\u00ebr her\u00eb t\u00eb par\u00eb nga subjekti i rivler\u00ebsimit vet\u00ebm pas kalimit t\u00eb barr\u00ebs s\u00eb prov\u00ebs n\u00eb Komision, si dhe nuk u provua me dokumentacion justifikues ligjor, duke mbetur k\u00ebshtu n\u00eb nivel deklarativ\u201d, arsyeton Kolegji.<\/p>\n<p>Edhe prej analiz\u00ebs financiare t\u00eb kryer n\u00eb KPA, jan\u00eb konfirmuar balancat negative n\u00eb konstatuara n\u00eb KPK, p\u00ebr pamund\u00ebsi n\u00eb investimin e depozitave n\u00eb vitin 2004 dhe shtesat n\u00eb 2010-\u00ebn. Po ashtu, \u00ebsht\u00eb konfirmuar pamund\u00ebsia financiare prej 235 mij\u00eb lek\u00ebsh e konstatuar nga Komisioni, edhe p\u00ebr blerjen e nj\u00eb automjeti t\u00eb llojit \u201cNissan\u201d n\u00eb shkurt t\u00eb vitit 2007.<\/p>\n<p>Megjith\u00ebse pamund\u00ebsia financiare prej 6.1 milion\u00eb lek\u00ebsh u reduktua n\u00eb 4.2 milion\u00eb lek\u00eb nga analiza financiare e kryer n\u00eb Kolegj, s\u00ebrish ajo u gjet shkarkuese.<\/p>\n<p><strong>Konflikti i interesit<\/strong><\/p>\n<p>Komisioni ka konstatuar se subjekti i rivler\u00ebsimit dhe personi i lidhur kan\u00eb krijuar t\u00eb ardhura apo p\u00ebrfitime si pasoj\u00eb e situat\u00ebs s\u00eb konfliktit t\u00eb interesit, pasi bashk\u00ebshorti ka lidhur kontrata me institucione t\u0451 ndryshme publike. Sipas KPK, nga verifikimi i dokumenteve t\u00eb administruara n\u00eb dosjen e ILDKPKI, rezulton se shoq\u00ebria e zot\u00ebruar nga bashk\u00ebshorti i gjyqtares \u00c7ela \u00ebsht\u00eb shpallur fitues n\u00eb disa procedura t\u00eb prokurimit publik deri n\u00eb vitin 2017.<\/p>\n<p>Subjekti ka parashtruar, se edhe sikur t\u00eb supozohet se bashk\u00ebshorti i saj ka konsumuar k\u00ebt\u00eb kund\u00ebrvajtje, n\u00eb kushtet kur nuk \u00ebsht\u00eb konstatuar asnj\u00eb indicie e qenies s\u00eb saj n\u00eb keqbesim, kjo gjetje e Komisionit nuk mund t\u00eb ket\u00eb ndikim n\u00eb procesin e rivler\u00ebsimit apo n\u00eb marrjen e mas\u00ebs disiplinore ndaj saj.<\/p>\n<p>N\u00eb p\u00ebrgjigje t\u00eb barr\u00ebs s\u00eb prov\u00ebs, ajo ka deklaruar se, p\u00ebr t\u00eb qen\u00eb n\u00eb kushtet e konfliktit t\u00eb interesit, k\u00ebrkohet q\u00eb zyrtari, p\u00ebr shkak t\u00eb interesave t\u00eb tij privat\u00eb, t\u00eb ket\u00eb ndikuar apo, n\u00eb pamje, duket se ka ndikuar ose mund t\u00eb ndikoj\u00eb n\u00eb kryerjen n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb t\u00eb detyrave t\u00eb tij si zyrtar. \u00c7ela ka theksuar se jo vet\u00ebm nuk ka pasur dijeni, por edhe nuk ka pasur mund\u00ebsi p\u00ebr t\u00eb ndikuar de facto apo n\u00eb dukje n\u00eb procedurat e prokurimit publik, kjo p\u00ebr faktin se veprimtaria si gjyqtare zhvillohet pran\u00eb Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Vlor\u00eb dhe jo pran\u00eb Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb Vlor\u00eb, e cila ka n\u00eb kompetenc\u00ebn e saj l\u00ebndore shqyrtimin e t\u00eb gjitha konflikteve q\u00eb lidhen me procedurat e prokurimit apo t\u00eb konflikteve n\u00eb zbatimin e kontratave me institucionet publike. P\u00ebr rrjedhoj\u00eb, ka pretenduar se nuk ka pasur konflikt interesi, as n\u00eb dukje.<\/p>\n<p>Po ashtu, subjekti ka parashtruar se tashm\u00eb p\u00ebr k\u00ebt\u00eb konflikt interesi ka vendimarrje t\u00eb Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb Tiran\u00eb, q\u00eb ka marr\u00eb form\u00eb t\u00eb prer\u00eb dhe nuk mund t\u00eb gjykohet p\u00ebrs\u00ebri.<\/p>\n<p>N\u00eb vendim konstatohet se, nga verifikimi akteve rezulton q\u00eb Inspektori i P\u00ebrgjithsh\u00ebm i ILDKPKI-s\u00eb, t\u00eb ket\u00eb vendosur ndaj \u00c7el\u00ebs mas\u00ebn administrative d\u00ebnim me gjob\u00eb, n\u00eb shum\u00ebn 200 mij\u00eb lek\u00eb, me arsyetimin se nuk ka marr\u00eb masat e duhura ligjore p\u00ebr parandalimin sa m\u00eb t\u00eb hersh\u00ebm t\u00eb konfliktit t\u00eb interesit.<\/p>\n<p>Subjekti ka k\u00ebrkuar pran\u00eb Gjykat\u00ebs s\u00eb Shkall\u00ebs s\u00eb Par\u00eb Administrative Tiran\u00eb shfuqizimin e vendimit t\u00eb ILDKPKI-s\u00eb. N\u00eb dhjetor t\u00eb vitit 2022, gjykata ka pranuar k\u00ebrkes\u00ebn \u00c7el\u00ebs, duke e rr\u00ebzuar gjob\u00ebn e caktuar ndaj saj.<\/p>\n<p>Kolegji nuk \u00ebsht\u00eb ndalur n\u00eb arsyetimin e vendimit t\u00eb Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb t\u00eb paraqitur nga subjekti n\u00eb funksion t\u00eb hetimit administrativ, por sjell n\u00eb v\u00ebmendje se ligji \u201cP\u00ebr parandalimin e konfliktit t\u00eb interesave n\u00eb ushtrimin e funksioneve publike\u201d, i ndryshuar, ndalon shprehimisht p\u00ebrfitimin e t\u00eb ardhurave nga lidhja e kontratave me institucione publike p\u00ebr funksionar\u00ebt publik\u00eb dhe personat e lidhur me to.<\/p>\n<p>\u201c\u2026P\u00ebr efekt t\u00eb k\u00ebtij procesi dhe rrethanave t\u00eb konstatuara, mbetet e provuar se subjekti i rivler\u00ebsimit dhe personi i lidhur me t\u00eb kan\u00eb krijuar t\u00eb ardhura dhe p\u00ebrfitime si pasoj\u00eb e situat\u00ebs s\u00eb konstatuar t\u00eb konfliktit t\u00eb interesit\u201d, vler\u00ebson Kolegji dhe konkludon se q\u00ebndron p\u00ebrfundimi i KPK, se subjekti gjendet n\u00eb kushtet e konfliktit t\u00eb interesit.<\/p>\n<p>KPA nuk shprehet lidhur me konkluzionin e KPK n\u00eb vler\u00ebsimin t\u00ebr\u00ebsor t\u00eb \u00e7\u00ebshtjes p\u00ebr c\u00ebnimin e besimit t\u00eb publikut, por v\u00ebren, se pavar\u00ebsisht se nj\u00eb pjes\u00eb e shkaqeve t\u00eb ngritura n\u00eb ankim nga \u00c7ela u gjet\u00ebn t\u00eb drejta, nuk mund t\u00eb konsiderohen t\u00eb tilla q\u00eb t\u00eb ndryshonin vendimin e KPK p\u00ebr shkarkimin e k\u00ebtij subjekti rivler\u00ebsimi.<\/p>\n<p>&nbsp;<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Kolegji i Posa\u00e7\u00ebm i Apelimit, KPA konstaton se ka gjetur t\u00eb drejt\u00eb nj\u00eb pjes\u00eb t\u00eb shkaqeve t\u00eb ngritur n\u00eb ankimin e gjyqtares s\u00eb Vlor\u00ebs, Herila \u00c7ela kund\u00ebr vendimarrjes s\u00eb Komisionitt \u00eb Pavarur t\u00eb Kualifikimit, KPK p\u00ebr shkarkimin e saj.
